## Bylaw 2000-08 ## i BYLAW TO CONTROL DOMESTIC ANIMALS The Council of the Town of Broadview in the Province of Saskatchewan enacts as follows: - 1) This bylaw shall be known as the "Animal Control Bylaw". ## 2) DEFINITIONS - a) In this bylaw, the term: 2. ii) "Animal Control Officer" shall mean - i) "Animal" shall mean a cat or dog or other animal designated by Council as a domestic pet; - (1) the Town Foreman, or - (3) any other person appointed by the Council to catch animals for the enforcement of provisions of this bylaw; - (2) any person authorised to act on his behalf, or 7. iii) "Cat" shall mean any cat, male or female, immediately after it has been weaned; - v) "Dog" shall mean any dog, male or female, immediately after it has been weaned; 9. iv) "Council" shall mean the Council of the Town of Broadview; 10. vi) "Owner" shall mean - (2) the person responsible for the custody of a minor where the minor is the owner of an animal; - - (1) a person, persons, partnership, association or corporation who keeps, possesses, harbours, or has care of an animal; or 2. vil) "Minor" shall mean a person under the age of 18 years; 3. viii) "Poundkeeper" shall mean - (1) the Town Foreman, or - (3) or any other person appointed by the Council to feed, water, shelter, or release impounded animals; - (2) any person authorised to act on his behalf, - (1) is beyond the boundaries of the land occupied by the Owner, or - (3) is not under the control by being - (2) is beyond the boundaries of any lands where it may be with the permission of the Owner or occupant of the said land, and 10. (a) in direct and continuous charge of a person competent to control it; or 11. (C) securely fastened so that it can not roam at will 12. (b) securely confined within an enclosure; or - x) "Town" shall mean the Town of Broadview; - c) Words in the masculine gender shall also include the feminine gender. - b) Words in the singular include the plural, and words in the plural include the singular. ## 3) REGISTRATION - a) Every Owner of an animal within the Town of Broadview shall cause said animal to be registered with and obtain a license from the Broadview Town Administration Office. A record of the license number, name and telephone number of the Owner shall be maintained thereat. - b) There shall be no charge for said license. - d) Every person to whom a license has been issued under this bylaw shall cause his animal to wear a collar to which shall be attached the license tag issued by the Town. - c) All licenses issued under the provisions of this bylaw shall remain in effect as long as the licensee owns the animal for which he obtained a license. ## 4) RUNNING AT LARGE - b) Any person who owns, possesses, or harbours an animal found running at large shall be deemed guilty of an infraction of this bylaw. - a) No person shall permit his animal to run at large. <!-- image --> <!-- image --> ## 5) GENERAL - a) No unauthorized person shall remove from an animal a collar or license tag. - b) No person shall own, possess, or harbour any dog which by loud and frequent barking, howling or yelping or chasing motor or other vehicles or in any manner or way creates a disturbance to the annoyance or discomfort of other persons residing in the neighbourhood, or to the public at large, or which causes injury to any other person or animal. - c) No person shall own, possess, or harbour any cat which in any manner or way creates a disturbance to the annoyance or discomfort of other persons residing in the neighbourhood, or to the public at large, or which causes injury to any other person or animal 4. No person shall tamper in any way with an apparatus belonging to the Town for the purpose of apprehending an animal running at large. 5. No person shall break open or assist in breaking open any Pound in which an animal may be impounded. 6. When an animal defecates on any public or private property other than the property of its Owner, the Owner or keeper shall cause such defecation to be removed immediately. - g) Any animal suspected of having rabies shall not be destroved, but shall be secured and isolated for ten 10] days and the matter reported to the Medical Health Officer of the Town of Broadview whose instructions shall be carried out. - h) The Town shall utilize The Urban Municipality Act, 1984 to deal with situations involving "dangerous dogs" ## 6) SEIZURE OF ANIMALS - a) The Animal Control Officer is hereby authorised to seize and capture any animal running at large in the Town of Broadview. - b) Any person of the full age of eighteen (18) years may restrain any animal running at large in the Town of Broadview, and shall deliver the animal so restrained to the Poundkeeper. Such person shall leave with the Poundkeeper a statement, in writing, detailing the place and time of restraint. - c) The Poundkeeper shall, as soon as practical, provide the Town Administrator with the details of an impounded animal. - d) The Town Administrator is hereby empowered to collect all necessary charges and fees in connection with any impounded animal. - e) In the case where ownership of the impounded animal is possible by its license tag, the Town Administrator shall mail to the registered owner, by regular mail, a notice to the effect that unless said animal is redeemed and the fees provided in this bylaw are paid within forty-eight (48) hours from the time of mailing said notice, the said animal will be sold or destroyed as provided herein. - f) In the case where ownership of the impounded animal can not be determined by a license tag, the Town shall contain a description of such animal, the date and time it was impounded, and the date and time when it will be sold or destroyed. The notice shall be posted at least forty-eight (48) hours before the said sale or destruction takes 7. The period of time noted above is to be extended if a Saturday, Sunday, or statutory holiday falls between the time the animal is impounded and the time when said animal would be sold or destroyed ## POUND For the purpose of impounding animals, a Pound shall be established at such place or places as may be designated by the Council from time to time. <!-- image --> ## Bylaw 2000-08 ## i) POUNDKEEPER - a) During the period of impounding of any animal, it shall be the duty of the Poundkeeper to supply such animal with adequate food, water, and heated shelter as necessary. - b) When the Owner provides the Poundkeeper with satisfactory evidence that all fines and charges provided for in this ylaw have been paid, the Poundkeeper shall release the impounded animal to the Owne 3. ) If the impounded animal is not redeemed within the time prescribed in this bylaw, the Town may sell the anima Except as may otherwise be provided in this bylaw, the sale price of the animal shall be an amount not less than the amount of fines and charges due to the Town. - d) If the impounded animal is not redeemed within the time prescribed in this bylaw, and the Town has not received any offers to purchase the animal, it shall be destroyed by the Poundkeeper, or at his request, by any other person. ## 9) PENALTY - a) Unless otherwise provided in this bylaw, any person committing a breach of this bylaw or neglecting or refusing to comply therewith, is guilty of an offence and liable on summary conviction to the penalties provided in the General Penalty Bylaw for the Town of Broadview. - b) The owner of any animal impounded, in order to have said animal released from the Pound, shall satisfy the Town Administrator be reasonable evidence that he is the lawful owner or person entitled to possession of said animal and shall pay to the Town Administrator the following charges - i) the sum of Fifteen Dollars [$15.00] if the animal has not been previously registered as required by this bylaw; and 4. ii) an additional sun of Twenty Dollars [$20.00] if an animal owned by the same person has been impounded for inning at large within the past twelve [12, months; ar 5. ii) the sum of Thirty-Five Dollars [$35.00] if the animal has been impounded for running at large contrary to the provisions of this bylaw; and 6. ) the sum of Five Dollars [$5.00] for each night, including Saturdays, Sundays, and statutory holidays, the anim is confined to the Pound. ## 10) REPEAL Bylaws #85-01 and #86.05 are hereby repealed. <!-- image --> Phil Borr Carol Mills, Mayor Phil Boivin Town Administrator <!-- image --> Certified a true capy of a bylaw adopted by resolution of Council november 15ch 2000 <!-- image --> Phillip A.
