NO. "City" means A By-law to provide for the maintenance of grasses and weeds. WHEREAS Council wishes to de by by-1 aw for maintenance grasses and weeds on private land within the urban area to iminate conditions which are or could become or cause public nuisances as a result neglect or improper yard maintenance; THE ST. CATHARINES enacts as follows: 1. In this By-law: "Counci 1" means the 1 of The Corporation the City St. nes; "land" means wi n the urban area of the City in vate ownership and includes grounds, yards and vacant lots; "occupant" means a person or persons over the age of ghteen years in possession of land; "Owner" includes: (i) both the owner in trust and benefici owner of land; (ii) the person managing or receiving the rent of the land or premises thereon; and, (iii) a 1essee or occupant of 1and means an , owner or agent thereof; "Weed Inspector" means a person appointed by Council to administer enforce the provisions of the Weed Control Act; 2. This By-law shall not apply to land designated Environmental Protection under the ty's Official Plan. 3. Every owner of land shall cut and remove from the land all grasses and weeds exceeding 20 em in height. 4. Where grasses or weeds exceeding em in height have been or removed in accordance with this law the Weed Inspector may give the owner of the land written notice to make the land conform with the requirements of this By-law within seventy-two hours by delivering such notice personally to the owner or by registered mail sent to last known address the person to whom the notice is to be given or to that person's agent. 5. Where anything required to done in accordance with this By-law is not done by the person directed or red to do it, Counci 1 hereby directs that such matter or thing may be done by the City or its agent under the rection of the Weed Inspector, at the owner's expense, and the City may recover the expense incurred in doing so by action or by adding the costs to the tax roll and collecting them in the same manner as taxes. 6. The costs of work done by the City under this By-law, and any expenses and administration fees in connection therewith, shall be pursuant to the schedule of rates and fees as approved by Council from me time. 7. The Weed Inspector appointed the ty shall be responsible for the administration and enforcement of this By-law. 8. occupant, owner land and agent of an owner of land is jointly and severally liable to ensure that the standards prescribed by this By-law are met. 9. Every person who contravenes any provision of s By-law is guilty of an offence and is liable upon conviction to a ne as provided for under the Provincial Offences Act. It is hereby declared that each and every of the foregoing provisions of this By-law is severable and that if any provisions of this By-law should, for any reason, be declared, invalid by any court, it is the i on and desire of this Council that each and every the then remaining provisions hereof shall remain in 1 force and effect.
