## THE CORPORATION OF THE TOWN OF TECUMSEH
## BY-LAW 2001-36
A By-law to regulate traffic and Parking on Highways and private Roadways under the jurisdiction of the Municipality
## 1. SHORT TITLE:
This by-law may be cited as the Tecumseh Traffic By-law.
## 2. DEFINITIONS
'AMPS' means the Town's Administrative Monetary Penalty System established in ByLaw 2024-048. (Added by amending by-law 2025-018)
'Authorized Emergency Vehicle' means a Vehicle of the Fire Department, Police Department, an ambulance or any other emergency Vehicle of any governmental agency or department or of private or public utilities when such Vehicle is in the performance of emergency and/or directed duties.
'Authorized Sign' means any Traffic Control Device or Traffic Control Signal placed or erected on a Highway for the purpose of regulating, warning or guiding traffic and/or parking in the Municipality.
'Bicycle' includes a tricycle and unicycle but does not include a motor assisted bicycle.
'Bicycle Route' means that part of the Highway designated for the exclusive use of muscular powered Vehicles including Wheelchairs.
'Boulevard' means that part of the Highway situated between the Shoulder and/or Curb Line of the Roadway and the property lines of the lots abutting the Highway
'Built -up Area' means the territory contiguous to a Highway within the Municipality where:
- a) not less than 50 per cent of the frontage upon one side of the Highway for a distance of not less than 200 metres is occupied by dwellings, buildings used for business purposes, schools or churches; or
- b) not less than 50 per cent of the frontage upon both sides of the Highway for a distance of not less than 100 metres is occupied by dwellings, buildings used for business purposes, schools or churches; or
- c) not more than 200 metres of the Highway separates any territory described in clause (a) or (b) from any other territory described in clause (a) or (b);
'Bus Stop' means that portion of a Highway designated by an Authorized Sign for the use of buses, as a space for loading and unloading passengers only.
'Commercial Motor Vehicle' means a Motor Vehicle having permanently attached thereto a truck or delivery body and includes ambulances, motor buses, hearses, casket wagons, and tractors used for hauling purposes on a Highway.
'Corner' means the point of Intersection of Curb lines.
'Council' means the Municipal Council of the Corporation of the Town of Tecumseh.
## 'Crosswalk' means:
- (1) that part of a Highway at an Intersection that is included within the connection of the lateral lines of Sidewalks on the opposite side of the Highway measured from the Curbs or, in the absence of Curbs, from the edge of the Roadway, or
- (2) any portion of a Highway at an Intersection or elsewhere distinctly indicated for Pedestrian Crossover by signs or by lines or other markings on the surface.
'Cul -desac' means that portion of a Highway which terminates in a turn-around.
## 'Curb line' and 'Curb' means:
- (1) where a Curb has been constructed, the line of the Curb, and
- (2) where no curb has been constructed, the edge of the traveled portion of the Highway
'Currently Validated Permit' means a permit issued for a Motor Vehicle pursuant to Section 7 of the Highway Traffic Act.
'Designated Parking Space' means that part of a Highway, the use of which is designated for persons holding a Disabled Parking Permit.
'Disabled Parking Permit ' means a permit issued by the Minister pursuant to Section 26 of the Highway Traffic Act and regulations thereunder.
'Double Park' and 'Double Parking' refers to a vehicle which remains stationary on the same side of the Highway alongside of and parallel to another Vehicle already parked at the Curb of such Highway, unless such Vehicle is being operated in obedience to traffic regulations, signs or signals.
'Director of Public Works' means the Director of Public Works of the Municipality or his designate.
'Driver' means a person who drives a Vehicle on a Highway.
'Driveway' means the improved land on a Highway which provides vehicular access from the Roadway to adjacent land.
'Engineer' means the Engineer of the Municipality, or the Director of Public Works of the Municipality, or their designate.
'Farm Tractor' means a self-propelled Vehicle designed and used primarily as a farm implement for drawing ploughs, moving machines, and other implements of husbandry and not designated or used for carrying a load.
'Fire Chief' means the Fire Chief of the Municipality or his or her designate.
'Fire Department' means the Fire Department of the Municipality.
'Fire Route' means
- (a) any road, lane, ramp or other means of vehicular access to or egress from a building or structure and may include part of a parking lot; and/or
- (b) a private lane in respect of which an agreement with the Municipality in Form 1 is entered into by the owner of the private lane and along with Authorized Signs are erected.
'Gross Weight' means the combined weight of:
- (a) a Commercial Motor Vehicle and load, or
- (b) a Commercial Motor Vehicle and Trailer or Trailers and load.
'Heavy Traffic' means a Commercial Motor Vehicle, having a weight when unloaded of (3) tonnes (3000 kilograms), or more, or when loaded, five 5 tonnes (5000 kilograms) or more, but does not include a passenger Vehicle, an ambulance, a Vehicle of the Police or Fire Departments, a Municipal Vehicle, a Vehicle of a local board, a public utilities Vehicle, or a private utilities Vehicle, or a Commercial Motor Vehicle making delivery to or collection from a bona fide destination which can only be reached via a Highway or Highways upon which Heavy Traffic is prohibited by this By-law.
