BYLAW NO. 010-2018
AS AMENDED BY BY-LAW NO. 022-2018 & 026-2020, 032-2020, 033-2020
012-2021, 020-2021, 047-2021, 018-2022, 039-2025, 020-2026, 027-2026
Being a Bylaw to Regulate Traffic and Parking in the Township.
WHEREAS Section 11 of the Municipal Act, R.S.O 2001 Chapter 25, authorizes the Council of a
Municipality to pass bylaws respecting highways, including parking and traffic on highways;
AND WHEREAS Municipalities may pass Bylaws under provisions of the Highway Traffic Act, R.S.O
1990,c.H, 8;
NOW THEREFORE the Council of the Corporation of the Township of Wainfleet HEREBY ENACTS AS
FOLLOWS:
1.
SHORT TITLE
1.1.
This Bylaw shall be known as the "Parking and Traffic Bylaw"
2.
DEFINITIONS
2.1.
In this Bylaw:
"Accessible Parking" means a parking space for people with a valid MTO issued
Accessible Parking Permit (APP).
"Bicycle" will have the same meaning as the Highway Traffic Act.
"Boulevard" means all parts of the highway save and except any roadway, shoulder,
driveway or sidewalk.
"outer Boulevard" means such portions of the highway lying between any
sidewalk and the roadway or the shoulder where such exits;
"inner boulevard" means such portions of the highway lying between the lateral
boundary and the sidewalk and where there is no sidewalk it means that portion of
the highway lying between the lateral boundary and the roadway or shoulder where
such exists;
"Chief of Police" means the Chief of the Niagara Regional Police Service.
"Commercial Motor Vehicle" will have the same meaning as the Highway Traffic Act.
"the Complex" means the Municipally owned Arena, Community Hall, Library and Fire
Hall Station 2.
"Corner" with reference to the highway intersection, means the point of intersection of
the prolongation of the lateral curb lines or in the absences of curbs the prolongation of
the edges of the roadways.
"Crosswalk" will have the same meaning as the Highway Traffic Act.

"Cul-de-sac" means a highway which is closed at one end where a turning circle or
basin is constructed to allow a vehicle to turn around and egress at the open end.
"Driveway" means the improved land on a highway which provides vehicular access
from the roadway to a laneway or parking area on adjacent land.
"Emergency Vehicle" will have the same meaning as the Highway Traffic Act.
"Emergency Route" means a route designated for emergency vehicles and situations.
"Farm Tractor" will have the same meaning as the Highway Traffic Act.
"Gross Weight" Will have the same meaning as the Highway Traffic Act.
"Highway" will have the same meaning as the Highway Traffic Act.
"Highway Traffic Act" or "HTA" means the Highway Traffic Act, R.S.O. 1990, c. H.8.
"Holiday" includes New Years Day, Family Day, Good Friday, Easter Monday, Victoria
Day, Canada Day, Labour Day, Thanksgiving, Remembrance Day, Christmas Eve,
Christmas Day, and Boxing Day.
"Intersection" will have the same meaning as the Highway Traffic Act.
"Ministry" means the Ministry of Transportation of Ontario.
"Motor Assisted Bicycle" will have the same meaning as the Highway Traffic Act.
"Motorcycle" will have the same meaning as the Highway Traffic Act.
"Motor Vehicle" will have the same meaning as the Highway Traffic Act.
"Municipality" means the Township of Wainfleet.
"Municipal Property" means any open area or portion of a structure other than a street
or highway, intended for the temporary parking of vehicles and on which there is
designated parking spaces.
"Official Sign" will have the same meaning as the Highway Traffic Act and/or means a
sign approved by the Ministry.
"One Way Road" means a roadway or part of a roadway designated as such by the
Municipality.
"Oversized Vehicles" means any motor vehicle having a registered gross weight in
excess four thousand five hundred (4,500) kilograms (9,925 lbs) including tractors used
for hauling purposes, busses, motorized and mobile homes and trailers.
"Park" or "Parking" has the same meaning as the Highway Traffic Act, namely, when
prohibited, means the standing of a vehicle, whether occupied or not, except when
standing temporarily for the purpose of and while actually engaged in loading or
unloading merchandise or passengers.
"Pedestrian" means a person on foot, or in a wheelchair, power wheelchair, medical 3 or
4 wheeled scooter, baby carriage, or on a child's play vehicle propelled by muscular
power or a 9 volt or 12 volt battery pack.

