ARTICLE 1
SECTION 1

deemed to have or imply the meanings
attributed to them, unless the context

Autorité
compétente
(Competent
authority) : toute personne nommée par
résolution du conseil municipal pour faire
appliquer ce règlement.
Chien (Dog) : comprend les chiennes et les
chiots.
Chien dangereux (Dangerous dog) : est
présumé dangereux tout chien qui a, de l'avis
de
l'autorité
compétente,
sans
aucune
provocation ni malice, mordu ou attaqué une
personne ou un autre animal et qui lui a
infligé une blessure.
Gardien (Guardian) : toute personne qui
possède, héberge ou a la garde d'un chien,
ainsi que le propriétaire, le locataire ou la
personne responsable des lieux où un chien
est gardé.
Lieu public (Public place) : comprend tout
chemin, rue, trottoir, ruelle, passage, allée,
carrossable, parc, square ou autre terrain
appartenant à la Ville, ainsi que toute cour
d'école et tout immeuble ou lieu accessible
au public.
Parc canin ou aire d'exercice canin (Dog
park or dog run facility) : tout terrain
identifié par des affiches apposées par la Ville
indiquant qu'il s'agit d'un endroit où il est
possible de laisser les chiens en liberté sans
laisse, et dont la désignation se trouve à
l'annexe A.
Propriété privée (Private property) : tous
les lieux qui ne sont pas un lieu public. »
Competent
authority
(Autorité
compétente): any person appointed by
resolution of the Municipal Council to enforce
this by-law.
Dangerous dog (Chien dangereux): is
presumed dangerous any dog that has, in the
opinion of the competent authority, without
any provocation nor malice, bitten or attacked
a person or another animal and injured said
person or animal.
Dog (Chien): includes bitches and puppies.
Dog park or dog run facility (Parc canin ou
aire d'exercice canin): an area marked by
signs affixed by the City indicating an area
where it is possible for dogs to run freely
without a leash, and which are designated in
Appendix A.
Guardian (Gardien): any person who owns,
harbors or has custody of a dog, and the
owner, tenant or person in charge of the
premises in or on which a dog is kept.
Private property (Propriété privée): any
place that is not a public place.
Public place (Lieu public): include any
street,
roadway,
sidewalk,
lane,
alley,
driveway,
park,
square
or
other
land
belonging to the City, as well as any
schoolyard
and
any
building
or
place
accessible to the public."

ARTICLE 2
SECTION 2
Il est interdit à quiconque de garder, sur une
propriété privée sur le territoire de la ville, un
chien à moins d'avoir un permis délivré par la
Ville pour ce chien pour l'année en cours.
No person shall keep a dog on a private
property in the territory of the city, unless he or
she has a license issued for the dog by the
City for the current year.
ARTICLE 3
SECTION 3
Pour obtenir un permis de garde d'un chien,
le gardien dudit chien doit, dans les 30 jours
de l'acquisition du chien, remettre à la Ville :
To obtain a license to keep a dog, the
guardian of such dog shall, within 30 days of
the acquisition of the dog, give to the City:

a) une demande écrite, signée par lui,
indiquant les détails concernant la
race, le sexe et la couleur du chien
ainsi que les marques ou autres
données nécessaires à l'identification
de l'animal ;
a) an application, in writing, signed by
him setting out particulars of the
breed, sex, and colour of the dog and
the markings or other description
necessary to identify it;
b) un certificat signé par un vétérinaire
attestant que le chien a été vacciné
contre la rage, tel vaccin ne devant
pas avoir été reçu plus de vingt-quatre
(24) mois avant l'obtention d'un permis
délivré par la Ville.

attesting that the dog has been
vaccinated
against
rabies,
such
vaccine not to have been received
more than twenty-four (24) months
prior to obtaining a license issued by
the City.
ARTICLE 4
SECTION 4
Un permis délivré par la Ville vient à échéance
un an suivant sa date de délivrance ou, le cas
échéant, la date du dernier renouvellement et
il n'est pas transférable.
A license issued by the City shall expire one
year following the date of its issuance, or, as
the case may be, the date of its last renewal
and shall not be transferable.

frais
applicables
sont
prévus
au
Règlement visant à établir les tarifs pour
l'exercice financier en cours. Ces frais ne
seront réduits ou remboursés à la suite de la
mort, de la perte ou du déplacement d'un
chien après la délivrance du permis.
The applicable fees are provided for in the
By-Law to establish tariffs for the current
fiscal year. Such fees will not be reduced or
reimbursed following the death, loss or
removal of any dog after the license has been
issued.

ARTICLE 5
SECTION 5
Il est interdit à quiconque de conduire ou
d'amener un chien dans un lieu public, à
moins de lui faire porter la médaille remise par
la Ville, portant le numéro du permis qui est en
vigueur pour l'année en cours, ou toute autre
preuve d'un permis valide, délivré par une
autre municipalité.
No person shall lead or take a dog in or to any
public place, unless the dog bears the tag
given by the City with a license number that is
valid for the current year or any other proof of
a valid license issued by another municipality.