'Heavy Truck' means a Commercial Motor Vehicle or a Commercial Motor Vehicle and Trailer or Trailers, for which the permit fee under the Highway Traffic Act and the regulations under that Act are based upon a Vehicle Gross weight in excess of 5 tonnes.
'Highway' includes a common, roadway and public highway, street, road, avenue, parkway lane, Driveway, square, place, bridge, viaduct, or trestle designed or intended for, or used by the general public for the passage of Vehicle
'Highway Traffic Act' means the Highway Traffic Act, R.S.O 1990, c. H.8, as amended, and the regulations thereunder.
'Intersection' means the area embraced within the prolongation or connection of the lateral Curb lines or, if none, then of the lateral boundary lines of two or more Highways that join one another at an angle, whether or not one Highway crosses the other.
'Island' means a portion of a Roadway so constructed or designated as to separate or direct vehicular traffic onto specific portion of the Highway.
'Median Strip' means the portion of a Highway so constructed or designated as to separate traffic traveling in one direction from traffic traveling in the opposite direction.
'Minister' means the Minister of Transportation.
'Motor Vehicle' includes an automobile, motorcycle, motor assisted bicycle unless otherwise indicated in the Highway Traffic Act, and any other Vehicle propelled or driven otherwise than by muscular power, but does not include a Street car, or other motor vehicles running only upon rails, or a motorized snow vehicle traction engine, Farm Tractor, self-propelled implement of husbandry or road building machine within the meaning of the Highway Traffic Act.
'Municipality' means The Corporation of the Town of Tecumseh.
'Officer' means the Town's appointed By -Law Enforcement Officer(s) and such other Officers who have been assigned the responsibility of administering and enforcing this by-law. (Added by amending by-law 2025-018)
'One Way Street' means a Highway upon which vehicular traffic is limited to movement in one direction.
'Park, Parking or Parked' means the standing or Stopping of a Vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
'Parking By -Law Enforcement Officer' means:
- (i) an assistant or any other officer or civilian person engaged by the Ontario Provincial Police; or
- (ii) a person appointed by by-law of the Municipality, to enforce or carry out the Parking provisions of this by-law or any part or parts thereof.
'Parking Space' means that part of the Highway, the use of which is designated for the purpose of Parking a Vehicle
'Pedestrian' means any person afoot, children in wheeled carriages, a person operating a Wheelchair, or any person upon roller skates, or riding in or by means of any coaster, toy vehicles, sleigh, cart, express wagon or similar device.
'Pedestrian Crossover' means any portion of a Roadway, designated by by-law of the Municipality, at an intersection or elsewhere, distinctly indicated for Pedestrian crossing by signs on the Highway and lines or other markings on the surface of the Roadway.
'Police Department' means the Tecumseh Detachment of the Ontario Provincial Police or any other police force contracted by the Municipality to serve the policing needs of the Municipality.
'Police Officer' means a member of the Ontario Provincial Police or any other police force contracted by the Municipality to serve the policing needs of the Municipality.
'Provincial Offences Act' means the Provincial Offences Act, R.S.O. 1990, c. P.33, as amended, and the regulations thereunder.
'Recreational Vehicle' shall mean a Vehicle which is intended to provide sleeping and other facilities for short periods of time, while travelling or vacationing, designed to be either towed behind a motor vehicle or is self propelled, and includes such vehicles commonly known as travel trailers, camper trailers, pick-up coaches, motorized campers, motorized homes, boats, utility trailer, personal watercraft, all-terrain vehicles or other similar vehicles. 'Repair and Storage Liens Act' means the Repair and Storage Liens Act, R.S.O. 1990, c. R.25, as amended, and the regulations thereunder.
'Roadway' means the part of the Highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the Shoulder, and where a Highway includes two or more separate Roadways, the term 'Roadway' refers to any one Roadway separately and not to all of the Roadways collectively.
'Shoulder' means that portion of the Highway lying adjacent to the Roadway which is improved with granular or paved surface and is not intended for the passage of vehicular traffic.
'Sidewalk' means that portion of a Highway between the Curb line and the property line of the lot abutting the Highway improved for the use of Pedestrians.
'Stop' or 'Stopping' means the halting of a Vehicle, even momentarily whether occupied or not except when necessary to avoid conflict with other traffic or in compliance with the direction of a Police Officer or a Traffic Control Device or a Traffic Control Signal.
'Through Highway' means a Highway or part of a Highway designated as such by bylaw of the Municipality, and every such Highway shall be marked by a Stop sign or yield right-of-way sign in compliance with the regulations of the Highway Traffic Act.
'Time' means, whenever certain hours are named herein, Standard Time or DaylightSaving Time, which ever shall be in official use in the Municipality.