"Peace Officer" means a constable or higher rank with the Niagara Regional
Police, a municipal law enforcement officer, or other peace officer authorized to
enforce the Highway Traffic Act, are hereby vested with the authority of enforcing
or carrying out the provisions of this bylaw.
"Police Service" means any of the Regional, Provincial or Federal Police Services being;
Niagara Regional Police Service (NRP), Ontario Provincial Police Service (OPP) and
Royal Canadian Mounted Police Service (RCMP).
"Public Vehicles" will have the same meaning as the Public Vehicle Act, R.S.O. 1980,
c.425 as amended.
"Reebs Bay Beach" meaning the sand beach and the access point to this beach.
"Regional Municipality" or "Region" means the Corporation of the Regional Municipality
of Niagara.
"Residential Parking Permit" means a permit issued under section 4.15.2.2
"Roadway" will have the same meaning as the Highway Traffic Act.
"School Bus" will have the same meaning as the Highway Traffic Act.
"School Days" means any Monday to Friday inclusive, between 7am and 5pm when
school is in session.
"Shoulder" means that portion of the highway lying adjacent to the roadway where there
is no barrier curb, and which is improved or maintained to support a stopped vehicle.
"Side Approach" means that side closest to lawfully approaching vehicular traffic.
"Side Remote" means that side most distant from lawfully approaching vehicular traffic.
"Sidewalk" means a foot path or any portion of a highway set aside or improved for the
use of pedestrians.
"Stand" or "Standing" has the same meaning as the Highway Traffic Act, namely, when
prohibited, means the halting of a vehicle, whether occupied or not, except for the
purpose of while actually engaged in receiving or discharging passengers.
"Stop" or "Stopping" has the same meaning as the Highway Traffic Act, namely, when
prohibited, means the halting of a vehicle, even momentarily, whether occupied or not,
except when necessary to avoid conflict with other traffic or in compliance with directions
of a police officer or a traffic control sign or signal.
"Traffic" meaning includes pedestrians, ridden, led or herded animals, vehicles,
motorized snow vehicles and other conveyances, either singly or together while using any
portion of a highway for the purposes of travel or movement of goods.
"Traffic Control Devices" means any sign, traffic signal or other roadway, curb or
sidewalk marking, or any other device erected or placed under the authority of this bylaw
for the purposes of regulating, warning or guiding traffic.

"Traffic Signal" means any device operated manually, electronically or mechanically for
the regulation of traffic.
"Trailer" will have the same meaning as the Highway Traffic Act.
"Town Hall" means the Township of Wainfleet Town Hall Office Building and front and
rear parking lots.
"Unauthorized Motor Vehicle" is a vehicle that does not have affixed thereto current
identification issued and displayed in accordance with the provisions of this bylaw.
"U-Turn" means to turn a vehicle within a roadway in order to proceed in the opposite
direction from the direction the vehicle was previously travelling.
"Vehicle" will have the same meaning as the Highway Traffic Act.
"Wheelchair" has the same meaning as the Highway Traffic Act.
3.
INTERPRETATION
3.1.
For the purpose of this bylaw, unless the context requires otherwise:
3.1.1.
Words imparting the singular number shall include the plural and words
imparting the masculine gender shall include the feminine and vice versa;
3.1.2.
Where a form of words or expression are prescribed in this bylaw, deviations
there from not affecting the substance or calculated to mislead do not vitiate
them
3.2.
Where words and phrases used in this bylaw are now defined in the Highway Traffic Act,
but not used in this bylaw, the definitions in the Highway Traffic Act shall apply to such
words and phrases.
3.3.
Where there is any conflict between the provisions of this bylaw and the provisions of the
Highway Traffic Act, the provisions of the Highway Traffic Act shall prevail.
3.4.
In the Schedules to this bylaw, the following abbreviations, definitions and symbols stand
for the words respectively set forth opposite thereto as follows:

3.5.
Where distance is used in this bylaw as from, to or within a specific distance of an object,
structure, land, intersection or part of a highway, such distance shall be measure along the
curb or edge of the roadway opposite such object, structure, land or corner, unless the
context otherwise requires.
3.6.
The various restrictions of this bylaw are cumulative and not mutually self-exclusive.
3.7.
Whenever in this bylaw a time of day or hour is referred to, the same shall be construed in
accordance with Standard Time or Day Light Savings Time, as may be in current official
use in the Region.
4.
STOPPING, STANDING AND PARKING
4.1.
Two-way Roadway
4.1.1.
Unless otherwise permitted in this bylaw, no person shall stop, stand or park
any vehicle on any highway, except:
4.1.1.1.
On the right hand side of the highway, having regard to the
direction in which such vehicle had been proceeding, and
4.1.1.2.
Parallel to the right curb or where there is no curb, as close as
practical to the right edge of the shoulder or edge of highway, and
4.1.1.3.
Not more than thirty centimetres (30 cm) for the curb.
4.2.
One-way Roadway
4.2.1.
Where stopping, standing or parking is permitted on a highway designated
for one-way traffic, no person shall stop, stand or park any vehicle on any
highway, except on the right side of the road;
4.2.1.1.
Having regard to the direction in which such vehicle has been
proceeding, and
4.2.1.2.
Parallel to the curb or where there is no curb, as close as
practical to the edge of the shoulder or edge of a highway, and
4.2.1.3.
Not more than thirty centimetres (30cm) from the curb.

4.3.1.
No person shall permit a vehicle to remained stopped, standing or parked on
any portion of and highway designated by signs or markings on the highway
for stopping, standing or parking except when said vehicle is entirely within
the space or area to so designated.
4.4.
Oversized Vehicles, Commercial Motor Vehicles and Trailers
4.4.1.
No person shall park an oversized vehicle, a commercial motor vehicle or a
trailer on any residential Street at anytime, except for the purposes of delivery
or while such vehicles are being used in conjunction with construction,
maintenance or repair which necessitates the parking of the vehicle on the
road.
4.5.
Shoulder and Boulevard Restriction
4.5.1.
Unless otherwise provided in this bylaw, no person shall stop, stand or park a
vehicle or permit or permit such vehicle to remain stopped, standing or parked
on any shoulder or inner or outer boulevard contrary to the prohibition or
restriction applicable to the adjacent roadway as herein provided by this
bylaw.
4.6.
Double Parking Prohibited
4.6.1.
No person shall stop, stand or park a vehicle or permit a vehicle to remain
stopped, standing or parked on any highway on the road side of any stopped,
standing or parked vehicle.
4.7.
Stopping and Standing Prohibited- Specific Places, Without Signs
4.7.1.
No person shall stop or stand any vehicle or permit any vehicle to be stopped
or standing on highway:
4.7.1.1.
On or partly on or over a sidewalk;
4.7.1.2.
Within an intersection crosswalk;
4.7.1.3.
Stopped or Standing in a way that would impede the free flow of
traffic;
4.7.1.4.
Upon any bridge or within thirty meters(30m) of either end of the
structure;
4.8.
Stopping and Standing Prohibited - Specific Places , With Signs
4.8.1.
When official signs are on display, no person shall stop or stand a vehicle or
permit a vehicle to remain stopped or standing on a highway;
4.8.1.1.
Within fifteen meters (15m) of an intersection;

4.8.1.2.
Within sixty meters (60m) of an intersection controlled by a traffic
signal;
4.8.1.3.
Within thirty meters (30m) of the approach side of a crosswalk at
a school crossing and ten meters (10m) of the remote side of a
school crosswalk.
4.8.2.
No person shall Stop a vehicle in an Emergency Route at any time or for any
purpose.
4.9.
Stopping and Standing- Schedule "AA", "AB" and "A1"
4.9.1.
Where official signs are on display, no person shall Stop or Stand a vehicle or
permit a vehicle to remain Stopped or Standing on any portion of a highway in
contravention of Schedule "AA" (Stopping Prohibitions), Schedule "AB"
(Standing Prohibitions) or Schedule "A1" (Stopping prohibitions - Emergency
Routes)
4.10.
Stop, Stand and Park
4.10.1.
For the purposes of this by-law, Stopping prohibitions, Standing prohibitions
and Parking prohibitions, shall be regulated under Schedules "AA" "AB" "AC",
"A1" "A2" "A3" "A4" and "A5" and shall be enforced by one or more official
signs identifying the applicable prohibition or prohibitions
4.11.
Parking Prohibited- Specific Places Without Signs
4.11.1.
No person shall park a vehicle or permit a vehicle to remain parked on a
highway:
4.11.1.1.
Within ten meters (10m) of an intersection;
4.11.1.2.
On an inner or outer boulevard;
4.11.1.3.
On either side of a roadway so as to obstruct a vehicle in the use
of any lane or driveway;
4.11.1.4.
For the purpose of displaying such vehicle for sale or lease;
4.11.1.5.
For the purpose of servicing or repairing such vehicle except for
repairs as have been necessitated by an emergency;
4.11.1.6.
For a longer period than 12 hours at any one time in the same
location;
4.11.1.7.
Interfering with road clearing or grading;
4.11.1.8.
Interfering with snow removal operations;
4.11.1.9.
Park on roadway without current valid MTO issued number
plates.

