BY-LAW CONCERNING THE USE OF
SEWERS
ATTENDU QUE le Règlement 46 concernant
la construction des égouts dans la Ville de
Dollard-des-Ormeaux a été adopté en 1962 et
que son contenu est désuet et ne reflète pas
les normes d'aujourd'hui ;
WHEREAS the By-law 46 concerning the
construction of sewers in the Town of
Dollard-des-Ormeaux was adopted in 1962
and its contents are outdated and do not
reflect today's standards ;
ATTENDU QU'il y a lieu d'adopter un nouveau
règlement dans le but de fournir les outils
nécessaires afin de mieux protéger le public,
l'environnement et les égouts de la Ville et
d'établir les amendes pour toute infraction au
présent règlement ; et
WHEREAS it is necessary to adopt a new
by-law in order to provide the tools needed
to better protect the public, the environment
and the City's sewers and to establish the
fines for any offence to the present by-law;
and
ATTENDU QU'un avis de motion du présent

DÉFINITIONS
CHAPTER 1
DEFINITIONS
1.
Dans le présent règlement, le genre
masculin comprend les deux sexes, à moins
que le contexte n'indique le contraire ; le
nombre
singulier
s'étend
à
plusieurs
personnes ou à plusieurs choses de même
espèce, chaque fois que le contexte se prête
à cette extension ; et, le nombre pluriel peut
s'étendre à une seule personne ou une seule
chose si le contexte s'y prête. Si un mot ou une
expression n'est pas spécifiquement défini
dans le présent règlement, le sens commun
défini au dictionnaire prévaudra.
1. In the present by-law, the masculine
gender shall include both sexes, unless the
contrary intention is evident by the context;
the singular number shall extend to several
persons or things of the same sort,
whenever the context suggests of such
extension; and, the plural number can
apply to one person only or to one thing
only if the context so permits. If a word or
expression is not specifically defined here,
it is understood to have its common
dictionary definition.

BPC (PCBs): Tout biphényle monochloré ou

Partie

municipal, les eaux pluviales et usées d'un

Canalisation (Conduit): Réseau de tuyaux
ou canaux destinés au transport des fluides.
Combustible (Fuel): Alcool, essence, naphte,
carburant diesel, mazout ou autre substance
inflammable destinée à servir de combustible.
Cours d'eau (Watercourse): Chenal, fossé
(ou dépression), naturel ou artificiel, dans
lequel de l'eau s'écoule de façon continue ou
intermittente.
Déchet biomédical (Biomedical waste):
1° Tout
déchet
anatomique
humain
constitué par une partie du corps ou d'un de
ses organes, à l'exception des dents, des
ongles, des cheveux, du sang et des liquides
biologiques ;
2° Tout
déchet
anatomique
animal
constitué par un corps, une partie du corps ou
d'un de ses organes, à l'exception des
phanères,
du
sang
et
des
liquides
biologiques ;
3° Tout déchet non anatomique constitué
de l'un des éléments suivants :
a) un objet piquant, tranchant ou cassable
qui a été en contact avec du sang, un liquide
ou un tissu biologique, provenant de soins
médicaux, dentaires ou vétérinaires ou d'un
laboratoire de biologie médicale ou vétérinaire
ou un tel objet provenant de l'exercice de la
thanatopraxie;
Authorized
representative
(Représentant autorisé): The persons
empowered to apply the provisions of this
by-law including the Division Heads,
Section
Heads,
foremen
and
civil
engineering technicians at the Urban
Planning and Engineering or the Public
Works Departments.
Biomedical waste (Déchet biomédical):
(1) Any
human
anatomical
waste
consisting of body parts or organs,
excluding teeth, nails, hair, blood and
biological liquids;
(2) Any
animal
anatomical
waste
consisting of carcasses, body parts or
organs, but excluding teeth, nails, hair,
claws, feathers, blood and biological
liquids;
(3) Any non-anatomical waste consisting
of any of the following:
(a) a sharp or breakable object having
been in contact with blood or with a
biological liquid or tissue and having been
used in medical, dental or veterinary care or
in
a
medical
or
veterinary
biology
laboratory, or such an object used in
thanatopraxy;
(b) a biological tissue, cell culture,
microbial culture or material in contact with
such tissue or culture, used in a medical or
veterinary biology laboratory;
(c) a live vaccine;
(d) any material that has been saturated
with blood and used in medical care, in a
medical
biology
laboratory
or
in
thanatopraxy.

