BEING A BY-LAW TO REGULATE TRAFFIC AND PARKING ON HIGHWAYS, PRIVATE PROPERTY AND MUNICIPAL PROPERTY WITHIN THE TOWNSHIP OF UXBRIDGE
WHEREAS pursuant to the Municipal Act, 2001 and the Highway Traffic Act, R.S.O 1990, c. H.8, by-laws may be passed by the councils of municipalities to regulate traffic and parking on highways, private property and municipal property;
NOW THEREFORE, the Council of the Corporation of the Township of Uxbridge enacts the following:

## Section 1- Definitions
- 1.1 "Accessible Permit Only Parking Space" shall mean a parking space with a minimum width ot 3.6 m., with ai disabith or a includes a saged the ly for the onal of the perse d symbol.

- 1.3 "Boulevard" shall mean all parts of the highway except any roadway, shoulder, or sidewalk; and

- 1.5 "Chief Fire Official" shall mean the Chief Fire Official of the Township or his designate.
- 1.6 "Chief of Police" shall mean the Chief of Police of the Durham Regional Police Service or a designate.
- 1.7 "Commercial Motor Vehicle" shall mean any vehicle designated or operated for the transportation of property or a bus which vehicle or bus exceeds 2.6 m in width or 7 m in length.
- 1.8 "Council" shall mean the Council for the Township of Uxbridge.
- 1.9 "Downtown Permit Parking Area" shall mean the Permit Parking Zone that falls within the 15 designated parking spaces in the Albert Street Municipal Parking (North side) Lot and the 15 designated spaces in the Centennial Park Drive Municipal Parking Lot;
- 1.10 "Director of Public Works" shall mean the Director of Public Works and Operations for the Township or a designate.
- 1.11 "Driveway" shall mean improved land on a highway which provides access from the roadway to a private roadway or to adjacent land.
- 1.12 "Dwelling" shall mean a building or part of a building containing one or more dwelling units, but does not include a mobile home or trailer;
- 1.13 "Dwelling unit" shall mean one or more habitable rooms occupied or capable of being occupied as a single, independent and separate housekeeping unit containing a separate kitchen and sanitary facilities; and
- 1.14 "Fields of Uxbridge Permit Parking Area" shall mean;
- a) the Permit Parking Zone that falls within the designated parking spaces located in the parking lots) located at 335 Main Street North; and
- the on-street parking controlled by Parking Permit near the Fields of Uxbridge
- 1.15 "Firefighter" shall mean a firefighter as defined in subsection 1(1) of the Fire Protection and Prevention Act, 1997, S.O. 1997 c. 4
- 1.16 "Fire Route" shall mean any private roadway marked as a fire route by fire route signs.
- 1.17 "Fire Route Sign" shall mean means a sign displaying the information "No Parking" or a symbol in lieu thereof as specified in the Highway Traffic Act and Regulations passed thereunder, and the words "Fire Route".
- 1.18 "Front yard", "rear yard", "side yard", "exterior side yard", and "yard" have the meanings ascribed to them in the Township of Uxbridge Zoning ByLaw 81-19, as amended;
- 1.19 "Heavy Vehicle" shall mean a vehicle, object or contrivance for moving loads, having a gross weight, including the vehicle, object or contrivance and loan, in excess of 5 tonnes.
- 1.20 "Highway Traffic Act" shall mean the Highway Traffic Act, R.S.O. 1990, c. 4.8, as amended from time to time, any regulations passed in accordance with that Act, and any successor legislation thereto
- 1.21 "Municipal Parking Lot" shall mean any parking lot owned or operated by the Township;
- 1.22 "Municipal Parking Permit" shall mean a permit issued by the Township to a number plate for a designated period;
- 1.23 "Municipal Property" shall mean property owned, or under the control or management of the corporation of the Township of Uxbridge, or any board thereof, by lease, agreement or otherwise.
- 1.24 "Municipal Law Enforcement Officer" shall mean a person appointed by the Council of the Corporation of the Township of Uxbridge to enforce Municipal by-laws.
