The Corporation of the City of Temiskaming Shores By-law No. 2012-101 Being a by-law to Regulate Traffic and Parking of vehicles in the City of Temiskaming Shores Whereas the Council of The Corporation of the City of Temiskaming Shores deems it necessary and expedient to pass a By-law to regulate traffic and parking of vehicles within the City of Temiskaming Shores; And whereas under Section 8.(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, the powers of a municipality shall be interpreted broadly to enable it to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues; And whereas under Section 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; And whereas under Section 10.(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, a single-tier municipality may provide any service or thing that the municipality considers necessary or desirable for the public; And whereas Section 10.(2) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes a municipality to pass by-laws respecting the health, safety and well-being of persons; And whereas Sections 100 through 102.1 of the Municipal Act, S.O. 2001, c. 25, as amended, provides that a municipality may make regulations regarding traffic and parking of vehicles; And whereas Section 100 of the Municipal Act, S.O. 2001, c. 25, as amended, provides that a municipality may, in respect of land not owned or occupied by the municipality that is used as a parking lot, regulate or prohibit the parking or leaving of motor vehicles on that land without the consent of the owner of the land or regulate or prohibit traffic on that land if a sign is erected at each entrance to the land clearly indicating the regulation or prohibition; And whereas Section 100.1 of the Municipal Act, S.O. 2001, c. 25, as amended, provides that a municipality may, in respect of land not owned or occupied by the municipality, that is not used as a parking lot, regulate or prohibit the parking or leaving of motor vehicles without the consent of the owner of the land; And whereas Section 101.(1) of the Municipal Act, S.O. 2001, c. 25, as amended, provides that if a municipality passes a bylaw regulating or prohibiting the parking or leaving of a motor vehicle on land, it may provide for the removal and impounding or restraining and immobilising of any vehicle, at the owner's expense, parked or left in contravention of the bylaw; And whereas Section 102.(1) of the Municipal Act, S.O. 2001, c. 25, as amended, provides that if a municipality passes a by-law for establishing a system of accessible parking, the sole manner of identifying vehicles shall be an accessible parking permit issued and displayed in accordance with the Highway Traffic Act and the regulations made under it; And whereas Section 102(2) of the Municipal Act, S.O. 2001, c. 25, as amended, provides that a municipality may require the owners or operators of parking lots or other parking facilities to which the public has access, whether on payment of a fee or otherwise, to provide designated parking spaces for vehicles displaying an accessible parking permit and if it does so, the municipality shall prescribe the conditions of use of the accessible parking permit and shall prohibit the improper use of the permit. And whereas Section 102.1(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a municipality may require a person to pay an administrative penalty if the municipality is satisfied that the person has failed to comply with any by- laws respecting the parking, standing or stopping of vehicles; And whereas under Section 425 (1) of the Municipal Act, S.O. 2001, c. 25, as amended, provides that a municipality may pass by-laws providing that a person who contravenes a by-law of the municipality passed under this Act is guilty of an offence; And whereas under Section 427 of the Municipal Act, S.O. 2001, c. 25, as amended, provides that a by-law establishing a system of accessible parking shall provide that every person who contravenes the by-law is guilty of an offence and on conviction is liable to a fine of not less than $300; And whereas under Section 428 of the Municipal Act, S.O. 2001, c. 25, as amended, a by-law may provide that, where a vehicle has been left parked, stopped or standing in contravention of a by-law passed under this Act, the owner of the vehicle is guilty of an offence, even though the owner was not the driver of the vehicle at the time of the contravention of the by-law, and is liable to the applicable fine unless, at the time of the offence, the vehicle was in the possession of another person without the owner's consent; And whereas under Section 429 (1) of the Municipal Act, S.O. 2001, c. 25, as amended, provides that a municipality may establish a system of fines for offences under a by-law of the municipality passed under this Act; And whereas under Section 432 of the Municipal Act, S.O. 2001, c. 25, as amended, a by-law under section 425 may establish a procedure for the voluntary payment of penalties out of court where it is alleged that a by-law related to the parking, standing or stopping of vehicles has been contravened; And whereas Section 122.(7) of the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, provides that a municipality may by by-law designate the date on which a reduced load period shall start or end and the highway or portion thereof under its jurisdiction to which the designation applies; And whereas Section 128(2) of the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, provides that a municipality may by by-law prescribe a rate of speed for motor vehicles driven on a highway or portions of a highway under its jurisdiction and may prescribe different rates of speed for different times of day; And whereas Section 128(5) of the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, provides that a municipality may by by-law, designate a portion of a highway under its jurisdiction that adjoins the entrance to or exit from a school and that is within 150 metres along the highway in either direction beyond the limits of the land used for the purposes of the school; and for motor vehicles driven, on days on which school is regularly held, on the portion of a highway so designated, prescribe a rate of speed that is lower than the rate of speed otherwise prescribed for that portion of highway, and prescribe the time or times at which the speed limit is effective; And whereas Section 137 (a) of the Highway Traffic Act, R.S.O. 1990, c. H.8 as amended, provides that a municipality may, in addition to stop signs required at intersections on through highways, by by-law provide for the erection of stop signs at intersections on highways under its jurisdiction; And whereas Section 170(15) of the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, provides