Il est interdit à quiconque de conduire ou
d'amener un chien dans un parc canin ou aire
d'exercice canin de la Ville, à moins de lui
faire porter la médaille remise par la Ville,

No person shall lead or take a dog to a dog
park or dog run facility in the City, unless the
dog bears the tag given by the City, with a
license number that is valid for the current
year.

ARTICLE 7
SECTION 7
Nonobstant toutes autres dispositions d'un
règlement en vigueur de la municipalité, il est
interdit à quiconque de mettre sur pied ou
d'exploiter une entreprise commerciale ou un
établissement destiné à prendre les chiens en
pension, à les garder ou à les dresser sans
avoir
obtenu

de

Notwithstanding any other provisions of a by-
law of the municipality, no person shall
establish or carry on any business or
establishment for boarding, keeping, or
training dogs, unless prior authorization has
been obtained from the competent authority.
ARTICLE 8

enfreint

présent
règlement, quiconque fait en sorte ou permet
que plus de trois (3) chiens âgés d'au moins
six mois soient gardés ou hébergés en même
temps dans, sur ou autour d'une propriété
résidentielle ou commerciale.
Shall be deemed to have infringed this by-law,
any person who causes or permits more than
three (3) dogs aged six months or older to be
kept or harbored at any time in, on or about a
residential or commercial property.

plus de trois (3) chiens dans un lieu public.
No person shall be the guardian of more than
three (3) dogs in a public place.

Notwithstanding the foregoing, the guardian
of a dangerous dog can only have custody of
this single dog in a public place.
ARTICLE 10
SECTION 10
Il est interdit pour le gardien d'un chien de ne
pas immédiatement enlever les matières
fécales produites par un chien sous son
contrôle et de ne pas en disposer de manière
hygiénique.
It is prohibited for the guardian of a dog not to
immediately remove fecal matter produced by
a dog in his or her custody and dispose of it in
a hygienic manner.
Le gardien d'un chien doit, en tout temps avoir
en sa possession, lorsqu'il se trouve dans un
lieu public, le matériel nécessaire afin de
rencontrer les exigences du premier alinéa.
The guardian of a dog must, at all times, have
in his or her possession, when in a public
place, the required materials to meet the
requirements of the first paragraph.
ARTICLE 11
SECTION 11
Sauf dans un parc canin ou aire d'exercice
canin identifiés à l'annexe A, tout chien qui se
trouve dans un lieu public doit en tout temps
être tenu en laisse et être sous le contrôle
d'une personne capable de le maîtriser. La
longueur de cette laisse ne peut excéder
1,82 mètre ou 6 pieds.
Except in a dog park or dog run facility as
identified in Appendix A, any dog that is in a
public place must at all times be held on a
leash and be under the control of a person
capable of controlling it. The leash cannot
exceed 1.82 metres or 6 feet in length.

ARTICLE 12
SECTION 12
Sous réserve de tout couvre-feu établi par le
Règlement 69 concernant les parcs, le
gardien d'un chien, à l'exception d'un chien
dangereux, portant une médaille remise par
la Ville de Westmount peut, à la condition
d'être sous le contrôle d'une personne
capable de le maîtriser en tout temps, le
laisser courir en liberté dans les parcs canins
ou aires d'exercice canin identifiées à l'aide
de panneaux officiels de la Ville et qui par
surcroît sont complètement entourées par
une clôture ou une barrière, et ce, entre 6 h et
22 h.
Subject to all curfews found in By-law 69
concerning Parks, the guardian of a dog,
except for a dangerous dog, bearing a tag
given by the City of Westmount, may allow
the animal to run off leash, provided it is
under the control of a person capable of
controlling it at all times, between 6:00 a.m.
and 10:00 p.m., in dog parks or dog run
facilities identified by official City signs and
that are fully enclosed by a fence or similar
barrier.

ARTICLE 13
SECTION 13
Malgré les articles 11 et 12 du règlement et
sous réserve de tout couvre-feu établi par le
Règlement concernant les parcs, le gardien
d'un
chien,
à
l'exception
d'un
chien
dangereux, portant une médaille remise par
la Ville de Westmount qui se trouve dans
l'aire d'exercice canin du Bois Summit :
Notwithstanding Sections 11 and 12, and
subject to any curfews established in the By-
law concerning Parks, the guardian of a dog,
except for a dangerous dog, bearing a tag
given by the City of Westmount found in the
dog run facility of Summit Woods:

a) peut, du 1er novembre au 15 avril,
laisser le chien courir en liberté dans
les sentiers du bois, à la condition
d'être sous le contrôle d'une personne
capable de le maîtriser en tout temps ;

allow the dog to run off leash on the
trails in the woods, provided it is under
the control of a person capable of
controlling it at all times;

ARTICLE 14
SECTION 14
Si un chien mord ou attaque une personne ou
un autre animal et lui inflige une blessure,
ledit chien sera, dès lors, présumé être
dangereux et son gardien sera réputé avoir
enfreint le présent règlement.
If a dog bites or attacks a person or another
animal and injures the person or animal, said
dog will be thereafter presumed dangerous
and its guardian will be deemed to have
infringed this by-law.

