WHEREAS Section 11( 3)( 8) of the Municipal Act, S. O. 2001, c. 25, as amended authorizes municipalities to enact by-laws regulating parking; AND WHEREAS O. Reg. 366/ 18 of the Municipal Act, S. O. 2001, c. 25, as amended sets out minimum standards for road and highway maintenance for all municipalities in Ontario; AND WHEREAS subsection 5( 3) of the Municipal Act, S. O. 2001 c. 25, as amended, provides that a municipal power shall be exercised by by- law; AND WHEREAS section 425 of the Municipal Act, S. O. 2001 c. 25, as amended, establishes that any person who contravenes a by- law passed under this Act is guilty of an offence; AND WHEREAS section 428 of the Municipal Act, S. O. 2001 c. 25, as amended, provides that a by-law may provide that where a vehicle has been left parked, stopped or standing in contravention of a by-law passed under this Act, the owner of the vehicle is guilty of an offence, even though the owner was not the driver of the vehicle at the time of the contravention of the by- law and is liable to the applicable fines unless, at the time of the offence, the vehicle was in the possession of another person without the owner' s consent; AND WHEREAS section 429( 1) of the Municipal Act, S. O. 2001 c.25, as amended, provides that subject to subsection ( 4), a municipality may establish a system of fines or offences under a by- law of the municipality passed under this Act; AND WHEREAS section 432 ( 1) of the Municipal Act, S. O. 2001 c.25, as amended, provides that a by-law under section 425 may establish a procedure for the voluntary payment of penalties out of court where it is alleged that any of the following by-laws have been contravened: By- laws related to the parking, standing or stopping of vehicles; AND WHEREAS Part II, Provincial Offences Act, R. S. O 1990, as amended, is hereby declared to apply to this by-law subject to section 15( 2) of the said Act; AND WHEREAS Section 122( 7) of the Highway Traffic Act, R.S.O. 1990 provides that a municipality or other authority having jurisdiction over a highway may by by-law designate the date on which a reduced load period shall start or end and the highway or portion thereof under its jurisdiction to which the designation applies; AND WHEREAS Section 122( 7) of the Highway Traffic Act, R.S. O. 1990 provides that a police officer, police cadet, municipal law enforcement officer, or any officer appointed for carrying out the provisions of this Act, upon discovery of any vehicle parked or standing in contravention of subsection ( 12) of a regulation made under subsection 26( 3) of the Public Transportation and Highway Improvement Act, or municipal by- law, may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for the removal, care and storage of the vehicle, if any, are a lien upon the vehicle which may be enforced in the manner provided by the Repair and Storage Liens Act, AND WHEREAS Section 7. 1( 1)( c) of the Fire Protection and Prevention Act, 1997, S. O. provides that a council of a municipality my pass by-laws designating private roads as fire routes along which no parking of vehicles shall be permitted and providing for the removal and impounding of any vehicle parked or left along any of the Page 4 of 12 fire routes at the expense of the owner; AND WHEREAS the Council of The Corporation of the Municipality of Thames Centre deems it expedient to pass a by- law to regulate parking and traffic in the municipality; AND WHEREAS the Council of the Corporation of the Municipality of Thames Centre deems it expedient to repeal By-law 35-2017 and all amendments, enacted on April 10, 2017 and to enact a new Parking and Traffic By-law; NOW THEREFORE the Council of The Corporation of the Municipality of Thames Centre HEREBY ENACTS AS FOLLOWS: 1. DEFINITIONS Definitions for the purpose of this by-law: a) Accessible Parking Permit means a permit which is issued under the Highway Traffic Act and is currently valid or a permit or other marker or device which is issued by another jurisdiction that is currently valid and recognize under the Highway Traffic Act and the regulations thereunder; b) Agricultural Purposes means land where animals or birds are kept for grazing, breeding, raising, boarding, training, or used for the tillage of soil, rowing, harvesting of vegetables, fruits, field crops or landscaping materials; c) Authorized Parking Area means an area owned by the Municipality, designated, or established, for the parking of motor vehicles, which may have posted regulations with respect to the use of the area; d) Bicycle includes a tricycle, a unicycle and a power- assisted bicycle but does not include a motor assisted bicycle e) Boulevard means that portion of every road allowance within the limits of the Municipality of Thames Centre, which