'Traffic Control Device' means a sign, marking or other device on a Highway for the purpose of controlling, guiding or directing traffic and/or parking in the Municipality.
'Traffic Control Signal' means any device, manually, electrically or mechanically operated for the regulation of traffic and/or parking in the Municipality.
'Trailer' means a Vehicle that is at any time drawn upon a Highway by a Motor Vehicle, except an implement or husbandry
'U -Turn ' means to turn a Vehicle within a Roadway so as to proceed in the opposite direction.
'Vehicle' or 'Vehicles' includes a Motor Vehicle, Trailer, traction engine, Farm Tractor, road building machine, motorcycle, Trailer, Bicycle and any Vehicle drawn, propelled, or driven by any kind of power including muscular power but does not include a motorized snow vehicle or street car.
'Wheelchair' means a chair mounted on wheels, driven by muscular or any other kind of power and used for the carriage of a person who has a physical defect or disability.
## 3. ENFORCEMENT AND AUTHORITY
## (a) Enforcement (Replaced and added by amending by-law 2025-028)
The provisions of the ByLaw shall be administered by the Town's duly appointed Officer (s) or when applicable, the Ontario Provincial Police.
- (i) No person shall under or obstruct or attempt to hinder or obstruct, any person exercising a power or performing a duty under this by-law.
- (ii) Every person who contravenes any provision of this By-law is guilty of an offence and upon conviction thereof is liable to a fine in the maximum amount provided for by the Provincial Offences Act, R.S.O. 1990, c.P.33, (hereinafter called Provincial Offences Act) as may be amended from time to time.
- (iii) A person who contravenes any provision of this By-law is guilty of an offence and can, at the option of the Officer, be issued a penalty notice in respect thereof requiring the payment of a penalty pursuant to the Towns Administrative Monetary Penalties System By-law 2024-048 as amended from time to time (the 'Administrative Monetary Penalty By -law' or 'By -law 2024048'). Instead of laying a charge under the Provincial Offences Act for any breach of any provision of this By-law, an Officer, may issue an Administrative Penalty to the Person who has contravened this By-law provided the authority for the Town to issue Administrative penalties has been granted by municipal by-law.
- (iv) An Officer has the discretion to either proceed by way of an Administrative Penalty (if prescribed) or a charge laid under the Provincial Offences Act. If an Administrative Penalty is issued to a Person for a contravention of this By-law, no charge shall be laid against that same Person for the same contravention.
- (v) The amount of the Administrative Penalty for a contravention of a provision of this By-law is fixed as set out in the Administrative Monetary Penalty By-law of the Town, as amended from time to time, or any successor by-law.
- (vi) If an Officer issues a penalty notice under AMPS, the property Owner may appeal the penalty through the Administrative Monetary Penalties System appeal process outlined in By-Law 2024-048 as amended.
- (vii) A Person who is issued an Administrative Penalty shall be subject to the procedures as provided for in the Administrative Penalty By-law of the Town, as amended from time to time, or any successor by-law.
- (viii) An Administrative Penalty imposed on a Person pursuant to this By-law this is not paid within fifteen (15) days after the day it becomes due and
payable, constitutes a debt of the Person to the Town and may be added to a municipal tax roll and collected in the same manner as municipal taxes.
## (ix) Collection of Unpaid Fines
Where a fine is in default, the Town may proceed with civil enforcement against the Person upon whom the fine has been imposed, pursuant to the Provincial Offences Act.
- (x) The Town may make a request to the treasurer of a local municipality to add any part of a fine that is in default to the tax roll for any property in the local municipality for which all the Owners are responsible for paying the fine and collect it in the same manner as municipal taxes.
## (xi) Validity and Severability
If any provision or part of this By-Law is declared by any court or tribunal of competent jurisdiction to be invalid, illegal or inoperative, in whole or in part, or inoperative in particular circumstances, the remainder of the By-Law, or its application in other circumstances, shall not be affected and shall continue to be in full force and effect.
- (xii) If there is a conflict between the provisions of this By-Law and any other by-law of the Town in force or a provincial or federal statute or regulation, the more restrictive provisions shall apply. (
## (b) Authority to Install Signs
- (i) The Director of Public Works is hereby authorized to place, erect and maintain any number of Traffic Control Devices and Traffic Control Signals that are required to give effect to the provisions of this by-law and/or the Schedules to this by-law.
- (ii) In an emergency or safety situation, the Director of Public Works is further authorized for the duration of such situation, to place, erect or maintain any number of Traffic Control Devices and/or Traffic Control Signals that are not otherwise authorized by this by-law.
- (iii) Unless otherwise permitted, no person shall place, maintain, or display upon any Highway, any sign, signal, marking or device which purports to be or is an imitation of or resembles any Traffic Control Device or Traffic Control Signal without the prior approval of the Director of Public Works.
## 4. GENERAL
## (a) Operation of Vehicles
## (i) Driving on Other than Roadway
No person shall drive a Vehicle within, across or along any Sidewalk, path or Boulevard except at a Driveway.
## (ii) Vehicle Unattended
No owner or Drive of a Commercial Motor Vehicle shall allow it to stand unattended unless it is locked in such a manner as to prevent its operation.
## (iii) Closed Roads
No Vehicle, except an emergency Vehicle or a Vehicle authorized by the Director of Public Works or by a Police Officer, shall be driven through or enter upon any Highway that is roped or barricaded, or marked by an Authorized Sign prohibiting its use.
## (iv) Repairing Vehicles
No person shall repair, wash, maintain or paint a Vehicle on a Highway.
## (v) Emergency Repair
No person shall repair or attempt to repair any Vehicle upon a Roadway unless such use of the Roadway is unavoidable by reason of emergency.
## (vi) Interception of Organized Procession
No person shall drive a Vehicle so as to intercept a funeral or other properly organized procession white it is in motion, except under the direction of a Police Officer.
## (vii) Driving in Organized Procession
The Driver of a Vehicle in a funeral or other organized procession shall drive as near to the right-hand edge of the Roadway as practicable and follow the Vehicle ahead as closely as it is practicable and safe.
## (viii) Parades
No person shall use a Highway for the purpose of a parade or procession without first obtaining the written permission of the Council and a Police Officer, at least five (5) days prior to the event. A Police Officer is authorized to Stop or divert traffic on any Highway during the passage of a parade or a procession.
## (b) Pedestrian Duties
## Games of Sport
- (i) No person shall play or take part in any game or sport upon a Highway.
- (ii) No person shall place, erect or leave, or cause or permit to be placed, erected or left, equipment of game or sport on a Highway.
- (iii) No person, being the parent or guardian of a person under the age of 16 years, shall permit or allow the person under the age of 16 years, to place, erect or leave equipment of game or sport on a Highway.
- (iv) Equipment of game or sport found placed, erected or left, in whole or in part, on a Highway, may be removed and stored on order of a Police Officer or Director of Public Works, as the case may be, at the expense of the owner of the said equipment.
## (c) Construction, Maintenance and Emergency Situations
## Obstructing Traffic
- (i) No person shall erect barricades, signs or planters, store earth or construction material or park work equipment on any portion of any Highway without first obtaining written permission from the Municipality.
- (ii) No person shall open a manhole without first obtaining permission from the Municipality.
- (iii) No person shall place, maintain or display upon or in view of any Highway any signal, marking or device which purports to be or is an imitation of or resembles any Traffic Control Device or Traffic Control Signal or which conceals from view or interferes with the effectiveness of any Traffic Control Device or Traffic Control Signal.
## (d) Bicycles
## (i) Riding abreast
No person shall operate a Bicycle on any Roadway abreast of another Bicycle except in the course of passing the other Bicycle.
## (ii) Passengers
No persons shall operate a Bicycle on a Roadway while riding with another person on such Bicycle unless such Bicycle is equipped with a carrier specifically designed and attached thereto for the purpose of carrying another person.
- (iii) No person shall operate a Bicycle on a Highway while carrying any goods thereon if such carrying interferes with that person having full control of the Bicycle.
- (iv) No person shall park a Bicycle on any Roadway.
- (v) No person shall park a Bicycle on any Boulevard, Sidewalk or Shoulder except in an upright position.
## (e) Animals
- (i) No person shall ride, drive, lead or back any animal, except household pets, within, across or along any Sidewalk or Boulevard except on a Driveway.
- (ii) The Driver or other person in charge of an animal drawn vehicle on a Highway shall remain upon the vehicle while it is in motion or walk beside the animal drawing it.
- (iii) No person shall leave a carriage, cart, wagon, sleigh, or sled, drawn by an animal on a Highway without the animal by which it was drawn.
## 5. PARKING AND STOPPING RESTRICTIONS
## A. Method of Parking
## (i) General
No person shall park any Vehicle on any street or Highway unless such Vehicle is parked on the right-hand side of the Highway with the right and right rear wheels of the Vehicle not more than 0.15 metres from the curb line.
No person shall park a Vehicle in the same spot, upon any street or Highway for longer than three (3) consecutive days. ( Section (i) Replaced by by-law 2025-018)
## (ii) Parking on One-Way Streets
Where Parking is permitted on a One-Way Street a person may park a Vehicle only in the direction it was permitted to proceed, parallel to and not to exceed a distance of 0.15 metres from the Curb line.
## (iii) Angle Parking
Notwithstanding subsection 5 (a) (i) above, where angle parking is permitted in the Municipality, no person shall park a Vehicle except at the angle indicated.
## (iv) Parking Space
Where Parking Spaces are designated on a Highway no person shall park a Vehicle in such manner as to infringe upon or take up more than one Parking Space.
## (v) Municipal Property
No person shall park or leave a Vehicle on property owned or occupied by the Municipality without the consent of the Municipality.
