THE CORPORATION OF THE TOWN OF WHITCHURCH-STOUFFVILLE
BY-LAW NUMBER 2008-114-PR
BEING A BY-LAW to govern and control the parking
of vehicles in the Town of Whitchurch-Stouffville.
WHEREAS the Municipal Act 2001, S.O., 2001, c.25, section 11 (1) authorizes a
municipality to pass by-laws prohibiting or regulating parking and traffic on highways and
on properties other than highways; and
WHEREAS sections 100 through 101 of the Municipal Act 2001, authorizes a
municipality to pass by-laws for prohibiting unauthorized parking on private or municipal
property; and
WHEREAS section 102 of the said Municipal Act 2001, authorizes a municipality to pass
by-laws requiring the owners or operators of parking lots or other parking facilities to
which the public has access, to provide designated parking spaces for the sole use of
vehicles operated by or carrying a disabled person; and
WHEREAS the Municipal Act 2001 provides that fines may be charged for breaches of
by-laws passed pursuant to the powers set out therein and further provides for the
removal, impounding or restraining or immobilizing of any vehicle parked on a highway
or on municipal property in contravention of a by-law or of the Highway Traffic Act.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
WHITCHURCH-STOUFFVILLE ENACTS AS FOLLOWS:
1. DEFINITIONS
In this By-law:
(a)
"Administrative Monetary Penalty System By-law" means By-law 2024-039-RE
of the Town, as amended from time to time or any successor thereof:
(b)
"Authorized sign" means any sign, or marking on a roadway, or curb or sidewalk,
or other device placed or erected on a highway under the authority of this By-law
for the purpose of regulating, warning or guiding traffic;
(c)
"Bicycle" includes a tricycle and unicycle but does not include a motor assisted
bicycle;
(d)
"Boulevard" means that portion of the highway located between the edge of the
roadway and the limit of the highway, and without limiting the foregoing, may
include a dirt, grassed, graveled or paved area and ditches;
(e)
"Commercial Motor Vehicle" means a motor vehicle having attached thereto a
truck or delivery body and includes ambulances, hearses, casket wagons, fire
apparatus, trailers, tow trucks, recreational vehicles, buses and school buses, and
tractors used for hauling purposes on a highway;
(f)
"Crosswalk" means:
(i)
that part of a highway at an intersection that is included within the
connections of the lateral lines of the sidewalks on opposite sides of the
highway measured from the curbs or, in the absence of curbs, from the
edges of the roadway, or
(ii)
any portion of a roadway at an intersection or elsewhere distinctly indicated
for pedestrian crossing by designs or by lines or other markings on the
surface;

(g)
"Designated" accessible parking space" means a parking space marked by a sign
indicating that such space is to be for the sole use of a vehicle operated by or
carrying a disabled person;
(h)
"Disabled person" shall mean a person who is temporarily or permanently
confined to a wheelchair, or who is restricted to the use of crutches or braces, or
otherwise is disabled in such a way that his or her mobility is seriously restricted,
such disability being confirmed by a general practitioner or other qualified
physician;
(i)
"Highway" includes a common and public highway, street, avenue, parkway,
driveway, square, place, bridge, viaduct or trestle, designed and intended for, or
used by, the general public for the passage of vehicles, and includes the area
between the lateral property lines thereof;
(j)
"Intersection" means the area embraced within the prolongation or connection of
the lateral curb lines or, if none, then of the lateral boundary lines or two or more
highways that join one another at an angle, whether or not one highway crosses
the other;
(k)
"Motor vehicle" includes an automobile, motorcycle, motor assisted bicycle unless
otherwise indicated in the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended,
and any other vehicle propelled or driven otherwise than by muscular power, but
does not include a street car, or other motor vehicles running only upon rails, or a
motorized snow vehicle, traction engine, farm tractor, self-propelled implement of
husbandry or road-building machine within the meaning of the Highway Traffic Act,
R.S.O. 1990, c. H.8, as amended;
(l)
"Municipal Law Enforcement Officer" means a person appointed by By-law to
enforce the Town's By-laws;
(m)
"Occupant" means:
(i)
the tenant or private property or part thereof whose consent to permit
parking on private property shall extend only to the control of the land or
part thereof which he is the tenant and any parking spaces allotted to him
under his lease or tenancy agreement;
(ii)
the spouse or same sex partner of a tenant;
(iii)
a person, a municipality or a local board thereof, having an interest in the
property under an easement or right-of-way granted to or expropriated by
the person, municipality or local board whose consent to permit parking on
private property shall extend only to that part of the property that is subject
to the easement or right-of-way;
(iv)
a person authorized in writing by an occupant as defined in clauses (i), (ii)
or (iii) of this section to act on the occupant's behalf for requesting the
enforcement of this by-law;
(n)
"Official sign" means an authorized sign approved by the Ministry of
Transportation of Ontario;
(o)
"O. Reg. 333/07" means Ontario Regulation 333/07, made under the Municipal
Act, 2001, S.O. 2001, c.25 as amended from time to time or any successor thereof:
(p)
"Owner" when used in relation to property means:
(i)
the registered owner of the property
(ii)
the registered owner of a condominium unit whose consent shall extend
only to the control of the unit of which he is the owner and to any parking