is not used as a sidewalk, driveway access, travelled roadway, or shoulder; f) By-law Compliance Officer means a person duly appointed by The Corporation of the Municipality of Thames Centre for enforcing the provisions of this By-law; g) Corporation means The Corporation of the Municipality of Thames Centre; h) Council means the Council of The Corporation of the Municipality of Thames Centre; i) Crosswalk means: i. That part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the absence of curbs from the edges of the roadway; or ii. Any portion of the roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by school crossing signs ( as per the Ontario Traffic Manual -- Book 5 Regulatory Signs) or by lines or other markings on the surface thereof; Q) Curb means the edge of the travelled portion of a street or roadway; k) Designated Parking Space means a parking space designated under Page 5 of 12 sections 11 and 12of this by- law for the sole use of vehicles carrying a person with a disability and is indicated as such by the erection of a sign in the form set out in Schedule " D" of this by-law; 1) Driveway means that portion of a lot which provides vehicular access from the roadway to a laneway or parking area on adjacent land. m) Fire Route means any private roadway along which official signs are erected pursuant to section 9 of this by-law; n) Heavy Truck means i. any commercial motor vehicle which has a rated gross vehicle weight exceeding 5 tonnes ( 5, 000 kilograms, or 11, 023 pounds) according to the current permit or vehicle registration which has been issued under the Highway Traffic Act, or its foreign equivalent for such vehicle, regardless of the actual weight of such vehicles, but does not include a vehicle operated by or on behalf of the Corporation or a school bus which is in the course of transporting children or adults to and from school; ii. a trailer that has a manufacturer's gross weight rating exceeding1, 360 kilograms, regardless of the actual weight of such trailer, but does not include a vehicle operated by or on behalf of the Corporation or a school bus which is in the course of transporting children or adults to and from school; o) Highway or Street includes a common or public highway, street, avenue, crescent, court, drive, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles; p) Identifying marker when used with respect to parking means the accessible persons parking permit issued by the Ministry of Transportation under the authority of the Highway Traffic Act; q) Intersection shall mean the area embraced within the prolongation or connection of the lateral curb lines, or if none, then of the lateral boundary lines of two or more highways which join one another at an angle, whether or not one highway crosses the other; r) Municipality means the Corporation of The Municipality of Thames Centre; s) Official Sign generally shall mean a sign authorized by this by-law and signs authorized by the Ministry of Transportation, contained within the Ontario Traffic Manuals or specified within a Schedule of this by- law; t) Park or Parking, when prohibited, means the standing of a vehicle, whether coupled or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers; u) Parking space means a portion of the surface of the roadway or public parking lot/facility designated suitable by markings; v) Pedestrian crossover has the same meaning as in the Highway Traffic Act; w) Person includes any person, firm, partnership, association, corporation, company or organization of any kind; x) Road Allowance shall mean all allowances for roads, except in so far as they have been stopped up according to law, made by the Crown Page 6 of 12 surveyors, all highways laid out or established under the authority of any statute, all roads on which public money has been expended for opening them or on which statute labour has been usually performed, all roads dedicated by the owner of the land to public use, and all alterations and deviations of and all bridges over any such allowance for highway or road; y) Roadway shall mean that part of a highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and where a highway includes two or more separate roadways, the term Roadway refers to any one roadway separately and not to all of the roadways collectively; z) School Bus shall mean a chrome yellow bus that is used for the transportation of children; people to or from a training centre and that bears on the front and rear thereof the words " school bus" and on the rear thereof the words " Do not pass when signals flashing"; aa) School Crossing shall mean a cross walk as identified by official " school crossing signs"; bb) School Zone has the same meaning as in the Highway Traffic Act; cc) Shoulder shall mean that portion of every street which abuts the roadway and which is designed and intended for passage or stopping of motor vehicles but which extends no more than 3. 