## TOWN OF CANORA ## BYLAW NO. 92-06 ## A BYLAW TO CONTROL AND REGULATE NOISE WITHIN THE TOWN OF CANORA THE COUNCIL OF THE TOWN OF CANORA, IN THE PROVINCE OF SASKATCHEWAN ENACTS AS FOLLOWS: 1. This Bylaw may be cited as "The Noise Bylaw." 2. In this Bylaw, including this Section: 3. (a) "Council" means the Council of the Town of Canora; 4. (b) "holiday terpretation Act *on Act, and amendments thereto, de any holiday In claimed as such by Council; 5. (c) "motor vehicle" means "motor vehicle" as defined in The Highway Traffic Act of Saskatchewan; 6. (d) "premises" means the area contained within the boundaries of any lot and includes any building situated within aries. Provided, however, that where any building contains more than one dwelling unit, each dwelling unit, oI area of such building and the land surrounding the ing within the boundaries of the lot shall be deemed to be separate premises; 7. (e) "occupant" mises means the owner, occupant of licensee of the PEnt or any person on the premises at or time when the noise or sound issues from the premises; 8. (f) "residential building" means a building which is constructed as a dwelling for human beings; 9. (g) "residential district" means a district defined as such in the Zoning Bylaw enacted by the Council of the Town of Canora and amendments thereto; 10. (h) "signalling device" means a horn, gong, bell, klaxon, siren or other device producing an audible sound for the purpose of drawing people's attention to an approaching vehicle, int cluding a bicycle; - (1) "weekday" means any day other than a Sunday or holiday; 12. (j) "Zoning Bylaw means Bylaw No. 89-07 as enacted by the Counci, of the Town of Canora and amendments thereto and includes any bylaw passed in substitution for or in addition to Bylaw No 89-07. ## GENERAL PROHIBITION 3. (a) Except to the extent it is allowed by this Bylaw no person or cause to be made, shali make, or continue to make pe continued to be made, or almade, or allowed to loud noise or any unnecessary noise, or any unusual noise. 2. (b) Except to the extent it is allowed by this Bylaw, shall make, or continue to make, or cause to be made or cause to be continued, or allow to be made, or allow to be continued, noise whatsoever which disturbs, injures, endangers or detracts from the comfort, health, peace or safety of other persons, annoy, distrub, injure, endanger or detract from the comfort repose, health, peace or safety of other persons) within the corporate limits of the Town. 3. (c) What is a loua noise, an unnecessary noise, an unusual noise, a noise which annoys, disturbs, injures or endangers detracts from the other persons (or is likely to annoy, comfort, repose, health disturb, endanger, or detract from the comfort, repose, health, peace safety of other persons) is a question which hears a prosecution of an offence against this 4. (d) absence of other evidence, or by way of corroberation evidence, conviction court from the evidence officer relating to any person or persons, whether ascertained or the comfort, health, or would likely be disturbed, annoyed, endangered. ## DOMESTIC NOISES 4. Without restricting the generality of Section 3, no person shall operate or allow to be operated a lawn mower, a snow clearing dea chain saw, or a roto tiller, powered by an engine of any or a model aircraft driven by an internal combustion engine 2. any residential district between the hours of: 3. (a) 10 o'clock in the evening and 7 o'clock of the next forenoon 4. on weekdays; 5. (b) 10 o'clock in the evening and 9 o'clock in the forenoon of - the following day which is a Sunday or holiday. 5. No person who owns, keeps, houses, harbours or allows to stay his premises a dog, shall allow such dog to bark excessively howl excessively. 6. No person being the owner or occupant of any premises shall or permit to be operated, or suffer to be operated, or allow to be operated, play or allow to be played, any radio, phonograph, record-player, tape recorder, television set, musical instrument, or any other apparatus, device or machine used for the production or amplification of sound, either in or on private prein a residential district in such an manner that be easily heard by an individual or member of the public wno the same premises from which such noise or sound ## CONSTRUCTION NOISES 7. Except in an emergency, no person shall carry on the construction, erection, alteration or repair of any type of builaing, structure or object which involves hammering, sawing, dr111or the use of any machine, tools or any other equipment of creating a sound beyond the boundaries of the site on activity is being carried on, in any district in the Canora other than one designated in the Zoning Bylaw District and UR Urban Reserve District between the hours of: 2. 