ARTICLE 1 : DÉFINITIONS
Dans le présent règlement, à moins que
le contexte n'indique un sens différent,
on entend par :
SECTION 1: DEFINITIONS
In the present By-law, unless the context
otherwise
requires,
the
following
expressions shall mean:
Aire de stationnement :
Espace réservé au stationnement
des
véhicules,
directement
et
facilement accessible.
Parking lot:
An
area
directly
and
readily
accessible,
designed,
used
or
intended for the parking of vehicles.
Allée :
Le passage débutant à la voie
publique ou dans une entrée de
stationnement menant à une entrée
du bâtiment.
Walkway:
The passageway beginning at the
public road or in a driveway leading to
the front entrance of a building.
Autorité compétente :
La personne occupant la position,
remplissant les fonctions ou agissant
en qualité de directeur d'un des
Services de la Ville, son représentant
ou employé autorisé à agir en son
nom en conformité avec les pouvoirs,
ordres et devoirs particuliers qui lui

en totalité ou en partie le présent
règlement.
Competent authority:
The person occupying the position,
fulfilling the duties or acting as a
Director of one of City's Departments,
his representative or an employee

conformity with the powers, orders
and specific duties which have been
assigned to him as well as any person
appointed
by
the
Council,
by
resolution, for the enforcement of the
present by-law, wholly or in part.

Front yard:
For interior sites and corner sites, the
front yard is the space between the
front property line of the site and the
extension of the front wall of the

site to the side property lines, when
the building is set parallel to the street
right-of-way. When the building is set
obliquely in relation to the street right-
of-way, the front yard is the space
between the front property line of the
site and two lines parallel to the street
which join the side property lines of
the site at the front corners of the
principal building.

Side yard:
The space between, on the one
hand, the sides of the principal
building nearest the side property
lines at the point where they meet
the lines marking the extension of
the front and back walls of the

the side yards end at a line drawn
parallel to the street and joining the
side property lines to the front and
back
corners
of
the
principal
building.

Entrepreneur en déneigement :
Toute personne qui effectue, au

compte
du
propriétaire,
de
l'occupant ou de la personne ayant
charge d'une propriété privée de
nature résidentielle, commerciale,
industrielle ou institutionnelle.
Snow removal contractor:
Any person who carries out, by
means of motorized vehicle, clearing
and snow removal works for the
owner, the occupant or the person in
charge of a private property of a
residential, commercial, industrial or
institutional nature.
Propriété publique:
Tous les terrains, bâtiments et objets
appartenant à la Ville et, sans limiter
la généralité de ce qui précède, les
rues, avenues, ruelles, trottoirs,
terrains, poteaux, égouts, fossés et
cours d'eau. Pour les fins du présent
règlement, la propriété publique
n'inclut pas l'emprise de la voie
publique.
Public property:
All lands, buildings and objects
belonging to the City and, without
restricting
the
meaning
of
the
foregoing, streets, avenues, alleys,
sidewalks, lands, posts, sewers,
ditches
and
streams.
For
the
purpose of the present by-law the
public property does not include the
public right-of way.

Public road:
The surface of land or of constructive
works whose maintenance is the
responsibility
of
a
city,
of
a
government or of one of its agencies,
and on a part of which are built one
or more roads opened to the public
traffic of motor vehicles and, as the
case may be, one or more cycling
paths.
ARTICLE 2 : TERRITOIRE ASSUJETTI
SECTION 2: TERRITORY
2.1 Le présent règlement s'applique à
tout le territoire de la Ville.
2.1 The present by-law shall apply to the
territory of the City.

ARTICLE 3 : OBLIGATIONS DE L'EN-
TREPRENEUR PRÉALABLEMENT AU
DÉNEIGEMENT
SECTION 3: CONTRACTOR'S OBLI-
GATIONS BEFORE SNOW REMOVAL
3.1 Tout entrepreneur en déneigement
doit, avant d'effectuer des travaux de
déneigement ou déblaiement de la
neige sur le territoire de la Ville,
obtenir préalablement un permis du
Service de l'aménagement urbain et
de l'ingénierie de la Ville moyennant
la somme de 50 $ pour chacun des
véhicules moteurs à être utilisés.
Ledit
permis
est
valide
du
1er novembre au 31 octobre et est
non cessible.
3.1 Any snow removal contractor must,
before carrying out clearing and
snow removal works within the
territory of the City, first obtain a
permit from the Urban Planning and
Engineering Department of the City
upon payment of $50 for each motor
vehicle to be used. The said permit
shall be valid from November 1 to
October 31
and
shall
be
non-
transferable.
3.2 Aux fins de l'obtention du permis
prévu à l'article 3.1, l'entrepreneur
en déneigement doit remplir une
demande
contenant
les
renseignements suivants :
3.2 To obtain the permit mentioned in
Section 3.1, the snow removal
contractor shall fill a request
containing the following information:
i) les nom, prénom, adresse et
numéro
de
téléphone
du
propriétaire de tout véhicule
moteur
à
être
utilisé
par
l'entrepreneur en déneigement
sur le territoire de la Ville ;
i) the
surname,
given
name,
address and telephone number
of the owner of any motor vehicle
to be used by the snow removal
contractor in the territory of the
City;
ii) les marque, modèle, année,
numéro de série et copie du
certificat d'immatriculation de tout
véhicule moteur à être utilisé par
l'entrepreneur en déneigement
sur le territoire de la Ville ;
ii) the trade mark, model, year,
serial number and copy of the
registration certificate of any
motor vehicle to be used by the
snow removal contractor in the
territory of the City;
iii) le cas échéant, une copie de la
déclaration
d'immatriculation
dans le registre des entreprises
individuelles, des sociétés et des
personnes
morales
de
l'entrepreneur en déneigement;
et
iii) if necessary, a copy of the
declaration of registration in the
register of sole proprietorships,
partnerships and legal persons
by the snow removal contractor;
and
iv) le cas échéant, si l'entrepreneur

déneigement
est
une

siège social et une copie de l'acte
constitutif de cette personne
morale.
iv) if the snow removal contractor is
a legal person, the address of its
head office and a copy of the
incorporation documents of the
said legal person.

3.3 Tout entrepreneur en déneigement
doit poser des poteaux, de chaque
côté des aires où il effectuera
l'enlèvement de la neige. Ces
poteaux doivent indiquer de façon
claire et lisible le numéro du permis
de la Ville ou le nom et le numéro de
téléphone
de
l'entrepreneur
en
déneigement, et doivent être visibles
en tout temps.
3.3 Any snow removal contractor must
place posts on each side of any
location where he shall carry out
snow removal. These posts must
indicate in a clear and legible
manner, the number of the City's
permit or the name and telephone
number
of
the
snow
removal
contractor and must be visible at all
times.

These posts must be installed after
November 1st and removed before

3.4 Tout entrepreneur en déneigement
doit
apposer
les
autocollants,
obtenus lors de la délivrance du
permis, dans le coin supérieur
gauche de la lunette arrière de
chaque véhicule moteur utilisé pour
le déneigement. L'autocollant doit
être visible de l'extérieur du véhicule.
3.4 Any snow removal contractor must
affix the stickers obtained at the
issuance of the permit, on the upper
left corner of the rear window of each
motor-vehicle
used
for
snow
removal. The sticker must be visible
from the exterior of the vehicle.
3.5 Avant l'obtention du permis prévu à
l'article
3.1,
l'entrepreneur
en
déneigement doit démontrer à la
satisfaction de la Ville que chaque
équipe
de
travail
utilise
un
équipement permettant d'effectuer le
déneigement de la manière prévue à
l'article 4.1 du présent règlement.
3.5 Prior to obtaining a permit as
provided for in Section 3.1 of the
present Article, the snow removal
contractor must demonstrate to the
satisfaction of the City that each of
his work teams shall use an
equipment permitting to carry out the
snow
removal
in
the
manner
prescribed by Section 4.1 of the
present by-law.
3.6 L'autorité compétente peut révoquer
un permis déjà émis et elle peut
refuser d'en émettre un à l'égard d'un
entrepreneur si lui-même ou une
personne agissant pour ce dernier
contrevient
à
l'une
ou
l'autre
disposition du présent règlement.

