ARTICLE 1 Title of By-Law This by-law is titled "By-Law concerning Parking - RMH 330". Public Road: includes any highway, road, street, lane, place, bridge, pedestrian walkway or cycling path, sidewalk or any right of way or public way which is not private as well as any usage or installation, including a ditch used for their development, operation or management; 2. Parking Space: Part of a public roadway or a lot used as a parking area for an automotive vehicle; 3. Officier : toute personne physique ou tout employé d'une firme autorisée par résolution du conseil municipal et tous les membres de la Sûreté du Québec chargés de l'application de tout ou partie du présent règlement; 3. Officer: Any physical person or employee of an authorized firm appointed by Council resolution and all members of the Sûreté du Québec responsible for the application of this by-law, in part or in its entirety; 4. Signalisation : toute affiche, panneau, signal, marque sur la chaussée ou tout autre dispositif compatible avec le Code de la sécurité routière et le présent règlement et permettant de contrôler et de régulariser la circulation des usagers de la route ainsi que le stationnement des véhicules routiers; 4. Traffic Sign: Any sign, billboard, signal, lines on the pavement or any other device, compatible with the Highway Safety Code and the present by-law, in order to control and regulate road user traffic as well as vehicle parking; Les mots et expressions non définis au présent règlement ont le sens donné par le Code de la sécurité routière. Words and expressions non-defined in this by- law have the meaning given in the Highway Safety Code. No provision of this by-law must be interpreted as being exempt from the Highway Safety Code obligations. In a parking space reserved for the exclusive use of the residents, unless the vehicle has an identification vignette issued by the municipality in accordance with the present by-law. Unless workers are present to carry out work, it is prohibited to park a trailer, a tractor trailer or a semi-trailer which is not attached to a vehicle for more than 30 minutes; 10. It is prohibited to park a vehicle in a private entrance or in a private parking where it could obstruct or hamper public circulation or the execution of work by the Public Works Department. ARTICLE 7 Règles saisonnières ARTICLE 7 Seasonal regulations Malgré les normes contenues à l'article intitulé « Règles générales relatives au stationnement sur un terrain municipal ou sur une voie publique », nul ne peut stationner ou immobiliser un véhicule routier sur la voie publique entre 0 h et 7 h, du 15 novembre au 1er avril inclusivement, et ce, sur tout le territoire de la municipalité sauf avis contraire de la municipalité, le cas échéant. Notwithstanding the standards contained in the article entitled "Règles générales relatives au stationnement sur un terrain municipal ou sur une voie publique ", it is prohibited to stop or park a vehicle on a public street within the municipalities' territory between 00 :00 (midnight) and 07 :00 from November 15th to April 1st inclusively, within the Town's territory unless otherwise indicated by the municipality. ARTICLE 8 Autorisation de déplacement et de remorquage ARTICLE 8 Removing and towing authorization Tout officier est autorisé à faire enlever ou à déplacer tout véhicule routier stationné à un endroit où il nuit aux travaux de voirie municipale, au libre passage des véhicules d'urgence, de transport scolaire ou de services municipaux, ou contrevient à toute autre disposition spécifiquement prévue au présent règlement et à remorquer ou à faire remorquer ce véhicule ailleurs : Any officer is authorized to remove or relocate any parked vehicle if it hinders municipal public works, impedes access to emergency vehicles, school transport vehicles or municipal service vehicles, or that contravenes to any other disposition specifically provided in the present by-law and to have the said vehicle towed elsewhere: - Aux frais du propriétaire, qui ne peut en recouvrer la possession que sur paiement des frais réels de remorquage et de remisage ou; - At the owner's expense, who can only recover the vehicle upon payment of actual towing and storage fees, or; Ville d'Hudson Town of Hudson En cas de divergence, la version française a préséance sur le texte anglais. ARTICLE 9 Stationnement des véhicules lourds ARTICLE 9 Heavy vehicle parking Sauf pour effectuer une livraison ou un travail, il est interdit de stationner ou d'immobiliser un véhicule lourd aux endroits suivants: It is forbidden to stop or park a heavy vehicle at the following locations, unless it is for delivery or work purposes: 1. Sur la voie publique dans une zone résidentielle; 1. On a public road in a residential zone; 2. Sur la voie publique, pour une période de plus de cent vingt (120) minutes hors d'une zone résidentielle; 2. On a public road, for a period of time exceeding hundred twenty (120) minutes outside the limits of a residential zone; 3. Sur un terrain propriété de la municipalité; 3. On a municipal property; 4. Sur un terrain de stationnement municipal. 