The Corporation of the Township of Zorra Page 2 By-law No. 48-20 THE CORPORATION OF THE TOWNSHIP OF ZORRA BY-LAW NO. 48-20 BEING A BY-LAW TO PROHIBIT OR REGULATE THE PARKING, STANDING OR STOPPING OF VEHICLES WITHIN THE TOWNSHIP OF ZORRA WHEREAS Section 10(2) paragraph 7 of the Municipal Act, 2001, S.O. 2001, c.25, ("Municipal Act" or "Act") as amended, provides that a municipality may pass by-laws to provide any service or thing that the municipality considers necessary or desirable to the public; AND WHEREAS Section 429 of the Act authorizes a municipality to establish a system of fines for offences under a By-law of the municipality passed under the Act; AND WHEREAS it is deemed necessary to repeal by-law 7-95 and all its amendments and replace it with a new by-law to prohibit or regulate the parking, standing or stopping of vehicles within the Township of Zorra; WHEREAS the Council of the Corporation of the Township of Zorra deems it necessary to prohibit or regulate the parking, standing or stopping of vehicles within the Township of Zorra; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ZORRA ENACTS AS FOLLOWS: 1. INTERPRETATION (1) In this by-law: (a) "boulevard" refers to municipally owned property within the public right-of-way extending between the curb or edge of the roadway and the nearest limit of the municipal road allowance, exclusive of any sidewalks or curbs located thereon. (b) "by-law enforcement officer(s)" means one or more persons duly i. empowered by the Council of the Corporation of the Township of Zorra to enforce the various by-laws of the municipality and carry into effect the provisions of any Act of the Legislature of the Province of Ontario to be enforced by the municipality, and ii. shall include the Township of Zorra Director of Public Works, Township of Zorra Public Works Lead Hands, and the Township of Zorra Fire Chief, or designate (c) "commercial vehicle" means a motor vehicle having attached thereto a truck or delivery body, and also includes ambulances, hearses, tow-trucks, motor buses, fire apparatus, farm vehicles (including farm tractors), and tractor trailers or any part thereof which are used for hauling purposes on the highways. (d) "designated fire route" refers to any right of way, or a driveway encircling the perimeter of any building that has signage posted to indicate such uses. (e) "Electric Vehicle" or "EV" means i. A battery electric vehicle that runs only on a battery and an electric drive train, or; ii. A plug-in hybrid electric vehicle that runs on a battery and an electric drive train, and also uses an internal combustion engine. The Corporation of the Township of Zorra Page 3 By-law No. 48-20 (f) "Electric Vehicle Charging Station" means a publicly owned parking space that provides access to equipment that supplies a source of electricity for charging electric vehicles and is designated for the use of Electric Vehicles as indicated by a sign. (g) "Embro" refers to that area of the Township of Zorra being the former Village of Embro. (h) "emergency service vehicles" refers to ambulances, hearses, fire apparatus, police vehicles and utility vehicles. (i) "front yard" shall have the same meaning as defined under the Township of Zorra's Zoning By-law No.35-99, as amended. (j) "highway" has similar and identical meaning to the term 'highway' as defined under Section 1 of The Highway Traffic Act, R.S.O. 1990, Chapter H.8. (k) "intersection" has similar and identical meaning to the term 'intersection' as defined under Section 1 of The Highway Traffic Act, R.S.O. 1990, Chapter H.8. (l) "Minister" means the Minister of the Ontario Ministry of Transportation or its successor agency. (m)"Ministry" means the Ontario Ministry of Transportation or its successor agency. (n) "motor vehicle" includes, but is not necessarily limited to an automobile, truck, tractor, motorcycle, or any other vehicle propelled or driven by any means other than by muscular power. (o) "park" or "parking", when prohibited or regulated, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while engaged in loading or unloading merchandise or passengers. (p) "pedestrian crossover" means any portion of a roadway, designated by municipal by-law, at an intersection or elsewhere, distinctly indicated for pedestrian crossing by signs on the surface of the roadway as prescribed by regulation under the Highway Traffic Act. (q) "point of intersection" means the point where the edge or curb of the travelled portion of the road or street extends in a straight line past the radius and intersects with the crossing street, as set out in the diagram below (see "Apex"). (r) "police officer" means a member of the Ontario Provincial Police or a member of a successor law enforcement agency. (s) "recreational vehicle" shall include the following: a snowmobile, a