A BY-LAW TO REGULATE THE SALE BY RETAIL OF
GOODS IN HIGHWAYS AND ON VACANT LOTS
ADJACENT THERETO IN THE CITY OF WINDSOR
Passed the 18th day of December, 1989
WHEREAS Section 210, paragraph 66, of the Municipal Act, R.S.O. 1980, as
amended, authorizes inter alia the passing of by-laws for prohibiting or regulating sales by retail
in the highways or on vacant lots adjacent to them;
AND WHEREAS it is deemed expedient to regulate the sales by retail of goods
in the highways or on vacant lots adjacent to them in the City of Windsor;
THEREFORE the Council of The Corporation of the City of Windsor enacts as
follows:
1.
In this by-law
(a)
"goods" includes wares and merchandise;
(b)
"highway" means a common and public highway and includes a street and a
bridge forming part of the highway or on, over or across which a highway passes.
2.
No person shall sell any goods by retail in the City of Windsor:
(a)
in any highway; or
(b)
on any vacant lot adjacent to a highway.

3.
City of Windsor By-law Number 66 is repealed.
4.
Every person who contravenes any of the provisions of this by-law (Chapter) is guilty of
an offence and shall, upon conviction thereof, forfeit and pay a penalty of not more than
Five Thousand Dollars ($5,000), exclusive of costs and every such fine is recoverable
under the Provincial Offences Act. (inserted B/L 10277, May 22/90)
5.
This by-law shall come into force and take effect on the day of final passing thereof.