6 metres ( 12 feet) in width from the limit of the roadway; dd) Sidewalk shall mean any public walkway, or that portion of a street between the curb line or the lateral line of a roadway and the adjacent property line, primarily intended for the use of pedestrians; ee) Stand or Standing when prohibited means the halting of a vehicle, whether occupied or not. ff) Stop or Stopping when prohibited, means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or of a traffic control sign or signal. gg) Trailer means a vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily drawn, propelled or moved upon such highway, and except a side car attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn. hh) Vehicle includes a motor vehicle, trailer, traction engine, farm tractor, road- building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power. For the purposes of this By-law, where no definition is made herein and a definition is required, the applicable definition shall be as set forth in the Highway Traffic Act, R. S. O. 1990, as amended. OBEDIENCE TO TRAFFIC REGULATIONS 2. ENFORCEMENT OF BY- LAW The enforcement of this by- law shall be undertaken by the Ontario Provincial Police and the Municipality of Thames Centre By-law Compliance Officers. Page 7 of 12 3. METHOD OF PARKING No vehicle shall remain parked or standing on any roadway except upon the right- hand side of the roadway, in the direction the vehicle is required to proceed, and when parked on a roadway, the right front and the right rear wheels shall be parallel and not more than 0. 3 metre ( 1 foot) from the right-hand edge of the roadway (or curb if it exists) adjacent to which it is parked. 4. OVER NIGHT PARKING REGULATIONS No Vehicle shall remain parked or standing upon any street in the Municipality between the hours of 2: 00 a. m. and 7: 00 a. m. between the date of November 1st and April 30t" of any year. 5. PROHIBITED PARKING WHERE " NO PARKING" SIGNS ARE DISPLAYED a) No vehicle shall remain parked or standing in any location when official " No Parking" signs have been erected and are on display between the streets or parts thereof set out in Schedule " A" of this By-law nor during the prohibited time of day as set out in Column 4 of Schedule " A". b) No vehicle shall remain parked or standing within 8 metres ( 25 feet) of the location of a fire hall and the premises used in connection therewith on that side of the street on which such fire hall is located, nor on the opposite side of the said street within 8 metres ( 25 feet) of a point opposite the centre of the exit of such fire hall. 6. SCHOOL BUS LOADING ZONES No vehicle shall remain parked or standing where official " School Bus Loading Zone" signs are erected and are on display, between the street or parts thereof set out in Schedule " B" of this By-law, except for the purpose of taking or discharging passengers, in the time periods stipulated. 7. BICYCLE LANES No vehicle shall remain parked or standing where official " No Parking Bike Lane" signs are erected and are on display, between the street or parts thereof set out in Schedule " C" of this By-law. 8. NO PARKING IN UNPOSTED LOCATIONS No vehicle shall remain parked or standing in any of the following locations, at any time or as specified: a) At any time in such a manner that any part of the vehicle is situated upon or over a sidewalk; b) between a sidewalk and the adjacent roadway; c) on any boulevard, except where authorized by by- law, enacted under the Municipal Act, 2001; d) in front of a public or private driveway or lane; e) within an intersection at any time; f) within 3 metres ( 10 feet) of a fire hydrant or where the hydrant is set back from the edge of the roadway, within 3 metres ( 10 feet) of the point at which the prolongation of the centre line of the hydrant at right angles to the edge of the roadway would intersect such Page 8 of 12 edge; g) on or within a crosswalk or obstructing a crosswalk at any time; h) within 6 metres ( 20 feet) of the nearest crosswalk at an intersection; i) on any street in a manner which obstructs traffic; j) on any roadway or shoulder for longer than twenty-four (24) hours; k) where parking spaces are designated by lines painted on the roadway or municipal property, no person shall stop or park any vehicle except within the area designated as a parking space; 1) in a place except on a roadway or in an authorized parking area; m) within 20 metres (65 feet) of any intersection; n) upon that side of the street and immediately adjacent to the frontage or flankage of any service station providing fuel for motor vehicles; and o) on or over a curb within a driveway. 