THE CORPORATION OF THE TOWN OF WASAGA BEACH
BY-LAW NUMBER 2009 -104
A BY-LAW TO AMEND BY-LAW #2002-63
(BEING A BY-LAW TO REGULATE AND CONTROL ANIMALS WITHIN THE
TOWN OF WASAGA BEACH) OF THE CORPORATION OF THE TOWN OF
WASAGA BEACH
WHEREAS By-Law #2002-63 passed the 12th day of November 2002, a By-Law to provide
for the Licensing, Regulation, Registration and Prohibition of certain types of Animals within
the Town of Wasaga Beach.
AND WHEREAS it is deemed necessary and expedient to amend the said By-Law to
implement an appeal process under Section 6.0;
NOW THEREFORE, the Council of The Corporation of The Town of Wasaga Beach
enacts as follows:

THAT By-Law #2002-63, Section 2.0 - Definitions, is hereby amended by adding
the following:
2.20
"CAO" means the Chief Administrative Officer for the Town of Wasaga
Beach and/or his/her designate.

"Clerk" means the Town Clerk for the Town of Wasaga Beach and/or
his/her designate.

THAT By-Law #2002-63, Section 6.0 Restrictions is hereby amended by adding the
following:
6.8
Section 6.1 Exemption
6.8.1 Any person who owns, controls, possesses, boards or harbours more
than two (2) dogs upon establishing residency on any property within
the Town of Wasaga Beach may apply in writing to the Clerk for an
exemption to Section 6.1.
6.8.2 The Clerk may authorize an exemption to section 6.1 subject to such
terms and conditions as are necessary to give effect to this by-law, if
the Clerk refuses the exemption, the applicant may appeal the decision
of the Clerk to the CAO. The Clerk shall notify the applicant in writing
of his/her decision and inform the applicant of his right of appeal.

6.9
Appeal of Exemption Refusal
6.9.1 Any person who has been denied an exemption under Section 6.8 may
file an appeal in writing to the CAO within seven (7) days of receipt of
notification of the Clerks decision. The CAO may authorize an
exemption to Section 6.1 subject to such terms and conditions as are
necessary to give effect to this by-law. The CAO shall notify the
applicant in writing of his/her decision and that decision will be final
and no further right of appeal will be granted.
3.
This By-Law shall come into full force and take effect upon passing.
Read a first, second and third time and finally passed this 24th day of November, 2009.