## (b) Parking Prohibited
No person shall on a Highway at any time park a Vehicle in any of the following places:
- (i) on or overhanging a Sidewalk or Curb;
- (ii) on a Boulevard between the Curb and the property line abutting the Highway where a Curb has been constructed, except on a Boulevard on any highway named in Column 1 of Schedule 'U' on the side or sides set out in column 2 and between the addresses set out in column 2 of said schedule (Replaced section by amending by-law 2002-95);
- (iii) on a Median Strip;
- (iv) on an Island;
- (v) in front of or within 1 metre of the entrance to a Driveway or so as to prevent ingress or egress to or from such Driveway;
- (vi) in front of or within 3 metres of an entrance to or from a public lane;
- (vii) in such a position as to prevent the removal or any other Parked Vehicle;
- (viii) in front of the entrance to any emergency exit from a hospital, theatre, auditorium, or other commercial, industrial, institutional or public building;
- (ix) on any Highway in such a manner as to obstruct road repair;
- (x) within three metres of a point in the edge of the Roadway nearest a fire hydrant;
- (xi) within 9 metres of an intersecting Roadway;
- (xii) within 15 metres of any level railway crossing;
- (xiii) within 15 metres of an Intersection where there is a signal light traffic control system installed;
(xiv) on any bridge, or on the approaches thereto, or in any alley.
- (c) Double Parking
No Vehicle shall be Double Parked on any Highway at any Time.
- (d) Emergency or Special Circumstances (Replaced section by Amending ByLaw 2005-08)
- (i) Notwithstanding any other provision of this by-law, the Mayor, Chief Administrative Officer, Police Officer, or the Fire Chief during any emergency or special circumstance deemed by them sufficient therefor, may restrict or prohibit any or all parking on a highway.
- (ii) For the purposes of this section, 'emergency', includes a major snow fall or other act of God which hinders, restricts or prohibits the normal movement of vehicles or pedestrians on a Highway.
- (iii) The declaration of an emergency and the parking restriction or prohibition shall be deemed in effect after a systematic broadcast on local radio and television stations serving the Town and such broadcast shall be deemed to be sufficient notification of the restriction or prohibition then in effect;
- (iv) The Mayor, Chief Administrative Officer, Police Officer or Fire Chief as the case may be, during such emergency may declare that any Vehicle already parked is being parked illegally regardless of the time permitted for parking such Vehicle under the provisions of this by-law, provided, however, that in this event the owner or Drive of such Vehicle is notified where possible by a Police Officer or Parking By-Law Enforcement Officer that such parking has been suspended, and further that the owner or Driver of such Vehicle is allowed a maximum period of fifteen minutes to remove said Vehicle. Where the owner or Driver so notified does not remove said Vehicle within fifteen minutes of such notification or where the owner or Drive cannot be located and notified to remove the said Vehicle within fifteen minutes of the declaration of the Vehicle being parked illegally, then the said Vehicle may be removed forthwith on order of the Police Officer, Fire Chief, or Director of Public Works, as the case may be, at the ow ner's expense.
- (e) Parking Prohibited Where Authorized Sign is on Display (Section amended by By-law 2025-018)
Where an Authorized Sign is on display, no person shall Park a Vehicle at any time in the following places:
- i. In any Town owned parking lot associated with a Town facility, park or other property as identified and as may be amended from time to time at the discretion of the Municipality.
- ii. Within 15-meter distance commencing on either side of an entrance to any commercial, industrial, institutional or public building;
- iii. In front of an entrance to any place where goods or merchandise are regularly delivered or removed;
- iv. In a Cul-de-sac along its circular turn around;
- v. On a highway within 15 metres of its terminus;
- vi. In a public lane;
- vii. On any portion of a Highway within 30 meters of a Pedestrian Crossover;
- viii. On any portion of a Highway within 15 metres of an Intersection;
- ix. On any portion of a Highway within 30 metres of an Intersection controlled by a Traffic Control Signal;
- x. On any portion of a Highway within 15 metres of any School Bus Loading Zone as designated under Section 16 of this by-law;
- xi. On any portion of a Highway within 7.5 metres of any fire hall;
- xii. On that portion of the south side of Tecumseh Road commencing at the southeast corner of Intersection of St. Anne Street and Tecumseh Road and continuing easterly to a point situate forty-one metres easterly from said Intersection;
- xiii. On a Designated Parking Space on any Highway or part of a Highway named or described in Schedule A of this by-law, on the side or sides of a Highway set out in said schedule, other than a Vehicle upon which is properly displayed a valid Disabled Parking Permit and such Vehicle is at the Time being used to transport physically disabled person;
- xiv. On any Highway or part of a Highway in Column 1 of Schedule B to this By-Law, on the side or sides of the Highway set out in Column 2 on said Schedule and that portion of the Highway as set out in Column 3 on said Schedule.
- xv. Every person who contravenes any of the provisions of Section 5 (e) would be guilty of an offence and subject to such fines and/or penalties as may be proscribed in the By-law.
