## TOWN OF ARBORFIELD PROVINCE OF SASKATCHEWAN ## BYLAW NO. 2014-02 ## A BYLAW TO LICENCE AND PROHIBIT DOGS RUNNING AT LARGE. The Council of the Town of Arborfield in the Province of Saskatchewan enacts as follows: ## 1. DEFINITIONS: For the purpose of this bylaw, the expression: - a) "dog" shall include male or female of the species; - c) "council" shall mean the council of the municipality; - b) "administrator" shall mean the administrator of the municipality; - d) "designated officer" shall mean that person designated by the council of the municipality; - f) "poundkeeper" shall mean the person appointed as poundkeeper by the council of the municipality; - e) "municipality" shall mean the Town of Arborfield; 7. "pound" shall mean such premises and facilities as may be designated by council, from time to time, as the pound - h) "running at large" shall mean off the premises and boundaries of the land occupied by the owner, possessor or harbourer or beyond the boundaries of any lands where the dog may be with the permission of the owner or occupier of the lands and is not under control by being tied or secured to a leash or chain or other similar restraining device not exceeding two meters in length. - 1) Every person in the municipality who owns, possesses or harbours a dog over 6 months old shall obtain a license from the Town office. - a) The license fee shall be according to a schedule attached as "Appendix A" - 2) The license shall be in effect from January 1 to December 31 of a calendar year and shall be obtained on or before March 1s or within 30 days of taking possession of a dog - b) A sum payable for a license required after June 30th shall be 50% of the charge for a full - 3) Every person to whom a license has been issued under this bylaw shall cause his or her dog to wear a collar to which shall be attached the license tag issued by the municipality pursuant to 14. A person residing in the municipality, who owns, possesses or harbours an animal mentioned in this bylaw, and neglects or refuses to take out a license therefore shall be deemed guilty of an infraction of this bylaw and subject to a penalty stated in Appendix A of this bylaw. ## 3. RUNNING AT LARGE AND IMPOUNDMENT: - 1) No dog shall run at large in the municipality. - 2) A person who owns, possesses or harbours a dog found running at large shall be deemed guilty of an infraction of this bylaw. - 3) Any person may take any dog found running at large contrary to the provisions of this bylaw to the municipal pound, where it shall be kept for up to five (5) days which shall [not] include statutory holidays and weekends unless the owner, possessor or harbourer redeems the animal by paying the at the Town office an impounding fine in the amount of $20.00 i addition to the sum of $15.00 per day or partial day for the care and keep of each animal. 4. The designated municipal official (administrator, pound keeper) may sell any animal which is not redeemed within the period of time noted in section 8 for a sum of not less than the amount required to redeem the dog under section 8. 5. The designated municipal official (administrator, pound keeper etc.) or person designated by the clerk/pound keeper etc, may destroy any dog which has not been redeemed within the period of time noted in section 8. - 1) It shall be an offence for any person to own, keep or harbour any dog which by loud and frequent barking, howling or yelping or chasing persons or vehicles, or in any other manner or way, creates a disturbance to the annoyance or discomfort of other persons residing in the neighbourhood or to the public at large, or cause injury to any person. - 2) The owner of any dog caught defecating on the property of any other resident's of the Town of Arborfield, or on any public property of the Town of Arborfield, shall be found in offence of this bylaw and is liable to any penalties as stated in Appendix A. 5. Where any person has committed or is alleged to have committed a breach of any of the provisions of this Bylaw, a ticket in the form appearing in Appendix B to this Bylaw, may be served on each person. Such person may pay to the Administrator of the Town of Arborfield a fine in accordance with Appendix A of this Bylaw, provided that payment is made within a period of 7 (seven) days from the service of the said ticket. 6. If the person, who has committed or is alleged to have committed a breach of any of the provisions of this Bylaw, fails to pay the specified fine within the time allowed following the service of the ticket, then the provisions of section 5 no longer applies and the person shall be liable on Summary Conviction. 