Town of Davidson
Bylaw No. 784
A BYLAW OF THE TOWN OF DAVIDSON IN THE PROVINCE OF SASKATCHEWAN
TO REGULATE THE BURNING OF REFUSE WITHIN THE BOUNDARIES OF THE
TOWN OF DAVIDSON
The Council of the Town of Davidson, in the Province of Saskatchewan, enacts as follows:
1.
Definitions:
a)
"Council" means the Council for the Town of Davidson;
b)
"Fire Chief" means the Fire Chief for the Davidson Volunteer Fire
Department;
c)
"Open burning" means a fire in the open air to burn and dispose of any type
of refuse
d)
"Peace Officer" means any member of the Royal Canadian Mounted Police,
or any other police service responsible for the policing of the Town of
Davidson;
e)
"Refuse" means trash, refuse, garbage, industrial waste, or any other
material or waste, including but not limited to wood, paper, cardboard, yard
wastes.
2.
Prohibition
No person or business shall cause or permit to be caused the open burning of
trash, refuse, garbage, industrial waste, paper products, wood, yard waste or any
other waste material in an open fire or an incinerator in a manner that causes air
pollution within the boundaries of the Town of Davidson.
3.
Incinerators
No person shall cause or permit to be caused the burning of trash, refuse, garbage,
industrial waste, paper products, wood, yard waste or any other waste material in
a manner or in an incinerator.
4.
Exclusions
Sections 2 and 3 of this bylaw do not apply to:
a)
a camp fire or outdoor fireplace used for recreational purposes;
b)
an outdoor fire using charcoal or processed coal for cooking purposes;
c)
a fire for the purpose of prevention or control of fires or the training of
persons for firefighting, if the fire is specifically authorized or required
pursuant to any legislation or the bylaw of the municipality.
5.
Approval
Approval from the Town of Davidson Council is required prior to causing a fire for
the purpose outlined in Section 4 c). In an emergency situation, approval may be
obtained from the local fire chief or the RCMP.

6.
Penalty
Any person convicted of an offence under any section of this bylaw shall forfeit and
pay a fine of not less than:
a)
First Offence:
$ 500.00
b)
Second Offence:
$ 2,500.00
c)
Third and each subsequent offence:
$ 5.000.00 exclusive of all costs.
7.
Coming into force
This Bylaw shall come into force and take effect on the day of approval by the
Council of the Town of Davidson.
