CITYOFTIMMINS BYLAWNO 20127175 BEINGABYLAW toProhibitandregulatebillboardsignswithintheCityofTimmins WHEREAS Section99oftheMunicipalAct RSO 2001 Chapter25 providesthatmunicipalitiesmay passBylawsrespectingadvertisingdevices includingsigns ANDWHEREAS Section11oftheMunicipalAct RSO 2001 Chapter25 providesthatasingletier municipalitymaypassBylawsrespectingstructures includingfencesandsigns ANDWHEREAS Section391oftheMunicipalAct RSO 2001 Chapter25 providesthat municipalitiesmaypassBylawsimposingfeesorchargesforservicesoractivitiesprovided ANDWHEREAS Section427oftheMunicipalAct RSO 2001 Chapter25 providesthat municipalitieshavetheauthoritybyBylaworotherwisetodirectorrequirethatamatterorthingbe done andthatmunicipalitiesmaydirectthat indefaultofthisbeingdonebythepersondirectedor requiredtodoit suchmatterorthingshallbedoneatthepersonsexpense NOWTHEREFORE theCouncilofTheCorporationoftheCityofTimminsenactsasfollows Part1 TitleandScope 11 ThisBylawshallbeknownandcitedasthe BillboardSignBylaw 12ThisBylawshallapplytotheCorporationoftheCityofTimmins Part2 Definitions 21 InthisBylaw 1 AbandonedBillboardSign shallmeanabillboardsignwhichnolongeridentifiesor advertisesabonafidebusiness lessor service owner productoractivity orforwhichnolegal ownercanbefound orhasnotbeenmaintainedtothesatisfactionoftheCityofTimminsasset outinSection411 2 Alter shallmeananyalterationtothesupportsorstructureofabillboard butdoesnotinclude anyalterationtothemessage advertisementoremblemthereon providedthatsuchalteration doesnotcompriseanalterationtothestructureorsupportofsaidbillboard 3 Area shallmean theareaofabillboard computedbymultiplyingthemaximumwidthofa billboardbythemaximumlengthofthatsign 4 BillboardSign shallmeanabillboardsignrelatedtoabusiness enterpriseorotheractivity notconductedwithinthebuildingoruponthepropertyonwhichthebillboardsigniserected 2 and forthepurposeofthisbylaw shallbelimitedtogroundsignswhichareover89m 2 958ft andarelocated inwholeorpart adjacenttoandfacingaruralorurbanhighwayas listedinSchedule B ofthisbylaw forallothertypesofsignage referto theCityof TimminsSignByLaw 5 DirectorofPublicWorksandEngineering shallmeantheDirectorofPublicWorksand EngineeringfortheCityofTimmins anysuccessortothispositionandthedesignates ofthat individual 6 City shallmeantheCorporationoftheCityofTimmins 7 Council shallmeantheCounciloftheCorporationoftheCityofTimmins 8 GroundSign shallmeanasignsupportedbyuprightsorbracesinoruponthegroundor structuralbase whichisnotattachedtoanypartofabuildingandwhich becauseofitsdesign nature maynotbemoved 9 Face shallmeanthegraphiccontentofasignsurfaceineitherpermanentorremovable letter pictorial symbolic ornumericform 10 SignByLaw shallmeanCityofTimminsByLawNo 20127223 asamended orany successorthereto 11 Zone shallmeanthezonedesignationcontainedintheCityofTimminsZoningBylawNo 1977850 asamended 12 ZoningByLaw shallmeanCityofTimminsZoningByLawNo 20117100 asamended oranysuccessorthereto Part3 Administration 31 ThisbylawshallbeadministeredbytheDirectorofPublicWorksandEngineeringand enforcedbythebylawenforcementdivisionoftheClerksDepartmentoftheCorporationof theCityofTimminsandshallapplytoanybillboardsignerectedadjacenttoaruralorurban highwayaslistedinSchedule B Part4 PermitsFees 41 Apermitisrequiredforanybillboardsignerected locatedordisplayedwithintheCityof TimminssubjecttothenewapplicationfeessetoutinSchedule A ofthisbylaw 42 