7. Summary Conviction shall be according to Appendix A. 8. In the case of a continuing offense, it shall be according to Appendix A. 9. Bylaw No. 5/71 is hereby repealed. <!-- image --> Read a third time and adopted this 16* day of June, 2014. <!-- image --> Mayor Sal Administrator Subsection 8(1)(k) The Municipalities Act ## Licences and Dog Tags The annual fee for a dog licence shall be: - a. $10.00 (ten dollars) per spayed or neutered dog. Proof of sterilization shall be required. - b. $20.00 (twenty dollars) per unspayed or unneutered dogs. The sum for the replacement of a lost dog tag, upon proof that the dog has a valid licence shall - a. $5.00 (five dollars) ## Impound Fees The fee for redemption of an impounded dog for kenneling costs shall be: - b. $15.00 per each period of 24 hours or part thereof that such dog is impounded plus any notification charges. - a. $20.00 for the impounding of the dog and an additional ## Infraction, Penalty or Breach of this Bylaw The penalty for each offence under this bylaw shall be a fine of: - b. $100.00 (one hundred dollars) for subsequent offences in any calendar year. 2. $50.00 (fifty dollars) for the first offence in any calendar year ## Summary Conviction Not less than $200.00 (two hundred dollars) Not more than $500.00 (five hundred dollars) In the case of a continuing offence: Not less than $50.00 per day, for each day the offence continues. ## Appendix A ## Appendix B ## NOTICE OF VIOLATION Owner's Name: Owner's Address: Details of Offence Date: Description of Dog: Time: Location of Violation: Licence No. (if applicable): You are charged with violation of Bylaw No. 2014-02 Sections(s): The penalty for violation is: You may make voluntary payment of the above penalty within 7 (seven) days of service of the Notice of Violation at the: Town of Arborfield office--201 Main Street, Arborfield, Saskatchewan Or it can be received by mail within 7 (seven) days of service of the Notice of Violation at: Town of Arborfield PO Box 95 Arborfield SK SOE OAO If you do not make a voluntary payment within the time set out above, you shall be liable to prosecution and upon Summary Conviction, you shall be liable to penalties provided under section 7 of this Bylaw. - Administrator, Town of Arborfield ## BYLAW NO. 2020-012 ## A BYLAW OF THE TOWN OF ARBORFIELD TO AMEND BYLAW NO. 2014-02 BEING A BYLAW TO LICENSE AND PROHIBIT DOGS RUNNING AT LARGE. Council of the Town of Arborfield, in the Province of Saskatchewan, amends Bylaw No. 2014-02 as enacted on June 16, 2014 and hereby enacts as follows: 1. That Sections 1. (f) and (g) be repealed 2. That the following clause be added to Section 1. (d): 3. "... as the canine control officer." 3. That the following clause be added to Section 2. (1): 5. "2. (1) (a) The license fee shall be according to a schedule attached as 'Appendix A'. " 4. That Section 2. (2) be repealed 5. That Section 3. (3) be repealed and the following substituted therefore: 8. "3. (3) The designated officer for canine control may take any dog found running at large contrary to the provision of this bylaw to the North East SPCA in Melfort, Saskatchewan, under agreement with the municipality to provide pound services. The animal shall be kept for up to three (3) business days unless the owner, possessor or harbourer redeems the dog by paying, to the North East SPCA, the penalty as stated in 'Appendix A' of this bylaw in addition to the boarding fees for each day that the dog was impounded at the current rates for the North East SPCA." 6. That Section 3(4) be repealed and the following substituted therefore: 10. residing in the Town of Arborfield." 7. That Section 3. (5) be repealed. 8. Appendix A be repealed and the following substituted therefore: ## "Appendix A 1. License fees: - a. The license fee for a dog shall be $20.00 (twenty dollars). ## 2. Penalties: - a. The penalty for each offence under this bylaw shall be a fine of: 2. $100.00 (one hundred dollars) for the first offence in any calendar year. 3. $150.00 (one hundred fifty dollars) for subsequent offences in any calendar year. ## 3. Summary conviction: - a. Upon summary conviction, the penalty shall be not less than $200.00 (two hundred dollars) and not more than $1000.00 (one thousand dollars). - b. Upon summary conviction, in the case of a continuing offence, the penalty shall be not less than $50.00 (fifty dollars) per day, for each day the offence continues." 9.
