BY-LAW 2019/60
BEING A BY-LAW TO REGULATE TRAFFIC AND PARKING
IN THE MUNICIPALITY OF WEST NIPISSING
WHEREAS Section 11 (2) of the Municipal Act, S.O. 2001, c. 25, as amended from time to time, provides
for a Municipality to pass by-laws respecting the following matters:

Protection of persons and property, including consumer protection.
AND WHEREAS Section 11 (3) of the Municipal Act, S.O. 2001, c. 25, provides for a Municipality to pass
by-laws respecting matters within the following spheres of jurisdiction;
1.
Highways, including parking and traffic on highways
2.
Transportation systems, other than highways
8.
Parking, except on highways
AND WHEREAS Section 102 (2) of the Municipal Act, S.O. 2001, c. 25, provides that a local municipality
may require the owners or operators of parking lots or other parking facilities to which the public has
access, whether on payment of a fee or otherwise, to provide designated parking spaces for vehicles
displaying an accessible (disabled) parking permit and if it does so, the Municipality shall prescribe the
conditions of use of the accessible (disabled) parking permit and shall prohibit the improper use of the
disabled permit;
AND WHEREAS Section 102 (3) of the Municipal Act, S.O. 2001, c. 25, states that a by-law passed in
accordance with subsection (2) may provide for the removal and impounding of any vehicle, at its owner's
expense, parked or left contrary to the by-law;
AND WHEREAS Section 425 (1) of the Municipal Act, S.O. 2001, c. 25, authorizes a Municipality may pass
by-laws providing that a person who contravenes a by-law of the municipality passed under this Act is
guilty of an offence;
AND WHEREAS Section 427 of the Municipal Act S.O. 2001, c. 25 provides for a by-law establishing a
system of accessible (disabled) parking shall provide that every person who contravenes the by-law
accessible (disabled) parking is guilty of an offence and on conviction is liable to a fine of net less than
$300.00;
NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF WEST
NIPISSING ENACTS THAT BY-LAW 2010/26, AS AMENDED, BE REPEALED AND REPLACED AS FOLLOWS:
1.0
DEFINITIONS
The following words and phrases, when used in this by-law shall, for the purposes of this by-law have the
meanings respectively ascribed to them in this section.
a)
Access aisle: means the space between parking spaces that allows persons with disabilities to get
in and out of their vehicles; which shall be a minimum of 1.75 meters wide and marked with high
tonal contrast diagonal lines
b)
Accessible Parking Space: means a parking space or zone marked by a sign or signs indicating that
such space or zone is for the sole use of vehicles displaying a valid permit, in accordance with the
requirements of the Highway Traffic Act and regulations made thereunder and this by-law;
c)
Authorized Emergency Vehicle: includes vehicles of the Fire Department, police vehicles,
ambulance, and any other emergency vehicles of federal, provincial or municipal departments or
of public or private facilities;
d)
Authorized Sign: means any sign or other device placed or erected on a highway under the
authority of this by-law for the purpose of regulating, warning or guiding traffic;
e)
Bus Stop; that portion of the highway designated by authorized sign to or for the use of buses as

space for loading and unloading passengers only;
f)
Boulevard: that part of the highway situated between the roadway and the property lines of the
lots abutting the highway and includes a shoulder but does not include a sidewalk, if any;
g)
By-Law Enforcement Officer: means any person appointed by by-law to enforce the by-laws of
the Municipality of West Nipissing
h)
Commercial Motor Vehicle: means a motor vehicle having permanently attached thereto a truck
or delivery body and includes ambulances, hearses, casket wagons, fire apparatus, buses and
tractors used for hauling purposes on the highways;
i)
Corner: the point of intersection of curbs or edges on the part of the highway used for vehicular
traffic;
j)
Corporation: means the Corporation of the Municipality of West Nipissing;
k)
Council: means the Municipal Council of the Corporation of the Municipality of West Nipissing;
l)
Crosswalk: means,
i)
that part of the highway at an intersection that is included within the connections of the
lateral lines of the sidewalks on opposite sides of the highway measured from curbs or, in
the absence of curbs, from the edges of the roadway, or
ii) any portion of a roadway at an intersection or elsewhere distinctly indicated for
pedestrian crossing by signs or by lines or other markings on the surface;
m)
Disabled Person: means a person who has been issued a permit by the Province of Ontario, or
other jurisdiction.