3.6 If the contractor or person acting on
its behalf contravenes any provision
of the present by-law, the competent
authority may revoke a permit that
has already been issued or refuse to
issue a permit to the contractor.

ARTICLE 4 : OBLIGATIONS APPLI-
CABLES LORS DU DÉNEIGEMENT
SECTION 4 : APPLICABLE OBLIGA-
TIONS DURING SNOW REMOVAL
4.1 Lors
des
opérations
de
déneigement
des
entrées
de
stationnement, des allées et des
aires
de
stationnement,
l'entrepreneur en déneigement doit
souffler ou soulever la neige et la
déposer de part et d'autre de
l'entrée de stationnement, de l'allée
ou de l'aire de stationnement sur la
cour avant ou latérale. Sans
restreindre la généralité de ce qui
précède, il est interdit à quiconque :
4.1 During snow removal operations of
driveways, walkways, and private
parking lots, the snow removal
contractor must blow or lift the snow
and deposit it on both sides of the
private driveway, walkway or parking
lot on the front or side yard. Without
restriction of the general sense of the
above-mentioned,
it
shall
be
forbidden for anyone:

i) De
transporter,
pousser,
déposer, permettre ou tolérer
que soit transportée, poussée ou
déposée la neige provenant de
l'entrée de stationnement, l'allée
ou d'une aire de stationnement
sur le côté opposé de la voie
publique.
i) To transport, push, deposit, allow
or
tolerate
that
the
snow
originating from the driveway,
walkway or a parking lot be
carried, pushed and laid on the
opposite side of the public road.
ii) D'amonceler, de permettre ou
de tolérer que soit amoncelée de
la neige ou de la glace sur un
terrain privé, sur la propriété
publique
ou
sur
l'emprise
publique, aux intersections des
voies publiques, de façon à
nuire
à
la
visibilité
des
automobilistes.
ii) To accumulate, to allow or to
tolerate that snow or ice be
accumulated on private land, on
public property or on the public
right-of-way
at
public
road
intersections in such a way as to
obstruct the visibility of drivers.
iii) D'amonceler, de permettre ou
de tolérer que soit amoncelée de
la neige ou de la glace sur un
terrain privé ou sur la propriété
publique
à
une
hauteur
excédant trois (3) mètres.
iii) To accumulate, to allow or to
tolerate that snow or ice be ac-
cumulated on private land or on
public property at a height
exceeding three (3) metres.

déposée de quelque façon de la
neige ou de la glace dans un

radius of one and a half (1.5)
metre of a fire hydrant.

or deposited in any way on any
public property or on the public
right-of-way.

4.2 Nonobstant les dispositions des
articles précédents, la Ville se
réserve le droit de souffler ou
déposer de la neige sur l'emprise de
la voie publique, incluant les entrées
circulaires quant à la partie opposée
au garage ou à l'allée menant au
bâtiment principal, et ce, en plus de
la neige laissée tout au long de
l'emprise de la voie publique lors du
passage du chasse-neige (charrue).
4.2 Notwithstanding the provisions of the
preceding
Sections,
the
City
reserves the right to blow and
deposit snow on public right-of-way,
including circular driveways on the
portion opposite to the garage or the
walkway
leading
to
the
main
building, and this, in addition to the
snow displaced on the total frontage
of the public right-of-way by the
snowplow.

4.3 Toute opération de déneigement,
entreprise
par
la
Ville
ou
un
entrepreneur de la Ville avec une
souffleuse à neige d'une masse nette
de plus de 900 kg, dans les voies
publiques où la vitesse permise

4.3 All snow operations undertaken on a
public thoroughfare by the City or a
City contractor with a snow blower of
more than 900 kg, where the speed
limit is 50 km/h or less, must be done
in the presence of a walking safety
escort ahead of the operating snow
blower.

