THE CORPORATION OF THE TOWNSHIP OF WELLESLEY BY-LAW NUMBER 32/96 BEING A BY-LAW TO REGULATE THE OPERATION OF MOTORIZED SNOW VEHICLES WITHIN THE TOWNSHIP OF WELLESLEY WHEREAS the Council of a local municipality is authorized under the Motorized Snow Vehicles Act, R.S.O. 1990, Chapter M.44, to pass by-laws to regulate the operation of Motorized Snow Vehicles. NOW THEREFORE the Council of The Corporation of the Township of Wellesley hereby enacts as follows: In this by-law: l. Highway - shall mean a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle designed and intended for, or used by, the general public for passage of vehicles. Motorized Snow Vehicle - shall mean a self propelled vehicle designed to be driven primarily on snow. Built up Area - means any territory in a rural contiguous to a highway having a residential density as calculated in The Highway Traffic Act and without limiting the generality of the foregoing includes any town, village or hamlet so designated in Schedule "A" attached hereto; 2. No person shall operate a motorized snow vehicle within the Township of Wellesley, including any highways therein or any part or parts thereof between the hours of 12:0l o'clock a.m. and 6:30 o'clock a.m. on any day or days from Monday to Saturday, inclusive, except when the operator is proceeding to or from their residence, a trail system, service station or an emergency during inclement weather; 3. No person shall operate a motorized snow vehicle within the Township of Wellesley, including any highways therein or any part of parts thereof, between the hours of I 2:0 l o'clock a.m. and 10:00 o'clock a.m. on any Sunday, except when the operator is proceeding to or from their residence, a trail system, service station or an emergency during inclement weather; 4. The maximum speed limit at which a motorized snow vehicle may be operated on any part of a road in any settlement area shall be in accordance with Section 14(1) of the Motorized Snow Vehicles Act R.S.O. 1990, Chapter M.44; 5. No person shall operate a motorized snow vehicle on any sidewalk, or on any pedestrian walkway within the Township except recognized and posted trails; 6. No person shall operate a motorized snow vehicle on any recreational or park land including G. R. C. A. lands without written permission of the affected Community Centre Board and the Township of Wellesley ; 7. Motorized snow vehicles shall not be operated within one hundred and fifty (150) feet of any senior citizen's home. church, home for the aged, nursing home, public school or other areas posted with a sign or signs which indicate that snowmobiling is prohibited; 8. Notwithstanding anything contained in this By-Law, this By-Law does not apply to prohibit the operation of a motorized snow vehicle: (I) by a member of the Regional Police Force, the Ontario Provincial Police or any other police force while engaged in the performance of a police officer's duty; (II) by an employee of the Township of Wellesley, the Regional Municipality of Waterloo or a local board while engaged in authorized duties; (Ill) by any persons engaged in a bona fide rescue or emergency operation under the direction of or with the authority of the Regional Police Force or the Ontario Provincial Police or the Township of Wellesley; (IV) by any persons involved in a special event duly authorized and sanctioned by the Township of Wellesley or a local board thereof. 9. Every person who contravenes any provision of this by-law: (I) is guilty of an offence, and (II) upon conviction thereof is liable to a fine or penalty of not more than (III) $5,000.00 as prescribed in the Provincial Offenses Act, R.S.O. 1990, Chapter P.33. 10. By-Law No. 3022 and any By-law inconsistent with the provisions of this By-law are hereby rescinded . READ a first and second time this 17th day of September, 1996.
