## THE CORPORATION OF THE TOWNSHIP OF TARBUTT
## A BY-LAW TO ESTABLISH SPEED LIMITS WITHIN THE TOWNSHIP OF TARBUTT.
By-Law 2022-21
WHEREAS Section 27 (1) and 28 (1) of the Municipal Act, S.O. 2001, c.25, as amended, authorizes municipalities to pass by-laws in respect of highways within its jurisdiction or joint jurisdiction; and
WHEREAS Section 128 (1) of the Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended, provides that no person shall drive a motor vehicle at a rate of speed great than 80 km/hour on a highway, not within a built-up area, that is within a local municipality; and
WHEREAS Subsection 128 (2) of the Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended, provides that the Council of a municipality may, for motor vehicles driven on a highway or portion of a highway under its jurisdiction, by By-law prescribe a rate of speed different from the rate set out in Subsection 128 (1);
WHEREAS it is deemed necessary to reduce and restrict the speed of motor vehicles on certain highways within the jurisdiction of The Township of Tarbutt; and
WHEREAS the Council of The Township of Tarbutt deems it expedient to pass a by-law to prescribe and authorize rates of speed on the highways within the jurisdiction of the Township;
## NOW THEREFORE THE COUNCIL OF THE TOWNSHIP OF TARBUTT ENACTS AS FOLLOWS:
1. That when any highway or portion of any highway set out in Schedule "A" appended hereto is marked in compliance with the regulations under the Highway Traffic Act, the maximum rate of speed thereon shall be either 50 km/hour, or 60 km/hour, as posted.
2. That when any highway or portion of any highway set out in Schedule "A" appended hereto is marked in compliance with the regulations under the Highway Traffic Act, the maximum rate of speed thereon shall be the rate of speed set out in Column 4 of Appendix "A".
3. That any previous by-law or resolution, or any section, clause or policy which conflicts with this by-law be and is hereby repealed
4. That any person who contravenes this by-law is guilty of an offence and, upon conviction, is subject to a fine as provided in the Highway Traffic Act and to any other applicable penalties.
5. That this By-law shall come into force and take effect as of October 1, 2022.
READ A FIRST, AND TAKEN AS READ A SECOND AND THIRD TIME and finally passed in open council this Twenty First day of September, 2022.