n)
Driver: every person who drives or is in actual physical control of a vehicle on a highway;
o)
Gross Weight: means the combined weight of vehicle and load;
p)
Heavy Vehicle: means a commercial motor vehicle, having a gross weight of five tons or more;
q)
Handicapped/Disabled/Accessible Parking Space: means a parking space or zone marked by a
sign or signs indicating that such space or zone is for the sole use of vehicles displaying a valid
permit, in accordance with the requirements of the Highway Traffic Act and regulations made
thereunder and this by-law;
r)
Highway: Includes a common and public highway, street, avenue, parkway, lane, alley, driveway,
square, place, bridge, viaduct or trestle, any part of which is intended for, or used by, the general
public for the passage of vehicles and includes the area between the lateral property lines thereof;
s)
Intersection: means the area embraced within the prolongation or connection of the lateral curb
lines, or, if none, then of the lateral boundary lines of two or more highways that join one another
at an angle, whether or not one highway crosses the other;
t)
Motor Vehicle: includes an automobile, a motorcycle, a motor-assisted bicycle unless otherwise
indicated in this Act, and any other vehicle propelled or driven otherwise than by muscular power,
but does not include a street car or other motor vehicle running only upon rails, a power-assisted
bicycle, a motorized snow vehicle, a traction engine, a farm tractor, any animal propelled mode
of transportation or a road-building machine;
u)
Municipality: means the Corporation of the Municipality of West Nipissing;
v)
Municipal or Private Property: means any open area or portion of a structure other than a street
or highway, intended for the temporary parking of vehicles and on which there are designated
parking spaces;
w)
Official Sign: means a sign approved by the Ministry;
x)
One-Way Street: means a highway upon which vehicular traffic is limited to movement in one
direction;
y)
Park or Parking: means the standing of a vehicle, whether occupied or not, except when standing
temporarily for the purpose of and while actually engaged in loading or unloading merchandise
or passenger;
z)
Parking Space: means a portion of the surface of a highway or parking lot designated by suitable

markings, the use of which is controlled and regulated by a parking meter or a parking ticket
dispenser;
aa)
Parking Meter Zones: those highways or parts of highways on which parking, where permitted
on such highways or parts of highways, is controlled and regulated by the use of parking meters;
bb)
Pedestrian: any person afoot, invalids, and children in wheeled carriages;
cc)
Permit: means an accessible parking permit issued by the Minister pursuant to the Highway
Traffic Act and the regulations made thereunder, or a permit, numbered plate or other marker or
device, issued for the same purpose by another jurisdiction and recognized under said Act;
dd)
Person: every natural person, firm, co-partnership, association or corporation;
ee)
Person in Charge of the Marriage Ceremony: any person permitted to solemnize a marriage
ceremony under the Marriage Act R.S.O. 1990, c.M.3, Section 24;
ff)
Police Officer: means any police officer employed by the Ontario Provincial Police ;
gg)
Public Parking Lot: means any open public area or portion of a structure other than a street or
highway, intended for the temporary parking of vehicles and on which there are designated
parking spaces, whether their use involves the payment of a fee or otherwise, which is owned by
or leased to the Municipality;
hh)
Regulations: means the regulations made under the Highway Traffic Act as amended, with
respect to Accessible Parking Permits for Persons with Disabilities.
ii)
Roadway: means the part of the highway that is improved, designed or ordinarily used for
vehicular traffic, but does not include the shoulder and, where a highway includes two or more
separate roadways, the term "roadway" refers to any one roadway separately and not to all the
roadways collectively;
jj)
Sidewalk: means a part or strip of land, paved or otherwise, in, on or alongside a highway and
designed and intended for, or used by the general public for pedestrian travel. "Sidewalk" includes
any structure above or below ground designed or intended for the use of pedestrians even in said
structure
is not wholly or partially above or below a highway;
kk)
Sign: means a sign prescribed by the provisions of the Highway Traffic Act, R.S.O. 1990, c. H.8,
as amended;
ll)
Signal Light Traffic Control System: means a Signal Traffic Control System as described in Section
133 of the Highway Traffic Act, R.S.O. 1990, C.H. 8 as amended from time to time;
mm)
Stop and Stopping: when prohibited, means the halting of a vehicle, even momentarily, whether
occupied or not, except when necessary to avoid conflict with other traffic or in compliance with
the directions of a police officer or of a traffic control device;
nn)
Times; whenever certain hours are named herein, they shall mean standard time or daylight
saving time, whichever shall be in official current use in the municipality;
oo)
Traffic: includes pedestrians, ridden or herded animals, vehicles, buses and other conveyances,
either singly or together while using any highway for the
purpose of travel;
pp)
Traffic Control Device: any sign, signal-light traffic control system, traffic signal, marking or device,
not inconsistent with this by-law, placed or erected by the authority of the Council for the purpose
of regulating, warning or guiding traffic;
qq)
U-Turn: to turn a vehicle within a roadway so as to proceed in the opposite direction to the
direction in which the said vehicle was proceeding immediately prior to the said turn;
rr)
Vehicle: includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine,
bicycle and any vehicle drawn, propelled or driven by any kind of power, including muscular
power, but does not include a motorized snow vehicle or a street car;
ss)
Unauthorized Vehicle: means a motor vehicle that does not have affixed thereto a current permit
identifying the vehicles as one operated by a disabled person or transporting a disabled person.