b) un tissu biologique, une culture cellulaire,

Déchet inflammable (Flammable waste): Un
déchet inflammable est :
1° un
liquide,
autre
qu'une
solution
aqueuse, contenant moins de 24 % d'alcool
par volume et dont le point d'éclair est inférieur
à 93 °C tel que déterminé par une méthode
d'essai approuvée;
2° un solide pouvant, à une température et
une pression normales, s'enflammer sous
l'effet de friction, de l'absorption d'humidité ou
de changements chimiques spontanés et
pouvant, une fois enflammé, brûler d'une
manière si intense et persistante qu'il constitue
un danger;
3° un gaz comprimé inflammable;
4° une matière comburante.
Déchet réactif (Reactive waste): Une
matière qui :
1° est
normalement
instable
et
subit
facilement des changements violents sans
détonation ;
2° réagit violemment au contact de l'eau ;
3° forme des mélanges potentiellement
explosifs avec l'eau ;
4° lorsque mélangée à l'eau, produit des
gaz, des vapeurs ou des émanations toxiques
en quantité suffisante pour constituer un
danger
pour
la
santé
humaine
ou
l'environnement ;
5° contient du cyanure ou du sulfure et qui,
lorsqu'exposée à un pH variant entre 2 et 12,5,
peut dégager des gaz, des vapeurs ou des
émanations toxiques en quantité suffisante
pour constituer un danger pour la santé
humaine ou l'environnement ;
6° peut détoner ou exploser si elle se trouve
en présence d'une forte source d'amorçage ou
si elle est chauffée dans un milieu fermé ;
7° à une température et une pression
normales, peut facilement détoner, exploser
ou être sujette à une décomposition explosive.
Blowdown water (Eau de purge): The
recirculating water that is discharged from a
cooling or heating water system, for the
purpose of controlling its water level or for
discharging materials contained therein,
the further build-up of which would or might
impair its operation.
Chemical oxygen demand (Demande
chimique en oxygène): A measure of the
capacity of water to consume oxygen as a
result of oxidation of inorganic chemicals
and decomposition of organic matter.
Combustible
liquid
(Liquide
combustible): A liquid that has a flash
point not less than 37.8 °C and not greater
than 93.3 °C.
Connection (Branchement): That part or
those parts of any pipe or system of pipes
that convey to the municipal sewer, storm
and waste water from a building or an
evacuation system.
Conduit (Canalisation): A network of
pipes or channels for conveying fluids.
Director (Directeur): The Director of the
Urban
Planning
and
Engineering
Department or the Director of Public Works,
or their representatives duly authorized to
act on their behalf.
Dwelling
(Habitation):
A
building
designed, used or intended for residential
purposes and containing one or more
dwelling units.
Flammable waste (Déchet inflammable):
A flammable waste is a substance that is:
(1) a liquid, other than an aqueous
solution containing less than 24% alcohol
by volume and has a flash point less than
93 °C as determined by an accredited test
method;
(2) a solid and is capable, under standard
temperature and pressure, of causing fire
through friction, absorption of moisture or
spontaneous chemical changes and, when
ignited, burns so vigorously and persistently
that it creates a danger;
(3) a flammable compressed gas;
(4) an oxidizing substance.
Fuel (Combustible): Alcohol, gasoline,
naphtha, diesel fuel, fuel oil or any other
flammable substance intended to be used
as a fuel.
Ground water (Eau souterraine): The
water
beneath
the
ground
surface
accumulating as a result of seepage.