boat, a motor home, an all-terrain vehicle, a trailer as defined herein; or a trailer for the hauling of snowmobiles or boat. (t) "road allowance" means the portion of the untravelled roadway that measures 66 feet from the centre of the roadway and includes the shoulder of the roadway." (u) "roadway" means that part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively. The Corporation of the Township of Zorra Page 4 By-law No. 48-20 (v) "side yard" shall have the same meaning as defined under the Township of Zorra's Zoning By-law No.35-99, as amended. (w) "stand" or "standing", when prohibited or regulated, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers. (x) "stop" or "stopping", when prohibited or regulated, means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic and in compliance with the directions of a police officer or a traffic control sign or signal. (y) "official sign" means a sign approved by the Ministry of Transportation. (z) "Thamesford" means that area of the Township of Zorra designated as Ward 2 and includes all of the former Police Village of Thamesford. (aa) "Township" means the Corporation of the Township of Zorra. (bb) "tractor" means a farm tractor, or any other self-powered agricultural or construction type machine. (cc) "traffic control signal" means any device, manually or electrically or mechanically operated for the regulation or control of traffic. (dd) "trailer" means any portable unit so constructed as to be suitable for attachment to a motor vehicle e.g. travel trailer or tent trailer and/or capable of being used for the temporary accommodation of persons but does not include a mobile home. (ee) "Unauthorized area" means a. Front Yard, except as otherwise permitted under the Township's Zoning By- law. (ff) "vehicle" includes an automobile, truck, motorized construction equipment, farm tractor, motorized farm equipment, motor home, or recreational vehicle, and also includes a trailer and any vehicle drawn or propelled by any kind of power, but does not include any other type of motor vehicle, bicycle, or any other device powered solely by means of human effort.. (gg) "Zoning By-law" means the zoning by-law currently in effect, being a restricted area by-law governing and regulating land use within the Township of Zorra. (2) Where any expression of time occurs, or where any hour or other period of time is stated, the time referred to shall be the time currently in effect within the time zone commonly referred to as the 'Eastern Time Zone'. 2. ENFORCEMENT OF THE BY-LAW (1) The following Officers shall be duly appointed and authorized to enforce the provisions of this by-law: (a) Township of Zorra By-law Enforcement Officer; (b) Township of Zorra Director of Public Works; (c) Township of Zorra Public Works Lead Hand; (d) Township of Zorra Fire Chief, or designate; and for purposes of this By-law each shall be deemed to be a 'By-law Enforcement Officer'. 3. GENERAL STOPPING, STANDING AND PARKING REGULATIONS (1) No person shall on a highway stop, park, or leave standing a vehicle in any The Corporation of the Township of Zorra Page 5 By-law No. 48-20 of the following places: (a) On or over a sidewalk or boulevard; (b) Within an intersection or within 9 metres of an intersecting highway; (c) Adjacent to or across the highway from any excavation or obstruction in the roadway when the free flow of traffic would thereby be impeded; (d) On a roadway adjacent to any stopped or parked vehicle. (e) On a bridge or any approach thereto or adjacent to any guard rail. (2) No person shall on a highway park, stop, or leave standing, a vehicle in any of the following places: (a) In front of a driveway or laneway or so as to obstruct vehicles in the use of a driveway or laneway; (b) within 3 metres of a point in the edge of the roadway and the fire hydrant; (c) within 30 metres of any level railway crossing; (d) In such a position as will prevent, or block, the removal of any other vehicle previously parked. (3) No person shall on a highway park or leave standing a commercial vehicle exceeding one (1) metric tonne capacity, except temporarily for the loading or unloading of passengers or merchandise and except for Ambulances, Police or Fire Service or Township vehicles, Emergency Services Vehicles and vehicles actually engaged in works undertaken for or on behalf of the Township, in the following areas of the Township: (a) Within the Village of Thamesford: - those areas designated as "R1" and "R2" in the Zoning By-law; (b) Within the Village of Embro: - those areas designated as "R1" and "R2" in the Zoning By-law; (c) Within all other areas of the Township: - those areas designated as "R1", "R2" and "RE" in the Zoning By-law. (4) No person shall park or leave standing a commercial vehicle in an Unauthorized Area in a Residential