By-law Explanation: The purpose of this by-law is to amend By-law 075-2024 to add a
delegation of authority to the City Manager or assigned delegate for the ability to
designate Temporary Construction Exemption Zones, allowing temporary exemption
from parking fees during major municipal construction or renewal projects.

THE CORPORATION OF THE CITY OF THUNDER BAY
BY-LAW NUMBER 298-2024
A by-law to amend By-law 075-2024 to delegate authority
to the City Manager or assigned delegate to designate
construction areas as Temporary Construction Zones
exempt from parking fees.
Recitals
1.
Section 9 of the Municipal Act, S.O. 2001, c. 25 provides that a municipality has
the capacity, rights, powers, and privileges of a natural person for the purpose of
exercising its authority under this or any other Act;
2.
Pursuant to Section 23.2 of the Municipal Act, S.O. 2001, c. 25, a municipality
may delegate legislative powers to an officer, employee, or agent of the municipal
corporation if such legislative power is minor in nature (subsection 23.2(4)).

On April 8, 2024, City Council approved By-law 75-2024 - Parking Regulation in
Thunder Bay.

It is deemed necessary and expedient to amend the Parking Regulation By-law
by adding an exemption to temporary construction zones
ACCORDINGLY, THE COUNCIL OF THE CORPORATION OF THE CITY OF
THUNDER BAY ENACTS AS FOLLOWS:

THAT Section 4 of By-law 75-2024 is hereby amended by adding the following
subsection:
4.14 Temporary Construction Exemption: The City Manager, or assigned
delegate, may designate any area where paid parking is required as a
Temporary Construction Exemption Zone while major municipal construction or
renewal projects are in progress, for a period not to exceed the required
construction/maintenance period. While an area is designated as a Temporary
Construction Zone, vehicles may park in designated metered parking spaces,
without payment, for a maximum of 2 hours. No persons shall park or permit the
parking of any vehicle for a continuous period that exceeds 2 hours in a single
space, where temporary signage, including designated meter covers, are on
display. Any such approved Temporary Construction Exemption Zones shall,
during the approved period, be displayed and described on the City's website
and identified at street-level through signage and/or marked meter-head covers.

This By-law shall come into force and take effect on the date it is passed.
Enacted and passed this 12th day of August, A.D. 2024 as witnessed by the Seal of the
Corporation and the hands of its proper Officers.
