2015 AND TO MODIFY BY-LAW 650
CONCERNING PETS
CONSIDÉRANT
QUE
le
règlement
666
constitue un amendement au règlement 650 par
lequel ont été introduites des dispositions
permettant la promenade de chiens sans laisse
selon certaines conditions.
WHEREAS By-Law 666 is a modification to
By-Law 650 by which were introduced
provisions allowing off-leash dog walking
under certain conditions.
CONSIDÉRANT la Loi visant à favoriser la
protection des personnes par la mise en place
d'un encadrement concernant les chiens (P-
38.002) et son règlement d'application adoptés
par le gouvernement provincial en juin 2020.
CONSIDERING the Act to promote the
protection of persons by establishing a
framework with regard to dogs (chapter P-
38.002) and its implementation regulation
adopted by the Provincial Government in June
2020.
CONSIDÉRANT
que
ledit
Règlement
d'application de la Loi visant à favoriser la
protection des personnes par la mise en place
d'un encadrement concernant les chiens (P-
38.002, r. 1) prévoit notamment, qu'un chien doit
être tenu en laisse en tout temps dans un lieu
public.
WHEREAS the said Act to promote the
protection of persons by establishing a
framework with regard to dogs (chapter P-
38.002) provides in particular, that a dog must
be on leash at all times in a public place.
CONSIDÉRANT QUE l'article 7 de la Loi précité
prévoit
que
« Tout
règlement
municipal
comportant une norme moins sévère que celle
prévue par un règlement pris en vertu de la
présente loi est réputé modifié et la norme du
règlement municipal remplacée par celle établie
par le règlement pris en vertu de la présente
loi. »
WHEREAS section 7 of the aforementioned
Act provides that «Any municipal by-law
containing a less strict standard than one
prescribed by a regulation made under this Act
is deemed to have been amended and the
standard in the municipal by-law replaced by
the one prescribed by the regulation made
under this Act.»
CONSIDÉRANT que les dispositions adoptées
par le règlement 666 ne sont ainsi plus
applicables et que, par souci de cohésion, il y a
lieu de les abroger.
WHEREAS the provisions adopted in By-Law
666 are no longer applicable and, for the sake
of cohesion, they should be repealed.
CONSIDÉRANT que quelques dispositions du
règlement 650 doivent être ajustées pour
correspondre minimalement aux exigences
établies par le Règlement précité.
WHEREAS a few provisions of By-Law 650
must be adjusted to meet the minimum
requirements
established
by
the
aforementioned Act;
CONSIDÉRANT que, à tout autre égard, la
tenue d'un registre pour les chats n'est plus
jugée utile.
WHEREAS, in this regard, a cat registry is no
longer deemed necessary.
CONSIDÉRANT QUE l'avis de motion du
présent règlement a été dûment donné par le
conseiller du district 5 (Heights Est) Jim Duff à
la séance ordinaire du 7 décembre 2020;
WHEREAS a notice of motion was duly given
by the Councillor for district 5 (Eastern
Heights) Jim Duff at the regular sitting held on,
December 7th, 2020;
ARTICLE 1
SECTION 1
Le règlement 666-2015 modifiant le règlement
650 sur les animaux de compagnie est abrogé.
By-Law 666-2015 modifying By-Law 650
concerning pets is hereby repealed.

Le paragraphe h) de l'article 4.30 du règlement
650 sur les animaux de compagnie revient donc
à son libellé initial, soit le suivant :
Paragraph h) of section 4.30 of By-Law 650
concerning pets therefore returns to its original
wording, which is as follows:
« le fait pour un chien de se trouver à l'extérieur
du terrain sur lequel se situe le bâtiment ou la
partie du bâtiment occupée par son gardien ou
propriétaire, ou d'errer dans les rues et places
publiques sans être accompagné et tenu en
laisse de plus de 1,85 m ou 6 pi de longueur par
une personne capable de maîtriser ou de
contrôler l'animal ».
«a dog to be outside the limits of the land on
which is found the building or part of the
building occupied by the guardian or owner, or
to wander on streets and public places without
being accompanied and on a leash of more
than 1,85 meters or 6 feet in length by a
person able to control or master the animal».