2.0
AUTHORIZED SIGNS AND TRAFFIC CONTROL DEVICES
2.1.
The Municipality is hereby authorized to place or erect, and to maintain such authorized

signs and traffic control devices as may be necessary to give effect to the provisions of
this by-law or as are required to warn or guide traffic for the safety or convenience of the
public;
2.2.
Unless otherwise permitted herein, no person shall place, maintain or display upon or in
a view of any highway any sign, signal, marking or device which purports to be or is an
imitation of or resembles any authorized sign or traffic control device, or which conceals
from view or interferes with the effectiveness of any authorized signs or traffic control
devices
3.0
PARKING AND STOPPING
3.1.
Method of Parking
(a)
No vehicle shall be parked or stopped on any highway unless on the right side of
the highway, having regard to the direction in which the vehicle has been
proceeding, with the right front and right rear wheels or runners not more than
six inches from the curb or edge of any roadway, but this provision shall not apply
to prevent the parking of a vehicle on the left side of a one-way street, nor to
prevent the angle parking of a vehicle on highways or parts of highways where
angle parking is permitted.
(b)
Where parking is permitted on a one-way street, a person may park a vehicle
facing only in the direction in which it was proceeding and parallel to and distant
not more than sixteen (16) centimeters from the curb or edge of the roadway.
(c)
Where angle parking is permitted, no person shall park a vehicle except at an
angle with the roadway, indicated by appropriate markings or signs, and no
vehicle of an overall length of more than six (6) meters shall be angle-parked.
(d)
Entry to an angle parking space of 45o or less must be made from the right hand
side of the highway, having regard for the direction in which the vehicle has been
travelling. On emerging from an angle parking space of 45o or less, the driver of
any vehicle must proceed in the same forward direction in which it was travelling
on entering the parking space.
4.0
PARKING PROHIBITED
4.1.
In Specified Places: No person shall at any time park a vehicle in any of the following
places:
(a)
On or overhanging a sidewalk;
(b)
On a boulevard;
(c)
Within an intersection;
(d)
On a crosswalk;
(e)
Within 3.5 meters of a fire hydrant;
(f)
Within 9.5 meters of any intersection;
(g)
Within 9.5 meters of a crosswalk or stop sign at an intersection;
(h)
In front of or within 1.5 meters of the entrance to a private driveway or so as to
prevent ingress or egress to or from such driveway;
(i)
In front of or within 3.5 meters of an entrance to or exit from a public lane or
driveway;
(j)
Adjacent to either side or end of any central median that divides any roadway;
(k)
Unless otherwise specified, on any bridge, or in any subway or underpass, or the
approaches thereto;
(l)
In such a position as to prevent the convenient removal of any other vehicle
previously parked;
(m)
In front of the entrance to a hotel, office building, any place where goods or
merchandise are regularly delivered or removed, or opposite the entrance to any
hospital or in front of an entrance to or any emergency exit from any theatre
auditorium or other building when large assemblages are being held in such
theatre auditorium or other building, or for a reasonable time immediately
preceding and following such assemblages;
(n)
On any roadway for a longer period than four (4) consecutive hours;
(o)
On a highway in such a manner as to interfere with the movement or traffic or
the clearing of snow from the highway
(p)
Private property owners wishing enforcement from the By-Law Enforcement
Officer for an area deemed to be an 'emergency exit' or 'emergency vehicle
parking area' shall apply in writing to the Municipality on the form attached
hereto as Schedule "L".

Upon receipt of the prescribed form, the By-Law Enforcement Officer will inspect
the area requiring enforcement to determine if it conforms to the requirements
of this by-
law.
If the property conforms to the requirements of this by-law, the request will be
presented to Council to amend Schedule 'H' of this by-law by adding thereto the
description of the private property requiring enforcement.