## 1.25 "Owner" when used in relation to real property shall mean;
- a) the registered owner of the property; and
2. the registered owner of a condominium unit, whose consent shall extend only to the control unit of which he is the owner and any parking spaces allotted to him by the condominium corporation or reserved for his exclusive use in the declaration or description of the property; and
- c) the spouse of a person described in sub-clause a.) or b.); and
- d) where the property is included in a description registered under the Condominium Act, the Board of Directors of the Condominium Corporation; and
- e) a person authorized by the property owner as defined in sub-clause a.) b.) c.) or d.) to act on the owner's behalf for requesting the enforcement of this by-law.
## 1.26 "Occupant" shall mean
- a) the tenant of the property or part thereof whose consent shall extend only to the control of the land of which he is the tenant and any parking spaces allotted to him under his lease or tenancy agreement; and
- b) the spouse of a tenant; and
- c) a person or municipality, or a local board thereof, having an interest in the property under an easement or the right of way granted to or expropriated by the person, municipality or local board whose consent shall extend only to the part of the property that is subject to the easement or right of way; and
- d) a person authorized in writing by an occupant as defined in subclause a.) b.) c.) to act on the occupant's behalf for requesting the enforcement of this by-law.
5. "Parking App" means a Township approved mobile application that allows the user to pay for a parking session on a mobile device or through an online process for a period of time for which a vehicle may be parked in a designated parking space or location.
6. 1.28 "Parking Lot" shall mean any parking lot or other parking facility, to which the public has access, whether on payment of a fee or otherwise, for the purpose of parking vehicles.
7. "Parking Permit" shall mean the confirmation of authorization from the Township for paying or registering to park in a Permit Parking Zone and shall include any permit issued in the form of;
- a) a colour coded tag obtained in person from the Township for the Downtown Permit Parking Area; or
- b) an approved parking session obtained through the Parking App for the Fields of Uxbridge Permit Parking area;
10. 1.30 "Parking Space" shall mean that part of the surface of a roadway, municipal property or private property designated by painted lines for the purpose of parking a vehicle.
- 1.31 "Permit Parking Zone" shall mean those streets or parts of streets, sides of streets and municipal parking lots identified in Schedule IV of this Bylaw in which parking is controlled and regulated by Parking Permits.
- 1.32 "Person" as used in this by-law shall be constructed where the context requires to mean and include person, firm, society, association, and corporation' the singular shall be instructed to include plural and the masculine and feminine.
- 1.33 "Private Property" shall mean property on which one or more signs have been erected by or on behalf of the owner or occupant prohibiting parking or restricting parking
- 1.34 "Private Roadway" shall mean any private road, laneway, ramp or other means of vehicular access to or egress from a building or structure and it may include part of a parking lot.
- 1.35 "Raised curb" shall mean a vertical or sloping member along the edge of a pavement forming part of a gutter, and clearly defines the pavement edge to vehicle operators, as is designed as a non-mountable or straight curb which is not intended to provide for the passage of vehicles from the traveled portion of the roadway to the shoulder and/or private property.
- 1.36 "School Bus Loading Zone" shall mean the part of a highway designated as such by signs.
- 1.37 "Shoulder" shall mean the part of the highway immediately adjacent to the traveled portion of the roadway and having a surface which has been improved for the use of vehicles.
- 1.38 "Sidewalk" shall mean the part of the highway set aside for the use of pedestrians or used by the general public for the passage of pedestrians.
- 1.39 "Tow Truck" shall mean a motor vehicle that is designed, modified or used for pulling, towing, carrying or lifting of other motor vehicles with or without the assistance or use of lifts, winches, dollies, trailers or any like equipment.
- 1.40 "Township" shall mean the Corporation of the Township of Uxbridge
- 1.41 "Traffic" shall mean and includes pedestrians, ridden or herded animals, vehicles and other conveyances, either singly or together, while using any highway for purposes of travel.
- 1.42 "Traffic Control Signal" shall mean any device, manually, electronically or mechanically operated for the regulation or control of traffic.