that a police officer, police cadet, municipal law enforcement officer or an officer appointed for carrying out the provisions of the Act, upon discovery of any vehicle parked or standing in contravention of a municipal by-law, may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for the removal, care and storage of the vehicle, if any, are alien upon the vehicle, which may be enforced in a manner provided by the Repair and Storage Liens Act. ; And whereas Section 214.1(1) of the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, provides that a municipality may by by-law designate a part of a highway under its jurisdiction as a community safety zone if, in the council's opinion, public safety is of special concern on that part of the highway; Now therefore the Council of The Corporation of the City of Temiskaming Shores hereby enacts as follows: 1. That Council adopts a by-law to regulate traffic and parking of vehicles within the City identified as Schedule "A", attached hereto and forming part of this by-law. 2. That By-law No. 2008-069 being a by-law to regulate Traffic and Parking upon the Streets of the City of Temiskaming Shores and amending By-laws 2008-165, 2010-018, 2010-029, 2010-124, 2010-146, 2011-015, 2011-069 and 2011-116 thereto, are hereby repealed on the date this by-law becomes effective. 3. That the Clerk of the City of Temiskaming Shores is hereby authorized to make minor modifications or corrections of an administrative, numerical, grammatical, semantically or descriptive nature or kind to the by-law and schedule as may be deemed necessary after the passage of this by-law, where such modifications or corrections do not alter the intent of the By-law. 4. That this by-law shall come into force and take effect on the date of its final passing. Pedestrian Crosswalk 86 27 Designation of Speed Limits on Streets or Portion of Streets Within the City of Temiskaming Shores 87 28 Designated Community Safety Zones 90 29 Prescribed Signs for Accessible Parking Spaces 92 30 Parking Meter Zones 93 City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 1 Part 01 General Provisions 1.1 Short Title This By-Law shall be cited as the "Traffic and Parking By-law. 1.2 Scope The provisions of this By-law shall apply to all City owned streets and property within the municipality and to all privately owned property within the municipality. 1.3 Enforcement This By-law shall be enforced by a By-law Enforcement Officer or a Police Officer. 1.4 Conflicts with other by-law Where a provision of this By-law conflicts with a provision of another by-law in force in the City of Temiskaming Shores, the provisions of this By-law shall prevail in order to protect the health, safety and welfare of the general public. 1.5 Conflicts with Highway Traffic Act In the event of conflict between the provisions of this By-law and the Highway Traffic Act, the provisions of the said Act prevail. Part 02 Definitions Definitions of words, phrases and terms used in this By-law that are not included in the list of definitions in this section shall have the meanings which are commonly assigned to them in the context in which they are used in this By-law. The words, phrases and terms defined in this section have the following meaning for the purposes of this By-law. 2.1 "Accessible Parking Permit" means a "accessible parking permit" issued by the Minister in accordance with the Highway Traffic Act to individuals or organizations and entitles the vehicle in which it is displayed to park in a designated accessible parking space. 2.2 "Accessible Parking Space" means a parking space designated for the sole use of a person to park vehicles displaying a valid Accessible Parking Permit. 2.3 "All Terrain Vehicle" means an "off-road vehicle" as defined by the Off Road Vehicles Act, R.S.O. 1990, Chapter 0.4, as amended. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 2 2.4 "Assembly Occupancy" means the occupancy or the use of a building, or part thereof, by a gathering of persons for civic, political, travel, religious, social, educational, recreational or like purposes, or for the consumption of food or drink. 2.5 "Authorized Emergency Vehicle" includes any ambulance or hearse, any vehicle of the fire department, any vehicle of the municipal, provincial or federal police, any vehicle including snow removal equipment operated by or for the City or a public utility company while actively engaged in the construction, maintenance or repair of any highway, or any equipment or facilities thereon and any vehicle or equipment required to address an ongoing or imminent danger to persons or property or any extraordinary response required to mitigate harm to the environment or community. 2.6 "Boardwalk" means the wooden promenade along a waterfront. 2.7 "Bus" means a vehicle designed for carrying ten or more passengers and used for the transportation of persons. 2.8 "Bus Stop" means that portion of a curb lane or roadway, designated for the purpose of stopping buses operated by the City transit while picking up or discharging passengers. 2.9 "By-law Enforcement Officer" means the person or persons duly appointed by Council as Municipal Law Enforcement Officers for the purpose of enforcing regulatory by-laws of the City. 2.10 "City" means The Corporation of the City of Temiskaming Shores. 2.11 "Commercial Motor Vehicle" means a vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, fire apparatus, buses and tractors used for hauling purposes on the streets. 2.12 "Community Safety Zone" means a portion of street designated by Council as having a special concern for public safety, as provided in the Highway Traffic Act. 2.13 "Corner" means the point of intersection of curbs or edges of the roadway. 2.14 "Council" means the Municipal Council of the City of Temiskaming Shores. 2.15 "Crosswalk" means: a) That part of a street at an intersection that is included within the connections of the lateral lines of the sidewalk on opposite sides of the street measured from the curbs or, in the absence of curbs, from the edges of the roadway, or City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 3 b) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the surface. 2.16 "Curb" means a physical boundary where provided identifying the outside edge of a curb lane. 2.17 "Curb Lane" means that portion of the shoulder adjacent to a roadway designated for the purpose of parking of vehicles. 2.18 "Designated Traffic Lane" means any lane designated for slowly moving traffic, traffic moving in a particular direction or specific classes or types of vehicles. 