CITY OF ST. CATHARINES BY-LAW NO. 89-3 A By-law to regulate the keeping of pigeons. THE COUNCIL OF THE CORPORATION OF THE CITY OF ST. CATHARINE$ enacts as follows: 1. No person shall keep any pigeons within the City of St. Catharines unless the same are enclosed in suitable coops, pens, runs or lofts except as otherwise provided for in this by-law. 2. No person shall keep or allow to be kept in a coop, pen, run or loft, a greater number of pigeons that one pigeon per two square feet of floor space. 3. No building or structure used or intended to be used as a coop, pen, run or loft for pigeons shall be deemed to be suitable unless the following conditions are complied with: (a) Each such building or structure shall be distant at least the required setback as provided for in the applicable Zoning By-law. (b) The inside walls and ceiling of all such coops, pens or lofts . shall be kept in a clean condition. (c) All runs and outside areas of confinement shall be dug in such a manner and as sufficiently and frequently as to prevent odours arising therefrom. ....... -2­ (d) All refuse resulting from the keeping of the said pigeons shall be kept in substantially airtight containers until it is removed from the premises or is dug into the earth in such a manner as to prevent odours arising therefrom. 4. (a) A person keeping pigeons shall allow the pigeons a controlled period of exercise two times a day for a maximum of two hours per exercise period. (b) Any person keeping pigeons sha11 not permit his pigeons to roost on other persons property without that property owner-s permission. 5. Any person convicted of a breach of any of the provisions of this By-law shall forfeit and pay at the discretion of the convicting Magistrate a penalty of not more than $2,000.00 exclusive of costs.
