## BYLAW NO. 5 (2024) A BYLAW OF THE TOWN OF BIENFAIT FOR THE CONTROL OF THE USE OF CAT TRAPS
Council hereby created a bylaw to:
- control the use of cat traps.
NOW THEREFORE, The municipal Council of the Town of Bienfait enacts as follows:
1. In this bylaw:
- a) "Animal Control Officer* means that person(s) appointed by the Mayor and Administrator for the purposes of this bylaw;
- b) "Cat Trap Permit" means a permit in the form set out in Form B, issued by the Animal Control Officer to a person to trap a cat being at large;
- c) "Cats" includes all species of the animals commonly known as cats, male or female, and of every breed or classification or mixture of breeds.
## PART I - GENERAL
1. A person, who has been bothered by a cat at large, may apply to the Animal Control Officer to receive a Cat Trap Permit and a cat trap.
2. Where a cat trap is issues, the permittee shall:
- abide by the terms of the Cat Trap Permit; a)
- place the cat trap only on the permittee's property located within the town; b)
- personally check the trap at least once each hour while the trap is set; c)
- when a cat is trapped, contact the Animal Shelter; d)
- immediately, if the Animal Shelter is open; or
- (il) as soon as the Animal Shelter re-opens;
- not use the trap when the temperature is: e)
- (1) 0° C or less; or
- (il) 28° C or more.
- return the cat trap to the Animal Shelter within 72 hours of the cat trap being issued; and fl
- pay for the cost of repair or replacement of the cat trap if the issues cat trap is damaged, lost or stolen: g)
3. a) when a cat has been trapped in a cat trap, the permittee shall:
- hold the cat for no longer than 24 hours:
- (ii) treat the cat humanely
- (ili) provide shelter for the cat in a warm, dry and secure area; and
- (IV) provide water and food for the cat.
- b) If a permittee cannot comply with the conditions in subsection (i), the permittee must release the trapped cat unharmed
- C) When a cat has been trapped in a cat trap, the permittee shall provide the Director with:
3. the name of the owner of the cat, if known; and
4. the location of the cat trap when the cat was trapped
## COMING INTO FORCE
19. This bylaw shall come into force on the day of its final passing.