ARTICLE 15
SECTION 15
Le gardien d'un chien doit, suite à une
morsure commise dans un lieu public,
produire à l'autorité compétente, dans les
douze (12) heures de cette morsure, un
certificat d'un vétérinaire attestant que la
morsure ne met pas en danger la santé de la
victime.
The guardian of a dog must, following a bite
committed in a public place, provide to the
competent authority, within twelve (12) hours
of the bite, a certificate from a veterinarian
attesting that the bite does not endanger the
health of the victim.
ARTICLE 16
SECTION 16
Un chien dangereux doit en tout temps :
A dangerous dog must at all times:
1º porter une muselière appropriée dans
un lieu public ;
1º wear an appropriate muzzle in a public
place;
2º être tenu en laisse ; et
2º be kept on a leash; and
3º être sous le contrôle d'une personne
âgée d'au moins dix-huit (18) ans
capable de le maîtriser.
3º be under the control of a person of at
least eighteen (18) years of age
capable of controlling it.

ARTICLE 17
SECTION 17
Le gardien d'un chien dangereux doit
s'assurer, lorsque ce chien se trouve sur une
propriété privée, que cette dernière est
sécurisée afin de ne pas permettre audit chien
de pouvoir s'en échapper.
The guardian of a dangerous dog must
ensure, at all times when said dog is kept
on private property, that such property be
secured so as to not allow the dangerous
dog to escape therefrom.
ARTICLE 18
SECTION 18
Si un chien endommage une pelouse, un
carré de gazon, un jardin ou une platebande
ou encore des fleurs, des arbustes ou des
plantes, ledit chien sera considéré comme
nuisible et son gardien sera réputé avoir
enfreint le présent règlement.
If any dog shall cause damage to any lawn,
grass plot, garden or flower bed, or any
flowers, shrubs or plants, said dog shall be
deemed to be a nuisance and the guardian
thereof shall be deemed to have infringed this
by-law.
ARTICLE 19
SECTION 19
Si un chien aboie ou hurle au point de troubler
la paix ou d'importuner le voisinage, ledit
chien sera considéré comme nuisible et son
gardien sera réputé avoir enfreint le présent
règlement.
If a dog barks or howls in such a manner as to
disturb the peace or to constitute a nuisance
in the neighborhood, said dog shall be
deemed to be a nuisance and the guardian
thereof shall be deemed to have infringed this
by-law.

ARTICLE 20
SECTION 20
Lorsqu'un chien est trouvé
Whenever a dog is found
a) dans un lieu public ou sur une
propriété privée et que le propriétaire,
l'occupant ou le détenteur s'oppose à
la présence du chien, et que ce
dernier n'est pas accompagné ; ou
a) in a public place or on any private
property and the owner, occupant or
guardian opposes to the presence of
the dog, and it is not accompanied; or
b) dans un lieu public, et qu'il n'est pas
bien tenu en laisse, si cette mesure
est requise à ce moment-là par l'article
11 dudit règlement,
b) in any public place, and is not securely
on a leash if so required at such time
by section 11 of this by-law,

ARTICLE 21

neutralize, or as the case may require, put
down immediately and without warning, a
dangerous dog running freely without a
muzzle.
ARTICLE 22
SECTION 22
Lorsqu'un chien est conduit à la fourrière,
conformément
à
l'article
20,
l'autorité
compétente doit en aviser par écrit le gardien
de l'animal en question si le nom et l'adresse
du maître lui sont connus. Si le chien n'est pas
réclamé par son gardien ou par une personne
désignée par ce dernier dans les quatre (4)
jours qui suivent la mise à la fourrière,
l'autorité compétente devra prendre des
mesures pour que le chien soit cédé à
quelqu'un ou euthanasié.
Whenever a dog has been impounded as
provided for in section 20, the competent
authority shall send a written notice thereof to
the guardian of such dog, if the name and
address of such guardian are known to him or
her. If such dog has not been claimed by or
on behalf of the guardian within four (4) days
after its impounding, the competent authority
shall take measures to have the dog assigned
to someone or to have it euthanized.

reprise de possession d'un chien mis en

The fees payable by the guardian to the City
for the repossession of any impounded dog
shall be the actual cost associated with the
impoundment, plus $50 per day until the dog
has been repossessed, or until the four (4)
day period expires in addition to any and all
fines that may be levied pursuant to this
by-law against the guardian of such dog.

ARTICLE 23
SECTION 23

by-law shall be liable to:

première infraction ;

articles 11, 12 et 13 du présent règlement est
passible :

any person who infringes Sections 11, 12 and
13 of this by-law is liable to:
