THE CORPORATION OF THE CITY OF WELLAND Hugust BY-LAW NUMBER 2000 - 175 ## A BY-LAW TO PROHIBIT THE OPERATION AND USE OF VEHICLES ON THE WELLAND CANAL MULTI-USE TRAIL AND ADJACENT LANDS WHEREAS the Corporation in conjunction with the Regional Municipality of Niagara, and adjoining area municipalities, have undertaken the project of developing a trail known as the Welland Canal Multi-Use Trail; AND WHEREAS the Corporation is the owner of the subject lands, and Council now deems it necessary and advisable to prohibit the operation and use of vehicles upon the said Multi-Use Trail and adjacent lands; NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE CITY OF WELLAND ENACTS AS FOLLOWS: 1. That for the purposes of this by-law, "vehicle" shall mean: any automobile, motorcycle, motor-assisted bicycle, scooter, trail bike, dune buggy, mini-bike, go-cart, trailer, traction engine, farm tractor, all-terrain vehicle, motorized snow vehicle and any vehicle drawn, propelled or driven by any power whatsoever, including muscular power, and includes aircraft and watercraft of any nature or kind whatsoever. 2. No person shall operate or use any vehicle in, along, or upon the Welland Canal Multi-Use Trail and adjacent lands of The Corporation of the City of Welland. 3. Any person who contravenes the provisions of this by-law is guilty of an offence, and therefore shall be liable to a fine of $500.00 upon a first offence and $1,000.00 for any subsequent offence. 4. This by-law shall be enforced by a Police Officer, a Municipal By-law Enforcement Officer or an Officer appointed for the purposes of carrying out the provisions of this by-law. 5. That the Director of Development Services shall cause the appropriate signage to be erected. READ A FIRST, SECOND AND THIRD TIME AND PASSED BY COUNCIL THIS 5'" DAY OF December, 2000. Any person who contravenes the provisions of this by-law is guilty of an offence, and therefore shall be liable to a fine of $500.00 upon a first offence and $1,000.00 for any subsequent offence. 4. This by-law shall be enforced by a Police Officer, a Municipal By-law Enforcement Officer or an Officer appointed for the purposes of carrying out the provisions of this by-law. 5. A Police Officer, Municipal By-law Enforcement Officer, Municipal Employee, or Contract Employee, in the course of his employment and duties, is for all purposes of this bylaw, exempt from the provisions thereof. 7.