spaces allotted to him by the Condominium Corporation, or reserved for his
exclusive use in the declaration or description of the property;
(iii)
the spouse or same sex partner of the person described in clauses (i) or (ii)
of this section;
(iv)
where the property is included in a description registered under the
Condominium Act, the board of directors of the condominium corporation;
(v)
a person authorized in writing by the property owner as defined in clauses
(i), (ii), (iii) or (iv) of this section to act on the owner's behalf for requesting
the enforcement of this by-law;
(q)
"Park or Parking", when prohibited, means the standing of a vehicle, whether
occupied or not, except when standing temporarily for the purpose of and while
actually engaged in loading or unloading merchandise or passengers;
(r)
"Parking Infraction Notice" means a notice authorized by the Provincial Offences
Act and placed on any vehicle parked in contravention of this By-law;
(s)
"Pedestrian" includes a disabled person in a wheelchair and a child in a baby
carriage;
(t)
"Pedestrian Crossover" means any portion of a roadway designated by By-law
of the Municipality, at an intersection or elsewhere, distinctly indicated for
pedestrian crossing by signs on the highway and lines or other markings on the
surface of the roadway as prescribed by the regulations;
(u)
"Private Property" means any property that is not municipal property;
(v)
"Private Roadway" means any private road, private driveway, lane, ramp or other
means of vehicular access to or egress from a property, building or structure, and
it may include part of a parking lot;
(w)
"Police Officer" means a member of York Regional Police or the Ontario
Provincial Police Force;
(x)
"Roadway" means the part of the highway that is improved, designed or ordinarily
used for vehicular traffic, but does not include the shoulder, and, where a highway
includes two or more separate roadways, the term "roadway" refers to any one
roadway separately and not to all of the roadways collectively;
(y)
"Schedule" means a schedule referred to in this by-law and forming part of this
by-law;
(z)
"School Crosswalk" means a crosswalk marked by authorized signs designating
it as a school crossing location;
(aa)
"Sidewalk" means that part of a highway not being part of the roadway that has
been improved by paving or other means for pedestrian traffic;
(bb)
"Stand" or "Standing", when prohibited, means the halting of a vehicle whether
occupied or not, except for the purpose of and while actually engaged in receiving
or discharging passengers;
(cc)
"Stop" or "Stopping", when prohibited, means the halting of a vehicle, even
momentarily, whether occupied or not, except when necessary to avoid conflict
with other traffic or in compliance with the directions of a constable or other police
officer or of a traffic control sign or signal;
(dd)
"Town" shall mean The Corporation of the Town of Whitchurch-Stouffville;

