## THE CORPORATION OF THE TOWNSHIP OF MICHIPICOTEN ## BY-LAW NO. 891-93 BEING A BY-LAW to prohibit and regulate the keeping of animals within the Township of Michipicoten. WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45, Section 210, Paragraph 1, provides that the council of local municipalities may pass by-laws for prohibiting or regulating the keeping of animals or any class thereof within the municipality or defined areas thereof and for restricting within the municipality or defined areas thereof, the number of animals or any class thereof that may be kept by any person, or that may be kept in or about any dwelling unit as defined in the by-law; AND WHEREAS the Council of The Corporation of the Township of Michipicoten deems it expedient to regulate and to probibit the keeping of certain classes of animals; NOWTHEREFORE the Council of The Corporation of the Township of Michipicoten enacts the following as a By-Law: ## 1. In this By-Law: - (a) "animal" means any variety of domestic, wild or tame animal including birds and reptiles; - (b) "pets" means dogs, cats, and other small animals that are tame and kept as a companion or playmate on the premises occupied as a residence by their owner and not kept or raised for profit, but shall not include any horse, colt, cow, mule, donkey, goat, sheep, swine, hens, chicken, turkeys, ducks, mink, or any exotic species. 2. (a) No person shall keep any animal, except pets, in, on or upon any lands or premises within the municipality. - (b) The use of any land or premises for the purpose of keeping any animal, except pets, shall be permitted to continue if such land or premise was used for such purpose on the day of passing of this ByLaw, so long as it continues to be used for that purpose. <!-- image --> · - (C) Subject to the provisions of Section 2 (b) of this By-Law, any nonconforming use of land or premise which has been discontinued or unused for an interval of more than ninety (90) days shall not be resumed nor shall such non-conforming use be changed to any other non-conforming use without prior approval of the Council of The Corporation of the Township of Michipicoten. 3. This by-law shall not apply to lands zoned Rural (RU) in the Township of Michipicoten Zoning By-Law No. 385-85, as amended, or any other lands specifically zoned to permit the keeping of animals. 4. Every person who contravenes any provision of this By-Law is guilty of an offence and shall be liable upon conviction to a fine that is consistent with the general penalty provision found under the Provincial Offences Act, R.S.O. 1990, Chapter P.33, as amended. 5. That Township of Michipicoten By-Law No. 175 be and is hereby repealed.
