THE CORPORATION OF THE TOWNSHIP OF TAY BY-LAW NO. 2025-40 Being a By-law of the Corporation of the Township of Tay to Prohibit the Use of Extreme Terrain Vehicles and Off-Road Motorcycles on Municipal Highways in the Township of Tay and to Repeal By-law No. 2020-71 WHEREAS the Highway Traffic Act, R.S.O. 1990, c. H.8, Section 191.8(1), provides that no person shall drive an off-road vehicle on a highway except in accordance with the Highway Traffic Act regulations and any applicable Municipal By-Laws; AND WHEREAS O. Reg. 316/03, Section 4.1 (2) provides that all-terrain vehicles, multi-purpose off-highway utility vehicles, recreational off-highway vehicles, extreme terrain vehicles and off-road motorcycles may be driven on a highway under the jurisdiction of a municipality if that municipality appears in O.Reg. 8/03; AND WHEREAS the Township of Tay is referenced in O. Reg. 8/03; AND WHEREAS the Council of The Corporation of the Township of Tay, at it's Council meeting dated October 22, 2025, ratified a decision made at the October 8, 2025 meeting of Committee of the Whole to allow for the use of all-terrain vehicles, multi-purpose off-highway utility vehicles and recreational off-highway vehicles on municipal roads for a one year pilot period of January 1, 2026 -- December 31, 2026; AND WHEREAS Council wishes to prohibit the use of extreme terrain vehicles and off--road motorcycles on municipal roads. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF TAY ENACTS AND BE IT ENACTED AS FOLLOWS; 1. That the following vehicles be prohibited from operating on Municipal Roads within the Township of Tay: "extreme terrain vehicle" means an off-road vehicle that, (a) has six or eight wheels, the tires of which are all in contact with the ground, (b) has no tracks that are in contact with the ground, (c) has seats that are not designed to be straddled, and (d) has a minimum cargo capacity of 159 kilograms; "off-road motorcycle" means an off-road vehicle, designed primarily for recreational use, that, (a) has steering handlebars, (b) has two wheels, the tires of which are all in contact with the ground, (c) has a minimum wheel rim diameter of 250 millimetres, (d) has a minimum wheelbase of 1,016 millimetres, (e) has a seat that is designed to be straddled by the driver, (f) is designed to carry a driver only and no passengers, and (9) does not have a sidecar; 2. That By-law No. 2020-71, Being a By-law Vehicles on Municipal Highways and Lan repealed; and 3. This By-Law shall come into force and take effect on January 1, 2026.