## (f) No Parking for Restricted Times
- (i) No person shall at any time park a Vehicle on any Highway during the times and/or for a longer period of time than that set out in column 1 of Schedule 'C' to this by -law for the months set out in column 2 of said Schedule.
- (ii) No person shall Park a Vehicle on any Highway named and or described in column 1 of Schedule 'D' to this by -law, on the side or sides of the Highway set out in column 2 of the said Schedule during the times and/or days set out in column 3 of the said Schedule for a longer period of time than set out in column 4 of said Schedule.
## (g) Angle Parking
No person shall angle park a Vehicle in the Municipality except on those Highways named in column 1 of Schedule 'E' to this by -law on the side or sides out in column 2 of the said Schedule
## (h) Boulevard Parking (Amended by By-Law 2012-37)
An Authorized Sign shall be displayed and when an Authorized Sign is on display, no person shall Park a Vehicle on a Boulevard.
## (i) Stopped Prohibited
No person shall at any time Stop a Vehicle in the following places:
- (i)
- (ii)
on a Highway adjacent to any school property; or on a Highway adjacent to any park or playground
## (j) No Stopping at Any Time
Where an Authorized Sign is on display, no person shall at any time Stop a Vehicle on a Highway named or described in Schedule 'G' to this by -law on the side or sides of the streets set out in Column 2 of said Schedule, in the area set out in column 3, of said Schedule.
## (k) Loading Zones
No person shall Stop a Vehicle, except for the loading and/or unloading of merchandise, on any of the Highways named or described in column 1 of Schedule 'H' to this by -law on the side of sides of Streets set out in column 2 of said Schedule during the times and/or days set out in column 3 of said Schedule for no longer period of time than set out in column 4 of said Schedule.
## (l) Taxicab Stand
No person shall Stop a Vehicle, other than a taxicab on any of the Highways named and or described in column 1 of Schedule 'I' to this by -law on the side or sides of Highways set out in column 2, of said Schedule
## (m) Bus Stop (Amended by By-Law 2010-21)
No person shall Stop or Park a Vehicle on any portion of a Highway within 15 metres on either side of any point designated as a Bus Stop, as shown on Schedule 'U' to this by -law.
## (n) Removal of Vehicles
Where any Vehicle is parked in contravention of this by-law a Police Officer or Parking By-Law Enforcement Officer may cause it to be moved or taken to and placed in storage and all costs for removing and storing the Vehicle shall be a lien upon the Vehicle which may be enforced in the manner provided for in the Repair and Storage Liens Act.
## (o) Unlicensed Vehicles
Where a Vehicle is a Motor Vehicle, no person shall park that Vehicle on a Highway unless such vehicle has a Currently Validated Permit displayed in accordance with the requirements of the Highway Traffic Act.
## (p) Parking of a Trailer Prohibited
No person shall park a Trailer on a Highway, even if the Trailer is attached to a Vehicle.
## (q) Parking of Recreational Vehicles (Added section by amending by-law 2025-018)
Notwithstanding any other provisions of this By-law No person shall park or store a Recreational Vehicle in any Residential Zone unless:
- (i) the owner or full-time occupant of the property in front of which the Recreational Vehicle is parked on the Street or highway is also the owner or operator of the Recreational Vehicle;
- (ii) there is only one (1) such Recreational Vehicle parked at any time on the street or highway in front of such property or upon such property;
- (iii) the Recreational Vehicle is operational and has valid license plates;
- (iv) the Recreational Vehicle is parked on a street or Highway as between April 16 to November 14 only and for the purposes of either loading or unloading goods and materials from the said recreational vehicle and for not more than three (3) consecutive days in a 30-day period.
## 6. PRIVATE ROADWAY FIRE ROUTES
- (a) The Fire Department shall be responsible for directing the erection and maintenance of Authorized Signs along Fire Routes and for the removal of Authorized Signs where an area ceases to be a Fire Route.
- (b) No person shall move, remove or interfere with an Authorized Sign along a Fire Route or obstruct the view of an Authorized Sign along a Fire Route.
- (c) No person shall erect or maintain a facsimile of an Authorized Sign along any private Roadway, whether a Fire Route or not.
- (d) No person shall erect or maintain along a Fire Route any sign which may conflict or be confused with an Authorized Sign.
- (e) No person shall Park a Vehicle along a Fire Route where Authorized Signs are installed.
- (f) The form of agreement to authorize and consent to the designation and administration of a Fire Route on private lands shall be as set out in Form 1, attached hereto and forming part of this by-law.
- (g) Those Fire Route agreements annexed hereto as Schedule 'J' to this By -Law form part of this By-law.
## 7. HIGHWAYS -STOP SIGNS:
## (a) Through Highways -Stop
The Highways and or parts of Highways named and/or described in Schedule 'K' to this bylaw are designated 'Through Highways Stop' except at Intersections thereon where a Traffic Control Signal is installed and is in operation.