Anannualfeeforanybillboardsignsissubjecttoanannualrenewalfeeassetoutin Schedule A ofthisbylaw 43 Theapplicantforapermitshallbetheownerorlessee ortheauthorizedagentoftheowner orlessee ofthepropertyonwhichtheworkistobeperformedandshallsubmittothe DirectorofPublicWorksandEngineering 1 acompletedapplicationformasprescribedbytheDirectorofPublicWorksandEngineering 2 duplicatecopiesofplansdescribingthelandonwhichtheproposedbillboardistobeerected Theplansshallshowthelocationoftheproposedbillboardonthelotandthedistancetothe nearestbillboardsignonbothsidesofthehighway roadorstreet 3 duplicatecopiesofadrawingshowingplan elevationandcrosssectionviewsoftheproposed billboardandbillboardstructure includingthedimensions copydesignandmaterials 4 whereapplicable proofofapprovalfortheproposedbillboardfromallothergovernmental authoritieshavingjurisdiction and 5 theappropriatefee assetoutinSchedule A tothisbylaw 44 TheDirectorofPublicWorksandEngineeringshallissuethepermitforabillboardsignifall provisionsofthisbylawandanyotherapplicablelawknowntotheDirectorofPublicWorks andEngineering includingbutnotlimitedtotheBuildingCodeAct bylawsofthe CorporationoftheCityofTimmins andanyguidelinesoftheMinistryofTransportationfor theProvinceofOntario havebeencompliedwith providednobillboardpermitshallbe issuedtoanybusinessthatrequiresalicencepursuanttoabylawoftheCity ifsuch businesshasnotobtainedtheappropriatelicence 45 Billboardlocationsshallbepermittedforamaximumfive 5 yearterm afterwhichtimethe approvedlocationofthebillboardwillbereviewedbytheDirectorofPublicWorksand Engineering 46 TheCitymayrevokeapermitunderanyofthefollowingcircumstances 1 wherethepermithasbeenissuedinerrorbytheCityoronthebasisoffalse mistaken incorrectormisleadinginformationorundertakingsprovidedtotheCity or 2 wherethebillboarddoesnotconformtothisBylaworanyconditionsofapprovalunderthisBy law 3 wherethebillboarddoesnotconformtoanyregulation laworrequirementsofany governmentalauthorityhavingjurisdictionovertheareawherethebillboardissituated 4 failuretopaytheannualrenewalfeewithin90daysofbeinginvoiced 5 whereanewdevelopmenthasoccurredadjacenttoanexistingbillboardandthebillboardis deemeddetrimentaltothenewdevelopment 47 EachpermitissuedbytheCityofTimminsforaBillboardSignshallexpire 1 oneyearfromthedateofissuanceofthepermit unlessrenewalfeehasbeenreceived 2 immediatelyuponremovalofthebillboard 3 ifthelocationofthebillboardsignhasbeenrevokedsubjecttoclause45 48 PropertyTaxesshallnotbeapplicablewheretheownerofthebillboardsignispayinga permitfeetotheCityorProvincetolocateabillboardsignonProvincialofmunicipal roadways Part5 LocationandSizeofBillboardSigns 51BillboardsignsshallnotbepermittedonanylandswithinanyResidentialAreaasdefinedby CityofTimminsZoningBylaw 52 BillboardsignsshallbepermittedonlyonthoseProvincialHighways RuralRoadsHighways andUrbanRoadsStreetsoruponlandsabuttingthosehighways roadsorstreetsassetout inSchedule B attachedheretosubjecttothefollowingadditionalregulations 1 Nopersonshallerect display repairoralterabillboardsignalongaProvincialHighwaywithout firsthavingobtaintheapprovalof andabillboardpermitfrom theMinistryofTransportation Ontario 2 AllbillboardsignsonProvincialHighwaysshallcomplywithallpolicies standardsand requirementsoftheMinistryofTransportation Ontario assetoutintheMinistrysCommercial SigningPolicyassuchpolicypertainstobillboardsigns 53 BillboardsignspermittedalongthoseRuralRoadsHighwayssetoutinSchedule