Including Amendments to February, 2022 OFFICE CONSOLIDATION RESORT VILLAGE OF CANDLE LAKE BYLAW NO 02-2020 A BYLAW TO AUTHORIZE THE CONTROL OF NUISANCE WILDLIFE WITHIN RESORT VILLAGE BOUNDARIES The Council of the Resort Village of Candle Lake in the Province of Saskatchewan enacts as follows: 1. In this bylaw: a) "Administrator" shall mean the administrator of the municipality; b) "Applicant Appointee" shall mean a person as appointed by the Committee. c) "Council" shall mean the council of the municipality; d) "Committee" shall mean the Mayor, Administrator and any one Councilor; e) "Hunting" (as defined by The Wildlife Act, 1998) including taking, wounding, killing, chasing, pursuing, worrying, capturing, following after or following the trail of, searching for, shooting at, trapping, setting snares for, stalking or lying in wait for any wildlife or attempting to do any of those things, whether or not the wildlife is then or subsequently captured, wounded or killed. f) "Mayor" shall mean the mayor of the municipality; g) "Municipality" shall mean the Resort Village of Candle Lake; h) "Owner" means the owner of the property or the person in charge or control of property; i) "Wildlife" shall be include any fur bearing mammal that is not normally domesticated including but not limited to bear, coyotes, fox, lynx, mountain lions and wolves and not otherwise permitted pursuant to S 4(1) of The Wildlife Regulations, 1981. 2. Persons(s) appointed by the Municipality to make application to the Ministry for a permit authorizing the control wildlife within the Municipality must: a) be a registered member of a trapping block within the Northern Fur Conservation Area and the Municipality boundaries or the Municipality must have received permission from the registered member to authorize an alternate applicant appointee; b) every appointment pursuant to this Bylaw shall be in the form of "Schedule A" and the Administrator shall present a copy of the completed "Schedule A" at the next regular meeting of Council and record so in the minutes; c) the Applicant Appointee must present the completed "Schedule A" to when applying for a permit, and d) the Applicant Appointee must meet any other requirements to be eligible for a permit. 3. The Municipality hereby authorizes wildlife control permit on lands within the boundaries of the Municipality, with the following provisions: a) the applicant has met all requirements under Section 2 of this Bylaw; b) trapping will not be permitted on privately owned lands that are zoned as residential, commercial, or community service; c) by written permission of owner, trapping may be permitted on privately owned lands that are zoned industrial or resource conservation; d) in accordance with (b) and (c), the approved area(s) within the Municipality covered by each permit; e) the permit will contain specific validity dates; 4. Only persons authorized under this Bylaw may, pursuant to Section 13(3) & 13(3.1) of The Wildlife Regulations, 1981 hunt wildlife responsibly within 500 meters of any building, stockade or corral in the Municipality. This hunting is restricted to trapping or euthanize purposes, rim fire rifle or shotgun only. 5. Bylaw 18-2011 is hereby repealed. Introduced and read for the first time this 17day of January, 2020. Read for a second time this 17 day of January, 2020. Read for a third time and passed this 17 day of January, 2020. SCHEDULE "A" BYLAW RESORT VILLAGE OF CANDLE LAKE APPLICANT APPOINTMENT PERMIT TO COTROL NUISANCE WILDLIFE WITHIN RESORT VILLAGE APPLICANT APPOINTMENT#: IN ACCORDANCE with Bylaw No. of the Resort Village of Candle Lake NOTICE IS HEREBY GIVEN THAT: NAME ADDRESS TELEPHONE hereby declares that he/she is a registered member, in good standing, of a trapping block within the Northern Fur Conservation Area or has been designated as an eligible appointee subject to Section 2 (a) of Bylaw and the Council Committee for the Resort Village of Candle Lake hereby appoints the above-noted as an applicant for a permit to control nuisance wildlife within Resort Village boundaries, such permit to be authorized and issued by the Minish}' of Environment.
