A BY-LAW TO PROHIBIT THE OPERATION OF
MOTORIZED SNOW VEHICLES WITHIN THE CITY
OF WINDSOR
Passed the 3rd day of March, 1997.
WHEREAS subsection 7(2) of the Motorized Snow Vehicles Act, R.S.O. 1990,
Chapter M.44, provides that the council of a local municipal may pass by-laws regulating,
governing or prohibiting the operation of motorized snow vehicles within the municipality,
including any highways therein or any part or parts thereof;
AND WHEREAS it is deemed expedient to pass a by-law prohibiting the
operation of motorizes snow vehicles within the City of Windsor;
THEREFORE the Council of the Corporation of the City of Windsor enacts as
follows:
1.
In this by-law,
(a)
"highway" includes a common and public highway, street, avenue, parkway,
driveway, square, place, bridge, viaduct or trestle designed and intended for or used by the
general public for the passage of vehicles.
(b)
"motorized snow vehicle" means a self-propelled vehicle designed to be driven
primarily on snow.

No person shall operate a motorized snow vehicle within the City of Windsor, including
any highways therein.
3.
Despite section 2, a dealer in motorized snow vehicles may, between the hours of 8:00
a.m. and 11:00 p.m., operate motorized snow vehicles on the premises on which such business is
carried on.
4.
By-law Number 4318, as amended, is repealed.
5.
Any person who contravenes any of the provisions of this by-law is guilty of an offence
and on conviction is liable to a fine of not more than Five Thousand Dollars ($5,000.00),
exclusive of costs, and every such penalty shall be recoverable under the Provincial Offences
Act, R.S.O. 1990, as amended.
6.
This by-law shall come into force and take effect on the day of the final passing thereof.
