BYLAW NO. 820
TOWN of DAVIDSON
A BYLAW TO REGULATE THE USE OF PUBLIC PARKS, SPACES,
AND BUILDINGS IN THE TOWN OF DAVIDSON
The Council of the Town of Davidson, in the Province of Saskatchewan, enacts as
follows:
1. Definitions:
a. Administration - means the Administrator or authorized designates,
unless otherwise specified.
b. Bylaw Officer - means a person appointed by the Council of the Town of
Davidson as a Municipal Law Enforcement Officer to enforce the provisions
of the bylaw, or in the absence of a Municipal Law Enforcement Officer, the
Town Administrator.
c. Camp - means to erect a structure, hut, tent, or to park a camper trailer
for the purpose of providing shelter.
d. Facility - means any area, building or structure under the jurisdiction of
the Town of Davidson; including but not limited to recreation centres, sports
facilities, museums, office spaces.
e. Landscaping tools - means shovel, spade, rake, post hole auger, trowels,
or all power tools.
f.
Motorized vehicle - means an automobile, truck, motorcycle or any other
vehicle propelled or driven by means other than muscular power but does
not include a wheelchair or scooter approved by the Administration.
g. Park - means a playground, playing field, ball diamond, sports field,
walking trail, campgrounds, the lands surrounding a recreation centre,
community building, recreation complex, municipal administration site,
pedestrian walkway or any other area owned, leased, or used by the Town
and devoted to active or passive recreation and includes any lane or
walkway or public parking area leading thereto.
h. Person - means any individual, association, firm, partnership, corporation,
agent or trustee and the heirs, executors, or other legal representatives of a
person whom the context can apply according to law.
i.
RCMP - means the Royal Canadian Mounted Police or authorized assistants
or persons acting under their authority.
j.
Town - means the municipal corporation of the Town of Davidson or the
geographic area of the Town of Davidson as the context requires.
k. Town Council - means the Council of the Town of Davidson.
l.
Waste - means paper, bottles, broken glass, cans, cigars, cigarettes, rags,
garbage, rubbish, debris or refuse of any kind.
2. Scope:
Unless authorized to do so by Town Administration:
a. No person shall in the Town, cut, climb, break, injure, deface, dig up,
disturb, or remove any public property including:
i. Tree, shrub, bush, flower, plant, grass, wood, soil, sand, rock or gravel
ii. Building, cage, pen or monument

b. No person shall camp in public parks unless such areas are designated as a
campground.
c. No personal shall drive a motorized vehicle in a park.
d. No personal shall construct any fence, storage shed, retaining wall, or other
structure of any kind on park property.
e. No person shall erect a barrier of string, wire, chain, rope or similar material
on park property.
f.
No person shall, in any public area, damage, deface, alter, or otherwise
injure any property of the Town of Davidson:
i. Any part of the interior or exterior of a building;
ii. Any monument, public art, fence, bench or other structure.
g. No person shall throw a stone or other object that may cause injury or
damage to any person or to property.
h. No person shall, in a park:
i. Disturb, injure, wound, hunt, trap, attempt to kill or kill any animal
ii. Touch, interfere with, remove or injure any bird's nest, the eggs or the
young birds contained therein; or
iii. Provide or cause to be provided, any food that may be used by wildlife
in a park.
i.
No person shall, in a park:
i. Dig any holes with any landscaping tools;
ii. Leave or deposit any waste, except in a receptacle provided for that
purpose;
iii. Deposit or leave any paint, grease, oil, offal or any dangerous matter
that has an odour or appearance found to be offensive by users of the
park;
iv. Erect a permanent or temporary monument or memorial except in
areas;
v. Bring household waste to a park for the purpose of depositing in Town
of Davidson maintained waste receptacles; scatter any paper,
cardboard, or any other material;
vi. Undertake any maintenance activities or alter existing grounds or
facilities.
j.
No person shall discharge, dump or leave any construction material, earth,
dirt, rock, snow, stone or any other materials in a park or in any public area
of the Town.
k. No person shall use a park or any part thereof for the purpose of:
i. Washing, cleaning, polishing, servicing, maintaining or, with the
exception of an emergency, repairing any motorized vehicle;
ii. Instructing, teaching or coaching any person in the driving or
operation of a motorized vehicle.
3. Enforcement:
The provisions of this bylaw shall not apply to the Town of Davidson or its agents,
employees or contractors during the course of performing their duties in relation
to park construction, maintenance, or other necessary activities.
The provisions of this bylaw shall not apply to the RCMP or other bona fide
emergency service providers.

The bylaw shall be enforced by the RCMP or by the Bylaw Officer of the Town of
Davidson.
4. Offences and Penalty:
Every person who is convicted of an offence under this bylaw is liable to a
minimum fine of $500, and to a maximum fine of $10,000.
A person who is convicted of an offence under this bylaw is liable, for each day or
part of a day that the offence continues, to a minimum fine of $500 per day, up
to a maximum fine of $10,000 until the offence ceases.
Every person who acts in contravention of this bylaw so as to cause the Town to
incur costs due to their actions shall, in addition to any penalty provided for
herein, be liable to the Town for all expenses incurred for the purpose of
repairing or replacing damaged property or removing unauthorized materials, and
such expenses may be recovered by court action or in a like manner as municipal
taxes.
5. Coming into Force:
This bylaw shall come into force and take effect on the final date of passing.