- 1.43 "Trailer" shall mean a vehicle without its own means of propulsion that has to be drawn upon a highway by a motor vehicle;
- 1.44 "Unauthorized area" shall mean: a Front Yard, Exterior Side Yard, or Side Yard, except as otherwise permitted under the Township of Uxbridge Zoning By-law 81-19; or the Boulevard, where parking is permitted by a Township of Uxbridge Traffic By-law 2013-184;
## Section 2- General Provisions
- Vo person shall place, maintain or display on any highway, any sign narking or device, which purports to be or is an imitation of or resemble an authorized official sign
- 2.2 No person shall drive a vehicle upon a sidewalk or footpath or on a highway except for the purpose of directly crossing the sidewalk or footpath of a driveway.
- 2.3 No person shall drive on any highway drive any vehicle over any raised curb.
- 2.4 The chief of police or director of public works and operations are hereby authorized to erect or place temporary "No Parking" or "No Stopping" signs on any highway.
- 2.5 The director of public works and operations is authorized to place or erect and to maintain such signs as are required to give effect to the provisions of this By-law.
- 2.6 The director of public works and operations is Authorized to issue permits for the movement on Highways under the jurisdiction of the Township of heavy vehicles, loads, objects or structures which are in excess of the dimensional limits set out in Section 109 of the Highway Traffic Act or the weight limits set out in Part VIll of the Highway Traffic Act.
## Section 3- General Stopping and Parking Regulations
## Right Side of Road Parking
- 3.1 No person shall park any vehicle on any highway except as follows:
- where there is a curb, on the right side of the roadway, having regard to the direction such vehicle was proceeding, with the right front and right rear wheels parallel to and not more than 15 centimetres out from such curb; or
- b) where there is no curb, with the right front and right rear wheels parallel to and as near to the right hand limit of the highway as is practicable without parking or stopping on or over a sidewalk, footpath or boulevard.
## Left Side of Road Parking
- 3.2 Where parking is permitted on the left hand side of the traveled portion of a highway designated for one way traffic, no person shall park any vehicle on the left side of the highway except as follows:
- where there is a curb, on the left side of the roadway, having regard to the direction such vehicle was proceeding, with the left front and left rear wheels parallel to and not more than 15 centimetres out
- b) where there is no curb, with the left front and left rear wheels parallel to and as near to the left hand limit of the highway as is practicable without parking or stopping on or over a sidewalk,
## Parking Within Space
- 3.3 No person shall park or stop any vehicle,
- a) except wholly within a parking space;
- b) so as to occupy more than one parking space; or
- C) in such a manner as to prevent other persons from utilizing adjacent parking spaces or obstruct the flow of traffic.
2. 3.4 No person shall park a commercial motor vehicle, except in an industrial area, unless such vehicle is actually engaged in the loading or unloading of goods, wares, merchandise, or passengers to adjacent premises.
## Section 4- Stopping Offences
- 4.1 No person on any highway shall stop any vehicle:
- a) on or over a sidewalk or footpath;
- b) within an intersection or crosswalk;
- C) in such a manner as to interfere with the movement of traffic or the clearing of snow from the highway;
- d) in such a manner as to interfere with highway cleaning operations;
- e) on the roadway, alongside of any stopped or parked vehicle;
- f) upon any bridge or elevated structure or within any tunnel or underpass;
- on any median strip separating two roadways or adjacent to either side or ends of such median strip;
- h) alongside or across the highway from any excavation or obstruction in the roadway whereby the free flow of traffic would be impeded;
- i) within 10 metres of a crosswalk.
- 4.2 Where official or authorized signs to that effect are displayed, no person shall on any highways stop any vehicle:
- a) within 30 metres of a pedestrian crossover;
- b) other than a school purpose vehicle in a school bus loading zone;
- c) other than a bus in a designated bus stop;
- d) anytime between the hours and days set out in the official signs on one or both sides of a highway or portion of a highway which is immediately adjacent to a school.
## Section 5- Parking Offences
- 5.1 No person shall on any highway park any vehicle:
- a) in front or within 1 metre of a driveway or private roadway or so as to obstruct vehicles in use of a driveway or private roadway
- within 3 metres of a point on the curb or edge of the roadway adjacent to any fire hydrant;
- c) within 10 metres of an intersecting roadway;
- d) for the purpose of displaying the vehicle for sale;
- e) for the purpose of washing, greasing or repairing the vehicle;
- within a distance of 4 metres of the tracks of any railway other than a street railway;
- within 15 metres of the nearest rail of a level railway crossing;
- in such a position as will prevent the removal of any other vehicle previously parked;
- for a period in excess of (3) hours unless otherwise indicated by official signs;
- i) on or over any boulevard;
- k) on the traveled portion of a roadway other than a cul-de-sac where the roadway within is 6 metres or less;
- 1) on or within 100 metres of a bridge over, under or across which a highway passes;
- m) within 6 metres of a point at the edge of the roadway and nearest to a public entrance to a hotel, theatre or public hall;
- Between the hours of 2 a.m. and 7 a.m. from November 1st to April 1st of any calendar year.
- 5.2 Where official signs to that effect are displayed no person shall on any highway park any vehicle:
- Anytime on one or both sides of a highway or portion of a highway which is immediately adjacent to a park or playground;
- b) within the turning basin of a cul-de-sac;
- c) within 15 metres of the end of a roadway on a dead end highway;
- anytime between the hours and days set out in the official signs on one or both sides of a highway or portion of a highway which is immediately adjacent to a school;
- e) excepting vehicles that display or obtain a valid Township Parking Permit. This provision also applies to "Permit Parking Only" signage.
## Restrictions on the Parking of Certain Vehicles
- No person shall park or leave an unattached trailer of any kind on a highway
## Front and Side Yard Parking Prohibitions
- 5.4 No person shall park a motor vehicle in an Unauthorized Area.
## Section 6- Paid Parking
- 6.1 No person shall park in a Permit Parking Zone, as defined in Schedule IV to this By-law, during the hours set out in Schedule IV to this By-law unless the driver holds a valid Parking Permit, designated for the Permit Parking Zone and has registered and/or paid the prescribed fee as set out
- 6.2 The provisions of this section shall apply to the Permit Parking Zones described in Schedule IV to this By-law and shall apply only during such hours as parking or stopping are not prohibited; all provisions of the Bylaw prohibiting or restricting parking or stopping on portions of such highways, or otherwise, shall remain in full force and effect.
- 6.3 Persons who have purchased a Parking Permit for the Downtown Permit Parking Area shall be given a color coded tag to hang from the rear-view mirror and the tag shall display the license number of the vehicle for which it was issued.
- 6.4 The Parking App shall be maintained and made available for the Fields of Uxbridge Permit Parking Area, for the purpose of controlling and regulating the parking of any vehicle in such zone and measuring and recording the duration of such parking; on those streets, parts of streets and sides of streets and parking lots, named or described in Schedule IV parking shall be allowed for the time indicated on the Parking App.
- On the days and between the hours specified in section 6.4, it shall be unlawful to permit a vehicle to remain parked in a parking space in the Permit Parking Zone for a period of time in excess of the time indicated as allowed by the Parking App.
- 6.6 Persons with a valid accessible parking permit in a designated accessible parking space within the Permit Parking Zone are exempt from payment for or having to obtain a Parking Permit.
- 6.7 The parking spaces in the Permit Parking Zones are on an as available basis and are not guaranteed.
- 6.8 Parking Permits will not be issued to commercial vehicles, nor will they permit repairs or maintenance of vehicles.
- The driver of a vehicle who commits a breach of the provisions outlined in Section 6 of this By-law and the owner of the vehicle shall be guilty of an offence and shall be liable to the penalty in Section 30.1 of this By-law or on conviction thereof shall be liable to the penalty provided for in Section 30.1 of this By-law.
- In addition to the penalties provided herein, a Police Officer or Municipal Law Enforcement Officer may order the removal of any unlawfully parked vehicle to a suitable place of storage and all costs and charges for the removal, care and storage thereof shall be a lien on such vehicle.
