THE CITY OF TIMMINS
BY- LAW NO. 2025-9130
BEING A BY-LAW to authorize the Corporation of the City of Timmins
to Regulate the sale of and setting off of fireworks in the City of
Timmins, and for acquiring a permit for the holding of fireworks
displays and repeal By-law 1984-2162.
WHEREAS the Municipal Act, 2001, S. O. 2001, C. 25, section 121, permits municipalities to
pass By- Laws for regulating the sale and prohibiting or regulating the setting off of fireworks and
for requiring a permit for the holding of fireworks displays; and
WHEREAS Council of the Corporation of the City of Timmins considers it desirable to regulate
the sale and prohibiting, or regulating the setting off of fireworks, and for requiring a permit for
the holding of fireworks displays within the City of Timmins; and
NOW THEREFORE the council of the Corporation of the City of Timmins enacts the following
as a By- law:
1.
THAT the storage, handling and discharge of fireworks and pyrotechnics within the City
of Timmins shall conform to Section 5. 2 of the Ontario Fire Code, ON Reg. 213/ 07.
2.
THAT no person shall sell or offer for sale within the City of Timmins any type F. 1 -
Consumer Fireworks ( other than toy pistol caps and sparklers), F. 2 - Display Fireworks
and F. 3 - Special Effect Pyrotechnics on any day of the year.
3.
THAT except as hereinafter provided no person shall set off or fire any type F. 1 -
Consumer Fireworks, F. 2 - Display Fireworks and F. 3 - Special Effect Pyrotechnic either
on private or public property or inside or outside any building within the City of Timmins.
4.
THAT permit(s) for the celebration of any event or day when proper arrangements have
been made by regularly constituted organizations may be obtained from the Fire Chief
for the setting off of any fireworks or special effect pyrotechnic at a time and place to be
specified in such permit under supervision of a properly qualified person.
5.
THAT application( s) for permit(s) shall be made in writing to the Fire Chief at least two
weeks prior to the date on which it is desired to set off fireworks and shall bring forth the
name of the applicant, the event or day being celebrated, the type and approximate
quantity of fireworks to be set off and the time and place of the setting off of such
fireworks and the name of the person who will supervise the setting off of such fireworks.
A ' City of Timmins Display Fireworks Event Application Form' is available on the
Timmins Fire Department website or by attendance in- person at Service Timmins.
6.
THAT if, in the opinion of the Fire Chief, it is necessary that a firefighter be present at the
setting off of any fireworks, such firefighter shall have the right to enter any premises for
that purpose and shall not be hindered or obstructed in anyway whatsoever. Such
firefighter shall also have the right to require any precaution for the prevention of fire
which to him seems necessary before any fireworks may be set off pursuant to such
permit.
7.
THAT every person who contravenes any of the provisions of this By- law is guilty of an
offense and upon conviction is liable to a maximum fine of not more than $ 5, 000. 00 (five
thousand dollars) exclusive of costs.
8.
THAT the Set Fine Schedule be attached hereto as Schedule ' A'
9.
THAT this By- law shall take full force and effect on the date it is enacted.
10. THAT City of Timmins By- Law 1984- 2162 and any amendments thereto are hereby
repealed.
READ a first and second time this 8th day of April, 2025.
READ a third and final time and enacted and passed this
8th day of April, 2025.
