THE CORPORATION OF THE MUNICIPALITY OF THAMES CENTRE
BY-LAW NO. 29-2019
Being a by law to prescribe a maximum rate of travel on certain sections
of highways in the Municipality of Thames Centre.
WHEREAS the Highway Traffic Act, R.S.O. 1990, c. H.8, s 128(2), as
amended authorizes the Council of a municipality by by-law to prescribe a rate of
speed of 40, 50, 60, 70, 80, 90 or 100 kilometres per hours for motor vehicles driven
on a highway or portion of a highway under its jurisdiction;
AND WHEREAS the Council of the Corporation of the Municipality of
Thames Centre has deemed it expedient that the speed of motor vehicles on certain
highways in the Municipality of Thames Centre be restricted;
NOW THEREFORE the Council of the Corporation of the Municipality of
Thames Centre HEREBY ENACTS AS FOLLOWS:
1.
THAT when any highway or portion of highway within the limits as set out
below in Schedule "A" is marked in compliance with the regulations under
the Highway Traffic Act, the maximum rate of speed thereon shall be 40
kilometres per hour.
2.
THAT when any highway or portion of highway within the limits as set out
below in Schedule "B" is marked in compliance with the regulations under
the Highway Traffic Act, the maximum rate of speed thereon shall be 50
kilometres per hour.
3.
THAT when any highway or portion of highway within the limits as set out
below in Schedule "C" is marked in compliance with the regulations under
the Highway Traffic Act, the maximum rate of speed thereon shall be 60
kilometres per hour.
4.
THAT when any highway or portion of highway within the limits as set out
below in Schedule "D" is marked in compliance with the regulations under
the Highway Traffic Act, the maximum rate of speed thereon shall be 70
kilometres per hour.
5.
THAT all highways not specifically identified in this by-law shall have a
prescribed maximum rate of speed as per the Highway Traffic Act.
6.
THAT the penalties provided in subsection 14 of Section 128 of the Highway
Traffic Act, R.S.O., as amended, shall apply to offences against this by-law.
7.
THAT By-law No. 71-2014, passed on 6th day of October, 2014, By-law No.
119-2016, passed on the 12th day of December, 2016, By-law No. 32-2017
passed on the 10th day of April, 2017 and By-law 77-2018 passed on the
10th day of September, 2018, be and they are hereby repealed.
8.
THAT this By-law shall come into force and take effect upon the final
passing thereof.
READ a FIRST and SECOND time this 8th day of April, 2019.
READ a THIRD time and FINALLY PASSED this 8th day of April, 2019.