ARTICLE 2
SECTION 2
L'article 4.1 du règlement 650 sur les animaux
de compagnie est modifié afin qu'il se lise
désormais ainsi :
Section 4.1 of By-Law 650 concerning pets
shall be amended to read as follows:
« Nul gardien ne peut garder un chien à
l'intérieur des limites de la ville à moins d'avoir
obtenu, au préalable, une licence conformément
aux dispositions du présent règlement, une telle
licence devant être obtenue dans les quinze
(15) jours suivant l'acquisition ou suivant le jour
où le chien atteint l'âge de trois (3) mois, le délai
le plus long s'appliquant.
Le coût annuel de chaque licence pour chien est
déterminé par le règlement de tarification en
vigueur. »
« No guardian may keep a dog within the
boundaries of the Town without having
obtained beforehand a license in conformity
with provisions of the present by-law, such a
license must be obtained within fifteen (15)
days following acquisition or the day after the
dog reaches the age of three (3) months, the
longest delay being applicable.
The annual cost of each dog license shall be
determined by the Tariff By-Law in force.»
ARTICLE 3
SECTION 3
L'article 4.7 du règlement 650 sur les animaux
de compagnie est modifié afin qu'il se lise
désormais ainsi :
Section 4.7 of By-Law 650 concerning pets
shall be amended to read as follows:
« Pour obtenir une licence, la demande doit
énoncer le nom, prénom, adresse et numéro de
téléphone du requérant et du propriétaire de
l'animal, s'il s'agit d'une personne distincte et
indiquer la race ou le type, le sexe, la couleur,
l'année de naissance, le nom, les signes
distinctifs, la provenance du chien et si son
poids est de 20 kg et plus afin de compléter le
registre municipal. »
«To obtain a license, the application must
contain the name, surname, address and
telephone number of the applicant and of the
dog's owner, if a distinct person, and indicate
the breed, sex, colour, year of birth, name,
distinguishing marks, origin of the animal and
if its weight is greater than 20 kg in order to
complete the municipal registry.»
ARTICLE 4
SECTION 4
L'alinéa 1 de l'article 4.10 du règlement 650 sur
les animaux de compagnie est modifié afin qu'il
se lise désormais ainsi :
Paragraph 1 of Section 4.10 of By-Law 650
concerning dogs shall be amended to read as
follows:
« Le prix de la licence s'applique pour chaque
chien. La licence est indivisible et non
remboursable. »
« The cost of a license applies for each dog.
The license is indivisible and non-refundable.»

ARTICLE 5
SECTION 5
L'article 4.15 du règlement 650 sur les animaux
de compagnie est modifié afin qu'il se lise
désormais ainsi :
Section 4.15 of By-Law 650 concerning dogs
shall be amended to read as follows:
« L'autorité compétente tient un registre pour les
licences émises à l'égard des chiens.
Advenant la perte de la licence, le gardien de
l'animal doit obtenir un duplicata de ladite
licence, auprès l'autorité compétente. Le prix de
cette licence de remplacement est déterminé au
règlement de tarification en vigueur. »
«The competent authority shall keep a register
of dog licenses issued.
Should the license be lost, the guardian of the
animal must obtain a duplicate of said license
from the competent authority. The cost of this
replacement license shall be determined by
the Tariff By-Law in force.»
ARTICLE 6
SECTION 6
Les articles 5.1 et 5.2 du règlement 650 sur les
animaux sont abrogés.
Sections 5.1 and 5.2 of By-Law 650
concerning pets are hereby repealed.
ARTICLE 7
SECTION 7
Tout règlement ou partie de règlement contraire
ou inconciliable avec les dispositions du présent
règlement est, par les présentes, abrogé.
Any by-law or part of a by-law contrary or
irreconcilable with the provisions of the current
by-law is hereby repealed.
ARTICLE 8
SECTION 8
Le
présent
règlement
entre
en
vigueur
conformément à la Loi.
The present By-Law shall come into force
according to Law.
