Sy. 444, Os CITY OF TIMMINS BY-LAW NUMBER 2012- 7223 BEING A BY-LAW to prohibit and regulate signs and other advertising devices within the Corporation of the City of Timmins WHEREAS Section 99 of the Municipal Act R.S. O. 2001, Chapter 25. provides that municipalities may pass By-laws respecting advertising devices, including signs: AND WHEREAS Section 11 of the Municipal.:Act, R.S. O. 2001; Chapter 25, provides that a single-tier municipality may pass By-laws respecting structures," ... including fences and signs; AND WHEREAS Section 391 of the Municipal Act, R.S. O. 2001, Chapter 25, provides that municipalities may pass By-laws imposing fees or charges for services or activities provided; AND WHEREAS Section 427 of the Municipal Act, R.S. O. 2001, Chapter 25, provides that municipalities have the authority by By-law or otherwise to direct or . require that a matter or thing be done, and that municipalities may direct that, in default of this being done by the person directed or required to do it, such matter or thing shall be done at the person' s expense; NOW THEREFORE the Council of The Corporation of the City of Timmins enacts as follows: PART I DEFINITIONS 1. In this by- law: 1) " A-frame Sign" shall mean any portable sign, triangular in shape, designed with no less than two sides of similar length forming its apex allowing it to stand freely on the ground; 2) " Abandoned or Obsolete Sign" shall mean a sign located on property which becomes vacant and unoccupied for a period of 60 days or more, or any sign which pertains to a time, event or purpose which has passed and/ or no longer applies; 3) " Advertising Device" shall mean any device or object which is used or can be used to attract public attention to any good( s) or service( s) or facility( ies) or event(s) including, but not limited to flags, banners, pennants and lights; Page I AdvertisingSign 4)" shallmeanasignwhichisownedand maintainedbyapersonengagedintherentalorleasingofthesign and/orsignfaceareaforadvertisinggoods/servicesorfacilitiesupon whichcopycanbefastenedinamannersuchthatanothercopycan besubstitutedfromtimetotime; Alter" 5) shallmeananychangetothesignstructureorsignface includingtheaddition, deletionorre-arrangementofparts, provided achangeinthemessagedisplayedbyasigndoesnotinitself constituteanalteration; AnimatedSign" 6) shallmeanavideoscreenoranykineticor illusionarymotionofalloranypartofasignandincludesthe rotationofasignbutdoesnotincludeanelectronicmessageboard; AwningSign" 7) shallmeanasignattachedtoorwhichformspart ofthesurfaceofeitheraretractableawningoranon-retractable canopyprovidedthatforpurposesofdeterminingtheSignAreaof anAwningSign, onlythenumberofsquaremetresofthepartofthe awningorcanopywhichisusedasavisualmediumordisplayto attractattentionshallbeconsideredtobetheSignAreaofthe AwningSign; Banner" 8) shallmeanasignoradvertisingdevicemadefromcloth, orasimilarlightweightmaterialsuchasplastic; BuildingCodeAct 9)"" shallmeantheBuildingCodeAct, 1992, S.O. 1992, c. 17, asamended, oranypredecessororsuccessorthereto; CharitableSign" 10) shallmeanamobilesigndisplayedonprivate propertyforthepurposeofadvertisingcommunityserviceevents and/oracharitableorganization'sfunctionsordrivesprovidedsuch signdoesnotpromoteabusinessorproduct; CommunityMobileSign 11)" shallmeanamobilesignerectedon Citypropertypursuanttotheprovisionsofthisby-lawuponwhich messageswhichadvertisecharitable, communityservicesorevents andwhichdonotpromoteabusinessorproductmaybedisplayed bymembersofthepublic; ConstructionSign" 12) shallmeanasignwhichidentifiesorprovides