Demande chimique en oxygène (Chemical
oxygen demand): Une mesure de la capacité
de l'eau à consommer de l'oxygène par
l'oxydation de substances inorganiques et la

Déversement (Spill): Un rejet direct ou
indirect
dans
un
réseau
d'égout
ou
l'environnement naturel qui est anormal par sa

sous l'effet de l'infiltration.
Eau
usée
(Wastewater):
Un
mélange
composé d'eau et de résidus transportés par
l'eau provenant d'installations résidentielles,
commerciales, industrielles ou institutionnelles
ou d'une autre source.
Égout (Sewer): Un tuyau, une conduite, un
drain, une canalisation à écoulement libre ou
un fossé servant à la collecte et au transport
des eaux usées, des eaux pluviales ou de
l'eau non contaminée, ou une combinaison de
celles-ci.
Égout domestique (Sanitary sewer): L'égout
servant à la collecte et au transport des eaux
usées domestiques ou industrielles, ou une
combinaison de celles-ci.
Égout pluvial (Storm sewer): L'égout servant
à la collecte et au transport des eaux non
contaminées, des eaux pluviales ou des eaux
de drainage d'un terrain ou d'un cours d'eau,
ou une combinaison de celles-ci.
Habitation (Dwelling): Un bâtiment conçu,
utilisé ou destiné à être utilisé à des fins
résidentielles et comprenant un ou plusieurs
logements.

dwelling): Une habitation conçue, utilisée ou

(Substance
dangereuse): Any substance or mixture of
substances, other than a pesticide, that
exhibits characteristics of flammability,
corrosion, reactivity or toxicity.
Industrial
(Industriel):
Pertaining
to
manufacturing, commerce, business or
institutions as opposed to domestic or
residential.
Matter (Matière): Any solid, liquid or gas.
PCBs (BPC): Any monochlorinated or
polychlorinated biphenyl or any mixture that
contains one or more of them.
Person (Personne): Natural and legal
persons, associations of persons, trusts
and cooperatives.
Pesticide: Any substance, matter or micro-
organism intended to control, destroy,
reduce, attract or repel, directly or indirectly,
an organism which is noxious, harmful or
annoying for a human being, fauna,
vegetation, or intended to regulate the
growth of vegetation, excluding medicine or
vaccine.
pH: A measure of the hydrogen ion activity
(or concentration) of a solution measured
on a logarithmic scale.
Reactive waste (Déchet réactif): A
substance that:
(1) is normally unstable and readily
undergoes
violent
changes
without
detonating;
(2) reacts violently with water;
(3) forms potentially explosive mixtures
with water;
(4) when mixed with water, generates
toxic gases, vapors or fumes in a quantity
sufficient to present danger to human
health or the environment;
(5) is a cyanide or sulphide bearing
waste which, when exposed to pH
conditions between 2 and 12.5, can
generate toxic gases, vapors or fumes in a
quantity sufficient to present danger to
human health or the environment;
(6) is capable of detonation or explosive
reaction if it is subjected to a strong
initiating source or if heated under
confinement;
(7) at
standard
temperature
and
pressure, is readily capable of detonation
or explosive decomposition or reaction.

gênant pour l'être humain, la faune, la
végétation ou destiné à servir de régulateur de
croissance de la végétation, à l'exclusion d'un
médicament ou d'un vaccin.
pH: L'indice exprimant l'activité (ou la
concentration) de l'ion hydrogène dans une
solution à l'aide d'une échelle logarithmique.
Représentant
autorisé
(Authorized
representative): Les personnes autorisées à
appliquer
les
dispositions
du
présent
règlement qui comprennent les chefs de
division,
les
chefs
de
section,
les
contremaîtres et les surveillants de travaux
des services de l'aménagement urbain et de
l'ingénierie et des travaux publics.
Substance
dangereuse
(Hazardous
substance):
Toute
substance
ou
tout
mélange de substances, autre qu'un pesticide,
qui
présente
des
caractéristiques
d'inflammabilité, de corrosion, de réactivité ou
de toxicité.
Substance toxique (Toxic substance):
Toute substance pouvant causer la mort, la
maladie, des anomalies du comportement, un
cancer,
des
mutations
génétiques,
des
anomalies physiologique ou reproductive, des
déformations physiques, chez tout organisme,
ou
qui
peut
devenir
toxique
après
concentration dans le réseau trophique ou
lorsque combinée à d'autres substances.
Sanitary sewer (Égout domestique): A
sewer for the collection and transmission of
domestic or industrial wastewater or any
combination thereof.
Sewer (Égout): A pipe, conduit, drain,
open channel or ditch for the collection and
transmission of wastewater, storm water or
uncontaminated water, or any combination
thereof.
Single
family
dwelling
(Habitation
unifamiliale): A dwelling designed, used or
intended for occupancy as one (1) dwelling
unit.
Spill (Déversement): A direct or indirect
discharge into the wastewater works, storm
sewer or the natural environment which is
abnormal in quantity or in quality, in light of
all the circumstances of the discharge.
Storm sewer (Égout pluvial): A sewer for
the
collection
and
transmission
of
uncontaminated water, storm water, or
drainage from land or from watercourse, or
any combination thereof.
Storm water (Eau pluviale): The water
running off the surface of a drainage area
during or immediately after a period of rain
or snow melt.
Total suspended solid (Matière en
suspension): An insoluble matter in a
liquid that is removable by filtration.
Toxic substance (Substance toxique):
Any substance liable to cause death,
disease, behaviour anomalies, cancer,
genetic
mutations,
physiological
or
reproductive
anomalies,
physical
deformations, to any organism, or that can
become toxic after concentration within the
food chain or once combined with other
substances.
Wastewater (Eau usée): The composite of
water and wastes carried by water coming
from residential, commercial, industrial or
institutional premises or any other source.
Watercourse (Cours d'eau): An open
channel, ditch or depression, either natural
or artificial, in which flow of water occurs
either continuously or intermittently.