4. On a municipal parking lot. ARTICLE 10 Stationnement des roulottes, caravanes et véhicules récréatifs ARTICLE 10 Parking for trailers, caravans and recreation vehicles Sauf avec l'autorisation de la municipalité dûment affichée sur le véhicule et sous réserve de la signalisation, nul ne peut stationner sur la voie publique ainsi que dans les terrains propriété de la municipalité ou terrain de stationnement municipal, une roulotte, une tente-roulotte ou une caravane aménagée en logement ou autres véhicules récréatifs ou hors route pour plus de douze (12) heures. Après ce délai, ces véhicules doivent quitter l'emplacement pour une période de plus de vingt-quatre (24) heures avant de débuter une autre période de stationnement, aux mêmes conditions. Unless duly authorized by the municipality and posted on the vehicle and subject to signage, it is prohibited for trailers, tent trailers or caravans or motorhome designed as housing or other recreation or off-road vehicles to park for more than twelve (12) hours on public roads and on municipal property or municipal parking lots. After this deadline, these vehicles must leave the location for a period of more than twenty-four (24) hours before starting another parking period under the same conditions. No one may, at any time, stop or park a vehicle in a priority access lane or in any other space reserved for emergency vehicles, and identified with appropriate road signs, except for vehicles used for loading and unloading of merchandise or vehicles that pick up and let off passengers, on the condition, however, that these operations be done rapidly, without interruption, and in the presence of or under the guard of the driver of these vehicles. SECTION III DISPOSITIONS PÉNALES SECTION III PENAL PROVISIONS ARTICLE 12 Amende ARTICLE 12 Penalties Quiconque contrevient au présent règlement commet une infraction et est passible, en plus des frais, d'une amende de cinquante dollars (50$). Anyone contravening this by-law commits an offence and is liable, besides the costs, to a fine of fifty dollars ($50). SECTION IV DISPOSITIONS PARTICULIÈRES À LA MUNICIPALITÉ SECTION IV SPECIAL PROVISIONS ARTICLE 13 Interdiction d'immobilisation ou de stationnement en tout temps ARTICLE 13 Parking and stopping prohibition at all times L'immobilisation ou le stationnement est interdit aux endroits où la signalisation l'indique sur les voies publiques mentionnées à l'annexe « A » du présent règlement, laquelle en fait partie intégrante. Stopping or parking is forbidden where the signage indicates it at all times on public roads mentioned at Annex "A" of the present by-law, which shall form an integral part thereof ARTICLE 14 Interdiction d'immobilisation ou de stationnement pour une durée limitée ARTICLE 14 Parking and stopping prohibition for a limited period L'immobilisation ou le stationnement est limité aux endroits où la signalisation l'indique sur les voies publiques mentionnées à l'annexe « B » du présent règlement, laquelle en fait partie intégrante. Stopping or parking is limited to locations as indicated by signage on the public roads mentioned at Annex "B" of the present by-law, which shall form an integral part thereof. ARTICLE 15 Stationnement privé ARTICLE 15 Private parking Dans le cas où le consentement du propriétaire de stationnement sur lot privé a été obtenu conformément à la loi, les dispositions du présent règlement, incluant, sans être limitatif, l'entretien, le déneigement, ainsi que la restriction et l'interdiction de stationnement de véhicule, s'appliquent sur les stationnements privés identifiés à l'annexe « C », laquelle en fait partie intégrante. The municipality may conclude an agreement with the owner of parking located on a private lot in accordance with the Law, the application of the provisions of this by-law concerning said private parking, including but not limited to maintenance, snow removal, as well as vehicle parking restrictions and prohibitions, apply those parking areas identified at Annex "C", which shall form an integral part thereof. Shaar, sur la rue Wharf et sur la rue Beach sans détenir un permis émis à cet effet par la Ville conformément au présent règlement. ____________ 743.1-2022, a.3 Road and on Beach Road without obtaining a permit to that effect beforehand from the Town in accordance with the present By-Law. ____________ 743.1-2022, s.3 ARTICLE 16.1 Exigences ARTICLE 16.1 Requirements Pour obtenir un permis de l'autorité compétente, le demandeur doit satisfaire aux exigences suivantes : To obtain a permit from the competent authority, the applicant must meet the following requirements: a) Remplir le formulaire requis; a) Complete the required form; b) Fournir une preuve de résidence; b) Provide a proof of residence; c) Fournir une copie du certificat d'immatriculation du véhicule routier; c) Provide a copy of the registration certificate of the road vehicle; d) Défrayer les coûts annuels du permis tel que prévu au règlement de tarification en vigueur; d) Pay the annual costs of the permit as provided for in the Tariff By-Law in force; ARTICLE 16.2 Validité du permis ARTICLE 16.2 Validity of the permit Le permis est valide pour une année, soit du 1er janvier au 31 décembre. A permit is valid for one year, from January 1st to December 31st. ARTICLE 16.3 Affichage du permis ARTICLE 16.3 Posting of Permit Le détenteur de permis doit afficher en tout temps le permis à l'intérieur du véhicule routier de manière à ce qu'il soit visible. The permit holder must display the permit inside the road vehicle at all times in such a way that it is visible. ARTICLE 16.4 Amende ARTICLE 16.4 Penalties Nonobstant l'article 12 du présent règlement, quiconque contrevient à une disposition du présent article commet une infraction et est passible, en plus des frais : Notwithstanding article 12 of the present By- Law, whoever contravenes to a provision of the present article commits an offence and is liable, in addition to the applicable fees: a) Pour une première infraction, d'une amende de cinquante dollars (50.00 $). a) For a first offence, a fine of fifty dollars ($50.00). b) Pour toute récidive, d'une amende de deux cent cinquante dollars (250.00$). b) For any subsequent offence, a fine of two hundred and fifty dollars ($250.00). Si une infraction au présent article se continue, elle constitue, pour chaque jour, une nouvelle infraction. If a contravention to this article continues, it constitutes a new offence for each subsequent day. ARTICLE 17 Abrogation de règlements antérieurs ARTICLE 17 Repeal of previous by-laws Le présent règlement abroge les règlements no 694-2017, 694.1-2019 et 694.2-2020. ARTICLE 18 Remplacement ARTICLE 18 Replacement Le présent règlement remplace le Règlement no 694-2017 (règlement relatif au stationnement - RMH 330-1) adopté le 2 octobre 2017.