informationrelatingtooradvertisingtheconstructionofabuilding orstructureonthelandsonwhichthesigniserected; Copy" 13) shallmeanthegraphiccontentofasignsurfaceineither permanentorremovableletter, pictorial, symbolic, ornumericform; Council" 14) shallmeantheCounciloftheCityofTimmins; SightTriangle" 15) shallmeanatriangularspace, freeofbuildings, streetlines structuresandobstructions, formedbytwointersecting Page2 abuttingacornerlotandathirdlinedrawnfromapointonastreet streetline linetoanotherpointona , eachsuchpointbeingthe street requiredsightdistancefromthepointofintersectionofthe lines asspecifiedintheCityofTimminsZoningBy-Law; DesignatedOfficial" 16) shallmeantheClerkoftheCityofTimmins, oranysuccessortothisposition, andthedesignateordesignatesof thatindividual; DirectionalSign" 17) shallmeananysignwhichgivesdirectionsor instructionsforthecontrolofvehicularorpedestriantrafficwithin thepropertyonwhichthesignislocatedandshallincludeanentry andexitsign; ElectionSign" 18) shallmeanasignadvertisingorpromotingthe electionofapoliticalpartyoracandidateforpublicofficeina federal, provincialormunicipalelectionandincludessigns promotingthepositionofapersonregisteredtocampaignwith respecttoaquestiononaballot; ElectronicMessageBoard" 19) shallmeanasignwhichis electronicallycontrolledandwhichdisplaysinformationina prearrangedsequence; Facade" 20) shallmeananentirebuildingwallincludinganyparapet butdoesnotincludeanystructureerectedabovethetopstoreyofa building; FasciaSign" 21) shallmeanasignwhichisattachedandparalleltothe surfaceofanexteriorwallofabuildingorstructureandincludesa horizontalsignattachedandparalleltotheperimetersurfaceofa canopy; FlagSign" 22) shallmeanasignmadeofclothorlightweightmaterial attachablebyoneedgetoapoleorrope; FlashingSign" 23) shallmeanasignwhichcontainsanintermittentor flashinglightsourceorwhichincludestheillusionofintermittentor flashinglightbymeansofanimationoranexternallymountedlight sourcebutdoesnotincludeanautomaticchangingsignor electronicallycontrolledmessageboard; Frontage" 24) shallmeanthehorizontaldistancebetweenthesidelot lines, suchdistancebeingmeasuredperpendicularlytothelinejoining frontlotlinerearlot themiddleofthe witheitherthemiddleofthe linesidelotlines ortheapexofthetriangleformedbythe andata frontlotline pointthereindistant7.5m [24.6ft.] fromthe ; PARTII - PERMITS 2. Apermitisrequiredforanysignerected, locatedordisplayedwithinthe CityofTimminswiththeexceptionofthesignslistedinSchedule "B" to thisBy-law. 3. TheapplicantforapermitshallsubmittotheDesignatedOfficial: Page7 1) acompletedapplicationformasprescribedbytheDesignated Official; 2) thewrittenauthorizationoftheownerofthepropertyandthe occupantofthepremisesorsignowner; 3) duplicatecopiesofacurrentplanofsurveycertifiedbyaregistered OntarioLandSurveyoronwhichthelocationoftheproposedsignis showninrelationtotheboundariesofthelot, adjacentstreetsand anybuildingsonthelot, ifrequiredbytheDesignatedOfficial; 4) duplicatecopiesofadrawingshowingplan, elevationandcross- sectionviewsoftheproposedsignandsignstructure, includingthe dimensions, copydesignandmaterials; 5) whereapplicable; drawingsandspecifications, induplicate, showing thepartsofthebuildingtowhichtheproposedsignistobeattached; 6) whereapplicable; proofofapprovalfortheproposedsignfromall othergovernmentalauthoritieshavingjurisdiction; and 7) theappropriatefee, assetoutinSchedule "A" tothisby-law. 4. TheDesignatedOfficialshallissuethepermitforasignifallprovisionsof thisby-lawandanyotherapplicablelawknowntotheDesignatedOfficial includingbutnotlimitedtotheBuildingCodeAct, by-lawsofthe