Dans le présent règlement, les mots suivants signifient : 1. In this by-law, the following words shall mean: Directeur (director): Director (directeur): Le directeur du Service de police de la Ville de Montréal. The Director of the Montreal Police Department. Exploitant (operator): Operator (exploitant): L'exploitant d'un commerce de prêt sur gages ou d'articles d'occasion, incluant tout employé, mandataire ou représentant de celui-ci. The Operator of a pawnshop or an establishment dealing in second-hand goods, including any of its employees, agents or representatives. Commerce de prêt sur gages ou d'articles d'occasion (pawnshop or establishment dealing in second-hand goods): Pawnshop or establishment dealing in second-hand goods (commerce de prêt sur gages ou d'articles d'occasion): Toute personne tenant un magasin ou un entrepôt, ou occupant une cour, un local ou tout autre lieu, pour l'achat, la vente, l'échange, le prêt sur gages, en gros ou en détail, de tout bien, article, effet ou marchandise d'occasion, qu'il soit neuf ou qu'il ait déjà servi. Any person operating a store or a warehouse, or occupying a yard, premises or other locations, for the purchase, sale, exchange, pawning, wholesale or retail, of any second-hand goods, items, effects or merchandise, whether they be new or used. Service de police (police department) : Police Department (service de police): Le Service de police de la Ville de Montréal. The Montreal Police Department. Transaction (transaction) : Transaction (transaction): La réception ou la remise d'un bien. The receipt or handing over of goods. Véhicule automobile (motor vehicle) : Motor vehicle (véhicule automobile): Un véhicule automobile au sens du Code de la sécurité routière (RLRQ, chapitre C-24.2). A motor vehicle as defined in the Highway Safety Code (CQLR, Chapter C-24.2). CHAPITRE II APPLICATION CHAPTER II INTERPRETATION 2. Le directeur est chargé de l'application du présent règlement. 2. The Director is responsible for the application of this by-law. Tout agent de la paix, fonctionnaire ou employé de la municipalité est autorisé à visiter et à examiner, à toute heure raisonnable, toute propriété immobilière ou mobilière aux fins de l'application du présent règlement. Les propriétaires ou occupants de ces propriétés doivent y laisser pénétrer les agents de la paix, les fonctionnaires ou les employés de la municipalité. Any peace officer, officer or employee of the municipality is authorized to visit and examine, at any reasonable time, any real estate property or personal property, for by- law application purposes. Owners or occupants of these properties must allow peace officers, officers or employees of the municipality to enter. Tout exploitant doit tenir à jour un registre dont la forme est prévue à l'annexe « A ». 3. Every Operator must keep an up-to-date register which format is set out in Schedule "A". Les inscriptions dans ce registre doivent être faites en lettres moulées, en français ou en anglais, de façon à pouvoir être facilement lues, dans l'ordre chronologique des transactions qui doivent être numérotées consécutivement, sans rature ou effacement. The entries in the register must be in block letters, in French or in English, so as to be clearly legible, in the chronological order of transactions that must be numbered consecutively, without erasures or deletions. 4. Tous les biens se trouvant dans un commerce de prêt sur gages ou d'articles d'occasion doivent être inscrits au registre, sauf ceux n'ayant pas fait l'objet d'une transaction ou n'y étant pas destinés. 4. All items found in a pawnshop or an establishment dealing in second-hand goods must be entered in the register, except those which were not subject to a transaction or are not intended to be so. 5. Les informations suivantes doivent être inscrites en en-tête du registre prescrit à l'article 3 : le nom exact de l'exploitant, son numéro de téléphone et sa raison sociale, l'adresse, les numéros de téléphone, de télécopieur et l'adresse électronique du commerce, ainsi que le numéro d'identification attribué par le Service de police. 5. The following information must be entered in the header of the register prescribed in section 3: the Operator's name, phone number and corporate designation, the address, phone and fax numbers and e-mail address of the establishment, and the identification number assigned by the Police Department. 6. Lors de la réception de tout bien, à des fins de vente, d'échange, de consignation, de réparation, d'estimation ou à toute autre fin, sans égard à la provenance du bien, l'exploitant doit inscrire les informations suivantes au registre prescrit à l'article 3 : 6. Upon receipt of any item, for sale, exchange, consignment, repair, or estimate purposes, or for any other purpose, irrespective of the origin of the item, every Operator must enter the following information in the register prescribed in section 3: 1° le numéro de lot attribué au bien conformément à l'article 12 du présent règlement; (1) the lot number assigned to the item in accordance with section 12 of this by- law; 2° une description complète du bien reçu, identifiant sa nature et les caractéristiques suivantes : la couleur, la marque de commerce, le modèle, le titre s'il s'agit d'un livre, d'un disque compact ou d'un disque vidéo digital, les renseignements exigés à l'article 155 du Code de la sécurité routière (RLRQ, chapitre C-24.2) et une photo s'il s'agit d'un véhicule automobile, le numéro de série et