4.11.2.
Without the prior written permission of the Township, no person shall park any
Vehicle or permit any Vehicle to remain parked in a Township cemetery or
Township facility except while such person is legally using said cemetery or
facility.
4.11.3.
Without the prior written permission of the Township, no person shall park any
Vehicle or permit any Vehicle to remain parked on a Highway, Township
parking lot, Township cemetery or Township facility for the purpose of
camping, tailgating or picnicking.
4.12.
Parking Prohibited - Specific Places With Signs
4.12.1.
When official signs are on display, no person shall park a vehicle or permit a
vehicle to remain parked on a highway:
4.12.1.1.
In front of or within eight meters (8m) of the main entrance, or any
emergency exit from any public house, hotel, motel, hospital,
nursing home, theatre, auditorium or other building or enclosed
space in which persons may be expected to congregate in large
numbers;
4.12.1.2.
Within twenty-two meters (22m) of an intersection;
4.12.1.3.
Within sixty meters (60m) of an intersection controlled by a traffic
signal;
4.12.1.4.
In front or within eight meters (8m) of the property limits on which
a fire hall or on the opposite said highway, within thirty meters
(30m) of prolongated lot limits of the said property;
4.12.1.5.
Having a road width of eight meters (8m) or less;
4.12.1.6.
Within thirty meters (30m) of the approach side and within fifteen
meters (15m) of the remote side of a crosswalk;
4.12.1.7.
So as to interfere with the formation of a funeral procession;
4.12.1.8.
Within fifteen meters (15m) of the termination of a dead end
roadway;
4.12.1.9.
On the inside curve (elbow curve) of a roadway, within fifteen
meters (15m) of the tangent;
4.12.1.10. On either side or both sides of the portion of highway adjacent to
a school property between the hours of 7am and 5pm Monday to
Friday while school is in session;
4.12.1.11. Where the Chief of Police or the Roads Superintendant or
designate, is of the opinion that for some temporary period, the

safety of the public, the proper movement of traffic, the proper
and safe performance of some vital function of the Township of
Wainfleet or the closure of a highway to accommodate the
having of a community event requires the prohibition or limitation
of parking;
4.12.1.12. park in an emergency route;
4.12.1.13. park within a designated Accessible Parking Space without a
valid Accessible Parking permit displayed;
4.12.1.14. park in the complex;
4.12.1.15. park on Reebs Bay Beach.
4.13.
Parking Prohibited- Schedules "AC", "A2", "A3", "A4" and "A5"
4.13.1.
Where official signs are on display, no person shall Park a vehicle or permit a
vehicle to remain Parked on any portion of a highway in contravention of
Schedule "AC" (Parking Prohibitions), Schedule "A2" (Parking Prohibitions -
Municipally Owned Lands), Schedule "A3" (Parking Prohibitions - Designated
Accessible Parking Area), Schedule "A4" (Parking Prohibitions - Angular
Parking) or Schedule "A5" (Parking Prohibitions - Parking by Residential
Parking Permit Only).
4.13.2.
Parking Prohibitions, with respect to Angular Parking.
4.13.2.1.
Subject to 4.7, 4.8 and 4.10, 4.11, when signs are on display no
person shall stop, stand or park a motor vehicle or permit a motor
vehicle to remain stopped, standing or parked on a highway in
any fashion except for angular to the road, during the times and
days set out respectively in Columns 1, 2, 3, and 4 of Schedule
"A-4" of this bylaw.
4.14.
Oversized Vehicles, Commercial Motor Vehicles and Trailers - Schedule "B"
4.14.1.
Subject to sections 4.7,4.8, and 4.10, 4.11, when official signs are on display,
no person shall stop, stand or park a trailer, oversized or commercial motor
vehicle or permit a trailer, oversized or commercial motor vehicle remain
stopped, standing or parked on a highway, at the side, between the limits, and
during the times and days set out respectively in Columns 1, 2, 3, and 4 of
Schedule "B" of this bylaw.
4.15.
Parking Restrictions Exemptions
4.15.1.
Funeral Corteges
4.15.1.1.
If the Road Superintendent of Township of Wainfleet or their
designate is of the opinion or deems it desirable, they may