CorporationoftheCityofTimmins, andanyguidelinesoftheMinistryof TransportationfortheProvinceofOntario) havebeencompliedwith, providednosignpermitshallbeissuedtoanybusinessthatrequiresa licencepursuanttoaby-lawoftheCity, ifsuchbusinesshasnotobtained theappropriatelicence. RevocationofPermits 5. TheCitymayrevokeapermitunderanyofthefollowingcircumstances: 1) wherethepermithasbeenissuedinerrorbytheCityoronthebasis offalse, mistaken, incorrectormisleadinginformationor undertakingsprovidedtotheCity; or 2) wherethesigndoesnotconformtothisBy-laworanyconditionsof approvalunderthisBy-law. ExpiryofPermits 6. ApermitissuedbytheCityshallexpire: 1) upontheexpiryofanydisplayperiodspecifiedunderthisby-lawor pursuanttothetermsofapermit; or 2) inallotherinstances, sixmonthsfromthedateofissuanceunlessthe signhasbeenerectedforitsintendedpurpose; and Page8 3) immediatelyuponremovalofthesign. PARTIII - GENERALPROHIBITIONSANDREGULATIONS 7. Nopersonshall: 1) erect, locateordisplayasignwithoutapermitwhereapermitis requiredunderthisBy-law; 2) erect, locateordisplayasignforwhichapermithasbeenobtained exceptinaccordancewiththeapprovedpermitapplicationasper plansanddrawingssubmittedaspartofthepermitapplication; 3) erect, locateordisplayasigninamannerthatisnotinaccordance withtheregulationsofthisby-lawortheconditionsofanyvariance grantedunderthisBy-law; 4) erect, locateordisplayasignofatypewhichisnotspecifically permittedunderthisBy-law; 5) erect, locateordisplayasignwhichisprohibitedunderthisby-law; 6) erect, locateordisplayasignwhichisonoroverhangsCity property, includinganyroadallowancewithouttheexpressed writtenconsentoftheDesignatedOfficialexceptasprovidedinPart VandVIofthisby-law; 7) erect, locateordisplayanysignthatobstructsthepathorviewof anypedestrian, ordriverofamotorvehicleorobstructsthevisibility ofanytrafficsignordevice, orwhereitinterfereswithvehicular trafficinanymannerthatcouldendangeranyperson; 8) erect, locateordisplayanysignthatmaybeconfusedwithany trafficsignordevice; 9) exceptasexpresslypermittedunderPartV, erect, locateordisplaya signwithintheSightTriangle, asdefinedBytheCityofTimmins ZoningBy-Law; 10) exceptasspecificallypermittedunderthisby-law, erect, locateor displayasignonprivatepropertyforapurposeotherthanapurpose ancillarytoaprincipalusepermittedundertheCityofTimmins ZoningBy-lawandcarriedonwithinabuildinglocatedonthe propertyorthepurposeoffacilitatingthecommencementofsucha use; 11) failtoensurethatthelightfromanysignwhichisilluminatedis deflectedawayfromanyadjacentpropertyandthepathofvehicular traffic; 12) failtoensurethatthelightingintensityofanilluminatedsignis turnedoffordimmedbetweenthehoursof9:00p.m. and8:00a.m. Page9 ifsodirectedbytheDesignatedOfficial, ortheconditionsofany permit; 13) failtomaintainasigninaproperstateofrepairsothatsuchsign doesnotbecomeunsafeorunsightly; or 14) failtoremoveorbringintocomplianceasignwhichiserectednotin accordancewiththeprovisionsofthisby-lawwhensodirectedby theDesignatedOfficial. 8. Apersonshallbedeemedtobeerecting, locatingordisplayingasignif thatpersonisasignowneranddirects, permitsorfailstostoptheerection, locationordisplayofthesign. 