(ee)
"Unauthorized Area" means a Front Yard, Exterior Side Yard, or Side Yard except
as otherwise permitted under the Town`s Comprehensive Zoning By-Law.
(ff)
"Vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-
building machine and any vehicle drawn, propelled or driven, by any kind of power,
including muscular power, but does not include a motorized snow vehicle or a
streetcar.
2. APPLICATION AND GENERAL REQUIREMENTS
(a)
This by-law applies to all highways and properties under the jurisdiction of The
Corporation of the Town of Whitchurch-Stouffville;
(b)
The Schedules referred to in this by-law shall form part of this By-law and each
entry in a column of such a Schedule shall be read in conjunction with the entry or
entries across therefrom and not otherwise;
(c)
Where any expression of time occurs or where any hour or other period of time is
stated in this By-law or on a sign erected pursuant to this By-law, the time referred
to shall be Standard Time, except in periods when Daylight Saving Time is in effect,
in which periods it shall be Daylight Saving Time;
(d)
The provisions of this By-law shall not apply to any vehicle owned by the Town,
Ambulances, Police, Fire Department vehicles, vehicles owned by other public
authorities and any other vehicle while actually engaged in performing works for
the Town;
(e)
No person shall place, maintain or display upon or in view of any highway, any
sign, signal, marking or device which purports to be or is in imitation of or
resembles an authorized sign or which conceals from view or interferes with the
effectiveness of an authorized sign.
3. METHOD OF PARKING - PARALLEL - TWO WAY TRAFFC
(a)
No person shall park or stop any vehicle on any highway or portion thereof except
as follows:
(i)
Where there is a raised curb, on the right side of the roadway, with the right
front and rear wheels having regard to the direction in which such vehicle
was proceeding, parallel to and not more than thirty (30) centimetres out
from such curb;
(ii)
Where there is a rolled curb or no curb, with right front and rear wheels
parallel to and as near to the right limit of the roadway as is practical.
(b)
The provisions of subsection (a) do not apply where parking is permitted or to
parking or stopping a vehicle on the left side of the roadway or a highway
designated for one-way traffic.
4. METHOD OF PARKING - PARALLEL - ONE WAY TRAFFIC
(a)
Where a highway is designated for one way traffic and parking is permitted on the
left side of such highway no person shall park or stop any vehicle on the left side
of the highway or portion thereof except as follows:
(i)
where there is a raised curb, on the roadway with the left front and rear
wheels, having regard to the direction in which such vehicle is proceeding,
parallel to and not more than thirty (30) centimetres out from such curb;
(ii)
where there is a rolled curb or no curb, with the left front and rear wheels
having regard to the direction in which such vehicle was proceeding, parallel
to and as near to the left limit of the roadway as is practical.

5. METHOD OF PARKING - ANGLE
(a)
No person shall stop or park any vehicle on a highway where angle parking is
permitted except:
(i)
in the case of an area clearly marked into parking spaces by lines painted
on the roadway within a parking space so marked so that no part of the
vehicle encroaches on a contiguous parking space;
(ii)
in all other cases where angle parking is permitted.
6. PARKING PROHIBITED IN SPECIFIED PLACES - SIGNS NOT REQUIRED
(a)
No person shall park any vehicle on any highway:
(i)
in front of or within two (2) metres of the intersection of a private roadway,
or within sixty (60) centimetres of a driveway;
(ii)
within three (3) metres of a point on the curb or edge of the roadway nearest
to any fire hydrant;
(iii)
within nine (9) metres of an intersection roadway;
(iv)
within fifteen (15) metres of any level crossing of a railway;
(v)
for a period longer than three (3) hours; except as noted in Schedule III,
Three (3) Hour Parking Exceptions;
(vi)
so as to interfere with the formation of a funeral procession;
(vii)
for the purpose of displaying the vehicle for sale;
(viii)
for the purpose of washing, greasing or repairing the vehicle, except for
such repairs as have been necessitated by an emergency;
(ix)
alongside the tracks of any railway;
(x)
in such a position as will prevent the removal under its power of any other
vehicle;
(xi)
so as to obstruct a crosswalk;
(xii)
so as to obstruct a sidewalk;
(xiii)
so as to interfere with the movement of traffic;
(xiv)
on a highway within one hundred and fifty-two (152) metres or five hundred
(500) ft. of firefighting apparatus where said apparatus is actually engaged
in fighting a fire, or when if directed by a member of the Police or Fire
Department;
(xv)
on a bridge;
(xvi)
on a boulevard; except where the vehicle is parking on a designated access
to private property;
(xvii) so as to interfere with the clearing of snow from the highway.
(xviii) with the front of the vehicle facing opposite to the direction in which
vehicular traffic is proceeding on that side of the street.
(b)
No person shall park a motor vehicle in an unauthorized area.

