## BYLAW #5 ## NOISE AND DISTURBANCE BE IT ENACTED by the Council of the Community of North Rustico that: - No person within the Community shall operate, cause or permit to be operated a - 1) motorcycle of any sort, kind or size; - motorized bicycle or any variation thereof; - її) motorized go-cart or variation thereof; - iv) vehicle identified as an all terrain vehicle; - other motorized vehicle, including snow mobiles; on any public or community property, excluding streets, highways, and other public rights of way intended for vehicular traffic, within the Community of North Rustico unless such persons) is authorized to do so by resolution of the Community Council. The provisions of the Highway Traffic Act, R.S.P.E.I. 1974, the Off-Highway Vehicle Act, R.S.P.E.I. 1974, and the Environmental Protection Act, R.S.P.E.I. 1988 are hereby incorporated and made part hereof as are the Regulations made under such Acts. - No person shall, within the Community of North Rustico, operate or cause to be operated any musical instrument, radio or similar device or instrument in any manner the effect of which may be to upset or disturb the tranquillity of the Community or the residents thereof; - 1) No person shall, within the Community of North Rustico, operate or cause to be operated, used or employed a chain saw, log splitter or any other machine or motorized or powered device, the effect of the use of which may be capable of upsetting or disturbing the tranquillity of the Community or the residents thereof, except as follows: - a) Monday to Saturday, 8:00 a.m. to 9:00 p.m. - Sundays, 10:00 a.m. to 9:00 p.m. - This bylaw shall not apply to the operation of machinery or equipment employed for the purposes of snow removal or other public purposes for the benefit of the Community. 4. Any person who violates the provisions of this bylaw is guilty of an offense and upon summary conviction is liable to a fine for a first offense of $25.00 and for any subsequent offense of $50.00. This bylaw shall come into full force and effect on the 27 day of June AD 1988. Signed original on file
