The Corporation of the Municipality of West Perth
By-law 52-2021
Being a By-law to amend By-law 19-2015 to regulate the parking or stopping of
vehicles on highways within the Municipality of West Perth
WHEREAS Section 8 of the Municipal Act provides that the powers of a municipality
under this or any other Act shall be interpreted broadly so as to confer broad authority on
municipalities to enable them to govern their affairs as they consider appropriate and to
enhance their ability to respond to municipal issues;
AND WHEREAS Section 9 of the Act provides a municipality has the capacity, rights,
powers and privileges of a natural person for the purpose of exercising its authority under
the Act or under any other Act;
WHEREAS Section 100 of the Municipal Act permits a municipality to pass by-laws for
the regulating of unauthorized parking of motor vehicles on certain designated private
property in the Municipality;
AND WHEREAS Section 102 of the Municipal Act permits a municipality to pass a by-
law for the regulating of accessible parking in accordance with the Highway Traffic Act
and the regulations made under it 2009, c. 33, Schedule. 26, s. 5(1);
AND WHEREAS the provisions of this by-law shall be subject to the provisions of the
Highway Traffic Act, R.S.O., 1990, Chapter H. 8 and amendments thereto;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of West
Perth enacts as follows:
1. That Bylaw 19-2015 be amended as follows:
a. Part 1 DEFINITIONS Section 1 is hereby amended to include:
Electric Vehicle
(i)
A battery electric vehicle that runs only on a battery and an
electric drive train; or
(ii)
A plug-in hybrid electric vehicle that runs on a battery and an
electric drive train, and also uses an internal combustion
engine.
Electric Vehicle Charging Station means a publicly or privately-owned
parking space that provides access to equipment that supplies a source of
electricity for charging electric vehicles.
b. Part 3 GENERAL OFFENCES Section 10 is hereby amended to include:
e) Electric Vehicle Designated Parking Spots
When authorized signs have been erected and are on display, as described
in Schedule 'L' attached hereto and forming part of this By-law, no Person
shall park a Vehicle in an Electric Vehicle designated parking spot unless
the Vehicle is an Electric Vehicle and the Electric Vehicle is attached to the
Electric Vehicle Charging Station.
Areas designated as Electric Vehicle designated parking spots as described
in Schedule 'L' attached hereto and forming part of this By-law.
c. That Part 2 Offences Schedule 'K' of By-law 19-2015 is hereby deleted in
its entirety and replaced with Schedule 'K' attached to this By-law.
d. That Schedule 'L' attached to this By-law shall be attached and form part of
By-law 19-2015.
3. That this By-law shall come into full force and effect on the date of its passing.