(c)
No person shall park a Commercial Motor Vehicle on a Highway within a residential
zone.
(d)
Section 6 (c) does not apply to prohibit the Parking or Standing of any such vehicle
upon a Highway in any residential zone while the operator thereof is actually
engaged in the delivery of goods or services to any premises within any such
zones, or to prohibit the Parking or Standing of any bus or School Purpose Vehicle
upon any Highway in any residential zone while the operator thereof is actually
engaged in the embarking or disembarking of passengers in any zone.
7. PARKING PROHIBITED IN SPECIFIED PLACES - WHERE SIGNS ARE ON
DISPLAY
(a)
Where authorized signs are on display indicating that parking is prohibited, no
person shall park any vehicle on any highway, contrary to such signs.
(b)
Notwithstanding the provision for inclusion of designated locations in Schedule II,
where Parking is to be prohibited by signage, the Chief of Police, Fire Chief,
Commissioner of Corporate Services and Town Clerk and/or his/her designate
may have erected "Emergency No Parking" signs in the event of fires,
emergencies, parades, construction, community festivals, large assemblies or
other events provided that wherever possible, such signs shall be erected at least
two hours before the event is scheduled to take place and shall be removed within
a reasonable time after the conclusion of the event.
8. STOPPING PROHIBITED IN SPECIFIED PLACES - SIGNS NOT REQUIRED
(a)
No person shall stop any vehicle on a highway;
(i)
on or over a sidewalk or footpath;
(ii)
within an intersection, crosswalk, or pedestrian crossover;
(iii)
within nine (9) metres of a pedestrian crossover;
(iv)
alongside or across the highway from any excavation or obstruction in the
roadway when the free flow of traffic would thereby be impeded;
(v)
on the roadway side of any stopped or parked vehicle;
(vi)
upon any bridge or elevated structure or within any tunnel or underpass.
9. STOPPING PROHIBITED IN SPECIFIED PLACES - WHERE SIGNS ARE ON
DISPLAY
(a)
Where authorized signs are on display indicating that stopping is prohibited, no
person shall stop any vehicle on any highway, contrary to such signs.
10. PARKING PROHIBITED FOR HAWKERS AND PEDDLERS
(a)
No person who sells, offers for sale or takes orders for goods, wares, merchandise
or produce from a vehicle shall for the purpose of carrying on his business, stop or
park the vehicle on any part of the highway.
11. PERMITTED ANGLE PARKING
(a)
Angle parking in accordance with the provisions of Section 5 is permitted on the
highways at the side and between the limits set out respectively in Columns 1, 2
and 3 of Schedule I.

12. PARKING RESTRICTIONS AND PROHIBITIONS ON CERTAIN HIGHWAYS
(a)
Where authorized signs are on display indicating that parking is prohibited, no
person shall park a vehicle on any highway at the side and between the limits set
out respectively in Columns 1, 2 and 3 of Schedule II during the prohibited times
or days set out in Column 4 of the said Schedule.
(b) (i)
Where authorized signs are on display indicating that parking is prohibited,
no person shall park a vehicle on any highway except for those places
designated in Schedule III - Three (3) Hour Parking Exceptions for a period
in excess of the time period therein specified.
(ii)
Nothing in this section shall be deemed to permit parking at any location
where or at any time when parking is otherwise prohibited.
13. STOPPING RESTRICTIONS AND PROHIBITIONS ON CERTAIN HIGHWAYS
(a)
Where authorized signs are on display indicating that stopping is prohibited, no
person shall stop a vehicle on any highway at the side and between the limits set
out respectively in Columns 1, 2 and 3 of Schedule IV during the prohibited times
or days set out in Column 4 of the said Schedule.
14. STANDING RESTRICTIONS AND PROHIBITIONS ON CERTAIN HIGHWAYS
(a)
Where authorized signs are on display indicating that standing is prohibited no
person shall stand a vehicle on any highway at the side and between the limits set
out respectively in Columns 1, 2 and 3 of Schedule V during the prohibited times
or days set out in Column 4 of the said Schedule.
15. PASSENGER OR FREIGHT LOADING ZONES
(a)
The highways set out in Column 1 of Schedule VI at the side and between the
limits set out respectively in Columns 2 and 3 of the said Schedule are hereby
designated as passenger or freight loading zones during the times set out in
Column 4 of the said schedule.
(b)
No persons shall park any vehicle on a highway in a passenger or freight loading
zone.
(c)
Each designation made under subsection (a) shall be effective upon the erecting
of authorized signs marking the passenger or freight loading zones and showing
the times of the parking prohibition.
16. SCHOOL BUS LOADING ZONES
(a)
School bus loading zones are hereby authorized and assigned on the highways at
the side and at the locations set out respectively in Columns 1, 2, 3 and 4 of
Schedule VII for use by school buses.
(b)
No vehicle other than a school bus waiting for, or in the process of, loading or
unloading students, shall be stopped in any school bus loading zone referred to in
subsection (a) when marked by an authorized sign indicating that such stopping is
prohibited in the zone.
17. ON STREET PARKING - WINTER MONTHS
(a)
No person shall park any vehicle on any highway under the jurisdiction of the Town,
at any time during the hours of 2:00 a.m. to 6:00 a.m. from and including December
1st of each year, to and including March 31st of the following year.
(b)
The provisions of 17(a) shall not apply to that portion of Church Street south of
Main Street in the Town of Whitchurch-Stouffville.