toute marque distinctive, ainsi que le code d'objet tel que fourni par le Service de police; (2) a full description of the item received, identifying its nature and the following characteristics: the color, brand name, model, title, in the case of a book, a compact disk or a digital videodisk, the information required in section 155 of the Highway Safety Code (CQLR, Chapter C- 24.2) and a photo, in the case of a motor vehicle, the serial number and any other distinctive feature, as well as the item code provided by the Police Department; 3° les nom et prénom, l'adresse complète, la date de naissance et une description des caractéristiques physiques de la personne de qui le bien a été reçu ainsi que le numéro d'une pièce d'identité avec photo ou tout autre (3) the family name and first name, full address, date of birth and a description of the physical features of the person from whom the item was received, as well as the number of an identification document with photo or any other document confirming the person's identity; VILLE DE DOLLARD-DES-ORMEAUX RÈGLEMENT / BY-LAW R-2016-116 Page 4 document permettant de confirmer l'identité de la personne; 4° la date et l'heure de la réception du bien, ainsi que les nom et prénom de la personne l'ayant reçu; (4) the date and time of receipt of the item, as well as the family name and first name of the person who received it; 5° le montant d'argent remis sur réception du bien. When the item received is a jewel, the description required under paragraph (2) must also include the number of carats, the weight in grams and all visible inscriptions. In addition, a picture of the jewel must be added to the register. 7. Every Operator must enter in the register prescribed in section 3: the family name and first name of the person to whom the item was sold, delivered, given in exchange or otherwise handed over, as well as the date and time of the transaction. 8. Chaque jour, avant 10 h, une copie du registre sur lequel ont été inscrites les transactions de la veille doit être transmise au Service de police, conformément aux exigences prescrites par ordonnance. 8. Every day, before 10 a.m., a copy of the register in which the previous day's transactions were entered must be submitted to the Police Department, in accordance with the requirements prescribed by ordinance. Dans le cas où aucune transaction n'a eu lieu, le registre doit tout de même être transmis avec une mention à cet effet. In the case where no transactions took place, the register must nevertheless be submitted with a note to that effect. 9. CHAPITRE IV INSPECTION CHAPTER IV INSPECTION 10. L'exploitant doit exhiber le registre prescrit à l'article 3, ainsi que tout bien, à l'agent de la paix qui en fait la demande, afin que celui-ci puisse l'examiner. 10. Every Operator must show the register prescribed in section 3, as well as any item, to the peace officer who so requests, for examination purposes. 11. Il est interdit d'empêcher l'accès au registre prescrit à l'article 3 ou à tout bien, ou de nuire de toute autre façon à l'inspection par un agent de la paix dans l'exécution de ses fonctions. 11. No person may prevent access to the register prescribed in section 3 or to any item, or interfere in any way with the inspection carried out by a peace officer in the performance of his duties. CHAPITRE V DISPOSITIONS RELATIVES AUX BIENS CHAPTER V PROVISIONS RELATING TO ITEMS 12. Dès réception d'un bien, l'exploitant doit lui attribuer un numéro de lot. Ce numéro de lot doit être inscrit sur une étiquette apposée sur le bien jusqu'au moment de sa remise par l'exploitant. 12. Upon receipt of an item, every Operator must assign it a lot number. The lot number must be entered on a label affixed to the item until it is handed over by the Operator. The label must be legible and remain affixed to the item at all times. Un nouveau numéro de lot doit être attribué pour chaque bien reçu même s'il s'agit d'un bien qui a déjà fait l'objet d'une remise par le passé. A new lot number must be assigned for each item received, even if it is an item that had already been received in the past. 13. L'exploitant doit garder sur les lieux du commerce pendant au moins 15 (quinze) jours à compter de la date de la réception les contrats originaux ainsi que les biens reçus dans les conditions prévues au présent chapitre. 13. Every Operator must keep on the premises of the establishment for at least 15 (fifteen) days from the date of receipt the original contracts as well as the items received under the conditions in this chapter. Malgré le premier alinéa, la personne de qui le bien a été reçu peut en reprendre possession à l'intérieur du délai de 15 (quinze) jours. Despite the first paragraph, the person from whom an item was received may recover it within 15 (fifteen) days. Au cours de la période de 15 (quinze) jours, le bien doit être mis à part des autres dans un endroit où il pourra faire l'objet de l'inspection requise par tout agent de la paix. During the 15 (fiteen) days period, the item must be set aside from other items in a place where it may be inspected by any peace officer. During such an inspection, the peace officer may be accompanied by any person likely to help him identify items reported as stolen. 