CORPORATION OF THE TOWNSHIP OF ZORRA Bl( -LAW NO. 72-20 BEING A BY-LAW TO REGULATE THE OPERATION OF AIIJERRAIN VEHICLES ( ATV) AND OFF- ROAD VEHICLES ( ORV) AND MOTORIZED SNOW VEHICLES WITHIN THE TOWNSHIP OF ZORRA WHEREAS the Highway Traffic Act, R.S. O. 1990, Section 191. 8 ( 3) c H. 8 as amended, provides that municipalities may pass by-laws to prohibit the operation of off-road vehicles on any highway within the municipality that is under the jurisdiction of the municipality, or on any part or parts of such highway; AND WHEREAS pursuant to O. Reg. 316/03, as amended, made under the Highway Traffic Act, a municipality may prohibit the operation of any all -terrain vehicles, multi-purpose off- highway utility vehicles and recreational off-highway vehicles on municipal highways; AND WHEREAS the Council of the Corporation of the Township of Zorra deems it appropriate to regulate the operation of All -Terrain Vehicles, being a class of Off -Road Vehicles as defined in Section 1 of Ontario Regulation 316/03, on highways within the jurisdiction of the municipality, or on any part or parts of such highways. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ZORRA ENACTS AS FOLLOWS: 1. 0. Short Title 1. 1. This By-law shall be known and referred to as the "Township of Zorra Off Road Vehicle By-law." 2. 0. Definitions 2. 1. Any word or term not defined in this by-law, that is defined in the Act or Regulations, shall have the meaning ascribed to it in the Act or the Regulation and any word or term not defined in this by-law, the Act or the Regulation, shall have the meaning that is normally associated with it. 2. 2. For the purpose of this By-law, the following terms shall be defined accordingly: a) " Act" shall mean the Highway Traffic Act, R.S.O. 1990, c, H8, as amended ( HTA). b) " All Terrain Vehicle" shall mean an off-road vehicle that, has four wheels, the tires of all of which are in contact with the ground, has steering handlebars, has a seat that is designed to be straddled by the driver, and is desianed to carry a driver only and no passengers. has the same meaning as in Ontario Regulation 316/03. c) ghway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles. d) " Motorized Snow Vehicle" means aself-propelled vehicle designed to be driven primarily on snow. e) " Off -Road Vehicle" means a vehicle propelled or driven otherwise than by muscular power or wind and designed to travel on not more than three wheels or on more than three wheels and being of a prescribed class of vehicle. f) " ORVA" means the Off -Road Vehicle Act, R. S. O. 1990, c. 0A g) " Township" shall mean the Corporation of the Township of Zorra. 3. 0. Prohibitions 3. 1 All motorized snow vehicles, off-road vehicles and all terrain vehicles operated within the Township limits shall be subject to the provisions of the Highway Traffic Act (HTA) and the Off -Road Vehicle Act (ORVA) and all other applicable legislation. 3. 2 No person shall operate a motorized snow vehicle, off-road vehicle and all terrain vehicle within the Township -limits, on sidewalks, and any other municipally owned property. 3.3 No person shall operate a motorized snow vehicle, off-road vehicle or all terrain vehicle on a Township highway within a Residential or Rural Residential Zone anywhere within the Township. 3.4 Except for the purpose of ingress and egress and crossovers ata 90 degree angle, no person shall operate a motorized snow vehicle, off-road vehicle or all terrain vehicle at any time on a highway within local jurisdiction within the limits of the Township of Zorra. 3.5 Despite subsection 3.2 and 3. 3 and in accordance with the HTA and the ORVA, a person is not contravening any provision of this by-law and may drive an off-road vehicle on a highway if the vehicle is designed to travel on more than two wheels and the driver is a person using the vehicle for agricultural purposes, and the vehicles or a vehicle drawn by it bears a slow-moving vehicle sign. 4.0. General Provisions 4. 1. The By-law Enforcement Officer for the Township shall enforce this by-law and any Police Officer of the Ontario Provincial Police may enforce this by-law. 4.2 The provisions regulating or governing the operation of motorized snow vehicles and off-road vehicles under the by- law do not apply to highways or any part or parts thereof that are not under the jurisdiction of the local municipality. 4.3 Any person who contravenes any provision of this By-law is guilty of an offence and, upon conviction, is liable to a penalty in accordance with Section 61 of the Provincial Offences Act, R. S. O. 1990, c.P. 33, as amended from time to time, or any successor thereof. 5. 0. Severability 5. 1. If any section, subsection, paragraph, sentence, clause, or provision of this by-law be declared by a Court of competent jurisdiction to be invalid, illegal or ultra vires for any other reason, all other provisions of this by-law shall remain and continue in full force and effect and shall remain valid and binding. 6. 0.
