REGLEMENT 1512
Lors d'une seance ordinaire du conseil
municipal de la Ville de Westmount, dument
convoquee et tenue a I'hotel de ville le 4
decembre 2017, a laquelle assistaient:

ATTENDU QUE le paragraphe 5° de Tarticle
626 du Code de la Securite Routiere (RLRQ,
c. C-24.2) permet a la municipalite d'adopter
un reglement pour prohiber la circulation de
tout vehicule routier dans les chemins qu'elle
indique pourvu que cette prohibition soit
indiquee par une signalisation appropriee;
ATTENDU QUE Tarticle 291 du Code de la
Securite Routiere (RLRQ, c. C-24.2) permet
a la municipalite de restreindre ou d'interdire
sur un chemin
public, dont elle
est
responsable de I'entretien, la circulation de
tous ou de certains vehicules lourds;
ATTENDU QUE Tarticle 291.1 du Code de la
Securite Routiere (RLRQ, c. C-24.2) prevoit
que la restriction ou ['interdiction de circuler
prevue a Tarticle 291 peut etre partiellement
levee, par une signalisation appropriee, pour
permettre de se rendre a un endroit ou Ton
ne peut acceder qu'en penetrant dans la
zone de circulation interdite afin d'y prendre
ou d'y livrer un bien, d'y fournir un service,
d'y executer un travail, d'y faire reparer le
vehicule ou le conduire a son point d'attache;

At a regular sitting of the Municipal Council
of the City of Westmount, duly called and
held at City Flail on December 4, 2017, at
which were present:

WFIEREAS paragraph 5° of section 626 of
the Flighway Safety Code (CQLR, c. C-
24.2) allows a municipality to adopt a by
law to prohibit all vehicular traffic on the
roads it indicates, provided that the
prohibition is indicated by appropriate
traffic signs;
WFIEREAS section 291 of the Flighway
Safety Code (CQLR, c. C-24.2) allows a
municipality to restrict or prohibit, on a
public highway of which it is responsible for
maintenance, the traffic of all or certain
heavy vehicles.
WFIEREAS section 291.1 of the Highway
Safety Code (CQLR, c. C-24.2) provides
that the restriction or prohibition under
section 291 may, by means of proper
signs or signals, be partially removed for
vehicles that must travel to a particular
place in order to collect or deliver
property, provide services, carry out work,
be repaired or return to their base, and
that cannot do so without entering a zone
to which access is prohibited.

ATTENDU QU'il est necessaire de reglementer
la circulation des camions et des vehicules-outils
sur les chemins publics dont I'entretien est a la
charge de la municipalite afin d'assurer la
protection du reseau routier, la securite des
citoyens et
la
tranquillite
des secteurs
residentiels;
ATTENDU QU'un avis de motion se rapportant
a la presentation du present reglement a ete
donne au cours de la seance ordinaire du
conseil municipal de la Ville de Westmount,
dument convoquee et tenue le 2 octobre 2017;
II est ordonne et statue par le reglement 1512
intitule « Reglement sur la circulation des
CAMIONS ET DES V^HICULES-CUTILS DANS LA ViLLE
DE Westmcunt» que:
WHEREAS it is necessary to regulate the
traffic of trucks and tool vehicles on public
highways of which the maintenance is the
responsibility of the municipality in order to
ensure the protection of the road network,
the safety of citizens and the tranquility of
residential sectors.
WHEREAS Notice of Motion of the
presentation of this by-law was given at the
regular sitting of the Municipal Council of
the City of Westmount, duly called and
held on October 2, 2017;
It Is ordained and enacted by By-law 1512,
entitled "By-law on truck and tool

ARTICLE 1
SECTION 1

considered an integral part of this by-law.
ARTICLE 2
SECTION 2
Dans le present reglement, les mots sulvants
sign iflent:
Camion : un vehicule routier, autre qu'un
vehicule d'urgence, dont le poids nominal
brut est de 4 500 kg ou plus, congu et
amenage principalement pour le transport de
biens ou pour le transport d'un equipement
qui y est fixe en permanence et de ses
accessoires
de
fonctionnement.
Sont
egalement des camions, les ensembles de
vehicules routiers dont au moins un des
vehicules le formant a un poids nominal brut
de 4 500 kg ou plus ;
Livraison locale : la livraison effectuee dans
une zone de circulation interdite et signalisee
In this by-law, the following words mean:
Truck: a road vehicle, other than an
emergency vehicle, whose gross vehicle
weight rating is 4500 kg or more, designed
and equipped primarily for the transportation
of goods or of the equipment with which it is
permanently equipped and its accessories.
Are also trucks, combination of road
vehicles in which at least one vehicle that
makes it up has a gross vehicle weight of
4500 kg or more.
Local delivery: delivery which is carried out
in a prohibited traffic zone and indicated by

Pick up or deliver goods;
Provide a service;
Perform work;
Have a vehicle repaired;
Return a vehicle to its home base;
Point d'attache : le point d'attache du
vehicule fait reference a I'etablissement de
I'entreprise, c'est-a-dire au lieu de remisage
du vehicule, au bureau, a I'entrepdt, au
garage ou au stationnement de I'entreprise ;
Vehicule d'urgence : un vehicule routier
utilise
comme
vehicule
de
police
conformement a la Loi suria police (RLRQ, c.
P-13.1), un vehicule routier utilise comme
ambulance conformement a la Loi sur ies
services prehospitaiiers d'urgence (RLRQ, c.
S-6.2), un vehicule
routier de service
d'incendie ou tout autre vehicule routier
satisfaisant aux criteres etablis par reglement
pour etre reconnu comme vehicule d'urgence
par la Societe de I'assurance automobile du
Quebec (SAAQ).
Vehicuie-outil ; un vehicule routier, autre
qu'un vehicule monte sur un chassis de
camion, fabrique pour effectuer un travail et
dont le poste de travail est integre au poste
de conduite du vehicule. Aux fins de cette
definition, un chassis de camion est un cadre
muni de I'ensemble des composantes
mecaniques qui doivent se trouver sur un
vehicule routier fabrique pour le transport de
personnes, de merchandises ou
d'un
equipement;
Vehicule routier : un vehicule motorise qui
peut circuier sur un chemin; sont exclus des
vehicules routiers les vehicuies pouvant
circuier uniquement sur rails, les bicyclettes
Home base: the home base of a vehicle
refers to the company's place of business,
meaning its
place of storage, office,
warehouse, garage or the parking lot of the
company;
Emergency vehicle: a road vehicle
used as a police car in accordance with
the Police Act (GQLR, chapter P-13.1),
a road vehicle used as an ambulance in
accordance with the Act respecting pre-
hospitai emergency services (CQLR,
chapter S-6.2), a fire safety vehicle, or
any other road vehicle which meets the
criteria established by regulation for
recognition as an emergency vehicle by
the Societe.
Tool vehicle: a road vehicle, other than
a vehicle mounted on a truck chassis,
manufactured to perform work and the
work station of which is an integral part of
the
driver's
compartment. For the
purposes of this definition, a truck chassis
is a frame equipped with
all the
mechanical components required on a
road
vehicle
designed
for
the
transportation of persons, goods or
equipment;
Road vehicle: a motor vehicle that can
be driven on a highway, other than a
vehicle that runs only on rails, a power-
assisted
bicycle
or
an
electrically

assistees et les fauteuils roulants mus

ARTICLE 3
La circulation des camions et des vehicules-
outils est interdites sur le territoire de la Ville,
sauf;
i)

sur I'avenue Atwater et la rue Saint-
Antoine Quest;
entre 7h et 19h sur les chemins, ou
partie des chemins, suivants, tel
qu'indiques sur le plan a I'annexe I du
present reglement:
avenue Claremont (entre les rues
Sherbrooke Quest et Ste Catherine
Quest);
avenue Clarke (entre
les
rues
Sherbrooke Quest et Ste Catherine
Quest);
boulevard Dorchester;
chemin Glen ;
rue Sherbrooke Quest;
rue Ste-Catherine Quest;
avenue Victoria (entre les rues
Sherbrooke Quest et Ste Catherine
Quest).
ARTICLE 4
L'article 3 ne s'applique pas aux camions et
aux vehicules-outils qui doivent effectuer une
livraison locale.

SECTION 3
Truck and tool vehicle traffic is prohibited on
the territory of the City, except;
i)
on Atwater Avenue and Saint-
Antoine Street West;
ii)
between 7:00 a.m. and 7:00 p.m. on
the following roads, or sections of
roads, as indicated in the plan in
Schedule I of this by-law:

Claremont
Avenue
(between
Sherbrooke Street West and St.
Catherine Street West);

Clarke
Avenue
(between
Sherbrooke Street West and St.
Catherine Street West);
-
Dorchester Boulevard;

Glen Road;

Sherbrooke Street West;

SECTION 4
Section 3 does not apply to trucks or tool
vehicles that must make local deliveries.

ARTICLE 5
Quiconque contrevient a rarticle 3 de ce
reglement commet une infraction et est
passible d'une amende de 175 $ a 525 $.
ARTICLE 6
Aucune disposition du reglement ne peut etre
interpretee comme ayant pour effet de
soustraire une personne a rapplication d'une
loi ou d'un reglement du gouvernement
provincial ou federal, ainsi qu'a toute
disposition d'un autre reglement municipal.
ARTICLE 7
Le present reglement entre en vigueur
conformement a la loi.

SECTION 5
Any person who violates section 3 of this by
law commits an offence and is liable to a fine
of $175 to $525.
SECTION 6
No provision of this by-law shall be
construed as having the effect of
exempting a person from the application
of a provincial or federal law or regulation,
or from any provision
of another
municipal by-law.
SECTION 7
This by-law comes into force in accordance
with the law.