## (b) Intersections -Stops Signs
Stop signs shall be erected at the Intersections designated in column 1 of Schedule 'L' to this by -law facing the direction of traffic specified in column 2 of said Schedule on the Highways named in column 3 of said Schedule.
## 8. INTERSECTIONS -YIELD SIGNS:
Yield right-of-way signs shall be erected at the Intersections set out in column 1 of Schedule 'M' to this by -law facing the direction of traffic specified in column 2 of said Schedule on Highways named and/or described in column 2 of said Schedule.
## 9. TURNS
- (a) Prohibition
## (i) U Turns
Where Authorized Signs to that effect are on display, no person operating a Vehicle shall make a U-turn on any Highway or part of any Highway in the Municipality.
## (ii) Prohibited Turns
Where an Authorized Sign is on display, no person operating a Vehicle on a Highway named in Schedule 'N' shall turn the Vehicle in the direction of the prohibited turn set out in column 3 of said Schedule, at the intersection set out in column 4 of said Schedule during the Time and on the days set out in column 5 of said Schedule.
## (iii) Temporary Signs
A Police Officer or the Director of Public Works may erect temporarily Authorized Signs prohibiting turns at any Intersection and while such sign is on display no person operating a Vehicle shall turn that Vehicle in any direction contrary to the sign.
## 10. ONE WAY STREETS:
No person shall drive a Vehicle upon those Highways described in column 1 of Schedule 'O' to this by -law in a direction opposite that indicted in column 2 of said Schedule.
## 11. RATES OF SPEED
## (a) Highways
No person shall drive a Motor Vehicle upon the Highways named and/or described in column 1 of Schedule 'P' to his by -law at a greater rate of speed than is described in column 2 of the said Schedule.
## (b) Other -Public Park
No person shall drive a Vehicle in any public park at a speed in excess of twenty (20) km/hr.
## 12. RESTRICTIVE LANES:
## Centre Lane Turns
No person shall operate a Vehicle in the center lane on a Highway described in Schedule 'Q' to this by -law, except for the purpose of turning left.
## 13. LIMITED LOADS ON HIGHWAYS
Pursuant to Section 122 of the Highway Traffic Act, when Authorized Signs have been erected and are on display no person shall drive, during the months of January through to, and including December, in each and every year, a Vehicle in excess of 5 tonnes per axle on those Highways named in Column 1, of Schedule 'R' to this by -law, from the Intersection of the Highway in Column 2, of the said Schedule, to the Intersection of the Highway in Column 2, of the said Schedule.
## 14. THROUGH TRUCK TRAFFIC:
No person shall operate a Heavy Truck on any Highway in the Municipality other than those Highway s described in Schedule 'S' to this by -law.
## 15. HEAVY TRAFFIC PROHIBITION:
- (a) No person shall Park any Heavy Traffic upon a Highway in the Municipality in excess of two hours where an Authorized Sign restricting parking of Heavy Traffic to two hours has been posted.
- (b) No person shall drive any Heavy Traffic upon any a Highway in the Municipality where an Authorized Sign to the effect is on display on the Highway.
- (c) This section does not apply to any Vehicle owned or operated by the Municipality; by the Corporation of the County of Essex; by any local boards; or to any commercial Vehicles making a bona fide delivery to or collection from a destination which cannot be reached via a Highway upon which Heavy Traffic is permitted by this by-law.
## 16. SCHOOL BUS LOADING ZONES:
In accordance with the provisions of sub-section 13 of Section 175 of the Highway Traffic Act, school bus loading zones are hereby designated on those Highways named and/or designated column 1 of Schedule 'T' to this by-law on the side or sides of the Highways set out in column 2 of said Schedule, for school buses traveling in the direction set out in column 3 of the said Schedule.
## 17. PENALTIES
## (a) Penalties:
- (i) Every person who contravenes any of the provisions of Sections 4(a)(i), 4(a)(ii), 4(a)(iii), 4(a)(iv), 4(a)(v), 4(a)(vi), 4(a)(viii), 4(b)(i), 4(b)(ii), 4(b)(ili), 4(c)(i), 4(c)(ii), 4(c)(iii), 4(d)(i), 4(d)(ii), 4(d)(iii), 4(d)(iv), 4(d)(v), 4(e){i), 4(e)(ii), 4(e)(iii), 5(a)(i), S{a)(ii), 5(a)(iii), S(a){iv), 5(a)(v), S(b)(i), 5(b)(ii), 5(b)(iii), 5(b)(iv), S(b)(v), 5(b)(vi), 5(b)(vii), S(b)(ix), 5(b)(x), 5(b)(xi), 5(b){xii), S(b)(xiii), 5(b)xiv), S(c), S(c)(i), 5(cXii), 5(e)(ili), 5(e)(iv), 5(e)(v), 5(e)(vi), S(e)(vii), S(e){vili), 5(e)(x), S(e)(xi), 5(e)(xiii), 5(t)(i), S(f)(ii), S(g), S(h), S(k), 5(1), 5(m), 5(o), S(p), is guilty of an offence and on conviction is liable to a penalty of not less than Forty ($40.00) Dollars or more than One Hundred Fifty ($150.00) Dollars and every such penalty shall be recoverable under the Provincial Offences Act, all the provisions of which shall apply.