B shallnot exceedthefollowingsizerestrictions 1 75metres 25feet inheightabovetheground 2 604squaremetres 650squarefeet inarea 54 BillboardsignspermittedalongthoseUrbanRoadsStreetssetoutinSchedule B shallnot exceedthefollowingsizerestrictions 1 884metres 29feet inheightabovetheground bylaw20015598 2 604squaremetres 650squarefeet inarea 55 WherearoadorstreetintersectsaruralroadhighwaylistedinSchedule B nobillboard shallbeerectedlocatedordisplayedwithin90metres 300feet ofthelimitofsuch intersectingroadorstreet 56 Nobillboardsignshallbepermittedalonganyroadwayorportionorpartthereoflistedin Schedule C ofthisbylaw 57 Nobillboardsignshallbepermittedwithintherightofwayofanyroadorstreetunless otherwiseapprovedwithinthisbylaw 58 InadditiontoallotherapprovalsandpermitsrequiredbythisBylaw nopersonshallerecta billboardsignonlandszonedFloodFringeundertheCityofTimminsZoningBylaw as amended oranysuccessorthereto withoutfirsthavingobtainedwrittenapprovalfromthe MattagamiRegionConservationAuthority 59 Theangleofabillboardsignasthisrelatestothecentrelineofahighwayshallbeequaltoor greaterthan45degreesbutshallnotbegreaterthan90degrees Thatis iftheplane formingthefaceofthebillboardwasextendedinastraightlinetointersectthecentrelineof thehighway theanglethusformedshallbeattheminimumangleof45degreesanda maximumof90degrees Part6 SetbackRequirements 61 Billboardsignsshallbesetbackfromthehighwaypropertylineasfollows 1 Billboardsupto119m 128sqft inarea 23metres 75feet 2 Billboardsover119m 128sqft butnotover186m 200sqft inarea 30metres 100feet 3 Billboardsover186m 200sqft butnotover302m 325sqft inarea 46metres 150feet 4 Billboardsover302m 325sqft butnotover604m 650sqft 84metres 275feet 62 Wherethe billboardsign wouldbehiddenfromtheviewofapproachingtrafficbybushwhen placedaccordingtothebasicsetbackdistancesetoutinSection64 thebillboardmaybe movednearertotherightofwayofthehighwaysubjecttothefollowing 1 Therearenoavailableclearareaswithin305metres 1000feet oftheproposedbillboard locationwherethesetbackrequiredbySection64canbemet 2 Thebillboardsignareadoesnotexceed119m 128sqft 3 Thebillboardsignislocatedontherighthandsideofthehighwayfacingthemotorist 4 Thefront right edgeofthebillboardisnotmorethan1metre 3feet fromthebushline 5 Theleftedgeofthebillboardshallnotbelessthan9metres 30feet fromtheedgeofthe pavement 6 TheminimumspacingbetweenbillboardsisassetoutinSection71 Part7 Spacing 71 Theminimumspacingbetweenbillboardsignsshallbe305metres 1000feet andshallbe measuredinaccordancewiththeprinciplesillustratedonSchedule D Part8 GeneralProhibitions 81 Nopersonshall 1 erect locateordisplayabillboardsignwithoutapermitwhereapermitisrequiredunderthisBy law 2 erect locateordisplayabillboardsignforwhichapermithasbeenobtainedexceptin accordancewiththeapprovedpermitapplicationasperplansanddrawingssubmittedaspart ofthepermitapplication 3 erect locateordisplayabillboardsignwithinaresidentialarea 4 erect locateordisplayabillboardsignotherthanagroundsign 5 wherearoadorstreetintersectsaruralroadhighwaylistedinSchedule B erectlocateor displayabillboardsignwithin90metres 300feet ofthelimitofsuchintersectingroadorstreet 6 erect locateordisplayabillboardsignwithinasighttriangleasdefinedwithintheCityof TimminsZoningBylaw 7 erect displayorallowtheerectionordisplayofanybillboardsignwhichisnotstructurally sound 8 erect displayorallowtheerectionordisplayofanybillboardsignwhichmayposeadangerous