## TOWN OF ABERDEEN BYLAW NO. 10/01 ## A BYLAW OF THE TOWN OF ABERDEEN IN THE PROVINCE OF SASKATCHEWAN TO REGULATE THE BURNING OF REFUSE WITHIN THIE DOUNDANED OI THI TOWN OF ABERDEEN The Council of the Town of Aberdeen in the Province of Saskatchewan under the authority of the Saskatchewan Clean Air Act, Section 18, hereby enacts as follows: - Definitions All terms and expressions used in this bylaw shall have the same respective meanings as in Section 2 and 18 of The Clean Air Regulations. - Prohibition No person shall cause or permit to be caused the open burning of trash, refuse, garbage, industrial waste or any other material or waste in an open fire or an incinerator in a manner that causes air pollution within the boundaries of the Town of Aberdeen. - Incinerators 3. No person shall cause or permit to be caused the burning of trash, refuse, garbage, industrial waste or any other waste material in a manner or in an incinerator other than that approved by the Department of Environment and Resource Management. - Exclusions Sections 2 and 3 of this bylaw do not apply to: - a) a camp fire or outdoor fireplace used for recreational purposes; - c) pure for the purpose of prevention or control of fires or tho training of persons for fire fighting, if the fire is specifically authorized or required pursuant to any Act of Parliament or bylaw of a municipality. - b) an outdoor fire using charcoal, processed coal or coke for cooking - Approval Approval from the Council of the Town of Aberdeen is required prior to causing a fire for the purpose outlined in section 4c. In an emergency situation approval may be obtained from the local fire or police authorities. - Penalties Any person who violates or fails to comply with any of the provisions of this bylaw is guilty of an offense and liable on summary conviction to the penalties set out in The Urban Municipality Act, 1984 or the General Penalty Bylaw of the municipality. - Coming into force 7. This bylaw shall not come into force until ninety days after the date of publication in the Warman Country Press. This bylaw shall come into force and take effect on the date of approval being issued by the Minister of Environment and Resource Management. <!-- image --> SEAL Mayor R.
