BY-LAW NO. 2016-12-009 Winter Parking on Municipal roads
CONSIDERING THAT Article 79 of the Municipal Powers Act allows a municipality
to adopt a by-law to regulate parking within the Municipality;
CONSIDERING THAT Article 80 of the Municipal Powers Act allows a municipality
to adopt a by-law to regulate the towing or removal and storage of a vehicle in
contravention with the current by-law;
CONSIDERING THAT Article 81 of the Municipal Powers Act allows a municipality
to adopt a by-law to authorize its Municipal Inspector or other personnel as designated by
Municipal Council to apply the by-law in regards to winter parking, and to have a vehicle
towed or removed and stored at the owner's expense;
CONSIDERING THAT this Council deems it necessary and of public interest to create
such a by-law;
CONSIDERING THAT a Notice of Motion was given on December 6, 2016;
It is hereby declared that:
ARTICLE 1 - PREAMBLE
The preamble is an integrant part of the present by-law.
ARTICLE 2 - TITLE OF THE BY-LAW
The present by-law is named "By-law #2016-12-009 Winter Parking on Municipal
Roads"
ARTICLE 3 - SIGNIFICATION OF TERMS
Municipal Road:
includes but is not limited to all roads, streets, bridges, sidewalks
that are not privately owned, as well as any ditches and
allowances;
Winter:
Period of time extending from the fifteenth (15th) of November to
the fifteenth (15th) of April of each year;
Responsible
Officer:
The officer responsible for the emission of permits, which has
been delegated by resolution from Council.
Municipality:
The municipality of Otter Lake.
Vehicle:
All means of transportation or locomotion.
Parking:
The act of leaving a vehicle at a stand still
ARTICLE 4 - TERRITORY
The present by-law applies to the entire territory under the jurisdiction of the
Municipality of Otter Lake.
ARTICLE 5 - PARKING
During the winter, no vehicle shall park or cause to be parked on any Municipal
road, between the hours of midnight (00:00) and six (06:00) o'clock in the
morning;
During or after a snow storm, no vehicle shall be parked on any Municipal road in
a manner such as to hinder the plowing and removal of snow
ARTICLE 6 - TOWING AND REMOVAL OF VEHICLES
Every person or officer empowered to do so by Municipal Council is authorized to
remove or have removed or towed any vehicle that is hindering snow removal and
plowing, to an impound lot, at the expense of the owner for said removal and storage,
the cost of which shall be paid before recuperation of the vehicle is possible
ARTICLE 7 - INFRACTIONS
Any person contravening the provisions of the present by-law or committing an
infraction thereto shall be liable to the payment of a fine of thirty (30$) dollars plus
costs
ARTICLE 8 - COMING INTO FORCE
The present by-law shall come into force according to law.
