At a regular sitting of the Municipal Council of
the City of Westmount, duly called and held at
City Hall on __________ , at which were

WHEREAS Notice of Motion of the
presentation of this by-law was given at the
regular sitting of the Municipal Council of the
City of Westmount, duly called and held on
March 20, 2023;
WHEREAS a draft by-law was presented at the
regular sitting of the Municipal Council of the
City of Westmount, duly called and held on
March 20, 2023;
It is ordained and enacted by By-law No. 1600
entitled "BY-LAW CONCERNING SOLID-FUEL
HEATING
AND
COOKING
DEVICES
AND
FIREPLACES" that:

CHAPTER 1
DECLARATORY, INTERPRETATIVE
AND ADMINISTRATIVE PROVISIONS
SECTION I
DECLARATORY PROVISIONS
ARTICLE 1.1
OBJECT OF THE BY-LAW
This By-law applies to all heating and cooking
devices and fireplaces permitting the use of solid
fuel combustible in all residential buildings.
ARTICLE 1.2
INTEGRITY OF THE RULES
The annexes form an integral part of this By-law.
Where the content of the by-law relate to a
referenced document, that document forms part
of this By-law.
ARTICLE 1.4
TERRITORY UNDER JURISDICTION
This By-law applies to the entire territory under
the jurisdiction of the City of Westmount.
ARTICLE 1.4
EXTENDED APPLICATION
No article or provision of this By-law shall be
construed so as to exempt any person from the
application of any law or regulation of the
provincial or federal government.

The provisions of this By-law shall be complied
with not only at the time of issuance of the
permit or certificate, but at all times thereafter.
SECTION II
INTERPRETATIVE PROVISIONS
ARTICLE 1.5
PRINCIPLES OF INTERPRETATION
The titles, tables, charts, graphs, symbols and all
forms of expression other than the actual text,
contained in this By-law and referred to herein,
form an integral part thereof.
ARTICLE 1.6
REFERENCE
Any reference to a section, article, subsection or
paragraph is a reference to this By-law unless
otherwise provided.
Any reference to another by-law is open-ended,
that is, it extends to any amendments that may
be made to the referenced by-law after the by-
law comes into force.
ARTICLE 1.7
PRECEDENCE
Unless otherwise specified, the following rules of
precedence apply:
1° In the event of an inconsistency between
the text and a title, the text prevails;

2° In the event of a discrepancy between the
text and the tables or other forms of
expression, with the exception of the table
of uses and standards, the text shall prevail.
3° In the event of a discrepancy between a
table and a graph, the data in the table
prevails.
4° In the event of any inconsistency between
any provision of this By-law, or between a
provision of this By-law and a provision
contained in another by-law, the specific
provision shall prevail over the general
provision, and the more restrictive or
prohibitive provision shall apply, unless
otherwise specified.
ARTICLE 1.8
TERMINOLOGY
Unless the context indicates otherwise, a word
or phrase has the meaning and significance
provided in the current Zoning By-law, except for
the following words and phrases:
CSA Standard (Norme CSA) - The Canadian
Standards Association's CAN/CSA-B415.1
Standard for Performance Testing of Solid-
Fuel-Fired Heating Devices, including its
amendments.
EPA Standard (Norme EPA) - The American
New Source Performance Standards (Title 40,
Part 60, Subpart AAA) of the Code of Federal
Regulations (USA) published by the United
States Environmental Protection Agency,
including their amendments.
Info-Smog (Info-Smog) - A daily air quality
forecast and smog warning program for the
regions of southern Québec produced by

Environment Canada in collaboration with the
Ministère
du
Développement
durable,
de
l'Environnement et des Parcs (MDDEP), the
Ministère de la Santé et des Services sociaux du Québec
and its regional public health departments, and
the City of Montréal
Removal (Enlèvement) - Removing from
premises or rendering unusable.
Smog warning (Avertissement de smog) - A
notice issued by Info-Smog.
Solid fuel combustible (Combustible solide)
- Wood or any other non-gas or non-liquid fuel.
SECTION III
ADMINISTRATIVE PROVISIONS
ARTICLE 1.9
ADMINISTRATION AND
ENFORCEMENT OF THE BY-LAW
The administration and enforcement of this By-
law shall be entrusted to any person appointed
as an "authority having jurisdiction" by way of
resolution of the Municipal Council, or to any
representative
of
the
Urban
Planning
Department or of the Public Safety Department
of the City of Westmount ("representative").
ARTICLE 1.10
INSPECTION AND PRESCRIPTIVE
POWERS
Upon presentation of identification, the
authority having jurisdiction or a representative
of the City of Westmount may, for the purpose
of enforcing this By-law, visit, examine, and take

