TOWN OF ASQUITH
BYLAW NO. 7-2025
A BYLAW TO FIX RATES FOR THE ASQUITH PUBLIC UTILITY SERVICE
WHEREAS a council may establish works for the supply, collection, treatment, storage and distribution
of water and sewer as a public utility service;
AND WHEREAS a council may by bylaw:
a. Purchase, lease, construct, operate, maintain and dispose of anything necessary for the provision
of a public utility service;
b. Contract with consumers for the provision of public utility services;
c. Set the terms and conditions under which public utility services are supplied;
d. Set, collect and enforce the collection of fees for a public utility service; and
e. Control, supervise and manage a public utility service;
NOW THEREFORE THE COUNCIL of the Town of Asquith in the Province of Saskatchewan enacts as
follows:
PART I INTERPRETATION
1.
This bylaw may be cited as The Asquith Public Utility Rates Bylaw.
Definitions

In this Bylaw,
a. Unit means a distinct residential (living) and/or commercial (working) space separate
from others in any particular home, residence, building or parcel, or parcels of land. For
example:
i. a house is 1 unit;
ii. a house with a suite is two units;
iii. a duplex is two units;
iv. a duplex with a suite is three units;
v. a fourplex is four units;
vi. a trailer court or mobile home park with 20 trailers is 20 units
vii. a commercial building with three bays is three units
PART II UTILITIES

The charges to be paid by the water consumer whose water service has been
turned on shall be those set out in Schedule "A" attached; provided, however, that the minimum
shall be payable in every case whether or not any water is consumed.

Persons who own or occupy premises drained or that are by bylaw required to
be drained into the sewer shall pay for such services a rental rate or service
charge in accordance with Schedule "B" attached.

An infrastructure fee will be added to each utility billing and shall become part of the monthly
fees as per Schedule "C" attached; and will be subject to change at Council's discretion.

Accounts for water service and/or sewer service shall cover a period of one month and shall be
rendered on or before the last day of the month following such period.

Accounts shall be paid within a period of thirty days from the date on which such accounts are
rendered.
a. If an account is not paid within the period of thirty days, the water service may be cut off.
b. When the water service is cut off, it shall not be turned on until all arrears have been paid,
together with a fee of $30.00 to cover the expense of turning off the water and turning it on
again;
c. If it is required to turn on the water service outside the employees' regular working hours,
the fee shall be $100.00.

If a customer is over 60 days in arrears on an account for utility services supplied by the Town,
the Town, by motion and approval of its Council, may add the amount owed to the Town to the
tax roll of the parcel receiving such service under Subsection 369(1) of The Municipalities Act and
the owner on the tax roll will be responsible for the payment of same whether the customer in
arrears is the owner of the premises or a tenant.
9.
The Town of Asquith shall not be responsible for any loss or damage incurred by the customer
because of discontinuing or disconnecting the water service.
PART III SEVERABILITY: Scope
10.
If any section, subsection, sentence, clause, phrase or other portion of this Bylaw is for any reason
held invalid or unconstitutional by any Court of competent jurisdiction, that portion shall be
deemed a separate, distinct and independent provision and the holding of the Court shall not affect
the validity of the remaining portions of the Bylaw.
PART IV: MISCELLANEOUS
11.
Bylaw No. 1-2023 and all amendments thereto are hereby repealed.
12.
The rates, charges, tolls, or rents contained in this bylaw shall come into force and take effect on
the day of approval being issued by the Local Government Committee or January 1, 2026,
whichever is later.

MONTHLY WATER RATES
Minimum charge for 3,000 gallons or less per month:
$34.25 per unit
Overage:
$11.50 per 1,000 gallons over 3,000 or part thereof
Bulk Water Station:
$3.00 per fill (approximately 300 gallons)