distractiontovehiculartraffic 9 failtomaintainadisplayedbillboardsigninaproperstateofrepairsothatsuchbillboarddoes notbecomeunsafeorunsightly 10 failtomaintainavacantbillboardsigninaproperstateofrepairsothatsuchbillboarddoesnot becomeunsafeorunsightly Part9 Enforcement 91 EverypersonwhocontravenesanyprovisionofthisBylawisguiltyofanoffenceandupon convictionapersonisliabletoafineundertheProvincialOffencesAct RSO 1990 c P33 ofnotmorethan 500000exclusiveofcosts 92 Whereapersonhasbeenconvictedofanoffence thecourtinwhichtheconvictionhasbeen enteredandanycourtofcompetentjurisdictionthereaftermay inadditiontoanyother remedyorpenaltyprovidedforbylaw makeanorderprohibitingthecontinuationor repetitionoftheoffencebythepersonconvicted 93 Whereabillboardsignoranypartthereofiserected locatedordisplayedonoroverhanging CityProperty theDirectorofPublicWorksandEngineeringmayremoveorcausethe billboardsigntoberemovedimmediatelywithoutnoticetoanyperson 94 Whereabillboardsigniserectedordisplayedincontraventionofthisbylaw theDirectorof PublicWorksandEngineeringmayimmediatelypulldownorremoveanybillboardsignthat heorshedeterminesconstitutesasafetyhazard 95 Whereabillboardsignerectedonprivatepropertydoesnotcomplywiththisbylawora permitissuedunderthisBylaw theDirectorofPublicWorksandEngineeringmaybynotice requirethebillboardownertobringthebillboardintoconformityinthemannerandwithinthe timespecifiedinthenotice 96 Whereabillboardsignonprivatepropertyisnotremovedorabillboardsignisnotbrought intoconformitywiththisbylawwithinthetimeframerequiredbytheDirectorofPublicWorks andEngineeringpursuanttonoticegivenunderthisbylawtheDirectorofPublicWorksand Engineeringmayhavethebillboardsignremovedandthesiterestored Forthispurpose theDirectorofPublicWorksandEngineering aninspectorandtheircontractororotheragent mayenteruponthelotandpremisesatanyreasonabletime 97 ThenoticeinSection96maybegiven 1 bypersonalserviceuponthepartybeingserved 2 byprepaidregisteredmailsenttothelastaddressofthepartybeingservedontherecordsof theCity or 3 byprominentlypostingacopyofthenoticeeitheronthebillboardsigninrespectofwhichthe noticeisgiven oronthepropertyuponwhichthebillboardsignislocated 98 WherenoticeisgiveninaccordancewithSection972 or 3 itisdeemedtohavebeen receivedbythepartybeingservedonthedayafterthemailingorpostingofthenotice 99 ThecostincurredbytheCityinremovingabillboardsignorrestoringasiteunderSection96 shallhaveprioritylienstatusundertheMunicipalAct 2001andmaybeaddedtothe collectorsrollandcollectedinthesamemannerasmunicipaltaxes Despitetheforegoing thecostincurredbytheCityinremovingabillboardsignorrestoringasiteunderSection96 isadebtduetheCityofTimminsandmayberecoveredinanycourtofcompetent jurisdiction 910 AnybillboardsignremovedbytheCityshallbestoredbytheCityforthirty 30 days during whichtimethebillboardsignownermayredeemsuchbillboarduponpaymentofthe applicablefeeprescribedonSchedule A 911 WhereabillboardsignhasbeenremovedbytheCityandstoredforaperiodofthirty 30 days andhasnotbeenredeemedbythebillboardownerduringthatperiod theCitymay disposeofthebillboardsignwithoutanyfurthernoticeandwithoutanyfurtherobligationto thebillboardowneroranyotherperson Part10 ExistingBillboards 101 BillboardsignsexistingatthedateofadoptionofthisBylawandlocatedalonganyhighway roadorstreetwithintheCity otherthanalongaProvincialHighwaylistedinSchedule1 may continuetoexistasnonconformingsubjecttomeetingtherequirementsofSections101106 