2.19 "Double Parking" means the parking of a vehicle on any street, beside another vehicle which is legally parked, so that vehicles are side by side or any part of the vehicles is side by side. 2.20 "Driver" means a person who drives a vehicle on a street. 2.21 "Driveway" means the portion of a street, which is improved to permit the passage of vehicles between a roadway and the adjacent property. 2.22 "Fire Access Route" means any portion of a street or a private road designated to provide access for fire department vehicles, pursuant to the Ontario Building Code, Ontario Fire Code or Municipal By-law. 2.23 "Fire Access Route Sign" means a sign approved by the Chief Fire Official in accordance with the Ontario Fire Code. 2.24 "Gross Vehicle Weight" means the total weight in kilograms transmitted to the street by a vehicle, or combination of vehicle, and load. 2.25 "Heavy Traffic" means any vehicle or commercial motor vehicle which has a gross vehicle weight exceeding 5,000 kilograms, and includes transports and heavy trucks. 2.26 "Highway Traffic Act" means the Highway Traffic Act, R.S.O. 1990. c. H.8 as amended. 2.27 "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more roadways which join one another at an angle, whether or not one roadway crosses the other. 2.28 "Laneway" means a public thoroughfare, whether or not improved for use, which has a right-of-way width of ten (10.0) metres or less and which affords only a secondary means of access for vehicular traffic to abutting lots, and which is not intended for general traffic circulation. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 4 2.29 "Minister" means the Minister of Transportation. 2.30 "Ministry" means the Ministry of Transportation. 2.31 "Motorcycle" means a self-propelled vehicle having a seat or saddle for the use of the driver and designed to travel on not more than three wheels in contact with the ground, and includes a motor scooter, but does not include a motor assisted bicycle. 2.32 "Motorized Snow Vehicle" means a "motorized snow vehicle" as defined by the Motorized Snow Vehicle Act, R.S.O. 1990, c. M.44, as amended. 2.33 "Municipality" means the land within the geographic limit of the City of Temiskaming Shores. 2.34 "Official Standard Time" means whenever certain hours are named herein they shall mean standard time or daylight saving time as may be in use in the City. 2.35 "One-Way Street" means a street upon which vehicular traffic is limited to movement in one direction. 2.36 "Park" or "Parking" when prohibited, means the stopping or standing of a vehicle whether occupied or not, except when stopping or standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. 2.37 "Parallel Parking" means the parking of a vehicle with both right wheels thereof drawn up parallel to the right-hand side of the curb lane or curb where provided. 2.38 "Parking Lot" means an area designed to accommodate the parking of vehicles of patrons and/or users of an adjacent facility. A facility shall include, but is not limited to, a community centre, retail outlet, or commercial establishment. 2.39 "Parking Meter" means a device, sometimes referred to as an "individual parking meter", which indicates thereon the length of time during which a vehicle may stop, stand or park, which device has as a part thereof a receptacle for receiving payment and a slot or place in which payment may be deposited to activate a timing mechanism to indicate the passage of the interval of time following the deposited payment, the measurement of which interval is determined by the payment so deposited, and which device also displays a signal when the said interval of time has elapsed; and a device, sometimes referred to as a "pay and display parking meter" which dispenses a piece of paper intended to be removed from the device and displayed by the operator of a vehicle on the interior side of the front windshield of the vehicle when parked, and which device has as a part thereof a receptacle for the receiving of payment and a slot or place in which payment may be deposited to activate a mechanism to imprint a time and date on the piece of City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 5 paper following the deposit of payment, the specific time and date being determined by the payment deposited 2.40 "Parking Meter Zone" means the streets or parts of streets, parking lots or property owned by the City designated by this by-law for parking purposes timed by parking meters. 2.41 "Parking Space" means a portion of the surface of a street or parts of streets, parking lots or property owned by the City, the use of which is controlled and regulated by a parking meter. 2.42 "Person" means an individual, firm or corporation. 2.43 "Provincial Offences Act" means the Provincial Offences Act, R.S.O. 1990, c. P.33, as amended. 2.44 "Police Officer" means a member of the Ontario Provincial Police Service. 2.45 "Police Use Only Zone" means that portion of roadway abutting the curb or that portion of a shoulder abutting the roadway, indicated by a posted sign for the purpose of parking police vehicles. 2.46 "Prohibited Truck Route" means a prohibited truck route as identified in Section 4.8 of this By-law. 2.47 "Private Road" means every privately owned way or place, driveway, road, lane, ramp, path or sidewalk used by pedestrians and/or vehicular traffic to access a roadway or sidewalk, and may include portions of a parking lot. 2.48 "Recreation Vehicle" means a piece of equipment designed for use as both a vehicle and for lodging and shall include conventional travel trailers, fifth wheel travel trailers, folding camper trailers, truck campers, type A, B and C motor homes and luxury bus conversions. 2.49 "Repair and Storage Liens Act" means the Repair and Storage Liens Act, R.S.O. 1990, c. R.25, as amended. 2.50 "Roadway" means that part of the street that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a street includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively. 2.51 "School Bus Loading Zone" means any portion of any street upon which school buses are operated in which an area is set aside and designated as a "Safety Zone" for school bus unloading or loading. 2.52 "Shoulder" means that area of a street between the edge of the roadway and the adjacent lateral property lines. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 6 2.53 "Sidewalk" means any municipal walkway, or that portion of a street between curb lines or the lateral lines of a roadway, and the adjacent property line, primarily intended for use by pedestrians. 2.54 "Stand" or "Standing" when prohibited means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers. 2.55 "Stop" or "Stopping" when prohibited, means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer, traffic control device or traffic signal. 