declare that sections 4.7, 4.8 and 410, 4.11 of this bylaw will not
apply for a temporary period to prevent the stopping, standing or
parking of vehicles forming a part of a funeral cortege, provided
that all such vehicles are parked on only one side of the highway
at one time.
4.15.2.
Residential Parking Permits
4.15.2.1.
No person shall Park a vehicle in an area designated for permit
Parking Only upon the highways or parts of the highways set out
in Schedule "A5" without a Residential Parking Permit.
4.15.2.2.
Residents of the Township are eligible to apply for and obtain up
to four (4) Residential Parking Permits per municipal address.
4.15.2.3.
All applications for a Residential Parking Permit shall be
submitted to the Township using the prescribed form that is
available from the Township and shall be accompanied by the
application fee as set out in the Township's Fees and Charges
By-law and such other materials as may be required by the
Township to confirm (i) that the applicant is a resident of the
Township; and (ii) the municipal address to which the application
relates.
4.15.2.4.
A Residential Parking Permit shall be valid for use in all vehicles
that are registered to persons who own or reside at the municipal
address in relation to which the Residential Parking Permit is
issued and shall not be valid for use in any other vehicles.
4.15.2.5.
A Residential Parking Permit shall expire on December 31st of the
year in which it was issued.
4.15.2.6.
Where a vehicle is parked pursuant to a Residential Parking
Permit issued in accordance with this section, the Residential
Parking Permit shall be displayed in the vehicle in a manner that
is clearly visible from outside the vehicle.
4.15.2.7.
Where a vehicle is parked in an area designated for Permit
Parking Only without a Residential Parking Permit and/or without
a Residential Parking Permit displayed in a manner that is clearly
visible from outside the vehicle, the registered owner of the
vehicle is guilty of an offence and is subject to penalty as set out
in section 11 of this by-law.

4.15.3.
Vehicles Exempt
4.15.3.1.
Marked vehicles owned and operated on behalf of the Township
of Wainfleet;
4.15.3.2.
An personal vehicle of an employee of the Township of Wainfleet
only on official business;
4.15.3.3.
Marked vehicles of the Region of Niagara;
4.15.3.4.
Any marked vehicle from the Province of Ontario;
4.15.3.5.
Marked MTO vehicles;
4.15.3.6.
Any Fire Dept., Ambulance or Police car;
4.15.3.7.
Any marked public utility, while engaging in repair, maintenance
or construction;
4.15.3.8.
Any volunteer fire fighters vehicle only during attendance on
scene at an emergency call.
4.16.
Special Zone- Schedule "C"
4.16.1.
With the exception of a school bus, no person shall stop, stand or park a
vehicle or permit a vehicle to remain stopped, standing or parked on a
highway, at the side, between the limits, and during the times and days set
out respectively in Columns 1, 2, 3, and 4 of Schedule "C" of this Bylaw
5.
TRAFFIC REGULATIONS
5.1.
Through Highways - Schedule "D"
5.1.1.
The highways between the limits set out in Columns 1 and 2 of Schedule "D"
of this bylaw are, except as provided in Subsection 5.1.2, hereby designated
as through highways.
5.1.2.
The designated in Subsection 5.1 of a highway or part of a highway as a
through highway shall not include any intersection thereon where the highway
intersected is a King's Highway or Regional Road where traffic signals are
installed or where the road passes over land owned by the Crown or the
Region.
5.2.
Stop Signs at Intersections- Schedule "E"
5.2.1.
The Municipality shall erect stop signs on the highways, at the intersections
set out in Columns 1 and 2 of Schedule "E" of this bylaw, facing traffic
proceeding in the direction set out in Column 3 of the said Schedule.
5.3.
Yield Signs at Intersections- Schedule "F"