andsubjecttopaymentofappropriatepermitfee 102 BillboardsignsexistingatthedateofadoptionofthisBylawwhichwereerectedwithoutany validpermitandwhichdidnotmeetallapplicablelawsonthedatetheywereerectedmaybe deemedillegalandmayberemovedinaccordancewithSection96 103 ExistingbillboardsignswhichdonotconformtothespecificprovisionsofthisBylawmaybe eligibleforthedesignation nonconforming providedthatthebillboard wasinstalledin conformitywithavalidpermit orcompliedwithallapplicablelawsonthedateofadoptionofthis Bylaw 104 Anonconformingbillboardsignmaylosethisdesignationif 1 Thebillboardisrelocatedorreplaced 2 Thestructureorsizeofthebillboardisalteredinanywayexcepttowardcompliancewiththis Bylaw Thisdoesnotrefertochangeofcopyortonormalmaintenance 105 Anypersonwhomaintainsanonconformingbillboardissubjecttoallrequirementsofthisby lawregardingsafety maintenanceandrepair 106 Ifthebillboard suffersmore thanfifty 50 percentdamageordeterioration basedonan appraisal theownershallbringthebillboardintoconformitywiththisBylaworthebillboard shallberemoved 107 Billboardsignsexistingatthedateofadoptionofthisbylawandlocatedalonganyroad street orhighway otherthanaProvincialHighwaylistedinSchedule B andwhicharepermittedto remainunderSections101106shallbesubjecttotheapplicableannuallicenserenewalfee setoutinSchedule A Part11 Conflict 111 WhereaprovisionofthisBylawconflictswithaprovisionofanyapplicablegovernment regulation theprovisionthatestablishesthehigherstandardtoprotectthehealth safetyand welfareofthegeneralpublicshallprevail 112 WhereaprovisionofthisBylawconflictswithanyotherbylaw thebylawwhichestablishes thehigherstandardshallprevail 113 NotwithstandingSections111and112 noconflictexistsifitispossibletocomplywiththis bylawandtheotherapplicablegovernmentregulationorbylaw 114 ExceptasexpresslyprovidedinthisBylaw nothinginthisBylawshallbedeemedtoaffect anyrequirementforabuildingpermitundertheBuildingCodeActoranyrequirementforsite planapprovalunderthePlanningAct norshallissuanceofabuildingpermitunderthe BuildingCodeActorsiteplanapprovalunderthePlanningActaffectanyrequirementofthis BylaworanyconditionofapprovalimposedunderthisBylaw 11 5 This Bylaw does not apply to an advertising device that was lawfully erected or displayed on the day this Bylaw comes into force if the advertising device is not substantially altered and the maintenance and repair of the advertising device or a change in the message or contents displayed shall be deemed not in itself to constitute a substantial alteration Part 12 Miscellaneous 12 1 The Schedules attached to this bylaw shall form part of this bylaw 12 2 The division of this bylaw into parts and the use of headings is for convenience only The headings shall not form part of this bylaw 12 3 Imperial measurements are provided solely for the purpose of convenience In the event of a conflict between the metric and imperial measurements provided in this bylaw the metric measurements shall prevail Part 13 Severability 13 1 If a court of competent jurisdiction declares any section or part of a section of this Bylaw to be invalid it is the intention of Council that the remainder of the Bylaw shall continue to be in force unless the court makes an order to the contrary Part 14 Repeal 14 1 ByLaw No 19985038 is hereby repealed Part 15 Title 15 1 This City of Timmins Bylaw shall be known and may be cited as the Billboard Sign Bylaw READ a first