9. FIRE ROUTES a) No vehicle or part of a vehicle shall remain parked or standing where official " No Parking Fire Route" signs, as set out in Schedule " D" to this by-law, are erected. b) A private roadway along which approval has been given by the Municipality of Thames Centre for the erection of official signs is a fire route. Fire routes are established by site plan agreements for development and/ or Fire Chief' s Order. c) No person shall move, remove or interfere with an official sign along a fire route or obstruct a view of an official sign along a fire route. d) No person shall erect or maintain along a fire route any sign which may conflict or be confused with an official sign. 10. NO STOPPING a) No vehicle or part of a vehicle shall stop or remain standing where official No stopping" signs are erected and are on display, between the street or parts thereof, during the prohibited time or times as set out in Schedule E" of this By-law; b) No vehicle or part of a vehicle shall stop in a manner known as "double parking" or in any traffic lane other than the curb lane; 11. EXEMPTION OF MUNICIPAL VEHICLES Sections 3 to 9 of this By- law do not apply to vehicles of the Corporation of The Municipality of Thames Centre, where such vehicles are actually engaged in the performance of cleaning, maintenance, repair, construction, snow removal or other work on any highway. 12. ACCESSIBLE ON- STREET PARKING Page 9 of 12 a) Accessible Parking Spaces Notwithstanding any provisions of this, or any other by-law, no vehicle shall be parked, stand, stop or leave a motor vehicle in any designated accessible parking space except a motor vehicle: i) that is identified by a current original, valid accessible parking permit; and i i) that is parked entirely within a designated parking space. b) Display of Permit An identifying marker shall be displayed on i) the inner surface of the windshield, as close as practicable to the lower left-hand corner and as close as practicable to the left-hand side of the motor vehicle; or ii) the outer surface of the sun visor on the left- hand side of the motor vehicle so as to be visible through the windshield from the exterior of the car when the sun visor is in a lowered position. 13. OFF- STREET ACCESSIBLE PARKING a) In this part official sign means a sign in the form set out in Schedule " F" of this by-law. b) where, in a public parking lot or facility, one or more parking spaces are intended for the sole use of the vehicle displaying a valid accessible parking permit, the owner or operator of the public parking lot or facility shall identify each such parking space by erecting one or more official signs in such a manner that the official sign or signs shall be clearly visible to the operator of any vehicle approaching or entering such parking space. c) Where the requirements of subsection 12( b) are complied with, each such parking space is for the purposes of this by-law a designated accessible parking space. d) Notwithstanding any provision in this section to the contrary, no designated accessible parking space shall be located in a fire route designated under Section 8 of this by-law. 14. UNAUTHORIZED SIGNS No person shall place, maintain or display on any highway, any unauthorized device which is imitation of, purports to be, or resembles any official sign or signal, or which purports to direct parking or the movement of traffic or the actions of operators of vehicles. Any such device shall be deemed a public nuisance and any Police Officer, By- law Compliance Officer, or other person authorized by the Director of Public Works, may remove the same without notice. OPERATION OF VEHICLES 15. HEAVY TRUCK RESTRICTIONS a) In this section, prohibited street means any street or part thereof within the Municipality of Thames Centre set out in Schedule " G" of this by law, and upon which there are signs prohibiting heavy trucks. b) No person shall operate or park a heavy truck on a prohibited street. Page 10 of 12 c) Subsection ( b) does not apply where a heavy truck is being necessarily operated in the usual conduct of business and proceeds by way of the shortest route to or from any street or part thereof set forth in Schedule G" of this by- law. d) The Director of Public Works of the Municipality of Thames Centre shall keep and maintain accurate maps illustrating those streets or parts thereof in Schedule " G", which maps shall be available to the public. e) The Director of Public Works of the Municipality of Thames Centre is hereby authorized to cause the streets listed in Schedule " G" to be marked with signs to prohibit their use by heavy trucks. f) This section does apply to heavy trucks being used for deliveries to or removals from properties being used for agricultural purposes. 