5.3.1.
The Municipality shall erect yield signs on the highways, at the intersections
set out in Columns 1 and 2 of Schedule "F" of this bylaw, facing traffic
proceeding in the direction set out in Column 3 of the said Schedule.
5.4.
One-way Highways- Schedule "G"
5.4.1.
When official signs are on display, the highways between the limits set out in
Columns 1 and 2 of Schedule "G" of this bylaw, are hereby designated as
one-way roadway for the passage of vehicles only in the direction set out in
Column 3 of the said bylaw.
5.5.
Traffic Circles
5.5.1.
No person shall drive any animal or vehicle otherwise than in a counter
clockwise direction in any traffic circle or turning circle of a cul-de-sac.
6.
SPEED REGULATIONS
6.1.
Speed limits on Bridges- Schedule "H"
6.1.1.
When any structure on a highway set out in Column 1 and 2 of the Schedule
"H" of this bylaw, is marked in compliance with the regulations under the
Highway Traffic Act , the maximum rate of speed on such structure shall be
the rate of speed set out in Column 3 of the said Schedule.
6.2.
Speed Limits on Highways- Schedule "H"
6.2.1.
Subject to subsection 6.1.1, when any highway or part of a highway between
the limits set out in Columns 1 and 2 of Schedule "H" of this bylaw is marked
in compliance with the Highway Traffic Act, the maximum rate of speed on
such highway or part of a highway shall be the rate of speed set out in
Column 3 of the said Schedule.
6.3.
Speed Limits in School Zones - Schedule "I"
6.3.1.
Subject to 6.1.1 and 6.2.1, when official signs are displayed and if available
the flashing amber beacons are on display in compliance with the Highway
Traffic Act, the maximum rate of speed on the highway or part of a highway
between the limits set out in Columns 1, and 2 of Schedule "I", shall be 40
kilometres per hour during the days and hours set out in Column 3 of the said
Schedule.
6.3.2.
Subject to 6.3.1 and if available, where required on any school day to
accommodate variations from normal school hours or a school emergency,
the flashing amber beacons may be actuated and the speed limit reduced to
40km/h for any period between 8am and 5pm of the same day and not
provided under Subsection 6.3.1.

7.
LOAD RELATED RESTRICTIONS
7.1.
Specific Load Restrictions- Schedule "J"
7.1.1.
Reduced load on highways, restricted to 5 tonnes per axle during the months
of March and April when official signs are on display, the reduced load
restriction provisions of the Highway Traffic Act are declared to be in force
with respect to the highways and between the limits set out in Columns 1 and
2 of Schedule "J" of this bylaw, during the specific period of 1st day of March
to the 30th day of April, inclusive, in each and every year.
7.2.
Yearly Road Restrictions- Schedule "K"
7.2.1.
Reduced load on highways, restricted to 5 tonnes per axle during the entire
year, when official signs are on display, the reduced load restriction provisions
of the Highway Traffic Act are declared to be in force with respect to the
highways and between the limits set out respectively in Columns 1 and 2 of
Schedule "K" of this bylaw, during the period from the 1st day of January to the
31st day of December inclusive in each and every year.
7.3.
Oversized and Overweight Load Permits
7.3.1.
The Roads Superintendent of the Township of Wainfleet or designate, is
hereby authorized to grant or refuse permits for the moving of heavy vehicles,
loads, objects or structures in excess of the otherwise lawful limits, pursuant
to the Highway Traffic Act.
8.
DRIVING AND REGULATED RULES
8.1.
Emerging from Driveway, Laneway or Lot
8.1.1.
The driver or operator of a vehicle emerging from a driveway, laneway,
building or lot onto a highway, shall bring the vehicle to a full stop immediately
before driving on to a sidewalk, and upon proceeding shall yield the right-of-
way to pedestrians upon the sidewalk.
8.2.
Barricaded Highways
8.2.1.
No person shall drive, operate or parka vehicle or permit a vehicle to remain
parked on any part of any highway barricaded and marked by signs showing
that its use is prohibited or restricted.
8.3.
Vehicles Crossing Sidewalks, Boulevards and Curbs
8.3.1.
In this section bicycles shall include any such vehicle having a wheel in
excess of 50 cm. No person shall drive a vehicle upon a sidewalk on a
highway, except for the purpose of crossing the sidewalk provided that this