Zone (as defined in the Zoning By-law) unless he or she is the owner or occupant of the lot, building or structure, and provided that said vehicle shall not exceed 4000kg (8818.3lb). (5) Where official signs are erected and are on display, no person shall on any highway park stop, or leave standing any vehicle within the areas defined in Schedule "A", attached hereto and forming a part of this by-law, and designated as "NO PARKING"/"NO STANDING" zones or as "NO STOPPING" zones. (6) Where official signs are erected and are on display, no person shall on any highway park any vehicle, within the areas defined in Schedule "B" hereto, for a continuous period of time exceeding two (2) hours. (7) Where official signs are erected, and/or where pavement markings have been installed, designating and indicating restricted parking control zones for disabled persons holding a valid 'disabled person parking permit', no person shall park in a designated disabled person parking zone unless officially displaying the disabled person parking permit in accordance with the regulations and in such a manner as to be readily visible from outside the vehicle. (8) Where official signs are erected and are on display, no person shall on any highway park any vehicle within thirty (30) metres of an intersection controlled by traffic lights; (9) No person shall on any highway park or leave standing a vehicle in front of or within three (3) metres of any entrance to driveway to a fire station or fire hall. (10) No person shall park or leave standing any vehicle, attended or unattended, on Township owned fire station (hall) property, in that area directly in front of and between the fire station (hall) and the adjacent highway thereby blocking access. The Corporation of the Township of Zorra Page 6 By-law No. 48-20 (11) Where official signs are erected and are on display, no person shall on any highway park, stop, or leave standing any vehicle parked within a designated fire route. (12) No person shall stop, park or leave a vehicle standing in or on a road allowance except where a vehicle has experienced mechanical malfunction or resulting from a vehicular accident. (13) No person shall stop, park or leave a vehicle standing on a roadway facing the opposing direction of traffic flow. (14) No person shall stop, park or leave a vehicle in an Unauthorized Area or shall permit the stopping, parking, or leaving of a motor vehicle in an Unauthorized Area. (15) No person shall, stop, park, or leave a recreational vehicle in the front yard of a lot in a residential zone from November 1-April 30. (16) No person shall park, stop, or leave a vehicle or any part of a vehicle in a Township of Zorra municipal Electric Vehicle Parking Space where such vehicle is: (a) Not an Electric Vehicle; (b) Not connected to an Electric Vehicle Charging Station and charging; (c) Connected to an Electric Vehicle Charging Station and charging in excess of 3 consecutive hours; (d) Parked or left standing in an Electric Vehicle Charging Station between the hours of 1:00 a.m. and 8:00 a.m., of the same day, during the winter control season commencing on the 15 day of November, in each calendar year, and continuing until the 31 day of March of the calendar year next following. (17) No person shall park (including park overnight) or leave standing, or permit to be parked (including parked overnight) or left standing, a vehicle on Township-owned or occupied land without authorization of the Township. (Amended by By-law 46- 22) 4. PARKING PROHIBITION - SPECIAL CONDITIONS - SNOW PLOW ROUTES: (1) No person shall park or leave standing any vehicle on any highway within and under the jurisdiction of the Township of Zorra between the hours of 1:00 o'clock in the morning and 8:00 o'clock in the morning, of the same day, during the winter control season commencing on the 15th day of November, in each calendar year, and continuing until the 31st day of March of the calendar year next following. 5. PENALTY AND ENFORCEMENT PROVISIONS: (1) Every person who contravenes any provision of this by-law is guilty of an offence and upon conviction is liable to a fine as provided for by the Provincial Offences Act, R.S.O. 1990, Chapter P.33, as amended (see Schedule "C" and Schedule "D"). (2) Where a vehicle is parked, stopped, or left standing in contravention of this by-law, the By-Law Enforcement Officer may cause such vehicle to be moved or taken to and placed or stored in a suitable place and all costs and charges for the removing, care and storage thereof, if any, are a lien upon the vehicle and no such vehicle shall be released or returned to the owner thereof until all such charges and costs, if any, have been paid in full. (3) Where a vehicle has been moved or taken to and placed or stored (impounded) in a suitable place and costs