9. ThesignownershallnotifytheDesignatedOfficialofthecompletionofthe erectionofanygroundsignorfasciasignerectedpursuanttoapermit underthisby-lawwithin15daysafterthesigniserected. PARTIV - REGULATIONSFORPARTICULARTYPESOFSIGNS ProhibitedSigns 10. Thefollowingsignsareprohibitedunderthisby-law: 1) abandonedorobsoleteSigns; 2) animatedsigns, withtheexceptionofElectronicMessageBoards permittedunderSections16and17ofthisby-law; 3) roofsigns; 4) awallsignotherthanamuralpermittedunderthisby-law; 5) flagsignsorpennants; 6) signsontrucks, trailers, orvehiclesthatareparkedonapropertyina mannerthatisunrelatedtotheirnormaluseasvehiclesandismore consistentwiththeuseorintendeduseofthevehicleasasign; 7) anysigncapableofbeingconfusedwithasignsuchasatrafficsign, trafficsignalorofficialsign; and 8) AnA-Framesignerectednotinaccordancewithsection38-3(c) of thisby-law. 11. Whereasignisnotexpresslypermittedunderthisby-lawitshallbe deemedprohibited. 12. WhereatypeofsignisnotspecificallypermittedunderSchedule "C", it shallbedeemedprohibited. Page10 GroundSigns 13. Nopersonshallerect, locateordisplayagroundsignotherthanin accordancewiththeregulationsinSchedule "C", thegeneralregulations underthisby-lawandthefollowingadditionalregulations: 1) nogroundsignshallbeerected, located, ordisplayed: a) within3metresofadrivewayentranceorexitattheedgeof theroadallowance; or b) within15metresofanintersection. LandscapeSigns 14. Landscapesignsarepermittedinaccordancewiththeregulationsin Schedule "A" andthegeneralregulationsunderthisby-lawforaground signpermittedunderthisby-law. MonolithSigns 15. Notwithstandingthedefinitionofsignarea, thesignareaofamonolithsign shallnotincludetheareaofthelowerportionofthesigntoalimitoftwo thirdsofthetotalheightofthesignstructure, providedthereisnochange ofcolourandcopy, otherthanthemunicipaladdressofthepropertywithin thatlowerportionofthesign. Ifthereiscopyorchangeofcolourfrom withinthelowerportionofthemonolithsign, thenthesignareashall includetheareaofthesignabovethelowestextremityofanycopyor changeincolour. ElectronicMessageBoards 16. ElectronicMessageBoardsarepermittedongroundsignserected, located ordisplayedinassociationwithapublicorprivateschoolasdefinedinthe EducationAct, auniversityorcommunitycollege, hospital, library, or governmentinstitutionontheproperty, provided: 1) amaximumof30% ofthesignareamaybeusedforthepurposesof anelectronicmessageboard; 2) theminimumdisplaytimeforanyelectronicmessage, without movementorchangeincolour, shallbe30seconds; and 3) theintensityoftheilluminationshallbemaintainedataconstant level. 17. ElectronicMessageBoardsarepermittedongroundsignsandfasciasigns inEmploymentZonesorCommercialZones. Page11 DirectionalSigns 18.( 1) Nopersonshallerect, locateordisplayadirectionalsignwithasign 2 areainexcessof0.56m (6sq.ft.). 2) Nopersonshallerect, locateordisplayadirectionalsignwithaheight greaterthan1.5m (4.92ft.). 19. Corporatelogosmaybedisplayedondirectionalsigns. FasciaSigns 20. Nopersonshalldisplayafasciasign, otherthaninaccordancewiththe regulationsinSchedule "C", thegeneralregulationsunderthisby-lawand thefollowingadditionalregulations: 1) nofasciasignshallextendbeyondtheextremityofthefacadeon whichitismounted; 2) nofasciasignshallextendbeyondapointwhichisamaximumof2 metres (6.56ft.) abovetheroof-lineofabuilding; 3) nofasciasignmayprojectmorethan0.45m (18inches) fromthe surfaceofthewalltowhichitisattached; 4) nofasciasignmayprojectoverCitypropertyexceptincompliance withPartVofthisby-law; and 5) everyfasciasignshallbeparalleltothesurfaceofthewalltowhich itisattached. 