(c)

18. PARKING ON PRIVATE OR MUNICIPAL PROPERTY
(a)
No person shall park or leave a motor vehicle
(i)
on private property without the consent of the owner or occupant of such
property; or
(ii)
on municipal property owned or occupied by The Corporation of the Town
of Whitchurch-Stouffville without the consent of The Corporation of the
Town of Whitchurch-Stouffville; or
(iii)
on municipal property owned or occupied by a local board of The
Corporation of the Town of Whitchurch-Stouffville without the consent of the
local board;
(b) (i)
A Police Officer or Municipal Law Enforcement Officer upon the written
complaint of an occupant or owner of any private property or municipal
property, that a motor vehicle is parked or left in contravention of this by-law
may provide for the removal and impounding of the motor vehicle.
(ii)
Where a Police Officer or Municipal Law Enforcement Officer has caused a
motor vehicle to be moved or taken to and placed or stored in a suitable
place, all costs and charges for removing, care and storage thereof, if any,
are a lien upon the vehicle, which may be enforced in the manner provided
by the Repair and Storage Liens Act, R.S.O. 1990 c. R.25, as amended.
(c)
Where an owner or occupant of property affected by this by-law has posted signs
stating conditions on which a motor vehicle may be parked or left on the property
or prohibiting the parking or leaving of a motor vehicle on the property, a vehicle
parked or left on the property contrary to such conditions or prohibition shall be
deemed to have been parked or left without consent.
(d)
A special constable appointed under The Police Services Act, R.S.O. 1990, c.
P.15, as amended, in respect of a particular property, to enforce this by-law shall
be deemed to have the written authority of the owner or occupant of the property
to enforce the by-law, and such special constable is not required to receive a
written complaint before enforcing the by-law.
19. PARKING ON UNTRAVELLED PORTIONS OF HIGHWAYS
(a)
No person shall park or leave any vehicle upon any portion of an untravelled
highway for a period exceeding seventy-two (72) hours.