2.56 "Street" means a common and public highway, street, roadway, crescent, avenue, parkway, driveway, square, place, bridge, viaduct, trestle or other such place designated and intended for, or used by the general public for the passage or parking of vehicles and includes the area of land between the lateral property lines thereof. 2.57 "Taxicab Zone" means a parking space(s) assigned for the sole use of taxicabs. 2.58 "Through Highway" means a street or part of a street designated as such by the Minister or by by-law of a municipality, and every such street which intersects it shall be marked by a stop sign or yield right-of-way sign in compliance with the regulations of the Ministry. 2.59 "Traffic" shall mean pedestrians, ridden or herded animals, vehicles, and other conveyances either singly or together while using any street for the purpose of travel. 2.60 "Traffic Control Device" means any sign or other device erected or placed by the authority of the Council or delegate of the City for the purpose of guiding, directing or regulating traffic. 2.61 "Traffic Signal" means any device manually, electrically or mechanically operated, for the regulation of traffic. 2.62 "Trailer" means a vehicle that is at any time drawn upon a street by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily drawn, propelled or moved upon such street, and except a side car attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn. 2.63 "Truck Route" means a designated truck route as identified in Section 4.6 of this By-law. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 7 2.64 "Vehicle" means an automobile, motor vehicle, all-terrain vehicle, bicycle, bus, farm tractor, truck, trailer, traction engine, motorcycle, motorized snow vehicle, road-building machine, motor assisted bicycle, and any vehicle drawn, propelled or driven by any kind of power, including muscular power. Part 03 Required Obedience to Traffic Regulation 3.1 Obedience to Traffic Signs and Signals Every person on any street or private road shall promptly obey all signals given either by a Police Officer or by a traffic control device or traffic signal and shall where applicable comply with the requirements of every sign authorized in this By-law. 3.2 Traffic Control Devices and Traffic Signals 3.2.1 Traffic control devices and traffic signals authorized in this By-law shall be identified in the Appendices attached hereto and forming part of this By-law. 3.2.2 No person shall place or exhibit any sign upon any street to guide direct or regulate traffic or the parking of vehicles unless authorized by this By-law. 3.2.3 The driver of any vehicle shall obey the instructions of all traffic control devices and traffic signals authorized in this By-law. Part 04 Designations 4.1 Designation of One-Way Street Upon those streets and parts of streets described in Appendix "13" of this By-law, vehicular traffic shall move only in the direction indicated by posted signage. 4.2 Designating Through Highways The streets or parts of streets as set out in Appendix "15" of this By-law coming under the jurisdiction of the City are designated as through highways, and every such street that meets a through highway shall be marked by a stop sign or yield right-of-way sign in compliance with the regulations of the Ministry. The designation of a street or part of a street as set out in this section, as a through highway shall not include any intersection thereon where the road intersected is a Queen's Highway or where traffic control devices are installed. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 8 4.3 Designated Traffic Lanes Designated Traffic Lanes are described in Appendix "16" attached to and forming part of this By-law. On the streets or parts of streets listed in Column "1" of Appendix "16" at the locations indicated in Column "2", each of the lanes indicated in Column "3", are designated for traffic moving only in the direction or directions indicated in Column "4" during the days and times indicated in Column "5". 4.4 Designation of School/Pedestrian Crosswalks The portions of streets or roadways set out in Appendix "26" attached hereto and forming part of this By-law, are designated as school/pedestrian crosswalks. 4.5 Designated Reduced Load Period Where the City has erected signs giving notice thereof, a reduced load period shall start on April 1st of each year and end on June 30th of each year on those streets or portion thereof set out in Table (a) of Appendix "23", attached hereto and forming part of this By-law. 4.6 Designation of Truck Routes Where the City has erected signs giving notice thereof, the streets or parts of streets as set out in Table (b) of Appendix "23" shall be designated as Truck Routes. 4.7 Truck Route - Offence No person shall operate heavy traffic on any street or portion of street other than on the parts of the streets set out in Table (b) of Appendix "23". 4.8 Designations of Prohibited Truck Routes Where the City has erected signs giving notice thereof, the streets or parts of streets as set out in Table (c) of Appendix "23" shall be designated as Prohibited Truck Routes. 4.9 Truck Route - Exceptions 4.9.1 Notwithstanding Section 4.7, a person may operate heavy traffic on any street to make a delivery to or collection from any destination in the City, provided that the operator of the heavy traffic proceeds by the most direct route between the nearest truck route and the place of delivery to or collection from and on the completion of the conduct of business, the heavy traffic returns by the most direct route to the nearest truck. 4.9.2 The provisions of Section 4.7 shall not apply to authorized emergency vehicles, public transit vehicles, school buses, a tractor-trailer used by a school registered by the Ministry of Training Colleges and Universities or tractor-truck-in-route from or to residence of owner. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 9 4.9.3 Notwithstanding Section 4.9.1, there are no exceptions that apply to the Prohibited Truck Routes outlined in Section 4.8. Part 05 Parking Regulations 5.1 Method of Parallel Parking Where parallel parking is permitted no person shall stop, stand or park a vehicle: a) on any street except upon the right hand side of the street, in the direction in which the vehicle is required to proceed; b) on any street where a curb is provided, with the right front and right rear wheels of the vehicle more than thirty (30 cm) centimetres from the curb; c) on any street where a curb is not provided other than on the curb lane; or d) in a manner which obstructs or interferes with traffic on a roadway. 