16. TURNS No driver or operator of a vehicle upon a highway shall make a U- Turn within 30 metres ( 98 feet) of an official sign designating " No- U- Turn" posted in accordance with this by-law. 17. FUNERAL AND OTHER PROCESSIONS No person shall drive a vehicle so that it intersects a funeral or other authorized procession in motion except under the direction of a police officer. 18. REMOVAL OF VEHICLES IN CONTRAVENTION OF BY- LAW a) In addition to any other penalty provided for in this by-law, a Police Officer or By- law Compliance Officer appointed by Council or by any person or class of persons designated pursuant to the Provincial Offences Act as a provincial offences officer, may cause a motor vehicle that is parked in contravention of this by-law to be removed and taken to be stored in a safe place. b) Where a motor vehicle is removed and stored pursuant to Section 13( a) all costs and charges for the removal, care and storage of the motor vehicle which may be enforced in the same manner as provided for in the Repair and Storage Liens Act. INFRACTION NOTICE AND PAYMENT OPTIONS 19. PARKING INFRACTION NOTICE Where a vehicle is found parked in contravention of the provisions of this by law, a Police Officer or Municipal By-law Compliance Officer so finding the vehicle may complete and place upon or attach to the vehicle a parking infraction notice, in the form attached as Schedule " H". 20. PROVISIONS FOR VOLUNTARY PENALTIES a) In this section, i) any provision of this by-law means any provision of this by-law for the contravention of which the Municipal Act permits a procedure for the voluntary payment of penalties out of court, and ii) parking infraction means any unlawful parking, standing or stopping of a vehicle that constitutes an offence. b) A specified penalty payable out of court within a specified time may be Page 11 of 12 imposed for a contravention of any provision of this by- law that constitutes a parking infraction. 21. METHOD OF PAYING VOLUNTARY PAYMENT Payment of any penalty out of court may be made on or before the 7t" day after date specified on the violation tag or parking infraction notice, a) by a cheque or money order payable to the Corporation by prepaid mail to an address or post office box indicated on the parking infraction notice, or b) by a cheque or money order payable to the Corporation delivered through the mail slot of the Corporation located at 4305 Hamilton Road, Dorchester, Ontario, NOL 1 G3, or c) through any agency designated by the Financial Services Department of the Corporation. 22. DEFAULT IN PAYING VOLUNTARY PENALTY In default of payment of a penalty out of court in accordance with Sections 19 and 20 any fine imposed under this by- law for the contravention thereof shall be recoverable under the by-law and the Provincial Offences Act all the provisions of which shall apply. GENERAL PROVISIONS 23. GENERAL PENALTY a) Except where otherwise expressly provided by this by-law or the Highway Traffic Act, every person who: i) contravenes any provision of this by-law; or ii) is the owner of a vehicle that is parked or stopped in contravention of any provision of this by- law; is guilty of an offence and upon conviction is liable to a fine not exceeding 5, 000. 00, exclusive of costs, or such other fines as may be levied in accordance with the Provincial Offences Act, Part 11. b) Notwithstanding subsection ( a), where an owner of a vehicle proves to the satisfaction of the court that, at the time of the offence, the vehicle was in the possession of another person without the owners' consent, express or implied, the owner shall not be guilty of the offence. c) In addition to any other remedy or penalty imposed under this by- law, the court in which a conviction has been entered and, any court of competent jurisdiction thereafter, may make an order prohibiting the continuation of the offence by the person convicted. d) A By-Law Compliance Officer or Police Officer may cause a vehicle parked or left in contravention of this By-law to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage, if any, are a lien against the said vehicle which may be enforced in the manner provided by the Repair and Storage Liens Act. 24. HEADINGS NOT PART OF BY- LAW The headings in the body of this by- law form no part of the by-law but are Page 12 of 12 inserted for convenience of reference only. 25. PROVINCIAL OFFENCES ACT, PART II TO GOVERN The provisions of this by-law shall be subject to the provisions of Part II of the Provincial Offences Act, R.S.O. 1990, chapter P.33, as amended. 26. CONFLICT WITH HIGHWAY TRAFFIC ACT In the event of conflict between the provisions of this by-law and the Highway Traffic Act, the provisions of the Act prevail. 27.