- Notwithstanding anything to the contrary contained herein, the Township, during any emergency or special circumstances deemed sufficient therefore, may by the use of appropriate signs or signals suspend the movement of any or all vehicular traffic on any street or portion thereof in the Paid Parking Zone and/or may suspend any or all parking thereon by authorizing the affixing of "No Parking" signs, and the Township or designate during such emergency may declare that any vehicle already parked is being parked illegally regardless of the time permitted for parking such vehicle under the provisions of this section and notwithstanding that the period allowed to the owner or driver under this section has not expired; provided however, that in this event the owner or driver of such vehicle is notified by a Police Officer or Municipal Law Enforcement Officer that parking at such place has been suspended, and further that the owner or driver of such vehicle is allowed a reasonable period of time to remove said vehicle.
## Section 7- Accessible Permit Only Parking Spaces
- 7.1 An accessible parking permit issued to an individual is not valid when displayed on a vehicle and the vehicle is not being used to pick up or transport the holder of the accessible parking permit.
- 7.2 An accessible parking permit issued to a corporation or organization is not valid when displayed on a vehicle and the vehicle is not being used to pick up or transport a person with a disability.
- An accessible parking permit shall be displayed on the sun visor or on the dashboard of a vehicle so that the international symbol of access for the disabled, the permit number and the expiry date of the permit are clearly visible from the outside of the vehicle.
- 7.4 Every owner and operator of a parking lot shall provide a minimum number of designated parking spaces therein in accordance with the following table:
- 7.5 For the purpose of calculating the required minimum number of designated parking spaces for multi-unit residential development: consisting of 10 or more dwelling units, the requirements of subsection 6. shall be applied only to the visitor parking provided for the development.
- 7.6 Section 6.5 shall not apply to residential developments consisting of less than 10 dwelling units.
- 7.7 Each designated parking space shall be,
- a) level with a maximum of 1.5% running slope for drainage;
- b) a minimum width of four metres;
- c) a minimum length of 5.3 metres;
- d) a minimum vertical clearance of 2.75 metres;
- e) located so sidewalks, paths or walkways will be accessible to disabled persons whether via ramps, aisles, depressed curbs, ol other appropriate means without requiring a person to pass behind parked cars or cross a traffic lane;
- located with sufficient clearance around the vehicle in terms of other vehicles or obstacles such as light standards and waste receptacles to permit free access by a wheelchair;
- g) identified by the official sign be mounted with the base of the sign no less than 1.7 metres and no more than 2.0 metres above grade; and
- h) located in a place approved by the Township of Uxbridge.

- 7.8 The requirement of section 6.7 b) and c) shall not apply to public highways
- 7.9 Where the Township permits a gravel surfaced parking space, each designated parking space shall:
- a) be identified with a pre-cast bumper curb across its entire width painted a bright blue and securely anchored in place; and
- b) meet the requirements of clauses (b) through (i) inclusive of section
- 7.10 No person shall park or stop a vehicle in an accessible permit only parking space unless:
- a) the vehicle is displaying a valid accessible parking permit; and
- the vehicle is being operated by or is conveying the person with a disability to whom the accessible parking permit has been issued
## Section 8- Parking on Municipal Property
- 8.2 Where one or more signs have been posted on municipal property, stating conditions on which a motor vehicle may be parked or left or prohibiting the parking or leaving of a motor vehicle on the property contrary to such conditions or prohibitions shall be deemed to have been parked or left without consent.
## Section 9- Parking on Private Property
- 9.1 No person shall park or leave any vehicle on private property without the consent of the owner or occupant of such property.
- 9.2 Where an owner or occupant of a property has posted one or more signs stating conditions on which a motor vehicle may be parked or left on the property, a motor vehicle parked or left on the property contrary to such conditions or prohibition shall be deemed to have been parked or left without consent.
## Section 10- Parking on Fire Route
- 10.1 Where authorized signs meting the minimum requirements of Schedule XVI are displayed, no person shall park, or stand, a vehicle along, in, or over, any designated fire route.
- 10.2 The private roadways, at the locations as set out in Schedule XVII to this By-law are designated as fire routes.
- 10.3 Site plans or sketches of the fire routes may be made part of Schedule XVII.