5.2 Angle Parking Angle parking shall be permitted only where the City has erected signs giving notice thereof in those areas set out on Appendix "17" attached hereto and forming part of this By-law. 5.3 Method of Angle Parking Where angle parking is permitted, no person shall stop, stand or park a vehicle: a) except within the limits defined by pavement markings; b) where no pavement markings are visible, except at an angle not less than forty (40) degrees and not exceeding sixty (60) degrees to that side of the street or curb where provided, having regard for the direction in which the vehicle is required to proceed, and with the front end of the vehicle drawn up to that side of the street, or at a distance of not more than thirty (30) centimeters from a curb where provided; c) where a load being carried upon the vehicle extends beyond the rear of the vehicle; d) where the vehicle has attached to it a trailer; or e) in a manner which obstructs or interferes with traffic in any way while so parked. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 10 5.4 Loading Zone Curb lanes or portions thereof as set out in Appendix "7" attached hereto and forming part of this Bylaw, are hereby designated as loading zones. 5.5 Parking Prohibition - Loading Zone - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand, or park any vehicle in a loading zone except while loading or unloading goods or passengers. 5.6 Parking Prohibition - Laneway - Offence No person shall stop, stand or park any vehicle on a laneway. 5.7 Parking Prohibition - Commercial Motor Vehicles - Offence No person shall stop, stand or park a commercial motor vehicle on any street between the hours of 12:00 a.m. and 7:00 a.m. Monday to Saturday or at all times on Sundays or Legal Holidays. 5.8 Parking Prohibition - Limited Commercial Parking - Offence No person shall stop, stand or park any tractor trailer unit or truck having three (3) or more axles or with a gross weight of five-thousand (5,000) kilograms or greater on any street within the City, for a period longer than two (2) hours. 5.9 Prohibition - Overnight Parking - Offence No person shall stop, stand or park a vehicle on any street or City owned parking lot between the hours of 12:00 a.m. to 7:00 a.m. during the period of November 1st in one year to March 31st of the next year. 5.10 Bus Stops Curb lanes or portions thereof as set out in Appendix "5" attached hereto and forming part of this Bylaw, are hereby designated as bus stops. 5.11 Parking Prohibition - Bus Stops - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle in a bus stop except the operator of a bus. 5.12 School Bus Loading Zone Curb lanes or portions thereof as set out in Appendix "6" attached hereto and forming part of this Bylaw, are hereby designated as school bus loading zones. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 11 5.13 Parking Prohibition - School Bus Loading Zone - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle in a school bus loading zone except the operator of a school bus. 5.14 Taxicab Zone Curb lanes or portions thereof as set out in Appendix "8" attached hereto and forming part of this Bylaw, are hereby designated as taxicab zones. 5.15 Parking Prohibition - Taxicab Zone - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle in a taxicab zone except the operator of a taxicab. 5.16 Police Use Only Zone The locations identified in Appendix "22" attached hereto and forming part of this By- law, are hereby designated police use only zones. 5.17 Parking Prohibition - Police Use Only Zone - Offence Where signs are erected giving notice thereof, no person shall stop or stand or park a vehicle in a police use only zone except the operator of a police vehicle. 5.18 Parking Prohibition - At All Times in Designated Places Those portions of streets as set out in Appendix "4" attached to and forming part of this By-law, shall be designated as areas where stopping, standing or parking of vehicles is prohibited at all times. 5.19 Parking Prohibition - At All Times in Designated Places - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle at any time in an area where stopping, standing or parking is prohibited. 5.20 Parking Prohibition - Time Limited in Designated Places Those portions of streets as set out in Appendix "9" attached to and forming part of this By-law, shall be designated as locations where stopping, standing or parking of vehicles is limited to times prescribed in this Section. 5.20.1 Parking Prohibition - Time Limited 90 Minutes - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle in locations set out in Table (d) of Appendix "9" for a period exceeding ninety (90) minutes between the hours of 9:00 a.m. and 6:00 p.m. daily excluding Sundays and Statutory Holidays. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 12 5.20.2 Parking Prohibition - Time Limited 60 Minutes - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle in locations set out in Table (c) of Appendix "9" for a period exceeding sixty (60) minutes between the hours of 9:00 a.m. and 6:00 p.m. daily excluding Sundays and Statutory Holidays. 5.20.3 Parking Prohibition - Time Limited 15 Minutes - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle in locations set out in Table (a) of Appendix "9" for a period exceeding fifteen (15) minutes at all times excluding Sundays and Statutory Holidays. 5.20.4 Parking Prohibition - Time Limited 15 Minutes (8:30 a.m. to 4:30 p.m.) - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle in locations set out in Table (b) of Appendix "9" for a period exceeding fifteen (15) minutes between the hours of 8:30 a.m. and 4:30 p.m. daily excluding Saturday, Sunday and School Holidays. 5.20.5 Parking Prohibition - During Certain Times - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle in those locations set out in Column "1", during the time periods set out in Column "2", of Table (e) of Appendix "9". 5.20.6 Parking Prohibition - During Certain Times - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle in locations set out in Table (f) of Appendix "9" between the hours of 7:00 a.m. and 5:00 p.m. daily excluding Saturday, Sunday, Statutory Holidays, and all days during the months of July and August in each calendar year. 5.21 Parking Prohibition - Assembly Occupancy - Offence Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle on any street in front of an exit from a building with an assembly occupancy. 5.22 Reserved This section is reserved. 5.23 Parking Prohibition - Private Road, Parking Lots or Property - Offence City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 13 5.23.1 No person shall stop, stand or park any vehicle on a private road, parking lot or property unless a valid parking permit issued by the owner of the property is visibly displayed on the dashboard or sun visor of the vehicle. 