4.4 Nonobstant l'article 4.3 du présent

safety
escort
is
authorized
to
exercise his/her functions aboard a
light
motor
vehicle
when
the
following conditions are satisfied:
i) Le

assigned the task of overseeing the
operation of the snow blower and be

during snow blowing operations;

iv) The safety escort is in two-way radio
communication with the snow blower
operator at all times during snow
blowing operations; and

safety
escort
is
able
to
instantaneously and completely stop
the motion of the snow blower's

ARTICLE 5: OBLIGATIONS DES PRO-
PRIÉTAIRES
SECTION 5: OWNERS' OBLIGATIONS
5.1 Tout propriétaire, qui retient les
services d'un entrepreneur en dé-
neigement pour effectuer le dénei-
gement
de
l'entrée
de
stationnement, de l'allée, et/ou des
aires
de
stationnement,
doit
s'assurer qu'il détient un permis
valide
pour
l'année
courante,
dûment délivré par la Ville.
5.1 Any owner, who hires a snow
removal contractor to carry out the
snow removal of his driveway,
walkway and/or parking lots, must
assure himself that he has obtained
a valid permit for the current year
duly issued by the City.
ARTICLE 6 : INFRACTIONS ET PÉNA-
LITÉS
SECTION 6: INFRACTIONS AND PEN-
ALTIES
6.1 Quiconque contrevient à l'article 5.1
du présent règlement commet une
infraction et est passible, en outre
des
frais,
d'une
amende
de
cinquante dollars (50 $).
6.1 Whosoever shall contravene the
provisions of Section 5.1 commits an
infraction and is liable, in addition to
the costs, to a fine of fifty dollars
($50).
6.2 Quiconque contrevient à une dis-
position du présent règlement, pour
laquelle aucune peine spécifique
n'est prévue, commet une infraction
et est passible, en outre des frais,
d'une amende. Cette amende ne doit
pas être inférieure à cinquante
dollars (50 $) dans tous les cas, ni
excéder mille dollars (1 000 $) si le
contrevenant est une personne
physique ou deux mille dollars
(2 000 $) s'il est une personne
morale; pour une récidive, ladite
amende ne peut excéder deux mille
dollars (2 000 $) si le contrevenant
est une personne physique ou
quatre mille dollars (4 000 $) s'il est
une personne morale.
6.2 Whosoever
shall
contravene
a
provision of the present By-law for
which no specific penalty has been
provided shall commit an infraction
and shall be liable to a fine, in
addition to costs. The said fine shall
not be less than fifty dollars ($50) in
all cases, nor shall it exceed one
thousand dollars ($1,000) when the
offender is a natural person or two
thousand dollars ($2,000) when the
offender is a legal person; if such
offence is repeated, the said fine
shall not exceed two thousand
dollars ($2,000) when the offender is
a natural person or four thousand
dollars ($4,000) when the offender is
a legal person.
6.3 Quiconque

6.3 Whosoever shall contravene any
provision of Section 4.1 of the
present by-law may be required to
remove the accumulated snow or ice
within a period of twenty-four (24)
hours of a written notice to that
effect, delivered by the Competent
Authority; should the offender fail to
comply with such notice, the City
may proceed with the removal of the
accumulated snow or ice and claim
the expenses of the said removal to
the offender.

6.3.1Quiconque

6.4 Nonobstant ce qui précède, aucun

au territoire de Dollard-des-Ormeaux..
SECTION 7: RESCINDING OF BY-
LAWS
The
present
by-law
rescinds
and
replaces By-Law RCA06-2003-006 of the
Borough
of
Dollard-des-
Ormeaux/Roxboro
regarding
its
application to the Dollard-des-Ormeaux
territory.
ARTICLE 8 : ENTRÉE EN VIGUEUR
Le présent règlement entre en vigueur
selon la Loi.
SECTION 8: COMING INTO FORCE
The present by-law shall come into force
according to Law.