- 10.4 Fire routes designated by this By-law shall be indicated by fire route signs erected and maintained by the owner or occupant and the location of such fire route signs shall be approved by the Chief Fire Official or a Municipal Law Enforcement Officer.
## Section 11- Parking at Pedestrian Crossovers
- 11.1 Where official signs to that effect are displayed, no person shall on any highway park any vehicle:
- a) within 30 metres in advance of, and 15 metres beyond a pedestrian crossover, on both sides of the highway, measured in the direction of travel of vehicles on the highway or portion of highway;
- anytime or between the hours and on the days set out on the official signs on one or both sides of a highway or portion of a highway which is immediately adjacent to a school.
## Section 12- Parking near Intersecting Highways
- 12.1 Where official signs to that effect are displayed, no person shall on any highway park any vehicle:
- a) within 30 metres of a Regional Road on an intersecting highway under the jurisdiction of an area municipality;
- b) within 60 metres of an intersecting highway on a Regional Road;
- 12.2 Nothing in this section shall be deemed to permit the stopping or parking of a vehicle where stopping or parking is prohibited.
## Section 13- Stopping Restrictions and Prohibitions
- 13.1 Where official signs to that effect are displayed, no person shall stop a vehicle on any highway at the side and between the limits set out in Columns 1, 2, and 3, of Schedule I to this by-law during the times or days set out in Column 4.
## Section 14-Parking Restrictions and Prohibitions
- 14.1 Where official signs to that effect are displayed, no person shall park a vehicle on any highway at the side and between the limits set out in Columns 1, 2, and 3, of Schedule Il to this by-law during the times or days set out in Column 4.
- 14.2 Where official signs to that effect are displayed, no person shall park a vehicle on any highway at the side and between the limits set out in Columns 1, 2, and 3, of Schedule Ill to this by-law during the times or days set out in Column 4 for a longer period than that set out in Column 5.
- 14.3 Where official signs to that effect are displayed, no person shall park a vehicle on any highway during periods of snow removal.
## Section 15- One-Way-Highways
- 15.1 The highways set out in Column 1 of Schedule V to this by-law between the limits set out in Column 2 of the said Schedule, during the times or day set out in Column 3 of the said Schedule, are hereby designated for oneway vehicular traffic only in the direction set out in Column 4 of the said Schedule.
- 15.2 The highways set out in Column 1 of Schedule V to this by-law having been divided into clearly marked lanes for vehicular traffic between the limits set out in Column 2 of the said Schedule, each of the said lanes indicated in Column 3 of the said Schedule is hereby designated for vehicular traffic moving in the particular direction set out in Column 5 of
the said schedule and such designation shall be indicated by an official sign or by traffic control signal.
## Section 16- Through Highways
- 16.1 The highways set out in Column 1 of the Schedule VI to this by-law between the limits set out in Column 2 of the said Schedule, are, except as provided in subsection 15.2 of this section, hereby designated as through highways for the purposes of The Highway Traffic Act.
- 16.2 The designation in subsection in 15.1 of this section of a highway or portion of highway as through highways shall not include any intersection thereon where the highway intersected is a King's Highway or where traffic control signals are installed.
## Section 17- Stop Signs
- 17.1 The erection of stop signs is hereby authorized at each of the intersections set out in Column 1 of Schedule VIl of this by-law facing traffic as set out in Column 2 of the said Schedule.
## Section 18- Rate of Speed
- 18.1 Where any highway or portion of highway set out in Schedules VIII, IX, X or Xl of this by-law, is signed in compliance with the regulations under The Highway Traffic Act, the maximum rate of speed thereon shall be the rate of speed prescribed in the said Schedule.
## Section 19- Pedestrian Crossover
- 19.1 The roadway set out in Column 1 of Schedule XII to this by-law, at the locations set out in Column 2 of the said Schedule, are designated as pedestrian crossovers and shall be indicated as such as prescribed by the regulations made under The Highway Traffic Act.
