By-law No. 2019-110
A By-law to authorize the adjustment of the speed limit on certain roads
within the Municipality of Trent Hills
and to Consolidate and Repeal By-law Nos. 2014-35, 2014-63 and 2018-024
Whereas Section 11 (3) of the Municipal Act, 2001, S.O. 2001, c.25, provides that a
municipality may pass by-laws within the spheres of jurisdiction, which includes
highways;
And Whereas Section 128(2) of the Highway Traffic Act, R.S.O. 1990, c.H.8, as
amended, provides that the council of a municipality may, for motor vehicles driven on a
highway or portion of a highway under its jurisdiction, by by-law prescribe a rate of
speed different from the rate set out in Section 128(1);
And Whereas Section 128(1)(a) of the Highway Traffic Act, R.S.O. 1990, c.H.8
provides that no person shall drive a motor vehicle at a rate of speed greater than 50
kilometres per hour on a highway within a local municipality;
And Whereas it is deemed necessary and expedient that the speed limit for motor
vehicles on certain portions of highways under the jurisdiction of the Municipality of
Trent Hills be adjusted to a speed limit other than 50 kilometres per hour;
And Whereas the Council of the Municipality of Trent Hills deems it expedient to
consolidate and update those by-laws previously enacted regulating speed of motor
vehicles within the Municipality of Trent Hills;
Now Therefore the Council of the Municipality of Trent Hills hereby enacts as follows:
1 .
That the maximum speed limit on highways listed and described in Schedule "A",
attached hereto and forming part of the by-law, shall be 40 kilometres per hour.
2.
That the maximum speed limit on highways listed and described in Schedule "B",
attached hereto and forming part of the by-law, shall be 70 kilometres per hour.
3.
That the maximum speed limit on highways listed and described in Schedule "C",
attached hereto and forming part of the by-law, shall be 80 kilometres per hour.
4.
That the penalties provided for in Section 128(14) of the Highway Traffic Act,
R.S.O. 1990, c.H.8, as amended, shall apply to offences under this by-law.
5.
That the portions of highways outlined in Schedules "A", "B" and "C", attached
hereto and forming part of this by-law, shall be signed in accordance with Section
128(11) and the Regulations of the Highway Traffic Act, R.S.O. 1990, c.H.8, as
amended.
6.
That By-law Nos. 2014-35, 2014-63 and 2018-024 are hereby repealed in their
entirety.
7.
This by-law shall come into force and take effect on the final passing thereof.
By-law read a first, second and third time, and passed this 17th day of December,
2019.
