## BYLAW NO 2-16
## A BYLAW RESPECTING FIREWORKS
The Village of Buena Vista, in the Province of Saskatchewan enacts the following:
## DEFINITIONS
- In this Bylaw, unless the context otherwise requires, the expression: (a) "fireworks" means firecrackers, rocket, squib or any other object or substance designed to be exploded or burned to produce noises or brilliant lighting effects and does not include paper percussion caps for toy guns.
- (b) "fireworks display" shall mean a display of fireworks for the entertainment of the public at large.
## PROHIBITION
3. (a) No person shall set off, detonate, ignite or cause to be exploded any fireworks in the Village of Buena Vista at any time whatsoever until a permit (form A) has been issued.
2. (b) No person shall set off or allow to be set off any fireworks in such a place, or manner, as might create danger or cause harm to any person or property. It is also unlawful to do, or cause, or allow, any unsafe act or omission at the time and place for the setting off of any fireworks.
3. (c) No person under the age of eighteen (18) years shall discharge any fireworks except under the direct supervision of and control of a parent, guardian or responsible person aged eighteen (18) years or over.
## APPLICATION
Every application for a permit shall include:
- a description of the event including,
- the date and time of the proposed discharge of display fireworks,
- the type and kind of display fireworks that may be discharged,
- the discharge techniques to be used,
- the manner and means of restraining unauthorized persons from attending too near the discharge site,
- the number of persons authorized to handle and discharge the display fireworks;
- the manner in which unused display fireworks are to be disposed of, and
- a site plan providing a description of the discharge site to be used for the discharging of the display fireworks;
- a description of the fire emergency procedures;
- the name and address of the applicant.
## AUTHORITY
- (a) The Council of the Village of Buena Vista may, at their discretion, issue a permit in writing (Form "A"), authorizing the setting off of family fireworks or a fireworks display under the supervision of a licensed pyrotechnician.
- (b) A firework display shall be held only in public parks and public beach.
- (c) A permit issued under Form "A" of this section shall prescribe the conditions which a display of fireworks may be held in the Village and no person shall conduct a display of fireworks in contravention of such prescribed conditions.
## PENALTY
5. Any person found guilty of an infraction of any of the provisions of this bylaw shall be liable to the penalties as provided in the General Penalty Bylaw of the Village.
4. Bylaw 3/94 is hereby repealed.
5. This bylaw shall come into effect on the final reading.