subsection shall not apply to children's play vehicles, bicycles propelled by
muscular power and having a wheel or wheels less than 50cm in diameter.
8.3.2.
No person shall drive a vehicle upon a sidewalk on a highway, except for the
purpose of directly crossing the sidewalk.
8.3.3.
No person shall drive any motor vehicle over a raised curb, wheelchair ramp
at a crosswalk or sidewalk except at a place where there is a driveway ramp,
mountable curb or depressed curb intended for vehicular access.
8.3.4.
No person shall drive any motor vehicle on any boulevard except for the
purpose of directly crossing the boulevard at a driveway or other designated
vehicular crossing.
8.4.
Boarding or Alighting
8.4.1.
No person shall board or alight from any vehicle while such vehicle is in
motion.
9.
PEDESTRIANS
9.1.
Playing on the Roadway Prohibited
9.1.1.
No person shall play of take part in any game or sport upon a roadway.
9.1.2.
No person upon roller skates or roller blades, or riding in or by means of
coaster, go cart or similar device shall go upon a road way except for the
purpose of crossing the roadway, and when so crossing such person shall
have the rights and be subject to the obligations of a pedestrian.
10.
ERECTION OF SIGNS
10.1.
Authorization
10.1.1.
The Road Superintendent for the Township of Wainfleet or their designate is
hereby authorized to apply, erect and maintain such traffic control devices
and other structures, plant and equipment as required to give effect to this
bylaw.
10.2.
Conflicting Private Signs
10.2.1.
No unauthorized person shall place, maintain or display upon any sign, signal,
marking or device visible from any highway which:
10.2.1.1.
Conceals a traffic control device from view;
10.2.1.2.
Interferes with the effectiveness of a traffic control device; or
10.2.1.3.
Purport to be an imitation of, or resembles any official sign or any
regulatory or traffic control device.

10.3.
Damage to Traffic Control Devices
10.3.1.
No person shall move, deface, damage, remove or in any manner interfere
with any traffic control device placed, erected or maintained by the Region or
the Municipality.
10.3.2.
No person shall drive any vehicle on or over any pavement marking, line or
strip on the roadway where markers are in place, or signs are on display to
indicate that the marking material has been freshly applied, nor shall any
person drive any vehicle into or over any such marker so placed, or move or
remove such marker unless authorized to do so.
11.
OFFENCES AND PENALTIES
11.1.
Subject to Administrative Monetary Penalty Bylaw (AMP Bylaw)
11.1.1.
Any fine imposed or offence created by this bylaw is subject to the provisions
of the Administrative Monetary Penalty Bylaw (AMP Bylaw)
11.1.2.
Any person who contravenes any section of this bylaw for which a penalty is
provided by the AMP Bylaw is subject to said penalty.
11.1.3.
Everyone who contravenes any provision of this bylaw is guilty of an offence
and subject to penalty as provided under the AMP Bylaw.
12.
APPLICATION AND ADMINISTRATION ENFORCEMENT
12.1.
Enforcement
12.1.1.
A Peace Officer as defined in this bylaw shall be responsible for enforcing and
carrying out of the provisions of this bylaw.
12.2.
Removal of Vehicles
12.2.1.
A peace officer as defined, upon discovery of any vehicle parked or standing
in contravention of this bylaw, of any vehicle apparently abandoned or any
vehicle without proper number plates on a highway or on a property listed in
this bylaw, may cause such vehicle to be removed or taken to and stored in a
suitable place and all costs and charges for removing, care and storage
thereof, if any, are a lien upon such vehicle, which may be enforced in the
same manner provided in the Mechanic's Lien Act.
12.3.
Application of this Bylaw
12.3.1.
This bylaw applies to all highways and parts of highways under the jurisdiction
of the Municipality.

12.4.1.
The Schedules referred to in this bylaw shall form part of this bylaw, and each
entry in a column of such Schedule shall be read in conjunction with the entry
of entries across there from and not otherwise.
13.
ADOPTION OF BYLAW
13.1.
Former Bylaw Repealed
13.1.1.
Once this bylaw has been approved by council, former Parking and Traffic
Bylaw No. 89-2000 and all amendments thereto are hereby repealed.
13.2.
Approval by Council
13.2.1.
The provisions of this bylaw shall take effect immediately after the passing of
this bylaw, after a first, second and third reading.