## Section 20- Heavy Traffic
- 20.1 Where official signs to that effect are displayed, Heavy Vehicles is prohibited on highways or parts of highways set out in Column 1 of Schedule XIII to this by-law between the limits set out in Column 2 on the said Schedule during the times or days set out in Column 3 of the said Schedule.
- 20.2 The provisions of subsection 19.1 of this section shall not apply to the use of said highways or parts of highways for deliveries to or removals from any premises abutting thereon which cannot be reached except by way of a highway or portion of highway referred to in the said section or to prohibit the use of such vehicles for such purpose, provided that in making such delivery or collection, the said highway or portion of highway is traveled only insofar as is unavoidable in getting to and from such premises.
- Where official signs to that effect are displayed and subject to section 93 of The Highway Traffic Act, there shall be a reduced load period in effect from the 1st day of February to the 31st day of May inclusive, in each and every year and no person shall on any highway or part of a highway affected, operate or draw any vehicle having a weight which is in contravention of The Highway Traffic Act.
- 20.4 Notwithstanding the provisions of any other section of this By-law, no person shall park any commercial vehicle or heavy vehicle on any highway or part of any highway set out in Column 1 of Schedule XIlI to
this By-law, unless the commercial vehicle or heavy vehicle is actually engaged in the loading and unloading, delivery and receipt of goods, wares, merchandise or passengers to adjacent premises.
## Section 21- School Bus Loading Zones
- 21.1 Where official signs to that effect are displayed, the highways or portions of highways set out in Column 1 of Schedule XIV to this by-law on the side of the highway set out in Column 2 of the said Schedule between the limits set out respectively on Columns 3 and 4 of the said Schedule are hereby designated as school bus loading zones.
- 21.2 No person shall on any highway stop any vehicle, other than a school purpose vehicle, in a school bus loading zone.
## Section 22- Accessible Permit only Parking Spaces
- 22.1 The roadway set out in Column 1 of Schedule XV to this by-law, at the locations set out in Column 2 of the said Schedule, are designated as Accessible Permit Only Parking Space and shall be indicated as such as prescribed by the regulations made under The Highway Traffic Act.
## Section 23- Bus Stop Zones
- Where official signs to that effect are displayed, the highways or portions of highways set out in Column 1 of Schedule XVIII to this by-law on the side of the highway set out in Column 2 of the said Schedule between the limits set out respectively on Column 3 of the said Schedule are hereby designated as bus stop zones.
- 23.2 Where official signs to that effect are displayed, no person shall on any highway stand any vehicle other than a bus within a distance of up to 18 m in advance of or 30 m beyond any point designated by an authorized sign or signs as a bus stop.
- No person shall on any highway, stop any vehicle, other than a bus, in a designated bus stop, except that the driver of the passenger vehicle may temporarily stop therein for the purpose of and while actually engaged in loading or unloading passengers when such stopping does not interfere with any bus.
## Section 24- Application for Exemption
- 24.1 Any person may make an application to the clerk for an exemption from

## 24.2 Details of Application for Exemption
The application referred to in Section 23.1 shall contain:
- a) the name and address of the applicant;
- b) the names of any Township Roads;
3. a statement of the particular provision or provisions of the by-law from which exemption is sought;
- d) the period of time of which the exemption is sought;
- e) the reasons why the exemption should be granted;
- f) an application fee according to the chart below;
- i) seventy five ($75.00) for events involving the parking of one to twenty five (1-25) vehicles or for the storage of items (bins, trailers etc)
8. ii) one hundred and twenty five ($125.00) for weddings or gatherings involving more than twenty (25) vehicles.
9. 24.3 A decision of the clerk shall be final and binding.
## Section 25- Tow Trucks
- 25.1 No person shall solicit, make or convey an offer of services of a tow truck while that person is within 200 metres of:
- a) the scene of an accident or apparent accident; or
- b) a vehicle involved in an accident, on any highway
- 25.2 No owner shall park, stop or stand a tow truck on any highway within 200 metres of:
- a) the scene of an accident or apparent accident; or
- b) a vehicle involved in an accident.
- 25.3 Sections 24.1 and 24.2 do not apply to a person who is at the scene of an accident at the request or direction of a Police Officer, a Firefighter or a person involved in the accident.
