## BY-LAW NUMBER 85-12 OF THE CORPORATION OF THE VILLAGE OF WESTPORT
BEING a by-law to require the licensing and regulation of
## dogs.
WHEREAS by Sections 2, 3 and 4 of the Dog Licensing and : Livestock Act, Chapter 123 R.S.O. 1980 a municipality may pass by-laws for requiring the licensing of dogs and kennels and for prohibiting or regulating the running at large of dogs.
NOW THEREFORE the Corporation of the Village of Westport (hereinafter called "The Corporation") enacts as follows:
1. By-law No. 444 of the Corporation is hereby repealed;
2. In this By-law "owner" includes any person in possession of a dog whether such person is, or is not, the owner thereof;
3. (a) apply to the Village Clerk for a dog license, valid until the 1st day of April in the subsequent year, and
3. The owner of a dog, whether male of female, shall on of before the list. day of April in each year, or as soon thereafter as such dog shall attain the age of two months,
5. pay the following fees therefor;

7. (ii) For each additional male dog belonging to the same
8. For a male dog $3.00
9. person $ 5.00
10. (iii) For an unspayed female dog $5.00
11. (iv) For each additional unspayed female dog belonging to the same person $ 7.00
12. (v)
13. For a spayed female dog $ 3.00
14. For each additional female dog belonging to the
15. (vi) same person $5.00
16. (b) affix and keep affixed to the dog by a collar the tag provided by the Clerk until such time as the tag is replaced.
4. The Clerk shall license all female dogs as unspayed unless the owner thereof produces to him a Veterinarian's Certificate or letter confirming that such dog has been spayed;
5. Notwithstanding the foregoing the owner of a kennel of purebred dogs may, on or before the first day ofAprilin each year, and upon production to the Clerk of the Corporation of a Certificate from the keeper of the Canadian Kennel Club register or a certified copy of the register, establishing that all of the dogs in the kennel are registered with the Canadian Kennel Club, and upon payment of a fee of $25.00 in lieu of the registration and licensing provided above receive a special kennel license to expire on the first day ofAprilin the subsequent year and the appropriate number of tags;
6. No person shall knowingly provide to the Clerk, upon application for any license, false information;
7. No owner of a dog shall permit such dog to cause a nuisance by unnecessarily making noise;
8. Any dog known to be rabid shall be immediately destroyed by the owner or his agent;
4. No owner of any female dog shall suffer or permit the same to run at large while in heat;
5. For the purposes of this By-law a dog shall be deemed to be running at large when found in a place other than the premises of the owner while not under the control of the owner:
11. No person shall permit his dog to run at large in the Village of Westport and any dog found running at large shall be liable:to be seized and, in addition to the penalties herein provided, and after a third offense, disposed of as hereinafter provided; 12. Any person may seize any dog running at large and shall deliver the same to the By-law Enforcement Officer to be disposed of .
7. as herein provided;
8. Any person who contravenes the provisions of this By-law shall be guilty of an offense and shall, upon conviction thereof be subject to a fine not exceeding the sum of $50.00 exclusive of costs and, in addition, the Court may order the owner of the dog to surrender the same to a Police Constable, the By-law Enforcement Officer, or other duly authorized person in order that it may be destroyed;
(b) Any person who refuses or neglects to deliver a dog to the proper authority within 24 hours of the issuance of such Order shall be liable to a penalty of $50.00 per day for each day he fails to comply with the Order, in addition to any other penalties applicable.
The Provincial Offenses Act, Chapter 400 R.S.O. 1980, as amended, applies to prosecutions under this By-law.