14. L'exploitant ne peut recevoir un bien: 14. No Operator may receive an item: 1° d'une personne de moins de 14 ans; (1) from a person less than 14 years of age; 2° d'une personne dont l'identité ne peut être confirmée par une pièce d'identité ou un autre document, tel que requis au paragraphe 3° de l'article 6 ; (2) from a person whose identity cannot be confirmed by an identification paper or other document, as required under paragraph (3) of section 6; 3° ailleurs que sur les lieux du commerce; (3) elsewhere than on the premises of the establishment; 4° tel un véhicule automobile, une partie ou accessoire de véhicule automobile, un tuyau ou autre objet de métal qui entre dans la construction des bâtiments, une bicyclette, une partie ou une pièce de bicyclette, à moins que la personne qui fait remise du bien ne fournisse à l'exploitant un rapport du Service de police établissant que l'objet a été vérifié par un policier et qu'il n'était pas rapporté volé au moment de la vérification. L'exploitant devra conserver ce rapport sur les lieux du commerce pour une période minimale d'un (1) an. Il devra le présenter, à la demande d'un agent de la paix ; (4) such as a motor vehicle, a part or an accessory of a motor vehicle, a pipe or other metal object used in the construction of buildings, a bicycle, a part or an accessory of a bicycle, unless the person who hands over an item provides the Operator with a report from the Police Department establishing that the item was verified by a police officer and that it was not reported stolen at the time of the verification. The Operator must retain this report on the premises of the business establishment for at least one (1) year. Every Operator must place and maintain, outside the establishment on the front of the shop or business establishment, a sign bearing their name and type of business, in visible letters. Il est interdit d'afficher, à l'extérieur comme à l'intérieur du magasin, des avis relatifs à la vérification par le Service de police des biens qui lui sont remis ou qui sont offerts pour en disposer. No person may display, either outside or inside a shop, notices relating to the verification by the Police Department of items handed over or offered to be disposed of. CHAPITRE VII DISPOSITIONS PÉNALES CHAPTER VII PENAL PROVISIONS 16. Quiconque contrevient à l'une ou l'autre des dispositions du présent règlement ou qui permet ou tolère toute contravention aux dispositions du présent règlement commet une infraction et est passible: 16. Any person who contravenes any provision of the present by-law or allows or tolerates any violation of the provisions of the present by-law is guilty of an offense and is liable: 1° s'il s'agit d'une personne physique: (1) in the case of an individual: a) pour une première infraction, d'une amende de 300 $ à 600 $; (a) for a first offense, to a fine of $300 to $600; b) pour une première récidive, d'une amende de 600 $ à 1 200 $; (b) for a second offense, to a fine of $600 to $1,200; c) pour une récidive additionnelle, d'une amende de 1 200 $ à 2 000 $. (c) For a subsequent offense, to a fine of $1,200 to $2,000. 2° s'il s'agit d'une personne morale: (2) in the case of a corporation: a) pour une première infraction, d'une amende de 600 $ à 1 200 $; (a) for a first offense, to a fine of $600 to $1,200; b) pour une première récidive, d'une amende de 1 200 $ à 2 400 $; (b) for a second offense, to a fine of $1,200 to $2,400; c) pour une récidive additionnelle, d'une amende de 2 400 $ à 4 000 $. (c) for a subsequent offense, to a fine of $2,400 to $4,000. CHAPITRE VIII RÈGLEMENTS CHAPTER VIII BY-LAWS 17. Le Conseil peut, par règlement: 17. Le présent règlement remplace le règlement R-2009-050 intitulé « Règlement sur les commerces d'articles d'occasion ». 18. The present by-law replaces By-law R- 2009-050 entitled "By-law concerning establishments dealing in second-hand goods". CHAPITRE X ENTRÉE EN VIGUEUR CHAPTER X COMING INTO FORCE 19. Le présent règlement entrera en vigeur selon la Loi. 19. The present by-law shall come into force according to Law. Il doit le déposer en personne, conformément aux exigences du règlement, au Centre opérationnel du secteur où est situé le commerce. A.1 Operators of pawnshops and establishments dealing in second- hand goods who do not have a computerized system containing the register must use form F520-58 - Marchandises brocantées/contrôle, provided by the Police Department. The form must be submitted in person, in accordance with by-law requirements, to the Operational Centre of the sector where the business is located. A.2 L'exploitant d'un commerce de prêt sur gages ou d'articles d'occasion qui dispose d'un système informatisé contenant le registre doit transmettre ce registre par voie électronique dans un format qui sera fournit par le Service de police. Le format et la disposition des données devront être conformes aux exigences du Service de police. A.2 Operators of pawnshops and establishments dealing in second- hand goods who have a computerized system containing the register must transmit the register by electronic means using the format provided by the Police Department, in accordance with the requirements of that format. A.3 Lorsqu'une transaction concerne un bijou, une photo numérique rapprochée de celui-ci permettant de l'identifier clairement doit également être transmise. Le format et l'identification des photos numériques devront être conformes aux exigences du Service de police. A.3 When a transaction concerns a jewel, a close-up digital photograph clearly identifying it must also be submitted. The format and the identification of the digital photographs must conform to the requirements of the Police Department.