- 25.4 Any person operating a tow truck or other motor vehicle parked, stopped or freiarent accident or to any other location as directed by a police officer
## Section 26- Yield Signs
- 6.1 The erection of stop signs is hereby authorized at each of the intersection set out in Column 1 of Schedule XIX of this by-law facing traffic as set ou in Column 2 of the said Schedule.
## Section 27-Community Safety Zone
- Where official signs to that effect are displayed, highways or portions of highways set out in Columns 1 and 2 of Schedule XX are designated as Community Safety Zones during the prohibited times and days as set out in Column 3.
## Section 28- Turning Movements Prohibited
- 28.1 Where Official Signs to that effect are displayed, no Vehicle in any portion of a Highway set out in Column 1 of Schedule XXI to this By-law proceeding in the direction or emerging from a property set out in Column 2 of the said Schedule, shall be turned in the direction set out in Column 3 of the said Schedule, during the times or days set out in Column 4 of the said Schedule.
- 28.2 Where Official Signs to that effect are displayed, no Person operating a Vehicle shall at any time make a left hand turn at the locations set out in Column 1 of Schedule XXI.
## Section 29- Administration and Enforcement
- 29.1 The provisions of this by-law may be enforced by a municipal law enforcement officer or a police officer.
- 29.2 No person shall hinder or obstruct, or attempt to hinder or obstruct, an Officer exercising a power or performing a duty under this By-law.
- 29.3 Unless otherwise defined in this By-law, definitions from the Highway Traffic Act and corresponding regulations, as amended from time to time shall apply to terms used in this By-law.
## Section 30- Penalties
- Every person who contravenes any provision of this By-law is guilty of an offence, pursuant to the provisions of the Provincial Offences Act, as amended from time to time, and upon conviction is liable to a fine of not more than $5,000.00.
- Where a vehicle has been left parked, stopped or standing in contravention of this By-law, the owner of the vehicle, notwithstanding that he was not the driver of the vehicle at the time of the contravention of the Bience unless of the one or the one ceo here me in or te possession of some person other than the owner without the owner's consent.
## Section 31- Short Title
- 31.1 This By-law may be referred to as the "Traffic By-law".
## Section 32- Severability
- 32.1 If a court of competent jurisdiction should declare any section or part of a section of this By-law to be invalid, such section or part of a section shall be construed as having persuaded or influenced Council to pass the emainder of this By-law and it is hereby declared that the remainder of this By-law shall be valid and shall remain in force

## Section 33- Effective Date

## Schedule XVI FIRE ROUTE STANDARDS
1. Fire route signs shall be permanently mounted on a rigid sign post, pole or building structure.
2. Fire route signs shall be erected at a height of between 1.9 metres and 2.4 metres as measured from the edge of the travelled portion of the designated route to the bottom edge of the sign.
3. Fire route signs shall be installed at a distance of between 0.3 metres and 3 metres from the travelled edge of the designated route.
4. Standard fire route signs shall be installed along the route at approximately 12 metre to 15 metre intervals or as frequently as is necessary to identify the route in the judgment of the chief fire official.
5. Standard Signs Type FR-1, FR-2, FR-3, and FR-6, when required, shall be installed at a 45 degree angle in relation to the edge of the travelled portion of the designated route facing approaching traffic.
6. Standard Signs Type FR-4, FR-5, and FR-7 when required, shall be installed at a 90 degree angle in relation to the edge of the travelled portion of the designated route, in such a manner as to allow both of the sign faces to be visible to traffic.
7. Standard Sign Type FR-10, when, shall be installed on a 90 degree angle to the edge of the travelled portion of the designated route and shall be erected between 0.6 metres and 3.0 metres from the said travelled edge and shall be positioned between 3.0 metres and 10.0 metres from the property line, along the fire route at all vehicular access points.
8. Standard Sign Type FR-8 and FR-9, shall be installed on a 90 degree angle in relation of the travelled portion of the unloading and loading zone as part of the designated fire access route in such a manner as to allow both of the sign faces to be visible to traffic.
