## BYLAW NO.2023-04
A BYLAW OF THE TOWN OF BROADVIEW TO FIX THE RATES TO BE CHARGED FOR THE USE AND CONSUMPTION OF WATER AND TO FIX THE RATES TO BE CHARGED BY WAY OF SERVICE CHARGE FOR THE USE OF THE SEWER
The Council of the Town of Broadview in the Province of Saskatchewan enacts as follows:
## Water & Sewer Services
- 1 Water and sewer services are deemed to be a service to the owner of land and/or buildings and all accounts for rates, costs or charges relating to providing these services shall be in the name of the owner, payable by the owner and collectible from the owner.
## Meter Deposits
- 2 a) All owners of land or buildings desiring to be supplied with water from the Municipality's water supply system shall make application to the officials of the Municipality. Each application shall be accompanied by the payment of a meter deposit in the following amounts;
- One hundred dollars ($100.00) for a 5/8 inch to 1 inch meter; or
- ii) Two hundred dollars ($200.00) for a 1½ inch to 2 inch meter
- b) All owners of land or buildings who refuse to have a water meter installed or refuse to pay a meter deposit will not have their water service connected and if connected will have their water service disconnected
- The meter deposit shall be refunded when ownership of the property changes or when the property is no longer connected to the Town's water supply system and all water and sewer usage charges are paid
## Re-connection Fee
- 3 Where water service is disconnected, a subsequent charge of one-hundred dollars ($100.00) shall be payable upon request for re-connection.
## Water Charges
- 4 The charges to be paid by owners of land or buildings for water service, once connected, shall be those set out in Schedule "A" attached hereto, provided, however, that the minimum shall be payable in every case whether or not any water is consumed.
## Sewer Charges
- 5 Where sewer from a property is drained into the Town's sewer system the owner of the land or buildings shall pay for such services by way of a service charge in accordance with rates as specified in Schedule "B" attached, or as amended from time to time.
## Accounts
- 6 a) Accounts for water service and/or sewer service shall cover a period of three successive months for the periods ending March 31, June 30, September 30 and December 31 of each year, and shall be rendered on or before the 10" day of the month next following such period.
- b) Accounts shall be paid within a period of thirty days from the date on which such accounts were rendered. Where accounts remain unpaid thirty days from the date on which such accounts were rendered they shall be subject to a penalty, with the method of calculating the penalty to be:

- a compound rate of two percent (2%) added thirty days from the date such accounts were rendered and every month thereafter to be applied to the total accounts and penalties that remain unpaid at the end of the preceding period in which the penalty is being applied.
- c) If the accounts, including penalty added, remain unpaid after sixty days from the date on which such accounts were rendered, the following shall occur:
- (1) The water service shall be disconnected. The water service shall not be re-connected until all arrears have been paid, together with any current charges and the re-connection fee; or
- (II) (A) In addition to the penalty added, a five dollar ($5.00) fee shall be added to the unpaid account to cover the cost to print and mail a disconnection notice, providing an additional fifteen (15) days to pay up the account and fees on the account; and
- (B) If the account and fees remains unpaid after these additional fifteen (15) days have lapsed, a further forty dollar ($40.00) fee shall be added to the unpaid account to cover the cost to print and post a FINAL disconnection notice on the serviced improvement on the property providing the account holder with an additional seven (7) more days to pay up all arrears and fees, should the account and fees still not be paid after these additional seven (7) days have lapsed then water service shall be disconnected.
- A twenty-five dollar fee ($25.00) shall be added to an account each time a property owner request in writing for a second party to be added to their utility account to receive a copy of the original utility bill or for a change in the name of the second party on the account.
## Accounts Preferential Lien and Charge
- 7 All rates, costs or charges made under the authority of this bylaw shall be a preferential lien and charge on the serviced improvement, tenement, lot or part of a lot, and may be levied and collected in like manner as municipal rates and taxes are by law recoverable.
## Meter Location
- a) The property owner shall provide a frost-proof location for the water meter that is readily accessible.
- b) The property owner shall be liable for the full replacement cost of a meter installed on his/her property where said meter is damaged by frost or other cause.
## General Provisions
- No person shall release, inject or discharge into the Town's water system or sewage system, sewer or drain, any harmful matter, substance or thing whether liquid or solid which will injure, damage or pollute any stream, drain, water system, sewer, sewer system or sewage treatment plant or interfere with the property operation of the water system or sewage system.
- 10 The Municipality shall have the right to ration or limit the amount of water furnished to any or all consumers should circumstances deem to warrant such action.
- 11 Any person who contravenes any provision of this bylaw for which no penalty is provided shall be guilty of an offence and liable upon summary conviction to penalties provided under the General Penalty Bylaw for the Town of Broadview.
- 12 Bylaw #2019-02 is hereby repealed.
- 13 The rates, charges, tolls or rents contained in this bylaw shall come into force and take effect on the day of approval being issued by the Local Government Committee or January 1, 2024, whichever is the later.

- The following minimum rates shall apply for the use of three thousand (3,000) gallons or less of water per month:
- For the consumption of water over three thousand (3,000) gallons per month the following rate shall apply:

- b) For the consumption of water over twelve thousand (12,000) gallons per month the following rate shall apply:

Enclosed for your records is approval of water and sewer rates excluding the management fees (Clause 2: Meter deposits; Clause 6-d): fee to add second party to utility account as approval is not required) pursuant to subsection 23(3) of The Municipalities Act.
Please be advised that the utility is running a deficit. it is necessary to review the utility's performance each year and consider adjusting rates as needed to ensure self-sustainability. We also recommend that rate adjustments be made gradually rather than through drastic changes.
The Local Government Committee recommends the Council to establish a specified utility reserve, which would be funded by an annual utility surplus when possible.