(b)
Vehicles parked or left in contravention of this section may, by order of a
Police Officer or Municipal Law Enforcement Officer be removed and impounded
at the expense of the owner thereof.
20. ACCESSIBLE PARKING
(a)
Every owner and operator of a parking lot or of a parking facility to which the public
has access shall designate parking spaces for the exclusive use of a motor vehicle
operated by a disabled person, or a motor vehicle carrying a disabled person in
respect of which a permit has been issued and properly displayed. The minimum
number and size of the designated accessible parking spaces which must be
provided shall be calculated in accordance with the Town of Whitchurch-Stouffville
zoning by-laws.
(b)
Every owner or operator of a parking lot or a parking facility to which the public has
access shall ensure that the designated parking spaces for disabled persons are:
(i)
identified by signs conforming to the requirements of the Ontario
Regulations made under The Highway Traffic Act, R.S.O. 1990, c. H.8, as
amended; and
(ii)
kept free from obstructions, kept clear of snow, ice and slush and be
otherwise maintained to the same standards as all other parking spaces in
the same parking area.
(c)
No fee shall be charged for the use of a designated accessible parking space in
excess of that fee charged to other members of the general public in respect of
non-designated parking spaces in the parking lot or parking facility.
(d)
No person shall park, store or leave standing, a motor vehicle in a designated
accessible parking space unless an accessible parking permit is properly displayed
on the vehicle.
(e)
No person other than a disabled person who is the operator of a motor vehicle or
a person operating a motor vehicle that carries a disabled person, shall use an
accessible parking permit.
(f)
The owner of a vehicle that has been left parked, standing or stopped in
contravention of Section 21 of this By-law is guilty of an offence, even if the owner
was not the driver of the vehicle at the time of contravention of the by-law, unless,
at that time, the vehicle was in the possession of a person other than the owner
without the owner's consent.
21. PENALTY PROVISIONS FOR PARKING INFRACTIONS
(a)
A Police Officer or Municipal Law Enforcement Officer, upon discovery of any vehicle
parked, stopped or left standing in contravention of the provisions of this By-law, may
attach a Penalty Notice to the vehicle.
(b)
Sections 3 to 20 of this By-law are hereby designated for the purposes of Section 3 of
0. Reg. 333/07 as parts of this By-law to which the Administrative Monetary Penalty
System By-law applies.
(c)
If a Vehicle has been left parked Standing or stopped in contravention of a
Designated Provision, the owner of the Vehicle shall, upon issuance of a penalty
notice in accordance with the Administrative Monetary Penalty System By-law, be
liable to pay an administrative penalty and any administrative fees, and subject to
towing, in accordance with the Administrative Monetary Penalty System By-law.
(d)
Notwithstanding any other provisions or penalties contained in this by law, a Police
Officer or Municipal Law Enforcement Officer, upon discovery of any motor vehicle
parked, or left standing in contravention of this By-law, may cause it to be moved

and stored in a suitable place and all costs and charges for removing, care, and
storage thereof, if any, are a lien upon the vehicle, which may be enforced in the
manner provided by the relevant provisions of the Repair and Storage Liens Act,
R.S.O. 1990, R.25, as amended.
(e)
A Police Officer or Municipal Law Enforcement Officer, who discovers a vehicle
apparently abandoned on or near a highway or a motor vehicle or trailer without
proper number plates may take the vehicle into custody of the law and may cause
it to be taken to and stored in a suitable place, and all costs and charges for
removing, care and storage thereof, if any, are a lien upon the vehicle, which may
be enforced in the manner provided by the relevant provisions of the Repair and
Storage Liens Act, R.S.O. 1990, R.25, as amended.
(f)
The Provincial Offences Act, R.S.O. 1990, c. P. 33, as amended from time to time,
or any successor thereof, does not apply to a contravention of a Designated
Provision of this By-law.
(g)
Except as set out in sections 21 (a) and (c), all other provisions of this By-law and
of any other applicable legislation shall continue to apply to the Designated
Provisions, in addition to the Administrative Monetary Penalty By-law.
(h)
The owner of a Motor Vehicle parked in violation of this By-law is also liable to any
penalty provided for herein unless the Motor Vehicle at the time the offence was
committed was in the possession of a person other than the owner without the
owner's consent.
(i)
No person shall provide false information or give a false statement to an Officer,
employee and/or agent of the Municipality in the lawful exercise of a power or duty
under this By-law.
(j)
No person shall hinder or obstruct, nor attempt to hinder or obstruct, either directly
or indirectly, an Officer, employee and/or agent of the Municipality in the lawful
exercise of a power or duty under this By-law.
(k)
Every person shall comply with any Order or Notice issued under the authority of
this By-law.
22. EFFECTIVE DATES AND REPEAL OF PRECEDING BY-LAWS
(a)
This By-law shall come into force and effect upon approval and receipt of a set fine
order issued by the Chief Judge of the Ontario Court of Justice at which time the
following By-laws shall be deemed to have been repealed together with any other
By-laws or parts thereof inconsistent with the provisions of this By-law:

(b)