5.23.2 Where signs have been erected on a private road, parking lot or property prohibiting parking or giving notice of a parking time limit, no person shall stop, stand or park a vehicle in contravention of such signs. 5.24 Parking Prohibition - General 5.24.1 No person shall stop, stand or park a vehicle that obstructs access to or egress from a driveway. 5.24.2 No person shall stop, stand or park a vehicle within two (2) metres of a fire hydrant or where the hydrant is set back from the edge of the roadway, within two (2) metres of the point at which the prolongation of the center line of the hydrant at right angles to the edge of the roadway intersects such edge. 5.24.3 No person shall stop, stand or park a vehicle on any bridge or within thirty (30) meters of the approaches thereto. 5.24.4 No person shall stop, stand or park a vehicle on any street in a manner which obstructs or interferes with traffic. 5.24.5 No person shall stop, stand or park a vehicle on any street in a manner which prevents the convenient removal of vehicles previously parked. 5.24.6 Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle on any street closer to an intersection than the distance indicated by signs. 5.24.7 Notwithstanding Section 5.24.6 where no signs have been erected giving notice thereof, no person shall stop, stand or park a vehicle within nine (9) metres of an intersection. 5.24.8 Where the City has erected signs giving notice thereof, no person shall stop, stand or park a vehicle on any street closer to a crosswalk than the distance indicated by signs. 5.24.9 No person shall stop, stand or park a vehicle within fifteen (15) metres of the nearest rail of a level railway crossing. 5.24.10 No person shall stop, stand or park a vehicle in front of the entrance to a fire hall or fire vehicle exit. 5.24.11 No person shall stop, stand or park a vehicle on any City sidewalk, boulevard, parkland, garden, lawn or other place set apart for ornament or embellishment, unless such parking has been authorized by Council. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 14 5.24.12 No person shall stop, stand or park a vehicle upon any street or municipally owned parking lot for the purpose of displaying the vehicle for sale or rent. 5.24.13 No person shall stop, stand or park a vehicle upon any street or City property for the purpose of washing, greasing or repairing such vehicle. 5.24.14 No person shall stop, stand or park a vehicle upon any street or City property for any purpose if the vehicle is inoperable or does not have current license plates. 5.25 Parking of Recreational Vehicles No person shall stop, stand or park a recreational vehicle on any street or City owned parking lot for the purpose of providing lodging, shelter or to camp. 5.26 Parking of Taxicab 5.26.1 No person shall stop, stand or park a taxicab upon any street where a parking time limit has been established in accordance with Section 5.20, during the period for which the time limit is in force. 5.26.1 Notwithstanding Section 5.26.1 a taxicab may temporarily stop upon any street where a parking time limit has been established in accordance with Section 5.20, while engaged in loading or unloading passengers. Part 6 Metered Parking 6.1 Application of Part The provisions of this Part shall apply to those parts of streets, parking lots or property owned by the City and established for vehicle parking named and described as Parking Meter Zones in Appendix "30" attached hereto and forming part of this Bylaw. 6.2 Use of Parking Meters Parking meters shall be erected, maintained and operated in the parking meter zones described in Appendix "30" attached hereto and forming part of this Bylaw for the purpose of controlling and regulating the parking of any vehicle in such zones and measuring and recording the duration of such parking. 6.3 Parking in Parking Meter Zone 6.3.1 No person shall stop, stand or park a vehicle at any individual parking meter in a parking meter zone during the applicable days and hours described in Column 5 of Appendix "30" attached hereto and forming part of this Bylaw: City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 15 a) unless the fee stipulated for a given parking period in the parking space as set out in Column 6 of Appendix "30" attached hereto and forming part of this By-law has been paid for the parking period or any portion of it, and the period shall be as measured by the parking meter controlling that parking space; b) unless that person has activated the parking meter; and c) in no case, longer than the maximum allowable parking time at that parking meter as may be stipulated in Column 7 of Appendix "30" attached hereto and forming part of this By-law. 6.3.2 No person shall stop, stand or park a vehicle in a parking meter zone during the applicable days and hours described in Column 5 of Appendix "30" attached hereto and forming part of this Bylaw, where a pay and display parking meter is in operation: a) unless the pay and display parking meter controlling the parking space is used and the fee stipulated in Column 6 of Appendix "30" attached hereto and forming part of this By-law for a given parking period in the parking space has been paid for that parking period or any portion of it, and the period shall be as measured by the pay and display parking meter controlling that parking space; b) in no case, longer than the maximum allowable parking time at that parking space as may be stipulated in Column 7 of Appendix "30" attached hereto and forming part of this By-law; and c) unless the receipt issued by the pay and display parking meter is placed inside the windshield of the vehicle in a position that the writing and markings on it face outward and can be easily seen from outside the vehicle. 6.3.3 Where pay and display parking meters have been erected and are in operation in a parking meter zone, the duration of the period of parking permitted shall be measured by the pay and display parking meter and shall be the period of duration indicated on the receipt issued by the pay and display parking meter. 6.4 Method of Parking 6.4.1 No person shall parallel park a vehicle at a parking meter unless the front bumper is adjacent to a single parking meter installation, or unless the front or rear bumper as indicated on the appropriate parking meter is adjacent to any double parking meter installation. 6.4.2 No person shall angle park a vehicle at a parking meter unless the front bumper City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 16 is adjacent to the designated parking meter. 6.5 Lines or Marks for Parking 6.5.1 Where lines or markings are place on the street, parking lot or on the curb alongside each parking meter to designate the parking space for which said parking meter is to be used, no person shall stop, stand or park a vehicle except within such lines or markings. 