## THE CORPORATION OF THE TOWNSHIP OF MICHIPICOTEN
## BY-LAW NO. 1059-96
BEING A BY-LAW to prohibit the throwing, placing or depositing refuse or debris (including snow and ice) on private and/or municipal property in the Township of Michipicoten.
WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45, Section 210, SubSection 82, provides that the council of any corporation may pass by-laws prohibiting the throwing, placing or depositing of refuse or debris on private property or on property of the municipality or any local board thereof without the authority from the owner or occupant of such property;
AND WHEREAS the Council of The Corporation of the Township of Michipicoten deems it to be desirable to pass a by-law to prohibit the throwing, placing or depositing of refuse on municipal or private property;
NOWTHEREFORE the Council of The Corporation of the Township of Michipicoten enacts the following as a By-Law:
1. No person or persons shall throw, place, or deposit refuse or debris, (including snow and ice) on private property or on property of the municipality or any local board thereof without the authority from the owner or occupant of such property being first obtained in writing permitting the person to do so.
2. The municipality may order the offending party to remove the said refuse or debris (including snow and ice) from the property on which it was thrown, placed or deposited. In the event that the offending party fails to remove the said refuse or debris (including snow and ice) within the time ordered, then the municipality shall have the right to remove the same at the expense of the offending party and to recover the said expense from such person by action or same may be recovered in like manner as municipal taxes.
## 3. PENALTY
Any person or persons found throwing, placing or depositing refuse or debris (including snow and ice) on private property or on property of the municipality shall be guilty of an offence. The penalty for conviction of a first offence being set at a minimum of $100.00; the penalty for conviction

of a second offence shall be a minimum of $500.00; and the penalty for conviction of a third and subsequent offence is a minimum of $1,000.00.
4. THAT the Reeve and Clerk be and are hereby authorized to execute this by-law on behalf of The Corporation of the Township of Michipicoten upon receiving third and final reading.
READ a first, second and third time and finally passed this 5th day of March, 1996.