and charges have been incurred therewith, and where the owner refuses or fails to pay such costs or charges within sixty (60) days upon receipt of notice from the stored place, the owner of the stored place may proceed to dispose of the said vehicle pursuant to the provisions of Section 4 of the REPAIR & STORAGE LIENS ACT, R.S.O. 1990, c. R.25. The Corporation of the Township of Zorra Page 7 By-law No. 48-20 (4) The duly authorized By-Law Enforcement Officer may serve an "Prescribed Certificate" or "Notice of Violation" on the offending party or parties providing for a voluntary payment of a fine as set forth on Schedule "C" hereto for each offence if paid out of court, or an amount fixed and approved by the Provincial Chief Judge, inclusive of costs, if the charge proceeds under Part II of The PROVINCIAL OFFENCES ACT. (5) The duly authorized By-law Enforcement Officer may serve a "Prescribed Certificate" or "Notice of Violation" on the offending party or parties providing for a voluntary payment of a fine as set forth on Schedule "D" hereto for each offence if paid out of court, or an amount fixed and approved by the Provincial Chief Judge, inclusive of costs, if the charge proceeds under Part I of the PROVINCIAL OFFENCES ACT. (6) The duly authorized By-law Enforcement Officer may enforce parking regulations on roads under the authority of the County of Oxford within the boundary limits of the Township of Zorra so long as the parking prohibitions are indicated as such in the County of Oxford's parking bylaw. 6. BY-LAW AMENDED OR REPEALED: (1) Any other by-law, the provisions of which are not consistent with those set forth herein, be and the same are amended or repealed in whole or in part as the case may be. (2) That By-law No. 7-95 ZORRA PARKING CONTROL BY-LAW is hereby repealed in its entirety. (3) That the following amending by-laws are hereby repealed in their entirety: By-law No. 16-95, By-law No. 36-95, By-law No. 14-96, By-law No. 24-03, By-law No. 27- 05, By-law No. 19-07, By-law No. 27-08, By-law No. 37-12, By-law No. 26-13, By- law No. 10-14, By-law No. 23-14, By-law No. 35-17, By-law No. 58-17, and By-law No. 68-19. (4) That the following appointment of officers by-laws are hereby repealed in their entirety: By-law No. 2012-09, By-law No. 2013-63, and By-law No. 2016-26. 7. CITATION: This by-law may be cited as the "Zorra Parking Control BY-LAW". 8. COMING INTO FULL FORCE & EFFECT: The provisions of this by-law shall take full force and effect on the date of passing. (Added by By-law 15-24) (C) HAMLET OF LAKESIDE: No person shall, within the Hamlet of Lakeside or in the area of Lake Sunova, immediately south of the Hamlet of Lakeside, park or leave standing a vehicle within the posted "NO PARKING"/"NO STANDING" designated area (s) listed hereunder: (i) Sunova Cres., West side, commencing at 256524 Sunova Crescent to 256437 Sunova Crescent; (ii) Sunova Cres., East side, commencing at 256440 Sunova Crescent to 256524 Sunova Crescent; (D) HAMLET OF KINTORE: No person shall, within the Hamlet of Kintore, park or leave standing a vehicle within the posted "NO PARKING"/"NO STANDING" designated area(s) listed hereunder: (i) Road 84 (Oxford County Road #16), North side, commencing at a point 170.078 metres (558 feet) east of the centreline of the 19th LINE Amended by By-law 34-21 SCHEDULE "A" BY-LAW No. 48-20 (Provincial Highway #19), easterly a distance of 69.19 metres (227 feet). 2. STOPPING PROHIBITION Pursuant to Section 3(5) of By-law No. 48-20 of the Corporation of the Township of Zorra no person shall, within the village of Thamesford, stop or leave standing a vehicle within the posted "NO STOPPING" zones designated here: (i) ST. PATRICK STREET East and West side from Dundas Street to Brock Street. (ii) DUNDAS STREET Within 50 feet east and west of Stanley Street intersection. (iii) ALLEN STREET East and west side north within 50 feet north of intersection at Dundas Street. (iv) BROCK STREET North and South side, from the intersection of St. Patrick Street to 73.5 m westerly. (v) MCCARTY STREET, south side, commencing at the intersection with Allen Street, and continuing westerly to the intersection with George Street from September 1 to June 30 of each year between the hours of 8:30 a.m. - 9:00 a.m. and 3:00 p.m. - 4:00 p.m. Amended by By-law 34-21 SCHEDULE "B" BY-LAW No. 48-20 PARKING REGULATION Pursuant to Section 3(5) of By-law Number 48-20 of the Corporation of the Township of Zorra: (A) VILLAGE OF THAMESFORD No person shall, within the Village of Thamesford, park or leave standing a vehicle within a designated and posted area, listed hereunder, for a continuous period of time exceeding two (2) hours: (i) George Street West side from 17.1 m south of its intersection with Dundas Street, southerly to a point 75.6 m from the intersection.
