## MAINTENANCE OF ORDER BYLAW MICE 1/7/89 This bylaw is made under the authority of the Munacipalities Act, Stats. P.E.I. 1983, Cap. M-15-1. BE II ENACTED by the Council for the Municipality of CRAPAUD as follows: ## 1.1 TITLE This bylaw shall be known and may be cited as the "Maintenance of Order Bylaw". In this bylaw: ## 1.2. DEFINITIONS "Administrator" means the Administrator of the Municipality, 'motor vehicle' means a vehicle that is powered drawn, propelled or driven by any means other than muscula: power; · "motorized machinery" includes all machinery powered by any other means other than muscular power with the exception of snow removal equipment. ## 1.3 ## NOISE - (a) No person shall, within the Municipality, disturb the peace and quiet of persons therein by: - (i) houting, screaming, blowing a horn or other noisemaker or amplifying speech or music or any other noise; - (ii) operating a motor vehicle or motorized machinery - which does not have the standard muffling equipment; - (iii) operating a motor vehicle or motorized machinery - manner which causes excessive noise; - (iv) discharging a firearm, unless in the performance of some duty sanctioned by proper authority. - (b) No person shall, within the Municipality, disturb the peace and quiet of persons therein by operating motorized machinery contrary to the provisions of this bylaw. ## 1.4 LOITERING No person shall loiter in a public place within the Municipality. ## 1.5 DISTURBANCES - (a) No person shall, within the Municipality, disturb the peare and quiet of persons therein by fighting, singing. using obscene or insulting language, or by unnecessarily ## 1.6 PUBLIC NUISANCES - (a) No person shall, without proper authority, deface, alter, or destroy, any public notice in the Municipality erected or placed under the authority of the Municipality or the federal or provincial government. - (b) No person shall encumber, damage, or unduly or unnecessarily obstruct any street, road, highway, sidewalk, or other public place or thoroughfare within the Municipality. - (c) No person shall cast, project, or throw, any stone, snowball, ice, or other object, or use a bow and arrow, catapult, slingshot, airgun, or any other such device on any street, road, highway, sidewalk or other public place or thoroughfare within the Municipality. - (d) No person shall use or be in any public park within the Municipality on any day between the hours of 12 o'clock midnight and 7 o'clock A.M. without first obtaining written authorization from the Administrator. ## 1.7 HALLOWEEN CURFEW - (a) Unless accompanied by a person of the age of majority, no person under the age of majority shall public place within the Municipality between 8.00 o'clock 150r6 p. по be in a p.m. on ' October 31st and 8.00 o'clock a.m. on November Ist each year. - (b) he restriction in section (a) shall also apply between 80 o'clock p.m. on October 30ths and 8.00 o'clock a.m. and on October 3lst of that year. ## 1.8 PENALIIES Any person who contravenes any provision of this bylaw is guilty of an offence and is liable upon summary conviction to a fine of $250.00 on the first offence, and not to exceed $500.00 on the second and reaccuring offences. ## 1.9 EFFECTIVE DATE This bylaw shall come into force on the Ist day of october, 1989 and any other bylaw before October 1st, 1989 is hereby repealed.