- (ii) Every person contravenes any of provisions of Sections 5(b)(viii), 5(e)(ix), 5(e)(xii), 5(i)(i), 5{i)(ii), 5(j), 6(b), 6(c), 6(d), 6(e), l l(b), 13, 14, 15(a) and 15(b) of this by-law is guilty of an offence and on conviction is liable to a penalty of not less than Eighty ($80.00) Dollars) and not more than One
- Hundred Fifty ($150.00) Dollars and every such penalty shall be recoverable under The Provincial Offences Act, all provisions of which shall apply.
- (iii) Every person who contravenes any of the provisions of sections 9(a)(i), 9(a)(ii), 10, 11(a) and 12, shall be subject to penalties prescribed by the Highway Traffic Act.
## (b) Voluntary Payment of Penalties
- (1) Not withstanding all the other provisions of this section, where it is alleged that there has been in respect of any Vehicle in contravention of any of the provisions of Section 4, 5, 6 and 11 of this by-law and notice of such alleged contravention has been given to the owner or Drive of such Motor Vehicle by means of a Parking infraction notice, issued by members of the Police Department or by Parking By-Law Enforcement Officers and attached to or left within such Vehicle, or delivered to the operator thereof, the defendant or any person on his behalf may within seven (7) days in person or by mail at 917 Lesperance Road, Tecumseh, Ontario after the time and date marked on such Parking infraction notice voluntarily pay the by-law payment of:
2. (i) The sum of Thirty Dollars ($30.00) in respect of each contravention of Sections 4(a)(ii), 4(11)(iv), .4(11Xv), 4(dXiv), 4(d)(v), S(a)(i), 5(aXii), S(a)(iii), S(a)(iv), S(a)(v), S(bXi), S(b)(ii), 5(b)(iii), 5(b)(iv), S(b)(v), S(b)(vi), S(b)(vii), S(b)(ix), S(b)(x), 5(b)(xi), S(b)(x.ii), 5(b)(xiii), 5(b)xiv), 5(c), S(e)(i), S(e)(ii), S(e)(iii), S(e)(iy), S(e)(v), S(e)(VJ), S(e){vii), S(e)(viii), 5(e)(x), S(e)(xi), 5(eXxiii), S(f)(i), S{f)(ii), S(g), S(h), S(k), 5(1), 5(m), S(o), 5(p)
3. (ii) the sum of Eighty Dollars ($80.00) in respect of each alleged contravention of Sections S(b)(viii), S(e)(ix), S(e)(xii), 5(i)(i), S(i)(ii), S(j), 6(e), l 5(a). Upon presentation of such Parking infraction notice, and if such voluntary payment is duly made, no further proceedings against the Defendant for such contravention shall be taken.
4. (iii) The defendant may, within fifteen days of the services of the Parking infraction notice, plead not guilty by signing the not guilty plea on the Parking infraction notice and thereafter the clerk of the court shall give notice of trial pursuant to The Provincial Offences Act.
5. (iv) Failure by the defendant to pay the voluntary By-Law payment as set out in Section 17 (b) (l) (i) herein, or to plead not guilty within fifteen days of the service of the Parking infraction notice shall render the defendant liable to prosecution pursuant to The Provincial Offences Act.
6. (v) Where it is alleged that in respect of a Vehicle there has been a contravention of any of the provisions as in section 17 (a), of this bylaw the amount of the by-law payment has not been made in accordance with section 17 (b) (l) (i) of this by-law, nor a plea of not
## (c) Owner Penalties
- (i) Notwithstanding anything in this By-Law to the contrary, the owner of a Vehicle that is Parked or Stopped in contravention of this by-law is guilty of an offence and on conviction is liable to the fine stated this by-law unless such owner proves to the satisfaction of the court that at the time of the offence, the Vehicle was in the possession of another person without that owner's consent, express or implied.
- (ii) Every day in which such contravention described in paragraph 17 (c)(i) above continues shall be deemed a separate offence.
## 18. APPROVALS
## Ontario Highway Traffic Act to Govern
The provisions of this By-law shall be subject to the provisions of the Highway Traffic Act and amendments thereto.
## 19. SCHEDULES
The Schedules and forms referred to in this by-law shall form part of this by-law and each entry in a column of such a Schedule shall be read in conjunction with the entry or entries across therefrom and not otherwise.
## 20. SEVERABILITY
Should any section, clause or provision of this by-law be declared by a court of competent jurisdiction to be invalid the same shall not affect the validity of the by-law as a whole or any part thereof, other than the part which was declared to be invalid.
## 21. EFFECTIVE DATE:
This by-law shall come into force and effect its final passing thereof.