21. WhereanofficebuildingislocatedwithinaCommercialGeneralZonea fasciasignmaybeerected, onlyonthesecondstoreyofthebuildingor higherforthepurposeofprovidingcorporateidentificationforthe occupant, ifany, oftheofficebuilding, providedsuchfasciasignhasa maximumsignareaof5% oftheareaoftheportionofthefacadebetween theroofandthefloorofthetopstoreyofthebuilding. Murals 22. Muralsshallbepermittedasfasciasignssubjecttothesameregulationsas otherfasciasigns. AwningSignsandProjectingSigns 23. Despitesection2, electionsignsmaybeerectedincampaignofficesupto (90) ninety dayspriortovotingday, providedthat; a) InthecaseofacandidateforthepositionofCouncilororTrustee, thatrightshall extendtonomorethan (1) onecampaignofficeinthewardwherethecandidateis runningforelection; b) InthecaseofacandidateforthepositionofMayor, thatrightshallextendtonomore than (4) fourcampaignoffices. Location 4. Nopersonshallerect, locateordisplayanelectionsign: a) onorwithinanyCitypropertyotherthanaroadallowance; b) overhanginganyCitypropertyotherthanaroadallowance; c) atanylocationonCitypropertywheretheelectionsignmightobstructanydoor, window, fireexitoranyopeningrequiredforlight, ventilation, ingress, egressor firefighting; d) atanylocationonCitypropertywheretheelectionsignmightinterferewith undergroundservices; Page27 e) atanylocationwheretheelectionsigncouldobstructtheviewofanypedestrian ordriverofamotorvehicleorobstructthevisibilityofatrafficsignordevice, or whereitcouldinterferewithvehiculartrafficsothatitcouldendangerany person; or f) atanylocationwheresuchelectionsign, intheopinionoftheDesignatedOfficial, constitutesasafetyhazardtothegeneralpublic. 5. Nopersonshallerect, locateordisplayanelectionsignwithinaroadallowancewhere theelectionsignis: a) onanycentremedian, trafficislandorcentreboulevard; b) within1.5metres (5feet) ofafirehydrant, curb, drivewayorthetravelledportion ofastreet; c) onanyrailing, retainingwall, bridge, bench, garbagecanorstructureofanykind; d) onCitypropertywithin30.48metres (100feet) ofanyentrancetoavoting location; or 6. Notwithstandingparagraph3and4ofthisScheduleanelectionsignmaybeinstalledina busshelterunderthedirectionandcontroloftheCityinaccordancewiththerulesand requirementsineffectfromtimetotimeregardlessofthelocationofthebusshelter. 7. Nopersonshallerectasignonprivateproperty: a) largerthan1.22metresby1.22metres (4feetby4feet) and/orhigherthan2metres abovegroundlevel; b) which, intheopinionoftheDesignatedOfficial, potentiallyinterfereswiththesafe operationofvehiculartraffic; c) withouttheexpressedconsentofthepropertyowner; d) whichthesignstructuredoesnotcomplytoanyotherprovisionoftheCityof TimminsSignBy-Law MethodofErectingSigns 8. Nopersonshallerectorpermitanelectionsigntobeerectedonautilitypoleusingnails, screws, tacks, glue, tapeorwire. Suchsignsshallbefastenedbystaplesonly; SeizureandReturnofElectionSigns 9. TheDesignatedOfficialmayremoveanyelectionsignfoundtobeincontraventionto thisby-lawwithoutnotice. Page28 10. TheDesignatedOfficialmaydestroyanyelectionsignwhichhasbeenseizedandisnot claimedandretrievedbythesignowneroranauthorizedagentofthesignownerwithin 15) fifteendayswithoutnoticeorcompensationtotheowner. 11. TheDesignatedOfficialshallreturnanyelectionsignwhichhasbeenseizedtothesign ownerorthesignowner'sauthorizedagentuponpaymentofthefeesspecifiedin Schedule "A" tothisby-law, provided: a) thesignownershallberequiredtocontacttheDesignatedOfficialonabusiness dayoftheCityandmakeappointmentfortheretrievalofthesigns. Such appointmentshallbeonthefollowingbusinessdayoftheCityunlessthe DesignatedOfficialagreestoanearliertime; b) thesignownershallberequiredtoprovidetheCitywithasigned acknowledgementandreleaseinaformacceptabletotheCity; c) noelectionsignshallbereturnedbytheDesignatedOfficialonVotingDay. ReturnofSecurityDeposit 12. TheDesignatedOfficialshallreturn, within60days, thebalanceofthesecurities depositedwiththeCity (ifapplicable) underparagraph1ofthisSchedule, afterdeducting thecostofremovingelectionsignsfollowingtheelectionifthesignswereremovedby theCityandthecostofanydamagewithintheroadallowance.