6.5.2 Where parking is regulated by a pay and display parking meter and where lines or markings are place on the street, parking lot or on the curb to designate parking spaces, no person shall stop, stand or park a vehicle except within such lines or markings. 6.6 Park using more than One Parking Spaces in Parking Meter Zone Upon parking any vehicle which by reason of its size necessarily occupies more than one parking space or portion thereof, a) in the case where an individual parking meter is installed adjacent to each parking space used in whole or in part by such vehicle, the parking meter for each such parking space shall be activated; or b) in the case where parking in each parking space used in whole or in part by such vehicle is controlled by a pay and display parking meter, a receipt issued by the pay and display parking meter shall be displayed for each such parking space. 6.7 One Vehicle in Parking Space 6.7.1 No person shall stop, stand or park more than one vehicle in any one parking space at any one time. 6.7.2 No person shall stop, stand or park a vehicle in a parking space that is partly or completely occupied by another vehicle. 6.7.3 Subsections 6.7.1 and 6.7.2 of this section do not apply to a person parking a motorcycle in a parking space occupied by another motorcycle so long as the number of motorcycles does not exceed three. 6.8 Parking Prohibited No Meter No person shall stop, stand or park a vehicle in a parking meter zone, unless a parking meter is erected or otherwise posted. 6.9 Overtime Parking Prohibited 6.9.1 On the days and between the hours set out in Column 5 of Appendix "30" attached hereto and forming part of this By-law, no person shall stop, stand or City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 17 park a vehicle in a parking space in any parking meter zone longer than the maximum allowable parking time stipulated in Column 7 of Appendix "30" attached hereto and forming part of this By-law. 6.9.2 On the days and between the hours set out in Column 5 of Appendix "30" attached hereto and forming part of this By-law, no person shall stop, stand or park a vehicle in a parking space in any parking meter zone: a) while the parking meter, if, any, for the parking space indicates that such vehicle is unlawfully parked, whether such indication is the result of failure to pay or the result of failure to activate the parking meter, or the result of mechanical operation of the parking meter following the expiration of the authorized parking time; or b) while the receipt issued by a pay and display parking meter, if any, for the parking space indicates that such vehicle is parked following the expiration of the authorized parking time; or c) without display of a valid receipt, issued from a pay and display parking meter controlling that parking space, inside the windshield of the vehicle in a position that the writing and markings on it face outward and can be easily seen from outside the vehicle. 6.9.3 The fact that a vehicle is parked in a metered parking space on the days and during the hours set out in Column 5 of Appendix "30" attached hereto and forming part of this By-law without the parking meter adjacent to such parking space showing that that such parking is in accordance with the provisions of this Part shall be prima facie evidence that such vehicle is unlawfully parked. 6.9.4 The fact that a vehicle is parked in a parking space controlled by a pay and display parking meter on the days and during the hours set out in Column 5 of Appendix "30" attached hereto and forming part of this By-law without a valid receipt being displayed showing that such parking is in accordance with the provisions of this Part shall be prima facie evidence that such vehicle is unlawfully parked. 6.10 Use of Slugs or Devices No person shall deposit or cause to be deposited in any parking meter, any slugs, devices or other substitute for a coin or affix to the parking meter any material or device which could interfere with the normal operation of the parking meter or mechanism thereof. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 18 6.11 Unauthorized Devices No person shall place or exhibit upon any street, parking lot or property owned by the City and established for vehicle parking any unauthorized device attempting or purporting to control or regulate the parking of vehicles. 6.12 Tampering with Parking Meter No person shall, unless authorized by the City, willfully or deliberately move, remove, alter or tamper with any parking meter erected or placed upon any street, parking lot or property owned by the City. 6.13 Person Not required to place Fee in Parking Meter 6.13.1 The payment of fees in parking meters shall not be required of the owner or driver of an authorized emergency vehicle, nor the owner or driver of any vehicle while actually engaged in loading or unloading passengers, provided that the parking for such purpose is restricted to such length of time as is absolutely necessary therefor, nor the owner or driver of a commercial motor vehicle to which the provisions of Section 6.13.2 applies. 6.13.2 The provisions of this Part shall not apply to commercial motor vehicles, other than buses, for loading and unloading purposes, from 9:00 a.m. to 6:00 p.m. 6.14 Accessible Parking Spaces Exempt Where a parking space within a parking meter zone is designated as an accessible parking space, the provisions of this Part shall not apply to such accessible parking space. Part 7 Designated Parking Spaces 7.1 Designated On-Street Accessible Parking Spaces The designated parking spaces described in Appendix "18" attached hereto and forming part of this By-law are hereby designated as accessible parking spaces. 7.2 Requirements for On-Street Accessible Parking Spaces All on-street accessible parking spaces on streets or private roadways shall be in accordance with the following requirements: a) they shall be identified by the prescribed sign for identifying accessible parking spaces; b) where parallel parking conditions exist spaces shall be no less than 7.0 metres City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 19 (23 ft) in length; c) a vertical clearance of 2.75 metres (9 ft) must be maintained below overhead structures; d) placed with sufficient clearance around the vehicle, in terms of other vehicles, or obstacles such as light standards, waste receptacles and other barriers; and e) placed where sidewalks are accessible to persons with disabilities whether via ramps, depressed curbs or other appropriate means. 