3. Quiconque
empêche
un
représentant
mandaté par la Ville de faire une inspection, le
gêne dans l'exercice de ses pouvoirs,
contrevient au présent règlement et se rend
passible des peines prévues par le présent
règlement.
3. A person who prevents a representative
mandated by the City from making an
inspection, or who interferes with that
person in the exercise of his powers,
contravenes this By-law and is liable to the
penalties provided for herein.
4. Le représentant mandaté par la Ville a le
droit d'entrer en tout temps raisonnable, en
tout lieu public ou privé, dans ou hors des
limites de la Ville et d'y rester aussi longtemps
qu'il est nécessaire afin d'exécuter une
inspection, observer, mesurer, échantillonner
et tester les eaux usées et pluviales ou de
constater si les dispositions du présent
règlement
ont
été
observées.
Toute
collaboration requise doit lui être donnée pour
lui faciliter l'accès. Ce représentant doit, sur
demande, exhiber une carte d'identité délivrée
par la Ville attestant sa qualité.
4. The representative mandated by the
City is entitled to enter at any reasonable
time, any public or private place, inside or
outside the City limits and to remain in that
place as long as necessary to make an
inspection, observe, measure, sample or
test the wastewater or storm water or to
ascertain if the provisions of the By-law
have
been
complied
with.
This
representative must be given the necessary
cooperation to facilitate such access. Upon
request, this representative shall produce
an identification card, delivered by the City,
attesting of his capacity.

permettre que soient rejetées ou déversées,
directement ou indirectement, des eaux usées
dans un égout domestique ou un branchement
raccordé à un égout domestique, si :

discharge or deposit or cause or permit the
discharge or deposit of wastewater into a
sanitary sewer or a connection to any
sanitary sewer in circumstances where:

(1) to do so may cause or result in:

authorized by the City to inspect, operate,
maintain, repair, or otherwise work on a
wastewater works;

(b) an offence under the Environment
Quality Act (LQE), as amended from time to
time, or any regulation made there under;

traitement des eaux usées ;
(c) an interference with the operation or
maintenance of a wastewater works or with
any wastewater treatment process;

(d) a hazard to any person, animal,
property or vegetation;

1,5 mètre du bâtiment dans les limites de la
propriété en évitant l'infiltration vers le drain de

servant à broyer des résidus alimentaires dont
les effluents seront rejetés directement ou
indirectement dans un égout domestique ou
pluvial. Tout broyeur de résidus alimentaires
installé avant l'entrée en vigueur de ce
règlement doit être enlevé avant le 1er janvier
2018.

law, no person shall install or operate,
within the City, any food waste grinding
devices, the effluent from which will
discharge directly or indirectly into a
sanitary or storm sewer. Any food waste
grinder installed before the coming into
force of this By-law must be removed

a restaurant or other industrial, commercial
or institutional premises where food is
cooked, processed or prepared, and where
the drains are connected directly or
indirectly to a sewer, shall take all
necessary measures to ensure that oil and
grease are prevented from entering the
sewer in concentration levels that exceed
the provisions of this By-law.