4.2.
In Specified Places Where Signs on Display: Where authorized signs to that effect are
displayed, no person shall at any time park any vehicle:
(a)
On any highway within twenty three (23) meters of any intersection or on any
hill;
(b)
On any highway adjacent or opposite to any school property, municipal
playground, municipal park, municipal ballfield or municipal recreation area;
(c)
On any of the parts of the highways named and described in Schedule "A" to this
by-law;
(d)
On any highway within seven (7) meters of any point designated as a bus stop
measured in the direction of travel of buses on that side of the highway or within
nineteen (19) meters of such point measured in the opposite direction;
(e)
On, in or upon any public lane.
4.3.
In Specified Places where Signs on display at Stated Times - Where authorized signs to
that effect are displayed, no person shall park a vehicle on any of the parts of the highways
named and described in Columns 1, 2, 3 and 4 of Schedule "B" to this by-law during the
hours and periods set out in Columns 5 and 6 of the said Schedule.
5.0
PARKING RESTRICTED
5.1.
In Specified Places Where Signs on Display at Stated Times: Where authorized signs to
that effect are displayed, no person shall park a vehicle on any of the parts of the highways
and municipality owned property named and described in Columns 1, 2, 3 and 4 of
Schedule "B i)" to this by-law during hours set out in Column 3 for a longer period than as
set out in Column 3 of the said Schedule.
5.2.
During Night Hours in Winter Months: No person shall park a vehicle on any highway
under the jurisdiction of the municipality, between the hours of twelve o'clock midnight
and seven o'clock in the morning, during the period from the first day of November in one
year, until the last day of March in the next year, except physicians on emergency calls,
operators of authorized emergency vehicles and taxi cabs while on duty and waiting for
fares.
5.3.
Commercial Motor Vehicles except Buses:
(a)
Notwithstanding subsection 5.2 and excepting motor buses, where authorized signs
to that effect are displayed, no commercial motor vehicle or commercial trailer
whether attached to a tractor or not, having a capacity in excess of two tons in
rating as prescribed by relevant Provincial Statutes, shall be parked on any of the
parts of the highways named and described in Schedule "B iii)" to this by-law
between the hours of 9:00 p.m. one day and 7:00 a.m. of the next following day.
(b)
no commercial motor vehicle or commercial trailer whether attached to a tractor
or not, having a capacity in excess of two tons in rating as prescribed by relevant
Provincial Statutes, shall be parked, at any time, on any municipally owned property
where authorizes signs to that effect are displayed.
6.0
ANGLE PARKING
6.1.
Angle parking in accordance with the provisions in Section 3.1.3 and 3.1.4 hereof is
permitted on the parts of the highways named and described in Columns 1, 2, 3 and 4 of
Schedule "B iii)" to this by-law at the angle to the roadway set out in Section 3.1.4 of this
by-law.
7.0
STOPPING PROHIBITED
7.1.
In Specified Places Where Signs on Display: Where authorized signs to that effect are
displayed, no person shall stop a vehicle at any time on any of the parts of the highways
named and described in Schedule "B iv)" to this by-law.

7.2.
Exceptions: The Provisions of this section shall not apply:
(a)
to a postal vehicle while actually engaged in loading mail from a postal box;
(b)
to a vehicle engaged for the transportation of money for commercial
establishments while engaged in delivering or picking up money or valuables;
(c)
to a vehicle, the crew of which is engaged in making emergency repairs to a public
utility or to any public service
8.0
LOADING ZONES
8.1.
Where authorized signs to that effect are displayed, no person shall park a vehicle
between the hours of 9:00 a.m. and 6:00 p.m. of any day except Sundays and holidays on
any of the parts of the highway named and described in Schedule "B viii)" to this by-law,
except for the loading or unloading of merchandise by commercial motor vehicles
providing that such loading and unloading shall not exceed thirty minutes.
9.0
PARKING PROHIBITED FOR SPECIFIC PURPOSE
9.1.
No person shall stop or park a vehicle upon any highway of any Municipal property for
the purpose of:
(a)
Displaying it for sale;
(b)
Storing it;
(c)
Washing, servicing, painting or repairing it, except where such repairing is
necessary for the removal of the vehicle from the highway;
10.0
PARKING DURING FUNERALS AND MARRIAGES
10.1.