7.3 Designated Accessible Parking Spaces on City and Privately Owned/Operated Parking Lot On City and privately owned/operated parking lots, a minimum number of accessible parking spaces shall be provided in accordance with Appendix "19" attached hereto and forming part of this By-law. Notwithstanding the above, Section 7.3 shall not apply to parking lots serving residential apartments, where tenants are assigned parking spaces. 7.4 Requirements for Off-Street Accessible Parking Spaces All accessible parking spaces on City or privately owned/operated parking lots where this By-law is in effect shall: a) be identified by the prescribed sign for identifying accessible parking spaces; b) have a width of not less than 4.6 metres (15 ft); c) have a vertical clearance of 2.75 metres (9 ft) ; and d) have no barriers such as but not limited to chains, steel barriers or blockades that impede the deployment of doors, lifts, or ramps from vehicles. 7.5 Prescribed Sign for Identifying Accessible Parking Spaces The prescribed sign for identifying accessible parking spaces authorized elsewhere in this By-law, is as set out in Appendix "29" attached hereto and forming part of this By- law and in accordance with the Highway Traffic Act. 7.6 Accessible Parking Spaces exempt from Time Limits (Section 5.20) The provisions of Section 5.20 with respect to parking time limits shall not apply to accessible parking spaces. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 20 7.7 Accessible Parking Spaces - Offence Where prescribed signs are erected giving notice thereof, no person shall stop, stand or park a vehicle in an accessible parking space, without a valid accessible parking permit being visibly displayed on the dashboard or sun visor of the vehicle. 7.8 Enforcement of Accessible Parking Spaces on Privately Owned/Operated Parking Lot The enforcement provisions of this By-law with respect to parking in accessible parking spaces shall apply to accessible parking spaces located on privately owned parking lots. 7.9 Fire Access Route Offence Where fire access route signs are erected giving notice thereof, no person shall stop or stand or park a vehicle in a fire access route. 7.10 Enforcement of Fire Access Routes on Private Roadways The enforcement provisions of this By-law with respect to parking in fire access routes shall apply to fire access routes located on private roadways. Part 8 - Operation of Vehicles 8.1 Prohibition - Drive on Sidewalk No person shall operate a vehicle within any sidewalk area except at a permanent or temporary driveway. 8.2 Restricting the Weight of Vehicles Passing over a Bridge No vehicle or combination of vehicles or any class thereof, shall be operated over any bridge, where such vehicle or combination of vehicles exceeds the posted gross vehicle weight limit for that bridge as described in Appendix "24" attached hereto and forming part of this By-law. Part 9 - Safety Precautions 9.1 Prohibition - Roller Blades, Skateboards No person upon roller blades, skateboards, or riding in or by means of a coaster, toy vehicle or similar device shall go upon any sidewalk along the designated streets as set out on Appendix "25" attached hereto and forming part of this By-law. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 21 9.2 Prohibition - Boardwalks No person shall ride a vehicle, roller blades, skateboards, coaster, toy vehicle or a similar device upon any portion of a boardwalk. Part 10 - Rate of Speed 10.1 Designated Speed Limits The streets or portions of streets described in Tables 1, 3, 4, 5 and 6 of Appendix "27" attached hereto and forming part of this By-law, are hereby designated for a prescribed speed limit for vehicles driven on these streets or portion thereof. 10.2 Community Safety Zones The designated street or portion of streets described in Appendix "28" attached hereto and forming part of this By-law, are hereby designated as a community safety zones. 10.3 Speed Limit in School Zones To prescribe a rate of speed for vehicles driven upon the portion of a street so designated on Table 2 of Appendix "27" attached hereto and forming part of this By-law, on days which school is regularly held and prescribe the time between the hours of 8:00 a.m. and 8:00 p.m. at which such speed is effective. 10.4 Speed Limit in Community Safety Zones To prescribe a rate of speed for vehicles driven upon the portion of a street so designated in Appendix "28" attached hereto and forming part of this By-law each calendar day between the hours of 8:00 a.m. and 8:00 p.m. at which such speed is effective. Part 11 - Penalties 11.1 General Penalties (a) Every person who contravenes any provision of this by-law is guilty of an offence and upon conviction is liable to a fine as provided for by section 61 of the Provincial Offences Act, R.S.O. 1990, Chapter P.33, as amended. (b) Where an offence is committed, each day on which a person contravenes any provision of this by-law shall be deemed to constitute a separate offence under this by-law as provided for in section 429 of the Municipal Act, S.O. 2001, c. 25. City of Temiskaming Shores Schedule "A" to Traffic and Parking By-law No. 2012-101 22 11.2 Notice of Parking Infraction Where a vehicle is parked or found to be parked or left in contravention of any provision of this By-law, a Police Officer or By-law Enforcement Officer so finding the vehicle may issue a Parking Infraction Certificate and Notice in accordance with the provisions of the Provincial Offences Act. 11.3 Voluntary Payment Notwithstanding the provisions of Section 11.1, any person may, upon presentation of a Parking Infraction Notice indicating the commission of an offence under any provision of this By-law, make voluntary payment to the City in the amount as set out in Appendix "21"attached hereto and forming part of this By-law. 11.4 Authority to Remove Vehicle Notwithstanding any other penalty imposed by this By-law, a Police Officer or By-law Enforcement Officer may cause any vehicle left stopped, standing or parked in contravention of the provisions of this By-law to be moved or taken to and placed or stored in a suitable place. Removal of the vehicle shall be at the owners risk and expenses and all such costs and charges for removing, care and storage, if any, shall be collectable pursuant to the provisions of the Repair and Storage Liens Act. Part 12 - Validity 12.1 Validity of By-law If any section, clause, or provision of this By-law, is for any reason declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the By-law as a whole or any part thereof, other than the section, clause or provision so declared to be invalid and it is hereby declared to be the intention that all remaining sections, clauses or provisions of this By-law shall remain in full force and effect until repealed, notwithstanding that one or more provisions thereof shall have been declared to be invalid.