10 o'clock in the evening and 7 o'clock of the next forenoon 3. on weekdays, 4. (b) the following day which is a Sunday or a holiday. 5. in the evening and 9 o'clock in the 8. Except In an emergency, no person shall operate or allow to be operated a cement mixer, a cement mixer truck, riveting machine, trenching machine, a gravel crusherr of drag line, a jack-hammer or pneumatic drill, or any other tool, device or machine of a noisy as to create a noise which may be heard in any residence the hours of 10 o'clock In the evening and 7 o'clock in the morning. ## ADVERTISING NOISES 9. No person shall advertise any event or merchandise by ringing bells, blowing whistles, calling loudly, playing music, playing any type of musical instrument, playing or using any type of noise making instrument, or by the use of loud speakers or other devices for the amplification of sound, or by any other audible means, on any street or other public place or in any building or premises with the intention or result that the sound therefrom shall be DI 1s audible to persons using or frequenting any street or other public place. ## DIESEL MOTORS 10. No person shall allow the diesel motor on a tractor or truck whibr pulls a trailer or on a semi-trailer truck to remain running longer than 20 minutes while the tractor-trailer, alone, 1s stationary in a residential district between the hours of: 2. (a) 10 o'clock in the evening and 7 o'clock of the next forenoon on weekdays; 3. (b) 10 o'clock in the evening and 9 o'clock in the forenoon the following day which 1s a Sunday or holiday. ## EXCEPTIONS 11. The provisions of this Bylaw shall not apply to: 2. (a) the ringing of bells in churches, religious establishments and schools; 3. (b) the moderate use of musical instruments to call attention an opportunity to contribute to a collection made for charitable undertaking; to a - (C) the playing of a band, the sounding of a steam whistle, sounding of motor vehicles' horns of the use of sound ampile fication equipment used in connection with any parade; - (d) the moderate playing of musical instruments appropriate any religious street service; to - (e) the sounding of a general or a particular alarm or warning announce a fire or other emergency or disaster; - (f) the sounding of police whistles or the sirens on any vehicle used by the police, fire department, ambulance, rescue unit or public service vehicle; - (g) any use of sound amplification equipment used by the police, fire department, ambulance service, rescue unit, or public service; - (h) the use in a reasonable manner of any apparatus or mechanism for the amplification of the human voice or of music in a public park or any other commodius space in connection with any public election meeting, publie celebration, or other reasonable gathering; - (i) snow removal, street cleaning, road maintenance and other construction equipment engaged by the Town In snow removal, street cleaning, or the construction repair or maintenance of any streets, crossings, storm sewers, culverts and approaches, grades, i sidewalks, water and sewer lines or any other works authorized by The Urban Municipality Act, 1984, and any amendements thereto, or any other Act. - (i) removing snow by a mechanical means from parking lots used in conjunction with commercial, educational or institutional establishments. of ## COUNCIL DISCRETION 12. At the discretion of Council upon application the Council may, any source of sound. ## PENALTIES 13. Any person, corporation or organization who contravenes any proviof this Bylaw is guilty of an offence and is liable on sunmary conviction to: 2. (a) a minimum fine of One Hundred Dollars ($100.00) and a maximum fine not in excess of Five Hundred Dollars ($500.00) 3. (b) costs as may be awarded by the Court hearing the matter 4. (c) in default of payment of the fine or costs to imprisonment for a period not exceeding 30 days. 14. This Bylaw shall come into force and take effect on the day of the final passing thereof. 15.