photographs of any immovable and movable
property.
Any person shall allow such representative to
enter a building without interfering with the
performance of their duties.
ARTICLE 1.11
VIOLATIONS AND PENALTIES
Any person who contravenes any of the
provisions of this By-law shall be liable to:
1° For a natural person:
a) A fine of $500 to $1,000, for a first
offence;
b) A fine of $1,000 to $2,000, for a repeat
offence.
2° For a legal entity:
a) A fine of $1,000 to $2,000, for a first
offence;
b) A fine of $2,000 to $4,000 for a repeat
offence.
CHAPTER 2
REQUIREMENTS
ARTICLE 2.1
INSTALLATION OR REPLACEMENT
Effective September 1, 2024, it is prohibited to
install or replace, inside a building, any heating
or cooking device or fireplace that allows the use
of solid fuel combustible, unless the device or
fireplace has been recognized by the United
States Environmental Protection Agency (EPA)

or the POLYTESTS Services through a
certification process as having an emission rate
of 2.5 g/hr or less of fine particulate matter to
the atmosphere.
A certificate of authorization is required for any
installation or replacement as provided in the
first paragraph, in accordance with the
requirements of the Permits and Certificates By-law.
ARTICLE 2.2
USAGE
Effective September 1, 2024, it is prohibited to
use or permit the use of any device or fireplace
allowing the use of solid fuel combustible unless
it has been recognized by the United States
Environmental Protection Agency (EPA) or the
POLYTESTS Services, through a certification
process, as having an emission rate of 2.5 g/hr
or less of fine particulate matter to the
atmosphere.
The prohibition provided for in the first
paragraph does not apply in the case of an EPA
or CAN/CSA-B415.1 certified pellet device
installed prior to the coming into force of this
By-law and in accordance with the municipal
regulations applicable at the time of installation.
ARTICLE 2.3
PROHIBITION DURING SMOG
WARNING
It is prohibited to use or permit the use of any
device or fireplace allowing the use of solid fuel
combustible when a smog warning issued by
Environment Canada is in effect for an area that
includes the City of Westmount, in whole or in
part.

ARTICLE 2.4
EXCEPTION IN THE CASE OF
PROLONGED HEATING FAILURE
The prohibitions on the use of devices or
fireplaces, in accordance with Articles 2.2 and 2.3
do not apply where a heating failure affecting the
building in which the device or fireplace is
located has lasted more than three (3) hours.
CHAPTER 3
DECLARATION
ARTICLE 3.1
DECLARATION OF USE
The owner of a solid fuel combustible device or
fireplace shall declare the device or fireplace to
the authority having jurisdiction or the City of
Westmount's representative using the form
entitled "Mandatory Declaration Form for Solid
Fuel Burning Devices and Fireplaces" attached
as Schedule "A" to this By-law. This form must
be completed and filed with the City of
Westmount within 120 days of the installation
or construction of the device or fireplace.
The authority having jurisdiction or the City of
Westmount's representative shall verify the
contents of the form and ensure that the
required documents are complete.
ARTICLE 3.2
DECLARATION OF AN EXISTING
SOLID FUEL BURNING DEVICE OR
FIREPLACE
The owner of an existing solid fuel combustible
device or fireplace, on the effective date of this

By-law, shall declare it in accordance with
Article 3.1, within 120 days after the coming into
force of this By-law.
ARTICLE 3.2
DECLARATION OF REPLACEMENT OR
REMOVAL
The owner of a solid fuel combustible device or
fireplace who proceeds with the replacement or
the removal of said device or fireplace, shall
report it, in accordance with Article 3.1, within
120 days of the replacement or removal.
CHAPTER 4
FINAL PROVISIONS
ARTICLE 4.1
COMING INTO FORCE
This by-law comes into force according to law.