Funerals:
(a)
During a period commencing sixty minutes in advance of the scheduled time of
any funeral service and ending immediately following the completion of the said
funeral service, operators of funeral parlours are hereby authorized to place "NO
PARKING" signs on portable bases along a maximum length of thirty eight (38)
meters of curb space to indicate that a funeral is being held at a location adjacent
to the parking area concerned and that parking is temporarily prohibited.
(b)
Where "NO PARKING" signs of the type mentioned in subsection (a) above are
displayed, no person shall park a vehicle at any of the parking meters concerned
or along the curb space concerned, as the case may be, unless permitted to do so
by the operator of the funeral home who has placed the said signs.
(c)
The said "NO PARKING" signs shall be removed by the operator of the funeral
home who has placed the said signs, immediately following the completion of the
funeral service.
10.2.
Marriage Ceremonies
(a)
During a period commencing sixty minutes in advance of the scheduled time of
any marriage ceremony and ending immediately following the completion of the
said marriage ceremony, the person in charge of the marriage ceremony is
hereby authorized to place "NO PARKING" signs on portable bases along a
maximum length of thirty eight (38) meters of curb space to indicate that a
marriage ceremony is being held at a location adjacent to the parking area
concerned and that parking is temporarily prohibited.
(b)
Where "NO PARKING" signs of the type mentioned in sub-section (a) above are
displayed, no person shall park a vehicle along the curb space concerned, unless
permitted to do so by the person in charge of the marriage ceremony.
(c)
The said "NO PARKING" signs shall be removed by the person in charge of the
marriage ceremony immediately following the completion of the marriage
ceremony.
11.0
EMERGENCY PROHIBITION OF PARKING
11.1.
Notwithstanding anything to the contrary contained herein, the By-Law Enforcement
Officer of the Municipality during any emergency or special circumstances deemed
sufficient therefore, may suspend any or all parking on any highway within the area
affected by these special circumstances, by authorizing the erection of "NO PARKING"
signs, and the Police Officer or the By-Law Enforcement Officer as the case may be during
such emergency, may declare that any vehicle already parked is being parked illegally
regardless of the time permitted for parking such vehicle under the provisions of this by-
law provided, however, that in this event the owner or driver of such vehicle is personally

notified by a police officer that parking at such place has been suspended, and further,
that the owner or driver of such vehicle is allowed a reasonable period of time to remove
the said vehicle.
12.0
ACCESSIBLE PARKING FOR PERSONS WITH DISABILITIES - GENERAL PROVISIONS
12.1
An accessible parking permit shall be displayed on the sun visor or on the dashboard of a
vehicle (driver's side) so that the international symbol of access for persons with a
disability, the permit number and the expiry date of the permit are clearly visible from
the outside of the vehicle.
12.2.
(a)
Any person who is qualified and holds a valid accessible parking permit may park
at any parking space in the Municipality of West Nipissing for up to two (2) hours,
in downtown spaces only.
(b)
Subsection 12.2 (a) shall not apply to accessible parking for employees at the
workplace or for parking at a special event.
12.3.
A sign marking an accessible parking space shall display the prescribed form of signage in
accordance with the Highway Traffic Act and all regulations made thereunder. Upon the
erection of such a sign, the parking space marked by said sign shall be deemed to be an
accessible parking space.
(a)
Private property owners wishing enforcement for an area deemed to be
'accessible parking space' shall apply in writing to the Municipality on the form
attached hereto as Schedule "L".
(b)
Upon receipt of the prescribed form, an inspection of the area requiring
enforcement will be carried out to determine if it conforms to the requirements
of this by-law.
(c)
If the property conforms to the requirements of this by-law, the request will be
presented to Council to amend Schedule 'H' of this by-law by adding thereto the
description of the private property requiring enforcement.
12.4.
Each and every designated accessible parking space shall:
(a)
be distinctly indicated by erecting an accessible parking permit sign which is in a
form and content as prescribed by the Highway Traffic Act and regulations made
thereunder;
(b)
have the sign prescribed in Subsection 12.4 (a) of this By-law installed in a
permanent manner at the designated accessible parking space;
(c)
have the sign prescribed in Subsection 12.4 (a) of this By-law mounted so that the
bottom edge of the sign shall be not less than 1.5 metres or more than 2.5 metres
above ground level;
12.5.
New construction or redevelopment of a designated accessible parking space shall be
generally in accord with the following criteria:
(a)
have a minimum length of 6 meters and a minimum width of 3.5 metres with an
adjacent access aisle of not less than 1.75 metres in width; which may be shared
by two (2) parking spaces;
(b)
be hard surfaced;
(c)
be level;
(d)
where practical, be placed so that sidewalks will be accessible to physically
disabled persons whether via ramps, depressed curbs, or other appropriate
means;
(e)
be placed with sufficient clearance around the vehicle to permit ingress and
egress in relation to other vehicles or obstacles such as light standards or waste
receptacles;
(f)
be kept clear of all accumulations of ice, snow or other material which could
render the parking space unusable.
13.0
OFFENCE (ACCESSIBLE PARKING FOR PERSONS WITH DISABILITIES)
13.1.
No person shall use an accessible parking space designated by a sign unless the vehicle
displays a valid accessible parking permit in accordance with this by-law.
14.0
ENFORCEMENT (ACCESSIBLE PARKING FOR PERSONS WITH DISABILITIES)
14.1.
The By-Law Enforcement Officer upon the discovery of a vehicle parked or left in
contravention of this By-law may cause the vehicle to be moved or taken to and placed
or stored in a suitable place, and all costs and charges for removing, care and storage

thereof, if any, are a lien.
14.2.
Enforcement of this by-law will only be for those properties described in Schedule 'H'
hereto.
15.0
PENALTY (ACCESSIBLE PARKING FOR PERSONS WITH DISABILITIES)
15.1.
The driver of a motor vehicle, not being the owner, is liable to any penalty provided under
this By-law, and the owner of the motor vehicle is also liable to such penalty unless, at
the time of the offence, the motor vehicle was in the possession of a person other than
the owner or his chauffeur, without the consent of the owner.
15.2.
Notwithstanding all other provisions of this By-law, any person may, within fifteen (15
days) upon presentation to the Municipality, at 225 Holditch Street, in Sturgeon Falls, of
a Certificate of Parking Infraction, pay to the Municipality, within fifteen (15) days from
the date of such Certificate of Parking Infraction, exclusive of Saturdays, Sundays and
Statutory Holidays, the sum of Three Hundred ($300.00) dollars, and upon payment of
the said sum, no further proceedings shall be taken under this By-law.
15.3.
If the payment is not made as provided in Section 15.2 of this By-law, the penalty provided
for in Section 15.4 shall apply.
15.4.
Any person who contravenes any of the provisions of this by-law is guilty of an offence
and on conviction is liable to a penalty not to exceed $5,000.00 as prescribed by the
Provincial Offences Act, R.S.O. 1990, c.P. 33, as amended.
15.5.
The Order of the Regional Senior Justice, Ontario Court of Justice, and attached hereto as
Schedule 'K', shall for all purposes form a part of this By-law.
16.0
OPERATION OF VEHICLES - TRAFFIC CONTROL
16.1.
No vehicle shall be driven through or enter upon any highway roped or barricaded or
marked by words or writing prohibiting its use for the time needed to repair or for any
other reason.
16.2.
No person shall stand, sit or ride on or in any portion of a vehicle not designed for carrying
passengers or merchandise, and no vehicle shall be operated while any person is standing,
sitting or riding on vehicle.
16.3.
No person shall reverse a vehicle into an intersection or over a crosswalk and shall not in
any event or at any place, reverse a vehicle unless such movement can be done in safety.
16.4.
No person shall drive a motor vehicle over a curb except at a place where a ramp has been
provided.
16.5.
No person shall drive a vehicle over any unprotected fire hose extended for firefighting
purposes.
16.6.
No person shall stop a vehicle on or obstruct a crosswalk or intersection.
16.7.
No person shall operate a vehicle so as to strike the rear of another vehicle in front of
such person.
17.0
EMERGING FROM LANE OF DRIVEWAY
17.1.
No person operating a vehicle so as to emerge from a lane, approach, driveway, lot or
building, shall proceed unless such person stops the vehicle immediately before entering
any part of a street and yields the right of way to pedestrians and to such other traffic as
may be necessary to avoid collisions.
18.0
VEHICLES ON SIDEWALK
18.1.
No vehicle shall be driven on a sidewalk except on a permanent or temporary driveway,
and except for the purpose of directly crossing such sidewalk. Public Utility vehicles used
for maintaining sidewalks are exempt from this section.
19.0
COASTING
19.1.
Coasting, whether on sleighs, carts or express wagons and tobogganing are prohibited on
all highways. No person upon roller skates or riding in or by means of a coaster, toy
vehicle or similar device shall go upon a roadway except while crossing a highway on a
crosswalk.

20.0
BOARDING AND ALIGHTING FROM VEHICLES
20.1.
No person shall board or alight from any vehicle while such vehicle is in motion.
21.0
EXCESS LOADS
21.1.
No person shall move or cause to be moved on any highway within the municipality any
heavy vehicles, load, object, or structure in excess of the limits prescribed by Section 109
or Part VIII of the Highway Traffic Act, R.S.O. 1990 Chapter H.8 unless he shall first have
obtained a permit under this section so to do.
21.2.
The By-Law Enforcement Officer is hereby appointed and authorized to issue on behalf of
the Corporation, permits as prescribed under Section 110 of the Highway Traffic Act,
R.S.O. 1990, Chapter H.8 with full power and authority to grant or refuse any such permit
and to attach such terms and conditions to the permit as may be attached by virtue of
the said section 110 and any amendments thereto from time to time.
21.3.
The provisions of Part VIII of the Highway Traffic Act, R.S.O. 1990, Chapter H.8 are hereby
declared to be in force with respect of all highways within the municipality except on the
parts of the highways named and described in Column 1 of Schedule "B v)" to this by-law.
22.0
LINES PAINTED ON ROADWAY
22.1.
No person shall drive or attempt to drive on or over, or tamper with or walk on any newly
painted lines or series of lines, or any newly painted signs on any roadway or crosswalk,
when the presence of such is indicated by markers on lighted lanterns.
23.0
TURNS
23.1.
Where a U-turn is not otherwise prohibited under this by-law such a turn shall be made
only where it can be made in safety and without interfering with other traffic.
23.2.
Where authorized signs to that effect are displayed, no person operating a vehicle shall
make a U-turn at any intersection named and described in Schedule "B vi)" to this by-law.
23.3.
Where authorized signs to that effect are displayed, no person operating a vehicle on the
highways named in Column 1 of Schedule "B viii)" to this by-law, in the Direction of Travel
indicated in Column 2 of the said Schedule shall make a left turn as indicated in Column 3
during the hours indicated in column 4 of the said Schedule "B vii)".
24.0
ONE-WAY STREETS
24.1.
The highways set out in Column 1 of Schedule "C i)" to this by-law between the limits set
out in Column 2 and Column 3 of the said Schedule are at the times or days set out in
Column 5 of said Schedule hereby designated for one-way traffic only in the direction set
out in Column 6 of the said Schedule.
25.0
THROUGH HIGHWAYS
25.1.
The parts of the highways named and described in Schedule "C ii)" to this by-law are
designated as "Through Highways" as defined in Section 1 of the Highway Traffic Act,
R.S.O. 1190, Chapter H.8.
26.0
STOPS AT INTERSECTIONS
26.1.
The intersections of highways set out in Column 1 of Schedule "D" to this by-law are
designated as intersections where stop signs shall be erected facing oncoming traffic
travelling in the direction of travel and on the highways shown in Column 2 of the said
Schedule.
26.2.
All stop signs within the Ministry of Transport road allowances are not the responsibility
of the Municipality of West Nipissing.
27.0
YIELD RIGHT-OF-WAY SIGNS
27.1.
The parts of the highways named and described in Schedule "E i)" to this by-law are
designated as intersections where yield signs shall be erected facing oncoming traffic
travelling in the direction of travel and on the highways indicated in Column 2 of the said
Schedule "E i)".

28.0
TRUCK ROUTES
28.1.
The parts of the highways named and described in Schedule "E ii)" to this by-law are
hereby designated as "Truck Routes".
28.2.
No heavy vehicle shall be operated on any highway within the municipality other than on
the parts of the highways set out in Schedule "E ii)" hereof, provided however;
(a)
That any commercial motor vehicle may be operated on any highway in the
municipality for the purpose of delivering or receiving, loading or unloading
goods, wares, merchandise or materials or in proceeding to or from a garage or
other premises for the housing or repair of such motor vehicles and provided
that:
(i)
Such deviation shall be made at a point on one of the said truck routes
nearest by road to where the service is performed, and
(ii)
On completion of the conduct of business such vehicle shall return by the
shortest route to the nearest truck route.
28.3.
The provisions of subsection 28.2 of this section shall not apply to vehicles owned by the
Corporation or to emergency vehicles, or to vehicles of a public transit system.
29.0
DESIGNATED TRAFFIC LANES
29.1.
Where the highways listed in Column 1 of Schedule "E iii)" to this by-law have been
divided into clearly marked lanes for traffic between the limits of the said highways
indicated in Column 2, each of the lanes indicated in column 3, is, during the days or times
indicated in Column 4, designated for traffic moving in the direction or directions
indicated in Column 5 therein.
30.0
PROHIBITED RIGHT TURNS ON RED LIGHT
30.1.
Notwithstanding Subsection 19 of Section 144 of the Highway Traffic Act, Chapter H.8,
where authorized signs to that effect are displayed at a signalized intersection, the driver
or operator of a vehicle traveling on the highway and in the direction of travel named and
described in Column 1 of Schedule "E iv)" to this by-law shall not turn right on a red signal
light on to the highway and in the direction of travel named and described in Column 2 of
the said Schedule "E iv)".
31.0
PRESCRIBED RATES OF SPEED
31.1.
Where authorized signs to that effect, are displayed, the maximum rate of speed on any
of the highways named and described in Columns 1, 2, 3 of Schedule "F" to this by-law
shall be the rate of speed prescribed in column 4 of the said Schedule "F".
32.0
PENALTIES (PARKING AND STOPPING)
32.1.
Parking/Stopping Violations Generally:
Unless specified otherwise in this by-law, any person violating the provision of Section 3
of this by-law shall with the exception of Section 2, be subject to a minimum fine of $25.00
exclusive of costs, as follows: General Parking / Stopping Violations $25.00, reduced to
$15.00 if paid within seven (7) days. Penalties imposed under 32.1 shall be recoverable
under Schedule "J" - Part II Section 16 of the Provincial Offences Act.
32.2.
Other Violations:
Any person violating the provisions of this by-law with the exception of the provisions of
Section 3 hereof, shall be subject to a penalty of not less than $25.00 and not more than
$100.00 exclusive of costs, and such penalty shall be recoverable under Schedule "I" - Part
I Section 16 of the Provincial Offences Act
33.0
VOLUNTARY PAYMENT OF PENALTIES
33.1.
When a vehicle is found parked or stopped in contravention of the parking or stopping
provisions of this by-law, the police officer so finding the vehicle may issue a certificate of
parking infraction and /or attach to the vehicle a parking ticket in the form of a serially
numbered notice, stating:
(a)
The license number and/or permit of the vehicle;
(b)
The date, time and place and nature of the alleged offence;

(c)
That the owner or operator thereof may report to the municipal office, within five
days, exclusive of Sundays and Holidays, after the day of the alleged offence to
make a voluntary payment of the penalty, which voluntary payment shall not be
less than the minimum prescribed amount set out in Section 32 of this by-law.
(d)
That, in the event of the failure to so report and make such payment, a notice of
impending conviction will be issued pursuant to the Summary Convictions Act.
33.2.
The owner or operator of the vehicle may, within five days, exclusive of Sundays and
Holidays, after the day of the alleged offence, report to the minimum amount prescribed
in Section 32 aforementioned, which shall be accepted as payment of a penalty in full
satisfaction in respect of the alleged offence, and a receipt thereof shall be given to the
person making the payment.
33.3.
A record shall be kept by the By-Law Enforcement Officer or his designate, in a special
book, of the names and addresses of persons making such voluntary payments, and of
the time when payments are made. A receipt for each such payment shall be made out
in duplicate, the original delivered to the person making the voluntary payment and the
copy retained by the Municipality.
33.4.
At least once a week, the By-Law Enforcement Officer shall turn over to the Treasurer of
the Municipality, all monies collected under this Section by him or his nominee.
33.5.
If a voluntary payment is not made in accordance with the procedure provided in
Subsection 33.3 of this Section, the procedure of the Provincial Offences Act shall apply.
34.0
ONTARIO HIGHWAY TRAFFIC ACT TO GOVERN
34.1.
The provisions of this by-law shall be subject to the provisions of the Highway Traffic Act,
R.S.O. 1990, Chapter H.8, as amended, and to any regulations made thereunder and any
reference in this by-law to the said Traffic Act or any provision thereof shall be deemed
to be a reference to the said Highway Traffic Act or provisions thereof as amended or re-
enacted from time to time.
35.0
ADMININISTRATION
35.1.
A police officer employed by OPP has the authority to enforce any provision of this by-
law and a By-Law Enforcement Officer has the authority to enforce any parking and
stopping provision of this by-law.
36.0
SCHEDULES
36.1.
All Schedules referred to herein and attached hereto, are hereby made a part of this by-
law and shall be construed herewith.
37.0
REPEALS
37.1.
That By-laws 2015/62, 2016/18, 2017/67, 2018/02, 2018/15, 2018/74, 2018/89,
2019/39, 2019/49 as amended be repealed.
